Enforcement Advisory: Consumer Products Regulation

A new Enforcement Advisory entitled "Changes to the Product
Dating Requirements for Consumer Products" has been posted. 
The
purpose of this advisory is to remind the consumer products
industry of changes in the California Consumer Products
Regulation for product dating.  It also is a reminder that date
code explanations are due by January 31, 2006 for all
manufacturers that do not clearly display either the
standard code or the actual date of manufacture.

This message is to inform you that select tables for the
preliminary data summary for the 2003 Consumer and Commercial
Products Survey have been updated.  An error was identified that
affected the total VOC reported for the following categories in
“Table B – Category Totals All Products”: 

21002¬¬ Driveway Cleaner
40299 Other fungicides and nematicides
40401 Animal Repellent 
60299 Other solvent and thinning products.
 
In addition, several other tables have been corrected due to
missing or incorrect links.  The following categories were
affected: 

10203 Driveway patching compound
10204 Floor seam sealer
20303 Cooktop cleaner
20909 Laundry starch product
30209 Chemical peels
30210 Exfoliant/peel/polish
60218 Thinner/reducer/retardant (marine vessel and watercraft
coating systems) 
60220 Other adhesive remover

files are saved in pdf format which can be opened by Adobe

Respond to the survey only if:
a)  you sold or supplied products in 2004 which contained
perchloroethylene (perc) or methylene chloride (mecl) that
were not sold or supplied in 2005; or

On October 12, 2006, Air Resources Board (ARB) staff will hold a
symposium in Sacramento to discuss development of the federal
8-hour ozone and fine particulate matter (PM 2.5) attainment
plans.  A meeting notice and further information will be sent
out prior to the meeting.

The focus of the symposium will be to outline the State’s
standing in relation to the federal standards, what current
science is telling us it will take to meet the standards, and
discuss the statewide strategy under development to find the
emission reductions needed to demonstrate attainment of the
standards.  At the symposium, ARB staff will discuss options
under consideration to reduce emissions from sources under State
and federal control, including sources addressed in the Air
Resources Board’s Goods Movement Emission Reduction Strategy and
Diesel Risk Reduction Plan.

The State Implementation Plans (SIPs) for 8-hour ozone and PM2.5
are due to the U.S. Environmental Protection Agency in 2007 and
2008 respectively.  ARB staff will propose a final strategy
before an ARB public meeting in the Spring of 2007 at which the
Board will consider the proposal as an addition to the
California SIP.

a workshop in Sacramento to discuss development of the Mobile
Sources Emissions Inventory (both on-road and off-road).  A

The focus of the workshop will be to outline the State’s
planned mobile source emissions inventory improvements for use
in the 2007 State Implementation Plans (SIPs). The workshop
will focus on methodological changes to be employed in both the
on-road (EMFAC) and off-road (OFFROAD) emissions inventory
models. It is anticipated that these changes will be completed
in November, 2006.

Additional workshops will be held in November in Sacramento,
Los Angeles, and Fresno following the release of the EMFAC and
OFFROAD models. These workshops will provide final emission
estimates from the models and a discussion of how and why they
differ from previous model estimates.

Public Workshop, which will take place on Thursday, September
14, 2006, in Sacramento, California.

The materials posted today include a full “strike-out/underline”
version of the Consumer Products Regulation and the modifications
to the Aerosol Coating Products Regulation.  The modified
consumer products regulation includes all proposed changes to
the regulation including category definitions, VOC limits, and
other provisions.  Also posted are example complying formulas
for the Third Staff Proposals for Category Standards, and an
agenda and presentation for this week’s Public Workshop.  These

documents that were posted to our website earlier today.  The
documents contained minor errors.  The errors have been
corrected and the revised versions of these two documents are

On November 14, 2006, Air Resources Board (ARB) staff will hold a
second meeting in Sacramento to discuss potential control
concepts to reduce emissions from sources under State and
federal control, for the purpose of attaining the federal 8-hour
ozone and fine particulate matter (PM 2.5) air quality standards.
 At a State Implementation Plan (SIP) symposium held on October
12, ARB staff presented an initial overview of concepts under
consideration for reducing emissions from sources including but
not limited to passenger vehicles, consumer products, heavy duty
diesel engines, locomotives, ocean-going vessels, and trucks.  At
the November 14 workshop, staff would like to receive feedback
about the potential control concepts as well as the overall
attainment strategies.

control concepts will be available approximately one week before
the workshop, at

The SIPs for 8-hour ozone and PM2.5 are due to the U.S.

The 2007 Regulation Amendments will address the need for further
reductions from consumer products as described in the "CONS-2"
commitment of the State Implementation Plan.
