This HRA was prepared under the 2005 Railroad Agreement between ARB and Union Pacific Railroad (UP) and BNSF Railway (BNSF). ARB staff reviewed public comments and incorporated appropriate changes to finalize the HRA on April 18, 2008. Consistent with the Agreement, UP then began the process to develop an initial draft railyard mitigation plan for this facility, with ARB staff providing consultation and technical review on the calculations of emissions and feasibility of control measures. This is UP’s initial draft railyard mitigation plan which has not been approved or endorsed by the ARB, but provides a starting point for discussions with community members. UP and ARB staff would now like to meet with community members and air district staff to discuss UP’s initial draft railyard mitigation plan. This process will allow the public to discuss the control measures in the draft plans, and to identify additional control measures to further reduce the risks identified in the HRAs. This program will provide new funding, roughly $30 million dollars annually through 2015 to expand the State’s existing voluntary vehicle retirement program. The Bureau of Automotive Repair will begin administering the program beginning January 1, 2010. There are two main features of the proposed program. First, the proposal would significantly expand the existing statewide program by removing the requirements that vehicles be subject to Smog Check and fail the emissions test to participate. Second, additional compensation would be made available to targeted consumers in areas with the most severe air quality problems to incentivize the retirement of probable gross polluting vehicles along with the purchase of newer, cleaner vehicles. It is proposed that compensation range from $1,000 for a basic retirement up to a maximum of $4,000 total for retirement and replacement voucher. The program is structured to provide extra funding and flexibility to low-income participants. This HRA was prepared under the 2005 Railroad Agreement between ARB, Union Pacific Railroad (UP), and BNSF Railway (BNSF). ARB staff reviewed public comments and incorporated appropriate changes to finalize the HRA on November 6, 2007. Consistent with the Agreement, UP then began the process to develop an initial draft railyard mitigation plan for this facility, with ARB staff providing consultation and technical review on the calculations of emissions and feasibility of control measures. This is UP’s initial draft railyard mitigation plan which has not been approved or endorsed by the ARB, but provides a starting point for discussions with community members. UP and ARB staff would now like to meet with community members and air district staff to discuss UP’s initial draft railyard mitigation plan. This process will allow the public to discuss the control measures in the draft plans, and to identify additional control measures to further reduce the risks identified in the HRAs. Cal/EPA's Environmental Justice Program seeks to accord all Californians, including low-income and minority populations, to public health and environmental protection programs in a manner that promotes equity and affords fair treatment, accessibility, and protection for all Californians, regardless of race, age, culture, income, or geographic location. "Every resident deserves to be treated fairly when it comes to the protection of their health and environment," said Linda S. Adams, Secretary for Environmental Protection. "An effective way to work towards this goal is through community-based programs that utilize innovative ideas and approaches." "Environmental justice" is defined in Government Code Section 65040.12 as "the fair treatment of people of all races, cultures, and incomes with respect to the development, adoption, implementation, and enforcement of environmental laws, regulations, and policies." The Cal/EPA EJ Small Grants Program was established under Assembly Bill 2312 (Statutes of 2002, Chapter 994) by Assemblywoman Judy Chu to provide grants to eligible community-based grassroots non-profit organizations and federally recognized Tribal governments that are located in areas adversely affected by environmental pollution and hazards and are involved in addressing environmental justice concerns. Projects that will be considered are those that enhance meaningful public participation; promote community-capacity building; collaborate with academia and/or other government agencies to document data related to exposure and health complaints; promote community involvement in climate change emission reduction processes and programs; and continue to expand previous successful projects. Eligible applicants are limited to non-profit entities or federally recognized tribal governments. A "non-profit entity" is defined as any corporation, trust, association, cooperative, or other organization that meets all of the following criteria: A. Operates primarily for scientific, educational, service, charitable, or other similar purposes in the public interest; B. Not organized primarily for profit; C. Uses its net proceeds to maintain, improve, or expand, or any combination thereof, its operations; and D. Is a tax-exempt organization under federal Internal Revenue Code Section 501 (c)(3), or is able to provide evidence that the state of California recognizes the organizations as a non-profit entity. Individuals and organizations that are tax exempt under federal Internal Revenue Code Section 501 (c)(4) are not eligible to apply for this grant. Grants under this program will be awarded on a competitive basis. Applications to the program must be submitted and received by August 5, 2009. Cal/EPA's Environmental Justice Program seeks to accord all Californians, including low-income and minority populations, to public health and environmental protection programs in a manner that promotes equity and affords fair treatment, accessibility, and protection for all Californians, regardless of race, age, culture, income, or geographic location. "Every resident deserves to be treated fairly when it comes to the protection of their health and environment," said Linda S. Adams, Secretary for Environmental Protection. "An effective way to work towards this goal is through community-based programs that utilize innovative ideas and approaches." "Environmental justice" is defined in Government Code Section 65040.12 as "the fair treatment of people of all races, cultures, and incomes with respect to the development, adoption, implementation, and enforcement of environmental laws, regulations, and policies." The Cal/EPA EJ Small Grants Program was established under Assembly Bill 2312 (Statutes of 2002, Chapter 994) by Assemblywoman Judy Chu to provide grants to eligible community-based grassroots non-profit organizations and federally recognized Tribal governments that are located in areas adversely affected by environmental pollution and hazards and are involved in addressing environmental justice concerns. Projects that will be considered are those that enhance meaningful public participation; promote community-capacity building; collaborate with academia and/or other government agencies to document data related to exposure and health complaints; promote community involvement in climate change emission reduction processes and programs; and continue to expand previous successful projects. Eligible applicants are limited to non-profit entities or federally recognized tribal governments. A "non-profit entity" is defined as any corporation, trust, association, cooperative, or other organization that meets all of the following criteria: A. Operates primarily for scientific, educational, service, charitable, or other similar purposes in the public interest; B. Not organized primarily for profit; C. Uses its net proceeds to maintain, improve, or expand, or any combination thereof, its operations; and D. Is a tax-exempt organization under federal Internal Revenue Code Section 501 (c)(3), or is able to provide evidence that the state of California recognizes the organizations as a non-profit entity. Individuals and organizations that are tax exempt under federal Internal Revenue Code Section 501 (c)(4) are not eligible to apply for this grant. Grants under this program will be awarded on a competitive basis. Applications to the program must be submitted and received by August 5, 2009. In December 2008, staff released a draft “Technical Options to Achieve Additional Emissions and Risk Reductions from California Locomotives and Railyards” document (Technical Options Document) which provided a technical assessment of 37 options that could provide further locomotive and railyard emissions reductions. The options were evaluated based on their ability to provide potential emissions reductions beyond existing U.S. EPA and ARB regulations and agreements. The 37 options were evaluated based on the following criteria: technical feasibility, potential emissions reductions, costs, and cost-effectiveness. Since December 2008, staff has incorporated public comments and provided updated information to be released in this revised Technical Options Document. Staff also acknowledges that the data used in this report represents a snapshot in time. Elements such as locomotive fleet composition data are fluid and are influenced by many factors. In addition, other data used to evaluate technological feasibility, potential emission reductions, and costs are also fluid and subject to change. The staff expects to provide updates as technology developments and demonstration project results warrant. The draft recommendations would provide emission reductions in excess of the existing U.S. EPA and ARB locomotive and railyard regulations and agreements. The report is expected to be available by September 9, 2009. Using the information presented in the Technical Options Report, staff developed draft recommendations based on those measures that had the greatest potential emission reductions, with consideration of technical feasibility, cost effectiveness, cost, and implementation timeframe. These draft recommendations are scheduled to be considered by the Board at the September 24 – 25, 2009 public meeting. As part of the guideline revision process, ARB staff is hosting a series of workshops to solicit input, share proposals, and allow public participation. The revision process will include two components: (1) revisions to the administration chapter of the guidelines and (2) revisions to the source category chapters of the guidelines. This workshop will provide an opportunity for stakeholders to share broad input on issues that ARB staff should consider in the guideline revisions.
