It instructed the California Environmental Protection Agency to coordinate activities between the University of California, the California Energy Commission and other state agencies to develop and propose a draft compliance schedule to meet the 2020 target. Furthermore, it directed the California Air Resources Board (ARB) to consider initiating a regulatory proceeding to establish and implement the Low Carbon Fuel Standard (LCFS). In response, ARB identified the LCFS as an early action item with a regulation to be adopted and implemented by 2010. As the result, the staff of the California Air Resources Board has released the “Proposed Concept Outline for the California Low Carbon Fuel Standard Regulation” as part of the process of the rule making. The CA-modified model (greet1.7ca_v98.xls) is available for download from the Low Carbon Fuel Standard website at http://www.arb.ca.gov/fuels/lcfs/lcfs.htm . Staff is seeking comments for these documents which will be discussed during the LCFS Life Cycle Analysis Working Group meeting on May 2, 2008, starting at 9:00 A.M. After the discussions, staff will review the comments received and modify the pathways as necessary. OAL’s main basis for their disapproval centered around Table 12 of the “California Procedures for Evaluating Alternative Specifications for Phase 3 Reformulated Gasoline Using the California Predictive Model.” Table 12 contains the means and standard deviations of the fuel properties in the model. OAL determined that Table 12 was updated in response to a comment as part of the first 15 day package and not released for public comment after it had been updated. This was the main basis for the disapproval. The rest of the issues in their disapproval are considered minor. Pursuant to Government Code section 11349.4, the adopting agency may resubmit the regulation(s) to OAL within 120 calendar days of receipt of the written decision detailing the reason(s) for disapproval of the regulatory filing. ARB staff are currently in the process of creating a second 15 day package so that changes to the “California Procedures for Evaluating Alternative Specifications for Phase 3 Reformulated Gasoline Using the California Predictive Model” may be reviewed by the public. After the second 15 day comment period staff will resubmit the regulation to OAL for approval. California Assembly Bill AB 679 requires ARB to convene a panel of interested parties to develop a test protocol and implement a test program to measure the emissions benefits of CARB diesel. This is the seventh set of workshops since the initial regulatory concept was presented in April 2007 and will also be the last series of workshops before the proposed regulation will be considered by the Board on October 23, 2008. At the workshops, staff plans to provide an overview of the proposed regulation and to discuss the associated costs and emissions benefits. Day and evening workshops are planned. The daytime workshops will be held in San Diego, El Monte, Redding, San Jose, Sacramento, and Fresno. The workshop in Sacramento will also be webcast. ARB Staff has been working hard to finalize its two regulatory proposals to reduce PM, NOx and GHG emissions from on-road trucks. These proposals are commonly known as the “Statewide Truck and Bus Rule” and the “AB 32 Truck Efficiency Rule”. An important part of this effort is to complete our analysis of the economic impact on the many different types of fleets that will be affected by these rules. We have also been meeting with many stakeholders, and are analyzing alternative regulatory proposals some have offered. Because of this effort, when coupled with the freeze on overtime associated with the budget impasse, we have concluded we will not be ready for the October, 2008, Board meeting. As a result, we have delayed the Board’s consideration of these two regulatory items to its December 11 & 12, 2008, hearing in Sacramento. This update was conducted to reflect updates in the September 2008 release Argonne National model. Additional information to include criteria pollutants is also updated in the model. For this release, updates have been performed for CARBOB, ULSD, CaRFG, CNG, and Electricity. Pathway documents reflecting the updates will be posted to the website shown below over the next 1-2 weeks. An additional update to incorporate the other fuel pathways will be posted in the next 1-2 weeks.
