The Air Resources Board (ARB or Board) staff has posted new documents related to the proposed 2010 Commitments to reduce the health risk in communities near four high priority railyards in the South Coast Air Basin. ARB’s Railyard Commitments website at: http://www.arb.ca.gov/railyard/commitments/commitments.htm provides an update on this initiative, including the most recent Board Resolution and revised drafts of the 2010 Commitments for each railyard. We will release an additional environmental analysis document in the first quarter of 2011 for public comment. Background ARB is committed to reduce the health risk from diesel particulate matter (PM) in communities near freight facilities (like railyards) and statewide. The Board’s regulations for drayage trucks, cargo handling equipment, and locomotive fuel; together with 1998 and 2005 enforceable agreements with railroads; are significantly reducing diesel PM emissions and health risk from railyard operations in the South Coast Air Basin and throughout California. The 2010 Commitments are the latest initiative to address the railyards with the highest health risks. The Commitments would establish enforceable requirements for the railroads and ARB, tracking mechanisms, and deadlines for the applicable railroad to further reduce diesel PM emissions at each railyard starting in 2011, with an 85% reduction by 2020. These reductions would need to be achieved regardless of cargo growth or increased activity at the yards. At its June 24, 2010 meeting, the Board heard staff’s recommendations for the proposed 2010 Commitments and extensive public testimony on that proposal. The Board adopted Resolution 10-29 delegating to the Executive Officer the decision on final approval of the 2010 Commitments, subject to his performing appropriate environmental analysis as required under the California Environmental Quality Act and attempting to strengthen the proposed 2010 Commitments with additional provisions to: increase accountability, ensure that progress is maintained at the four railyards, make certain that the oldest locomotives are not relocated to other yards in California, and push the deployment of advanced technologies. The Supplement provides an expanded analysis of the five alternatives to the Scoping Plan analyzed in the FED: a no project alternative, an alternative based on cap-and-trade, an alternative based on source-specific regulatory requirements, an alternative based on a carbon fee or tax, and an alternative program based on a variation of proposed strategies. This report includes updated emissions and health risk estimates and a California Environmental Quality Act Functional Equivalent Document (FED). The FED evaluates the potential environmental impacts of the proposed project, which is approval and implementation of the Revised 2010 Commitments between ARB and Union Pacific (UP) Railroad and BNSF Railway (BNSF). The supplement presents revised estimates of diesel particulate (PM) emissions and health risk at four railyards (BNSF San Bernardino, BNSF Hobart, UP Commerce and UP ICTF/Dolores). The report quantifies the significant reduction in diesel PM emissions and health risk at each railyard between 2005 and 2010. The Revised 2010 Commitments are an agreement to reduce diesel PM emissions at the four railyards in Southern California by 85 percent by 2020, as compared to 2005 levels. The FED identifies three topics with potentially significant impacts: light, noise, and transportation/traffic. Although the execution and implementation of the Revised 2010 Commitments do not directly and adversely affect the physical environment, ARB has determined that operational changes that may be undertaken by the railroads to meet the emission reduction targets or reduce health risk have the potential to result in changes to the physical environment in the vicinity of the railyards. The public review and comment period for the FED was originally July 5, 2011 through August 19, 2011. This public comment period has been extended, by at least 15 calendar days, to September 6, 2011 at 5:00 pm. The Air Resources Board (ARB) staff prepared a Supplement to the June 2010 Staff Report on Proposed Actions to Further Reduce Diesel Particulate Matter at High-Priority California Railyards (BNSF San Bernardino, BNSF Hobart, UP Commerce and UP ICTF/Dolores). This report includes updated emissions and health risk estimates and a CEQA FED. The FED evaluates the potential environmental impacts of the proposed project, which is approval and implementation of the Revised 2010 Commitments between ARB and Union Pacific (UP) Railroad and BNSF Railway (BNSF). The Final Supplement provides an expanded description and environmental analysis of the five alternatives analyzed in the 2008 AB 32 Scoping Plan Functional Equivalent Document: (1) a no project alternative; (2) an alternative based on cap-and-trade; (3) an alternative based on source-specific regulatory requirements with no cap-and-trade component; (4) an alternative based on a carbon fee or tax; and (5) an alternative program based on a variation of proposed strategies. The Final Supplement was released in draft form on June 13, 2011 for a 45-day public review and comment period that concluded on July 28, 2011. A total of 109 written comments were received during the public comment period, and several oral comments were also received at a public workshop that was held on July 8, 2011. Written responses to these comments have been prepared by ARB staff and are included in the Responses to Comments on the Supplement to the AB 32 Scoping Plan Functional Equivalent Document (Responses to Comments). OAL has until December to approve the regulations and file them with the Secretary of State. Background The Air Resources Board adopted a number of regulations that require diesel engine owners to reduce their engine emissions. These regulations are part of the State’s plan to meet federal ambient air quality standards and to protect public health. Between now and 2023, nearly all trucks and buses that operate in California and have a manufacturer’s gross vehicle weight rating greater than 14,000 pounds must upgrade to reduce exhaust emissions. Similar requirements will also become effective in the next several years affecting owners and operators of certain off-road equipment (including equipment used in construction, industrial, and airport operations). To comply with these requirements, fleet owners can upgrade existing engines by installing particulate matter (PM) filter retrofits or other Verified Diesel Emission Control Strategies (VDECS), or by upgrading to cleaner engines. In addition, the California Global Warming Solutions Act of 2006 (AB 32) established requirements to achieve reductions of greenhouse gas (GHG) emissions. AB 32 requires the Air Resources Board (the Board or ARB) and other state agencies to adopt regulations and other requirements that would reduce statewide GHG emission levels to the equivalent of 1990 levels by 2020. The Tractor-Trailer GHG rulemaking is one of 44 early action measures identified by the Board and requires certain tractor and trailer combinations to use low-rolling resistance tires and aerodynamic technology.
