BACKGROUND: Assembly Bill (AB) 32, the California Global Warming Solutions Act of 2006, requires California to reduce statewide GHG emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, the Air Resources Board (ARB) has developed a Cap-and-Trade program that limits statewide emissions from sources responsible for 85 percent of greenhouse gases and creates a financial incentive for clean and efficient technologies. Under the program, a portion of the allowances required for compliance are auctioned. The State portion of the proceeds from these auctions will be used to fund projects to reduce greenhouse gas emissions, consistent with State law. In September 2012, the Legislature passed and Governor Brown signed into law two bills – AB 1532 (Pérez, Chapter 807) and Senate Bill (SB) 535 (De León, Chapter 830) – that together establish a framework for developing an investment plan for projects and programs to be funded with Cap-and-Trade auction proceeds. SB 535 further requires that 25 percent of the proceeds that will be expended benefit disadvantaged communities and at least 10 percent of the proceeds expended be invested in projects located within those communities. The Department of Finance (Finance), in consultation with the ARB and other state entities, will develop and submit to the Legislature a three-year investment plan for the auction proceeds. The investment plan will identify the State’s greenhouse gas reduction goals and priority programs for investment of proceeds to support achievement of those goals. Funding will be appropriated to State agencies by the Legislature and Governor through the annual Budget Act, consistent with the plan. The Air Resources Board (ARB) has transferred the verifications of the Cleaire Advanced Emission Controls, LLC (Cleaire) LongMile-S and Horizon diesel particulate filter systems to ESW CleanTech, Incorporated (ESW CleanTech). ESW CleanTech acquired the Cleaire product line on April 18, 2013, completed all the verification transfer requirements specified in the Verification Procedure, Warranty, and In-use Compliance Requirements for In-Use Strategies to Control Emissions from Diesel Engines, Title 13, California Code of Regulations, and will sell new systems as well as provide support for existing Cleaire customers. The LongMile-S and Horizon systems reduce emissions of diesel particulate matter by at least 85 percent and are designated as a Level 3 Plus systems. The systems are compatible with on-road vehicles using diesel fuel that contains up to 20 percent biodiesel. The Air Resources Board (ARB) has verified the RYPOS, Inc. active diesel particulate filter ActiveDPF/C3+TM for certified Tier 3, 2, or 1, or pre-certification diesel engines used in rubber tired gantry (RTG) crane applications operating on CARB diesel fuel. The RYPOS ActiveDPF/C3+TM active diesel particulate filter uses an active flow through filter followed by a diesel oxidation catalyst (DOC) to achieve at least an 85 percent reduction in particulate matter emissions qualifying it for a Level 3 Plus verification. Level 3 Plus verification means that the system will reduce diesel particulate matter (PM) emissions by 85 percent or more and meets the January 2009 NO2 limit. Specific engine conditions for which the RYPOS ActiveDPF/C3+TM has been approved may be found in the final verification executive order.
