Approved engines are certified to particulate matter emission levels equal to or less than 0.1 grams per brake horsepower-hour, and may or may not be equipped with exhaust gas recirculation systems (EGR). The extension excludes EGR engines certified with diesel oxidation catalysts. Purifilter PlusTM uses a catalyzed silicon carbide wall-flow filter for passive regeneration and electric heating elements for active regeneration. The events include One-Stop Truck Events, Vehicle and Equipment Seller trainings, and a number of training classes. The events and training classes will provide information about statewide idling limits, Heavy-Duty Vehicle Inspection Program (HDVIP), engine labeling, Truck and Bus Regulation, Drayage Truck Regulation, Tractor and Trailer Greenhouse Gas Regulation, Transport Refrigeration Unit Regulation, and associated funding opportunities. The topics for each event may vary. For instance, certain training classes will focus on the Tractor-Trailer Greenhouse Gas regulation compliance planning and reporting, while others will provide information about the Truck and Bus regulation with a focus on agricultural vehicle extension reporting. Background The Air Resources Board has a long history of adopting regulations to reduce criteria pollutant and greenhouse gas emissions. In 1998, California identified diesel exhaust particulate matter (PM) as a toxic air contaminant based on its potential to cause cancer, premature death, and other health problems. Diesel engines also contribute to California's fine particulate matter (PM 2.5) air quality problems. Those most vulnerable are children whose lungs are still developing and the elderly who may have other serious health problems. In addition, in September 2007, the Board adopted a State Implementation Plan in coordination with local air districts to meet federal ambient air quality deadlines. The (SIP) identifies the reductions needed to attain national ambient air quality standards for ozone and PM2.5. The largest share of new emission reductions in the 2007 SIP is expected from trucks. A number of regulations are now in effect that that require diesel engine owners to take steps to reduce their engine emissions. All truck owners must maintain engines so that they do not smoke excessively, must limit unnecessary idling, and meet other state emission reduction requirements. Nearly all trucks and buses with a manufacturer’s gross vehicle weight rating greater than 14,000 pounds and transport refrigeration units that operate in California are required to have exhaust retrofits or to upgrade to cleaner engines early. The regulations are part of the state’s plan to meet federal ambient air quality standards and to protect public health. The California Global Warming Solutions Act of 2006 (AB 32) established requirements to achieve reductions of greenhouse gas (GHG) emissions. AB 32 requires the Air Resources Board (the Board or ARB) and other state agencies to adopt regulations and other requirements that would reduce statewide GHG emission levels to the equivalent of 1990 levels by 2020. The verification includes certain off-road diesel engines up to and including model year 2010. ARB also modified the executive order for on-road applications for engines certified with maximum horsepower ratings no more than 810 and which are not certified with external exhaust gas recirculation (EGR) although select engines with internal EGR are approved. HUSS does not permit swapping of filters among vehicles or equipment. Re-designation of the entire system may only be done within a common ownership fleet and with HUSS’ approval. Re-designations must be in compliance with the California Code of Regulations, Title 13, Section 2706, and HUSS’ Re-designation Policy. The FS-MK system uses a silicon carbide wall-flow filter with a fuel burner for regeneration to achieve an 85 percent reduction in particulate matter emissions. The RYPOS ActiveDPF/CTM active diesel particulate filter uses an active flow through filter followed by a diesel oxidation catalyst (DOC) to achieve an 50 percent reduction in particulate matter emissions qualifying it for a Level 2 Plus verification. Level 2 Plus verification means that the system will reduce diesel particulate matter (PM) emissions by 50 percent or more and meets the January 2009 NO2 limit. Specific engine conditions for which the RYPOS ActiveDPF/CTM has been approved may be found in the Executive Order. The LongMile system reduces emissions of diesel particulate matter by at least 85 percent and is designated as a Level 3 Plus system. The Air Resources Board (ARB) has released a draft of the proposed amendments to the California tier 4 off-road compression-ignition (CI) engine test procedures. The basis of these test procedures are the U.S. Environmental Protection Agency’s (U.S. EPA’s) nonroad CI engine regulations contained in title 40 Code of Federal Regulations (40 CFR) Parts 1039, 1065, and 1068, and which ARB adopted originally on October 20, 2005. The released ARB draft proposal reflects both the amendments that U.S. EPA has made to Parts 1039, 1065, and 1068 since 2005, as well as ARB’s proposed amendments for aligning with those federal amendments. Except for draft amendments of Table 1b (Tier 4 Exhaust Emission Standards) and Table 2b (Upper Limit for Tier 4 Family Emission Limits (FELs) and Alternative Allowances), from title 13, California Code of Regulations (13 CCR) §2423, a draft of the other amendments that will be proposed to the California tier 4 off-road CI engine regulations in 13 CCR §2420 is not included with this release. However, such amendments are forthcoming and will reflect the amendments being proposed in the draft test procedures proposal. The draft test procedure amendment proposal can be found on the following webpage, http://www.arb.ca.gov/msprog/mailouts/mouts_11.htm. Specifically, ARB is planning on proposing modifications to the California tier 4 off-road CI engine regulations in order to increase the level of harmonization with the current U.S. EPA regulations. The proposal will retire the current test procedures (i.e., Part I-C, adopted October 20, 2005) with the 2010 model year, and create new Parts I-D, I-E, and I-F. The proposed Part I D amends the Part 1039-portion of Part I-C by adopting portions of U.S. EPA’s Part 1039, of 40 CFR, as last modified in Vol. 75 of the Federal Register, Pg. 37977 (76 FR 37933), on June 28, 2011. The proposed Part I-E adopts U.S. EPA’s 40 CFR Part 1065, as last modified in 76 FR 37977, on June 28, 2011, as a replacement for the Part 1065-portion of Part I-C; and, the proposed Part I-F amends the Part 1068-portion of Part I-C by adopting portions of U.S. EPA’s 40 CFR Part 1068, as last modified in 76 FR 37977, on June 28, 2011. Although not included in the draft proposal (except for the above mentioned Tables 1b and 2b), staff is also planning on amending the applicable sections of 13 CCR to reflect the draft test procedures amendments described herein. In order to satisfy the required deadlines that are involved in this rulemaking process, comments related to the draft proposed amendments should be received by the close of business on Friday, September 9, 2011. Background In 2001, the U.S. EPA adopted 40 CFR, Part 1065, as a “united” test procedure for both “nonroad” engines and equipment and on-highway heavy-duty CI engines. The test procedures in Part 1065 essentially replaced those previously used in Part 89 for nonroad CI engines. Since its initial adoption, Part 1065 has been amended repeatedly to both improve and expand its applicability for other nonroad engine categories. Federal nonroad CI engines certified for tier 4 standards must be tested using Part 1065. Use of Part 1065 was optional for tier 3 and earlier model engines. In addition, U.S. EPA adopted Part 1039, which is the “standard-setting” part for nonroad CI engines. Besides the actual emission standards, Part 1039 contains other provisions, such as certification protocols, credit-generation allowances, etc. Also adopted was Part 1068, which contains the general compliance provisions. California adopted Part 1065 originally in 2005 in conjunction with its adoption of the tier 4 off-road CI engine emission standards. Since 2005, U.S. EPA has adopted several amendments to its nonroad CI engine regulations (i.e., to Parts 1039, 1065, and 1068). In May 2009, off-road CI engine manufacturers formally asked ARB to maintain full alignment and harmonization with the federal regulations in order to avoid performing separate testing and certification processes and thereby reduce their burden of compliance. Since that time, ARB has worked cooperatively with these manufacturers in developing harmonizing amendments to its off-road tier 4 CI engine regulations and test procedures without changing the stringency of California’s current emission standards. This advisory only applies to vehicles subject to the following regulations: • Truck and Bus Regulation • Transit Fleet Vehicle Regulation • Urban Bus Regulation • Public Agency and Utility Fleet Regulation • Solid Waste Collection Vehicle Regulation • In-Use Off-Road Vehicle Regulation ARB is providing time for fleets affected by this to purchase and install other verified PM filters, or to allow for completion of approved modifications for PM filters that are removed by the manufacturer, without affecting fleet compliance or the ability of fleets to earn or retain early compliance credits. Under this advisory, if a PM filter manufacturer requires a verified PM filter to be removed from a particular engine family, the fleet owner will have 90 days or until January 31, 2012, whichever is longer, to take appropriate action. During this period, the fleet owner will be permitted to operate any affected vehicles in their original equipment manufacturer configuration without a PM filter. The fleet owner must keep records of the change as specified in the applicable regulation. OAL has until December to approve the regulations and file them with the Secretary of State. Background The Air Resources Board adopted a number of regulations that require diesel engine owners to reduce their engine emissions. These regulations are part of the State’s plan to meet federal ambient air quality standards and to protect public health. Between now and 2023, nearly all trucks and buses that operate in California and have a manufacturer’s gross vehicle weight rating greater than 14,000 pounds must upgrade to reduce exhaust emissions. Similar requirements will also become effective in the next several years affecting owners and operators of certain off-road equipment (including equipment used in construction, industrial, and airport operations). To comply with these requirements, fleet owners can upgrade existing engines by installing particulate matter (PM) filter retrofits or other Verified Diesel Emission Control Strategies (VDECS), or by upgrading to cleaner engines. In addition, the California Global Warming Solutions Act of 2006 (AB 32) established requirements to achieve reductions of greenhouse gas (GHG) emissions. AB 32 requires the Air Resources Board (the Board or ARB) and other state agencies to adopt regulations and other requirements that would reduce statewide GHG emission levels to the equivalent of 1990 levels by 2020. The LongMile system reduces emissions of diesel particulate matter by at least 85 percent and is designated as a Level 3 Plus system. The primary components of the LongMile include a diesel oxidation catalyst, a non-catalyzed sintered metal diesel particulate filter with a containment shroud, a spark arrestor, an electronic control system, and a backpressure monitor. Background On December 11, 2008, the Board approved for adoption the Truck and Bus regulation to control emissions from nearly all existing diesel powered heavy-duty trucks and buses operating in California. The regulation became effective under California law on January 8, 2010. The regulation applies to diesel fueled trucks and buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds that are privately owned, federally owned, and to publicly and privately owned school buses. Local and state government owned diesel fueled trucks and buses are already subject to other ARB regulations. Reducing emissions from in-use trucks and buses is necessary to meet federally imposed clean air standards and to reduce the adverse health effects from truck and bus pollution. On December 17, 2010, the staff recommended amendments, which are presently pending adoption, that would delay the initial requirement to install particulate matter (PM) retrofit filters by one year to January 1, 2012 and extend the time before a vehicle equipped with a PM filter would have to have an engine that meets 2010 model year emission standards. The amendments also defer engine replacements for vehicles without PM filters for two years until January 1, 2015. Prior to 2020, replacements are limited to 20 year old or older trucks that are not equipped with PM filters. By January 1, 2023, most vehicles will need to be equipped with an engine meeting 2010 model year emission standards. California Air Resources Board (ARB or Board) staff has posted draft regulatory language for the January 19, 2012 workshop to discuss proposed amendments to the Verification Procedure, Warranty, and In-Use Compliance Requirements for In-Use Strategies to Control Emissions from Diesel Engines (Verification Procedure). It is expected that these amendments will be considered by the Board at its May 2012 meeting. Background: The Verification Procedure is used by staff to evaluate diesel emission control strategies (DECS) to determine their suitability for use by regulated fleets. Under the guidance of the Verification Procedure, DECS manufacturers perform emissions, durability, and field testing to quantify emissions reductions and validate the durability of their retrofit strategies. Manufacturers of verified DECS are required to conduct in-use testing using devices that have been in operation for a prescribed period of time once a predetermined sales threshold has been reached. Any DECS used to satisfy the requirements of ARB’s in-use fleet rules must be verified under the Verification Procedure. The Air Resources Board (ARB) has modified the engine family list to the HUSS Umwelttechnik GmbH’s (HUSS) FS-MK Filter System Series Diesel Particulate Filter (FS-MK Filter System)for off-road applications. The modification includes additional engines that meet the terms and conditions of the Executive Order. The verification includes certain off-road diesel engines up to and including model year 2011. The FS-MK Filter System uses a silicon carbide wall-flow filter with a fuel burner for regeneration to achieve an 85 percent reduction in particulate matter emissions. Specific conditions for which the FS-MK Filter System has been approved may be found in the Executive Orders on ARB website at http://www.arb.ca.gov/diesel/verdev/companies/huss/fs-mk-offroad.htm.
