On October 25, 2007, the Board approved an emission reduction strategy to reduce venting and leaks from oil and gas systems as an early action measure. This designation means that the regulation is scheduled to be adopted by the Board and become enforceable by January 1, 2012. Additional measures for this sector are being evaluated for the overall AB 32 Scoping Plan that the Board must adopt by January 1, 2009. The purpose of this initial workshop is to provide an overview of ARB activity to date, and to discuss concepts to achieve the maximum reduction in GHG emissions that is technically feasible and cost-effective. The proposed measure specifically applies to tractors over 33,000 pounds gross vehicle weight that pull 53-foot box-type trailers and 53-foot box-type trailers used in long-haul transportation. This measure, which is based on the voluntary SmartWay(SM) Program developed by The United States Environmental Protection Agency (USEPA), aims to improve transportation efficiency by requiring technologies that reduce aerodynamic drag and rolling resistance. In addition to requirements applicable to truck operators, this measure will also require logistics companies to ensure that operators they contract use only compliant tractors and trailers within California. At the April 20, 2006 Air Resources Board meeting, staff presented the results of a health impacts analysis related to goods movement in California. This analysis can be found in Appendix A at http://www.arb.ca.gov/planning/gmerp/gmerp.htm . Staff also informed the Board of plans to revise the health impacts methodology by updating it with new health information that relates changes in PM2.5 exposures to premature death. Staff reviewed all relevant literature and revised its methodology, which has undergone peer review by a panel formed by the University of California, Berkeley. The new methodology will be presented to the Board on May 22, 2008. This new methodology and results will be discussed in detail at a public workshop on: June 25, 2008 10:00 am to 12:00 noon Sierra Hearing Room (2^nd floor), Cal/EPA Headquarters 1001 I Street, Sacramento, CA In the draft methodology, staff has incorporated new health information that relates changes in PM2.5 exposures to premature death and developed a new relative risk of a 10% increase in premature death per 10 mg/m3 increase in exposure. Staff also recommended that a range of 7 mg/m3 to 2.5 mg/m3 be used as the lowest level of PM2.5 that can be associated with the increased risk. In the report, staff also updated the ambient air quality database to years 2004-2006. The draft methodology has undergone peer review by a panel formed by the University of California, Berkeley. This is the seventh set of workshops since the initial regulatory concept was presented in April 2007 and will also be the last series of workshops before the proposed regulation will be considered by the Board on October 23, 2008. At the workshops, staff plans to provide an overview of the proposed regulation and to discuss the associated costs and emissions benefits. Day and evening workshops are planned. ARB Staff has been working hard to finalize its two regulatory proposals to reduce PM, NOx and GHG emissions from on-road trucks. These proposals are commonly known as the “Statewide Truck and Bus Rule” and the “AB 32 Truck Efficiency Rule”. An important part of this effort is to complete our analysis of the economic impact on the many different types of fleets that will be affected by these rules. We have also been meeting with many stakeholders, and are analyzing alternative regulatory proposals some have offered. Because of this effort, when coupled with the freeze on overtime associated with the budget impasse, we have concluded we will not be ready for the October, 2008, Board meeting. These HRAs were prepared under the 2005 Railroad Agreement between ARB and Union Pacific Railroad (UP) and BNSF Railway (BNSF). This program (AB 2588, Connelly, 1998) requires stationary sources to report substances released into the air by collecting emission data to ascertain health risks. Pursuant to Health and Safety Code section 44360 (b) (2), OEHHA must develop health risk assessment guidelines under the Air Toxics Hot Spots Program. This document replaces and updates previous guidelines for cancer risk assessment by revising the procedures for deriving and applying cancer potency factors to address information that suggests that children may be especially susceptible to certain carcinogens. Technical Evaluation Document The technical evaluation of each option is based on the following criteria: technical feasibility, potential emission reductions, costs, and relative cost-effectiveness. The overall purpose of this document is to provide a sound technical basis for the ongoing dialogue on how best to achieve further emissions reductions of oxides of nitrogen (NOx) and diesel particulate matter (PM or diesel PM). The Technical Evaluation Document, and related documents, can be found on the ARB website at http://www.arb.ca.gov/railyard/ted/ted.htm This draft report is intended only to provide an initial technical assessment of various options that are available or may be available in the near future to accelerate and provide additional emissions reductions from locomotives and major railyards in California. It is not intended to serve as an implementation blueprint, as it does not evaluate which agency or agencies may have authority to implement such options. The document also does not evaluate what role, if any, the availability of public funding might play in assuring earlier or further reductions. Following receipt and evaluation of the public comments, ARB staff will develop a final report on the technical evaluation of the options. Following the completion of that report, ARB staff will develop a separate draft report for public comment that addresses possible implementation mechanisms. The range of potential mechanisms includes direct regulation, incentive funds, voluntary actions by the railroads, and enforceable agreements with the railroads. This second report will draw on the results of the previous technical evaluation. In developing the second report, ARB staff will again seek public comments.
