ARB is preparing a Functional Equivalent Document (FED) pursuant to the California Environmental Quality Act (CEQA)to identify potentially significant environmental impacts of the proposed Advanced Clean Cars regulations, and feasible mitigation for such impacts. The FED will focus on the potential environmental impacts associated with compliance responses and will include a reasonable range of alternatives to the proposed regulations, as required under CEQA. This workshop will serve as the scoping meeting for the environmental document. Also, ARB staff will present their proposal for the adoption of the new Federal Fuel Economy and Environmental Label in place of the California’s Environmental Performance Label. Finally, ARB staff is proposing to update specifications for certification fuel for on-road gasoline vehicles. These amendments will be part of proposals for major amendments to the California SORE and Tier 4 off-road compression-ignition (CI) engine regulations and test procedures intended to provide greater alignment with the applicable federal nonroad small SI engine and nonroad CI engine regulations and test procedures. Specifically, the proposed certification test fuel will have a ten-percent blend of ethanol, and will be consistent with the new certification test fuel that ARB will soon propose for adoption by on-road motor vehicles under the third phase of California’s Low Emission Vehicle rulemaking (LEV III). One of the court’s rulings preliminarily enjoins the Air Resources Board (ARB or Board) from enforcing the regulation during the pendency of the litigation. While ARB intends to appeal these rulings and to seek an order staying the preliminary injunction, as long as the injunction remains in effect, ARB will respect the Court’s ruling and withhold enforcement of the LCFS requirements, including enforcement of the requirements described in this supplemental regulatory advisory. In seeking a stay of the preliminary injunction, ARB will request an order that all requirements of the LCFS in 2011 and 2012 are enforceable for the entire period. Thus, to the extent that existing guidance issued by ARB is expiring or stakeholders or the Board has requested modifications to the regulation, ARB will continue its stakeholder and rulemaking processes. This includes the issuance of this advisory to provide guidance in response to stakeholder requests. Today the ARB is issuing Supplemental Regulatory Advisory 10-04B (Supplemental Advisory 10 04B), which goes into effect January 1, 2012, to provide further guidance to stakeholders on the Low Carbon Fuel Standard (LCFS) regulation. This Supplemental Advisory 10-04B further elaborates on the guidance provided in Supplemental Advisory 10 04A. This Supplemental Advisory 10-04B will remain in effect through December 31, 2012, unless superseded by a subsequent ARB advisory, notice, or rulemaking.
