Date: Tue, 22 Jan 2013 14:47:11 -0800 Subject: arbcombo -- Request for Nominations for Appointment to the Air Resources Board Environmental Justice Advisory Committee From: jraymond@arb.ca.gov The California Air Resources Board (ARB) is seeking nominations from environmental justice organizations and community groups for representatives to serve on the Environmental Justice Advisory Committee. Pursuant to Assembly Bill 32 (Chapter 488, Statutes of 2006), ARB convened the Environmental Justice Advisory Committee (EJAC or Committee) in 2007 to advise it on the development of California’s Climate Change Scoping Plan (http://www.arb.ca.gov/cc/scopingplan/document/scopingplandocument.htm) and other matters pertinent to the implementation of AB 32. ARB is required to develop an updated Scoping Plan to bring to the Board by December 2013. The plan will focus on strategies to reduce greenhouse gas emissions and achieve additional co-benefits both in the near-term and beyond 2020, including in disadvantaged communities. Sectors of focus will include transportation, fuels, and infrastructure; energy generation, transmission, and efficiency; waste; water; and agriculture. It will also focus on how best to align California’s greenhouse gas emission reduction strategies with other state policy priorities like air quality, goods movement, sustainable communities, and clean energy. ARB is reconvening the EJAC to advise on the development of the updated Scoping Plan. Staff expects the EJAC to meet twice during the spring and summer of 2013 to discuss the Scoping Plan prior to Board consideration of the Plan. Nominations from environmental justice organizations and community groups for membership on the EJAC are being solicited for representatives that meet the membership requirements of AB 32, Health and Safety Code, section 38591: “The advisory committee shall be comprised of representatives from communities in the state with the most significant exposure to air pollution, including, but not limited to, communities with minority populations or low-income populations, or both. The state board shall appoint the advisory committee members from nominations received from environmental justice organizations and community groups.” Current or former members of the EJAC that still meet the eligibility requirements are invited to resubmit a nomination. Nominations shall include the following information: - Name, business address, and brief description of nominating environmental justice organization or community group; - For its nomination, the group shall indicate: - Name and business address of representative being nominated for appointment to the Committee; * The community or communities in the state the representative represents; * Relevant professional work experience of the representative being nominated; and * Brief description of interest of nominee in service on the Committee. To be considered for appointment to the EJAC, nominations should be received no later than 5:00 pm on March 1, 2013 and addressed to the following: Email: Clerk of the Board, Air Resources Board cotb@arb.ca.gov Or Postal mail: Clerk of the Board, Air Resources Board 1001 I Street, Sacramento, California 95814 For additional information or questions please contact Alexandra Kamel at Alexandra.Kamel@arb.ca.gov; (916) 322.5840. TTY/TDD/Speech to Speech users may dial 711 for the California Relay Service. BACKGROUND: Assembly Bill (AB) 32, the California Global Warming Solutions Act of 2006, requires California to reduce statewide GHG emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, the Air Resources Board (ARB) has developed a Cap-and-Trade program that limits statewide emissions from sources responsible for 85 percent of greenhouse gases and creates a financial incentive for clean and efficient technologies. Under the program, a portion of the allowances required for compliance are auctioned. The State portion of the proceeds from these auctions will be used to fund projects to reduce greenhouse gas emissions, consistent with State law. In September 2012, the Legislature passed and Governor Brown signed into law two bills – AB 1532 (Pérez, Chapter 807) and Senate Bill (SB) 535 (De León, Chapter 830) – that together establish a framework for developing an investment plan for projects and programs to be funded with Cap-and-Trade auction proceeds. SB 535 further requires that 25 percent of the proceeds that will be expended benefit disadvantaged communities and at least 10 percent of the proceeds expended be invested in projects located within those communities. The Department of Finance (Finance), in consultation with the ARB and other state entities, will develop and submit to the Legislature a three-year investment plan for the auction proceeds. The investment plan will identify the State’s greenhouse gas reduction goals and priority programs for investment of proceeds to support achievement of those goals. Funding will be appropriated to State agencies by the Legislature and Governor through the annual Budget Act, consistent with the plan. To download the complete report, summary and transmittal letter please visit: http://www.arb.ca.gov/cc/jlbcreports/jlbcreports.htm The report provides a detailed update on ARB’s activities to achieve the goals of AB 32. ARB has undertaken ground-breaking climate change initiatives, notably Cap-and-Trade, the Low Carbon Fuel Standard, and the Advanced Clean Cars Program, and we are working in close partnership with our regional partners to implement SB 375. Since AB 32 was passed, ARB has worked diligently to develop California’s climate change programs and to ensure their smooth implementation. We have made excellent progress towards achieving our goal of reducing greenhouse gas emissions to 1990 levels by 2020. This report was prepared pursuant to the requirements of the Supplemental Report of the 2012 Budget Act, item 3900-001-0001, which requires ARB to provide AB 32 program updates semi-annually and AB 32 fiscal information annually to the Joint Legislative Budget Committee. The report also meets the requirements of Senate Bill 1018 (Budget and Fiscal Review, Chapter 39, Statutes of 2012), to provide semi-annual updates to the Joint Legislative Budget Committee about Western Climate Initiative, Incorporated (WCI, Inc.). At this workshop, staff will be soliciting input on the following proposals: •Adopting a new regulation to harmonize with the Greenhouse Gas (GHG) Emissions Standards for Medium- and Heavy-Duty Engines and Vehicles that the United States Environmental Protection Agency (U.S. EPA) adopted in 2011; •Making amendments to ARB’s existing Heavy-Duty Vehicle GHG Emission Reduction Regulation (Tractor-Trailer GHG regulation) to align with the proposed new regulation above; •Adopting a new set of optional oxides of nitrogen (NOx) standards for heavy-duty vehicle engines more stringent than the current 2010 model year standard; and •Making amendments to the Airborne Toxic Control Measure (ATCM) to Limit Diesel-fueled Commercial Motor Vehicle Idling to expand compliance responsibility. The workshop is described further in the workshop notice at http://www.arb.ca.gov/msprog/mailouts/msc1305/msc1305.pdf and will be held at the following time and location: Date: Monday, March 11, 2013 Time: 8:30 a.m. – 4:00 p.m. Location: Air Resources Board Coastal Hearing Room 1001 I Street Sacramento, California 95814 Directions are at http://www.arb.ca.gov/maps/sactomap.htm Background: In September 2011, the U.S. EPA adopted a new regulation for controlling GHG emissions from new medium and heavy-duty engines and vehicles. ARB staff is proposing to align with the federal regulation in order to provide California with the ability to certify engines and vehicles to the new standards as well as enforce them. On December 11, 2008, the Board approved the Tractor-Trailer GHG regulation codified in sections 95300-95312 of title 17, California Code of Regulations, and later amended it on December 17, 2010. This regulation reduces GHG emissions from long-haul tractor-trailer combinations by requiring them to utilize U.S. EPA SmartWay verified or designated technologies that will improve fuel efficiency. To harmonize the tractor requirements of the federal and California regulations, ARB staff is considering modifications to its Tractor-Trailer GHG regulation. ARB staff will be proposing optional NOx emission standards for California certified 2015 and later model year engines. If the optional standards are adopted, ARB’s existing incentive programs such as the Carl Moyer Memorial Air Quality Standards Attainment program could be modified to give preference to engines certified to the optional standards. On July 22, 2004, ARB adopted an ATCM to Limit Diesel-fueled Commercial Motor Vehicle Idling. This regulation is codified in section 2485 of title 13, California Code of Regulations, and was later amended on October 20, 2005 and December 11, 2008. ARB staff is proposing to extend responsibility for complying with the requirements of the idling ATCM to the owner of the vehicle. In addition, staff’s proposal would require California-based shippers and California-based brokers to share responsibility for compliance with the idling restrictions in the event that they utilized the services of motor carriers that violated the regulation and/or they did not settle their outstanding fines. For specific questions regarding the new heavy duty engine and vehicle GHG regulation and the optional engine NOx standard, you may contact Ms. Kim Heroy-Rogalski, Manager of the Off-Road Implementation Section, by email at kheroyro@arb.ca.gov or by phone at (916) 327 2200. For questions regarding the in-use tractor-trailer GHG regulation amendments and the anti-idling ATCM amendments, you may contact Mr. Stephan Lemieux, Manager of the On-Road Heavy Duty Diesel Section, by email at slemieux@arb.ca.gov or by phone at (626) 450-6162. SACRAMENTO - The Air Resources Board today posted on its website the public discussion draft of the required update to the AB 32 Scoping Plan. The Scoping Plan describes the comprehensive range of efforts California must take to reduce greenhouse gas emissions to 1990 levels by 2020 and meet the state’s long-term goals to combat climate change. AB 32 requires the Scoping Plan to be updated every five years. The original Plan, first released in 2008, was developed on the principle that a balanced mix of strategies is the best way to cut emissions and grow California’s economy in a clean and sustainable direction. This draft update continues with that approach and focuses on three questions: • How have we done over the past five years? • What is needed to continue the prescribed course of action to 2020? • What steps must California now take to meet the state’s climate goals beyond 2020? California’s strategy to meet the goals of AB 32 is based on the continued implementation of adopted actions including Advanced Clean Cars, the 33% Renewables Portfolio Standard, statewide energy-efficiency initiatives, Cap-and-Trade, the Low Carbon Fuel Standard and other programs. They are designed to achieve significant reductions of greenhouse gases in every sector of California’s economy through improved energy efficiency, and by providing consumers with cleaner fuel choices. The discussion draft includes an analysis of progress to date, finding that California is on track to meet the AB 32 2020 goal of greenhouse gas reductions. An overview of the current science of climate change in the draft includes an expanded discussion of short-lived climate pollutants such as methane and black carbon. It also includes actions California must take to continue greenhouse gas reductions in six key focus areas: energy; transportation, land use, fuels and infrastructure; water; agriculture; natural and working lands; and, waste. The draft update is the result of a series of discussions and input over the past year by a broad range of state agencies and departments and the state Climate Action Team. In addition, four public workshops were held over the summer in Los Angeles, Fresno, Sacramento and San Francisco in an effort to consider comments prior to developing the draft. The release of the discussion draft update marks the beginning of a public comment period to help inform the Proposed Update to the Scoping Plan. Future steps in the development of the Proposed Update include a public workshop on October 15 in Sacramento (which will also be webcast), and a meeting of the Board at the end of October to hear from all stakeholders and provide further direction to staff on revisions to the discussion draft presentation to the ARB at its Board meeting at the end of October. Following the October Board meeting, the draft will be revised and then presented to the Board at its December meeting. The Board is anticipated to consider approval of the update in Spring of 2014. What is the 2013 Update to AB 32 Scoping Plan? As required by AB 32, the initial Scoping Plan was adopted in 2008. This Plan must be updated every five years. The 2013 Update to the Scoping Plan will define ARB’s climate change priorities for the next five years and lay the groundwork to start the transition to achieve post-2020 goals. The 2013 Update will highlight California’s progress toward meeting the “near-term” 2020 GHG emission reduction goals defined in the original 2008 Scoping Plan. It will also evaluate how to align the State's “longer-term” GHG reduction strategies with other State policy priorities, such as for water, waste, natural resources, agriculture, clean energy, transportation and land use. From: lquattro@arb.ca.gov The Air Resources Board (ARB or the Board) invites you to participate in the next public workshop on December 3, 2013, in Oakland, California, to discuss concepts that are being considered and take input from stakeholders on what additional amendments should be considered to the Zero Emission Bus (ZBus) regulation and to explore the status of, and future developments to, ZBus technology and related systems. Workshop Location and Time: Metropolitan Transportation Commission 101 Eighth Street, Auditorium Oakland, CA 94607 Tuesday December 3, 2013 10:00 am to 1:00 pm Since the first workshop on September 17, 2013, staff have been conducting individual meeting with bus and technology manufacturers, as well as transit districts. At this workshop, staff will summarize the four panels (fuel cell electric bus, battery electric bus, ZBus infrastructure, and transit fleets operating ZBuses) from the first workshop and the common themes expressed during the individual stakeholder meetings. This workshop will also focus on regulatory concepts and options under consideration for ZBus deployment, and the potential to incorporate potential changes to the ZBus regulation into a broader assessment of the transit fleet rule that will occur next year. Based on feedback from this workshop, additional workshops may be scheduled to discuss specific regulatory language and to take comments on draft amendments prior to taking the regulatory package to the Board. We encourage you to attend the meeting as zero emission buses will be on display for rides and viewing. For those that cannot attend in person, a webinar is available. The webinar information along with the agenda is now posted on our website: ZBus website: http://www.arb.ca.gov/msprog/bus/zbus/zbus.htm BACKGROUND: The ZBus regulation, first adopted in 2000, applies to transit agencies with 200 or more urban buses. The regulation required a demonstration for diesel path transit agencies and 15 percent of new buses purchased to be zero emission beginning in 2008 for diesel path transit agencies, and 2010 for alternative path transit agencies. The ZBus regulation was amended in 2006, to include an advanced demonstration from the diesel path transit agencies. The Board postponed the purchase requirement to 2011 for diesel path transit agencies, and 2012 for alternative path transit agencies. The Board directed the Executive Officer to delay the ZBus purchase requirement through Resolution 09-49 at the July 2009 Board Meeting. In January 2010 “Mail-Out #MSC 10-04” notified all affected transit agencies of the ZBus purchase requirement suspension. The Board will be considering changes or amendments to the ZBus regulation which may affect the purchase requirement in May 2014. Regular releases beginning in 2014 will be at 12:00 (noon) Pacific Time on the last business day of each quarter. These releases will include information about covered, opt-in, and voluntarily associated entities registered for the Cap-and-Trade Program in CITSS. The information will be posted on ARB’s Cap-and-Trade website at: http://www.arb.ca.gov/cc/capandtrade/capandtrade.htm Background CITSS is a market tracking system that supports the implementation of greenhouse gas (GHG) cap-and-trade programs for California and other jurisdictions. CITSS provides accounts for market participants to hold and retire compliance instruments and to participate in transfers of compliance instruments with other account holders. CITSS is used to register entities participating in the California Cap-and-Trade Program, track the ownership of compliance instruments, enable and record compliance instrument transfers, facilitate emissions compliance, and support market oversight. The CITSS Registrant Report continues ARB’s process of making market related information public. ARB will continue to develop and release additional market related information as part of implementation of the Cap-and-Trade Program. ARB has held three workshops to discuss release of market information and received many oral and written comments during that process. The CITSS Registrant Report implements the regulatory requirements regarding information release and addresses stakeholder concerns related to releasing confidential business information that could place stakeholders at a market disadvantage. The CITSS Registrant Report will include the names of account holders in the tracking system. This will allow counter parties to verify each other and will provide for program transparency. For covered and opt-in entities, information will include the legal entity name, the four digit CITSS ID, and the status of the account as a covered or opt-in entity. In the case of voluntarily associated entities, information will include the legal entity name, the four digit CITSS ID, and the status of the account holder as an organization or individual. Where applicable, the report will also include the GHG reporting ID’s for any facilities associated with the CITSS account. Individual CITSS account numbers will not be released.
