TTY/TDD/Speech to Speech users may dial 711 for the California Relay Service. BACKGROUND: Assembly Bill (AB) 32, the California Global Warming Solutions Act of 2006, requires California to reduce statewide GHG emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, the Air Resources Board (ARB) has developed a Cap-and-Trade program that limits statewide emissions from sources responsible for 85 percent of greenhouse gases and creates a financial incentive for clean and efficient technologies. Under the program, a portion of the allowances required for compliance are auctioned. The State portion of the proceeds from these auctions will be used to fund projects to reduce greenhouse gas emissions, consistent with State law. In September 2012, the Legislature passed and Governor Brown signed into law two bills – AB 1532 (Pérez, Chapter 807) and Senate Bill (SB) 535 (De León, Chapter 830) – that together establish a framework for developing an investment plan for projects and programs to be funded with Cap-and-Trade auction proceeds. SB 535 further requires that 25 percent of the proceeds that will be expended benefit disadvantaged communities and at least 10 percent of the proceeds expended be invested in projects located within those communities. The Department of Finance (Finance), in consultation with the ARB and other state entities, will develop and submit to the Legislature a three-year investment plan for the auction proceeds. The investment plan will identify the State’s greenhouse gas reduction goals and priority programs for investment of proceeds to support achievement of those goals. Funding will be appropriated to State agencies by the Legislature and Governor through the annual Budget Act, consistent with the plan. At this workshop, staff will be soliciting input on the following proposals: •Adopting a new regulation to harmonize with the Greenhouse Gas (GHG) Emissions Standards for Medium- and Heavy-Duty Engines and Vehicles that the United States Environmental Protection Agency (U.S. EPA) adopted in 2011; •Making amendments to ARB’s existing Heavy-Duty Vehicle GHG Emission Reduction Regulation (Tractor-Trailer GHG regulation) to align with the proposed new regulation above; •Adopting a new set of optional oxides of nitrogen (NOx) standards for heavy-duty vehicle engines more stringent than the current 2010 model year standard; and •Making amendments to the Airborne Toxic Control Measure (ATCM) to Limit Diesel-fueled Commercial Motor Vehicle Idling to expand compliance responsibility. The workshop is described further in the workshop notice at http://www.arb.ca.gov/msprog/mailouts/msc1305/msc1305.pdf and will be held at the following time and location: Date: Monday, March 11, 2013 Time: 8:30 a.m. – 4:00 p.m. Location: Air Resources Board Coastal Hearing Room 1001 I Street Sacramento, California 95814 Directions are at http://www.arb.ca.gov/maps/sactomap.htm Background: In September 2011, the U.S. EPA adopted a new regulation for controlling GHG emissions from new medium and heavy-duty engines and vehicles. ARB staff is proposing to align with the federal regulation in order to provide California with the ability to certify engines and vehicles to the new standards as well as enforce them. On December 11, 2008, the Board approved the Tractor-Trailer GHG regulation codified in sections 95300-95312 of title 17, California Code of Regulations, and later amended it on December 17, 2010. This regulation reduces GHG emissions from long-haul tractor-trailer combinations by requiring them to utilize U.S. EPA SmartWay verified or designated technologies that will improve fuel efficiency. To harmonize the tractor requirements of the federal and California regulations, ARB staff is considering modifications to its Tractor-Trailer GHG regulation. ARB staff will be proposing optional NOx emission standards for California certified 2015 and later model year engines. If the optional standards are adopted, ARB’s existing incentive programs such as the Carl Moyer Memorial Air Quality Standards Attainment program could be modified to give preference to engines certified to the optional standards. On July 22, 2004, ARB adopted an ATCM to Limit Diesel-fueled Commercial Motor Vehicle Idling. This regulation is codified in section 2485 of title 13, California Code of Regulations, and was later amended on October 20, 2005 and December 11, 2008. ARB staff is proposing to extend responsibility for complying with the requirements of the idling ATCM to the owner of the vehicle. In addition, staff’s proposal would require California-based shippers and California-based brokers to share responsibility for compliance with the idling restrictions in the event that they utilized the services of motor carriers that violated the regulation and/or they did not settle their outstanding fines. For specific questions regarding the new heavy duty engine and vehicle GHG regulation and the optional engine NOx standard, you may contact Ms. Kim Heroy-Rogalski, Manager of the Off-Road Implementation Section, by email at kheroyro@arb.ca.gov or by phone at (916) 327 2200. A first-of-its kind study examining the impact of black carbon (BC) on California has made it clear the state’s efforts to reduce emissions from trucks and buses has also helped in the fight against climate change. Even while diesel fuel consumption rose by a factor of five over a 45-year period, black carbon levels decreased by about 90 percent over that same period, according to the study. Researchers found the state’s efforts to reduce diesel emissions have lessened the impact of global warming on California. The study’s results support a growing body of scientific evidence that suggests it is possible to immediately slow the pace of climate change by reducing emissions of short-lived climate pollutants, like black carbon. SACRAMENTO - The Air Resources Board today posted on its website the public discussion draft of the required update to the AB 32 Scoping Plan. The Scoping Plan describes the comprehensive range of efforts California must take to reduce greenhouse gas emissions to 1990 levels by 2020 and meet the state’s long-term goals to combat climate change. AB 32 requires the Scoping Plan to be updated every five years. The original Plan, first released in 2008, was developed on the principle that a balanced mix of strategies is the best way to cut emissions and grow California’s economy in a clean and sustainable direction. This draft update continues with that approach and focuses on three questions: • How have we done over the past five years? • What is needed to continue the prescribed course of action to 2020? • What steps must California now take to meet the state’s climate goals beyond 2020? California’s strategy to meet the goals of AB 32 is based on the continued implementation of adopted actions including Advanced Clean Cars, the 33% Renewables Portfolio Standard, statewide energy-efficiency initiatives, Cap-and-Trade, the Low Carbon Fuel Standard and other programs. They are designed to achieve significant reductions of greenhouse gases in every sector of California’s economy through improved energy efficiency, and by providing consumers with cleaner fuel choices. The discussion draft includes an analysis of progress to date, finding that California is on track to meet the AB 32 2020 goal of greenhouse gas reductions. An overview of the current science of climate change in the draft includes an expanded discussion of short-lived climate pollutants such as methane and black carbon. It also includes actions California must take to continue greenhouse gas reductions in six key focus areas: energy; transportation, land use, fuels and infrastructure; water; agriculture; natural and working lands; and, waste. The draft update is the result of a series of discussions and input over the past year by a broad range of state agencies and departments and the state Climate Action Team. In addition, four public workshops were held over the summer in Los Angeles, Fresno, Sacramento and San Francisco in an effort to consider comments prior to developing the draft. The release of the discussion draft update marks the beginning of a public comment period to help inform the Proposed Update to the Scoping Plan. Future steps in the development of the Proposed Update include a public workshop on October 15 in Sacramento (which will also be webcast), and a meeting of the Board at the end of October to hear from all stakeholders and provide further direction to staff on revisions to the discussion draft presentation to the ARB at its Board meeting at the end of October. Following the October Board meeting, the draft will be revised and then presented to the Board at its December meeting. The Board is anticipated to consider approval of the update in Spring of 2014. In addition, ARB is collecting public comments on the discussion draft at the following website: http://www.arb.ca.gov/cc/scopingplan/2013comments.htm (Note: The comment period on the discussion draft opened on October 1, 2013 at 3:00 pm and closes on November 1, 2013 at 5:00 pm.) What is the 2013 Update to AB 32 Scoping Plan? As required by AB 32, the initial Scoping Plan was adopted in 2008. This Plan must be updated every five years. The 2013 Update to the Scoping Plan will define ARB’s climate change priorities for the next five years and lay the groundwork to start the transition to achieve post-2020 goals. The 2013 Update will highlight California’s progress toward meeting the “near-term” 2020 GHG emission reduction goals defined in the original 2008 Scoping Plan. It will also evaluate how to align the State's “longer-term” GHG reduction strategies with other State policy priorities, such as for water, waste, natural resources, agriculture, clean energy, transportation and land use. Air Resources Board (ARB or Board) staff has revised the schedule for the Proposed Update to the AB 32 Scoping Plan (Proposed Update). The purpose of the schedule revision is to provide adequate time for staff to review, consider and incorporate stakeholder comments. ARB anticipates releasing the Proposed Update and Environmental Assessment in late January followed by a February Board meeting that will include additional opportunities for stakeholder feedback and public comment. In late spring 2014, ARB will hold a Board Hearing to consider the Final Scoping Plan Update and Environmental Assessment. To view the revised schedule, please visit the AB 32 Scoping Plan website at: http://www.arb.ca.gov/cc/scopingplan/scopingplan.htm What is the Update to AB 32 Scoping Plan? As required by AB 32, the initial Scoping Plan was developed in 2008. This Plan must be updated every five years. The Update to the Scoping Plan (Update) builds upon the initial Scoping Plan with new strategies and recommendations. The Update will define ARB’s climate change priorities for the next five years and lay the groundwork to start the transition to achieve California’s post-2020 climate goals. It will highlight California’s progress toward meeting the near-term 2020 GHG emission reduction goals defined in the initial Scoping Plan and will evaluate how to align the State's longer-term GHG reduction strategies with other State policy priorities, for water, waste, natural resources, agriculture, clean energy, transportation and land use. From: lquattro@arb.ca.gov The Air Resources Board (ARB or the Board) invites you to participate in the next public workshop on December 3, 2013, in Oakland, California, to discuss concepts that are being considered and take input from stakeholders on what additional amendments should be considered to the Zero Emission Bus (ZBus) regulation and to explore the status of, and future developments to, ZBus technology and related systems. Workshop Location and Time: Metropolitan Transportation Commission 101 Eighth Street, Auditorium Oakland, CA 94607 Tuesday December 3, 2013 10:00 am to 1:00 pm Since the first workshop on September 17, 2013, staff have been conducting individual meeting with bus and technology manufacturers, as well as transit districts. At this workshop, staff will summarize the four panels (fuel cell electric bus, battery electric bus, ZBus infrastructure, and transit fleets operating ZBuses) from the first workshop and the common themes expressed during the individual stakeholder meetings. This workshop will also focus on regulatory concepts and options under consideration for ZBus deployment, and the potential to incorporate potential changes to the ZBus regulation into a broader assessment of the transit fleet rule that will occur next year. Based on feedback from this workshop, additional workshops may be scheduled to discuss specific regulatory language and to take comments on draft amendments prior to taking the regulatory package to the Board. We encourage you to attend the meeting as zero emission buses will be on display for rides and viewing. For those that cannot attend in person, a webinar is available. The webinar information along with the agenda is now posted on our website: ZBus website: http://www.arb.ca.gov/msprog/bus/zbus/zbus.htm BACKGROUND: The ZBus regulation, first adopted in 2000, applies to transit agencies with 200 or more urban buses. The regulation required a demonstration for diesel path transit agencies and 15 percent of new buses purchased to be zero emission beginning in 2008 for diesel path transit agencies, and 2010 for alternative path transit agencies. The ZBus regulation was amended in 2006, to include an advanced demonstration from the diesel path transit agencies. The Board postponed the purchase requirement to 2011 for diesel path transit agencies, and 2012 for alternative path transit agencies. The Board directed the Executive Officer to delay the ZBus purchase requirement through Resolution 09-49 at the July 2009 Board Meeting. In January 2010 “Mail-Out #MSC 10-04” notified all affected transit agencies of the ZBus purchase requirement suspension. The Board will be considering changes or amendments to the ZBus regulation which may affect the purchase requirement in May 2014.
