The California Cap on Greenhouse Gas Emissions and Market-Based Compliance Mechanisms Regulation was adopted by the California Air Resources Board in October of 2011 and went into effect January 1, 2012. Subarticles 13 and 14 of the regulation describe the compliance offset program and the approval of Early Action Offset Credits. Included in these sections is a requirement for third-party verification of all GHG emission reductions and GHG removal enhancements before any ARB offset credits may be issued. Only ARB accredited offset verifiers may provide offset verification services under the compliance offset program. Accordingly, ARB has established a program to accredit offset verifiers that meet the regulation’s requirements. To become an accredited offset verifier, the applicant must submit a completed Verifier Application to ARB along with the required documentation. Once the verifier applications have been reviewed by ARB and determined to have the potential to meet the minimum qualifications listed in the regulation, the verifier applicant will be notified how to register for ARB approved training courses. BACKGROUND: Assembly Bill (AB) 32, the California Global Warming Solutions Act of 2006, requires California to reduce statewide GHG emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, the Air Resources Board (ARB) has developed a Cap-and-Trade program that limits statewide emissions from sources responsible for 85 percent of greenhouse gases and creates a financial incentive for clean and efficient technologies. Under the program, a portion of the allowances required for compliance are auctioned. The State portion of the proceeds from these auctions will be used to fund projects to reduce greenhouse gas emissions, consistent with State law. In September 2012, the Legislature passed and Governor Brown signed into law two bills – AB 1532 (Pérez, Chapter 807) and Senate Bill (SB) 535 (De León, Chapter 830) – that together establish a framework for developing an investment plan for projects and programs to be funded with Cap-and-Trade auction proceeds. SB 535 further requires that 25 percent of the proceeds that will be expended benefit disadvantaged communities and at least 10 percent of the proceeds expended be invested in projects located within those communities. The Department of Finance (Finance), in consultation with the ARB and other state entities, will develop and submit to the Legislature a three-year investment plan for the auction proceeds. The investment plan will identify the State’s greenhouse gas reduction goals and priority programs for investment of proceeds to support achievement of those goals. The Cap-and-Trade Regulation contains provisions for the use of a limited number of ARB offset credits generated under approved Compliance Offset Protocols to meet an entities compliance obligation. Currently the Regulation recognizes four Compliance Offset Protocols: Ozone Depleting Substances Projects, Livestock Projects, Urban Forest Projects, and U.S. Forest Projects. ARB publicly announced at the June 2012 Board Meeting their intent to evaluate additional protocols to help meet the demand for ARB offset credits in the program. ARB has identified two new protocols, Rice Cultivation Projects and Coal Mine Methane Projects, as potentially meeting the requirements specified in the Regulation for approval as Compliance Offset Protocols. The protocol for Coal Mine Methane Projects quantifies reductions in methane emissions from mining operations. Underground and surface coal mining can release methane to the atmosphere before, during and after the mining process. There are two key sources of methane from active coal mining: ventilation and degasification. During ventilation dilute methane is vented through mine ventilation shafts. For degasification vertical or horizontal wells remove methane from the underground mine before, during, or after mining. To reduce methane emissions, methane can be captured and used for energy production or flared. The protocol would include methodologies to identify eligible project types, and to identify and quantify of eligible methane sources. The protocol for Rice Cultivation Projects quantifies reductions in methane emissions from flooded rice fields. Flooding results in anaerobic decomposition of organic matter. The organic matter can originate from soil amendments, plant residues or root exudates. The amount of methane produced is affected by the duration of flooding, the rice variety and the availability of crop residues and organic matter. The protocol would use the DeNitrification-DeComposition (DNDC) biogeochemical process model to quantify soil carbon dynamics, N2O and CH4 emissions. At this time projects would be limited to California and the Mid-South Region (list states) for which the DNDC model has been calibrated with empirical data. And the protocol would be limited to three specific project activities: (1) replacing wet seeding with dry seeding, (2) early drainage, and (3) baling of rice straw. Regular releases will be at 12:00 (noon) Pacific Time on the on the first business Wednesday of each month. This release will include information about early action offset projects that have been reviewed and approved for listing. The information will be posted on ARB’s Early Action Projects website at: http://www.arb.ca.gov/cc/capandtrade/offsets/earlyaction/projects.htm. Background Some voluntary offset projects that have been issued offset credits by approved voluntary registries for GHG reductions or removal enhancements that occurred between January 1, 2005 and December 31, 2014 may be eligible to be issued ARB offset credits. These projects are referred to as early action offset projects. Early action offset projects must meet specific requirements in the Cap-and-Trade Regulation. The first step in the process is to list the early action offset project with ARB. Once the listing information for an early action offset project has been submitted ARB will review it and the offset project will be listed below. The listing information provides general information about the early action offset project. In order for the early action offset credits to be eligible to become ARB offset credits, after listing they must undergo regulatory verification which includes an assessment of conflict of interest and a desk review to confirm the validity of the initial verification. Upon satisfying the requirements in section 95990(c) of the Regulation, and successfully completing the regulatory verification process, applicants may request the issuance of ARB offset credits. After the request has been made, ARB will conduct a full review of all project documents. If the review shows conformance with the Regulation, ARB offset credits will be issued. After issuance, information regarding the early action offset project, including number of ARB offset credits issued by vintage, and invalidation status will be made publicly available on this website. The Cap-and-Trade Regulation contains provisions for the use of a limited number of ARB offset credits generated under approved Compliance Offset Protocols to meet an entities compliance obligation. Currently the Regulation recognizes four Compliance Offset Protocols: Ozone Depleting Substances Projects, Livestock Projects, Urban Forest Projects, and U.S. Forest Projects. ARB publicly announced at the June 2012 Board Meeting their intent to evaluate additional protocols to help meet the demand for ARB offset credits in the program. ARB has identified two new protocols, Rice Cultivation Projects and Coal Mine Methane Projects, as potentially meeting the requirements specified in the Regulation for approval as Compliance Offset Protocols. The protocol for Coal Mine Methane Projects quantifies reductions in methane emissions from mining operations. Underground and surface coal mining can release methane to the atmosphere before, during and after the mining process. There are two key sources of methane from active coal mining: ventilation and degasification. During ventilation dilute methane is vented through mine ventilation shafts. For degasification vertical or horizontal wells remove methane from the underground mine before, during, or after mining. To reduce methane emissions, methane can be captured and used for energy production or flared. The protocol would include methodologies to identify eligible project types, and to identify and quantify of eligible methane sources. The protocol for Rice Cultivation Projects quantifies reductions in methane emissions from flooded rice fields. Flooding results in anaerobic decomposition of organic matter. The organic matter can originate from soil amendments, plant residues or root exudates. The amount of methane produced is affected by the duration of flooding, the rice variety and the availability of crop residues and organic matter. The protocol would use the DeNitrification-DeComposition (DNDC) biogeochemical process model to quantify soil carbon dynamics, N2O and CH4 emissions. At this time projects would be limited to California and the Mid-South Region (list states) for which the DNDC model has been calibrated with empirical data. And the protocol would be limited to three specific project activities: (1) replacing wet seeding with dry seeding, (2) early drainage, and (3) baling of rice straw. There are two key sources of methane from active mining: ventilation and degasification. During ventilation dilute methane is vented through mine ventilation shafts. For degasification vertical or horizontal wells remove methane from the underground mine before, during, or after mining. To reduce methane emissions, methane can be captured and used for energy production or flared. The protocol would include methodologies to identify eligible project types, and to identify and quantify of eligible methane sources. The protocol for Rice Cultivation Projects quantifies reductions in methane emissions from flooded rice fields. Flooding results in anaerobic decomposition of organic matter. The organic matter can originate from soil amendments, plant residues or root exudates. The amount of methane produced is affected by the duration of flooding, the rice variety and the availability of crop residues and organic matter. The protocol would use the DeNitrification-DeComposition (DNDC) biogeochemical process model to quantify soil carbon dynamics, nitrous oxide (N2O) and methane (CH4) emissions. Projects would be limited to the major rice growing regions in California and the Mid-South (Arkansas, Missouri, Mississippi, Louisiana, and Texas) for which the DNDC model has been calibrated with empirical data. ARB is considering three eligible practices for California: 1) replacing wet seeding with dry seeding, 2) early drainage at the end of growing season, and 3) rice straw removal after harvest; and four eligible practices for the Mid-South: 1) early drainage at the end of growing season, 2) rice straw removal after harvest, 3) intermittent flooding, and 4) staggered winter flooding. SACRAMENTO - The Air Resources Board today posted on its website the public discussion draft of the required update to the AB 32 Scoping Plan. The Scoping Plan describes the comprehensive range of efforts California must take to reduce greenhouse gas emissions to 1990 levels by 2020 and meet the state’s long-term goals to combat climate change. AB 32 requires the Scoping Plan to be updated every five years. The original Plan, first released in 2008, was developed on the principle that a balanced mix of strategies is the best way to cut emissions and grow California’s economy in a clean and sustainable direction. This draft update continues with that approach and focuses on three questions: • How have we done over the past five years? • What is needed to continue the prescribed course of action to 2020? • What steps must California now take to meet the state’s climate goals beyond 2020? California’s strategy to meet the goals of AB 32 is based on the continued implementation of adopted actions including Advanced Clean Cars, the 33% Renewables Portfolio Standard, statewide energy-efficiency initiatives, Cap-and-Trade, the Low Carbon Fuel Standard and other programs. They are designed to achieve significant reductions of greenhouse gases in every sector of California’s economy through improved energy efficiency, and by providing consumers with cleaner fuel choices. The discussion draft includes an analysis of progress to date, finding that California is on track to meet the AB 32 2020 goal of greenhouse gas reductions. An overview of the current science of climate change in the draft includes an expanded discussion of short-lived climate pollutants such as methane and black carbon. It also includes actions California must take to continue greenhouse gas reductions in six key focus areas: energy; transportation, land use, fuels and infrastructure; water; agriculture; natural and working lands; and, waste. The draft update is the result of a series of discussions and input over the past year by a broad range of state agencies and departments and the state Climate Action Team. In addition, four public workshops were held over the summer in Los Angeles, Fresno, Sacramento and San Francisco in an effort to consider comments prior to developing the draft. The release of the discussion draft update marks the beginning of a public comment period to help inform the Proposed Update to the Scoping Plan. Future steps in the development of the Proposed Update include a public workshop on October 15 in Sacramento (which will also be webcast), and a meeting of the Board at the end of October to hear from all stakeholders and provide further direction to staff on revisions to the discussion draft presentation to the ARB at its Board meeting at the end of October. Over 700 entities, including facilities, fuel suppliers, and electric power importers, are required to report their greenhouse gas emissions data to ARB. Emissions data reports from entities with 25,000 metric tons carbon dioxide equivalent or greater emissions must be verified by ARB-accredited third-party verifiers. The information in the emissions data reports is used to support ARB’s GHG emissions reduction actions, including California’s Cap-and-Trade program. Entities that emit 25,000 metric tons carbon dioxide equivalent or greater in any year beginning in 2009 through 2012 are considered a covered entity beginning January 1, 2013. Covered entities must register with the Compliance Instrument Tracking System Service (CITSS) and submit compliance instruments equal to their emissions for each compliance period. The purpose of the schedule revision is to provide adequate time for staff to review, consider and incorporate stakeholder comments. ARB anticipates releasing the Proposed Update and Environmental Assessment in late January followed by a February Board meeting that will include additional opportunities for stakeholder feedback and public comment. In late spring 2014, ARB will hold a Board Hearing to consider the Final Scoping Plan Update and Environmental Assessment. Regular releases beginning in 2014 will be at 12:00 (noon) Pacific Time on the last business day of each quarter. These releases will include information about covered, opt-in, and voluntarily associated entities registered for the Cap-and-Trade Program in CITSS. The information will be posted on ARB’s Cap-and-Trade website at: http://www.arb.ca.gov/cc/capandtrade/capandtrade.htm Background CITSS is a market tracking system that supports the implementation of greenhouse gas (GHG) cap-and-trade programs for California and other jurisdictions. CITSS provides accounts for market participants to hold and retire compliance instruments and to participate in transfers of compliance instruments with other account holders. CITSS is used to register entities participating in the California Cap-and-Trade Program, track the ownership of compliance instruments, enable and record compliance instrument transfers, facilitate emissions compliance, and support market oversight. The CITSS Registrant Report continues ARB’s process of making market related information public. ARB will continue to develop and release additional market related information as part of implementation of the Cap-and-Trade Program. ARB has held three workshops to discuss release of market information and received many oral and written comments during that process. The CITSS Registrant Report implements the regulatory requirements regarding information release and addresses stakeholder concerns related to releasing confidential business information that could place stakeholders at a market disadvantage. The CITSS Registrant Report will include the names of account holders in the tracking system. This will allow counter parties to verify each other and will provide for program transparency. For covered and opt-in entities, information will include the legal entity name, the four digit CITSS ID, and the status of the account as a covered or opt-in entity. In the case of voluntarily associated entities, information will include the legal entity name, the four digit CITSS ID, and the status of the account holder as an organization or individual. Where applicable, the report will also include the GHG reporting ID’s for any facilities associated with the CITSS account. Individual CITSS account numbers will not be released.
