The guidance will be made publicly available here: http://www.arb.ca.gov/cc/capandtrade/capandtrade.htm Background The compliance offset program serves as an important cost containment feature of the Cap-and-Trade Program. The Cap-and-Trade Regulation (Regulation) requires projects to be in regulatory conformance prior to the issuance of compliance offset credits. And, the Regulation allows ARB to investigate and invalidate any issued compliance offset credits that were generated if the offset project activity and implementation of the offset project was not in accordance with local, state, or national environmental and health and safety regulations during the reporting period for which the ARB offset credit was issued. The guidance document provides additional clarity on the role of verifiers reviewing projects for regulatory conformance and additional clarity on the scope of project activities that would be included in any potential invalidation investigation. ARB will also provide further offset protocol-specific clarifications as part of its existing process to update and publicly post FAQs for the offset program. California is in a drought emergency. Short-lived climate pollutants (SLCPs) include methane, tropospheric ozone, black carbon, and fluorinated gases. They are powerful climate forcers that remain in the atmosphere for a much shorter period of time than longer-lived climate pollutants, including carbon dioxide. Their relative potency, when measured in terms of how they heat the atmosphere, can be tens to thousands of times greater than that of carbon dioxide (CO2). Senate Bill 605 (Lara, Chapter 523, Statutes of 2014) requires ARB, in coordination with other state agencies and local air districts, to develop a SLCP Strategy by the end of 2015, to further reduce SLCP emissions in California. The Concept Paper presents initial ideas that will be considered and evaluated in the coming months by ARB staff, in coordination with other agencies, as it develops a SLCP Strategy pursuant to SB 605. The concepts included in this discussion draft do not represent commitments at this time, nor do they comprise an exhaustive list of elements or considerations that may be included in the Strategy or shape its development. The intent of the paper is to elicit new ideas and refine strategies to reduce emissions of SLCPs throughout the state. The Concept Paper will be discussed at a May 27, 2015, public workshop. The comments received on the Concept Paper will inform the development of a draft Strategy that ARB expects to release for public comment later this summer. ARB welcomes broad participation among stakeholders, experts and interested parties throughout this process. The Concept Paper and workshop notice can be found at ARB's Short-Lived Climate Pollutant website at: http://www.arb.ca.gov/cc/shortlived/shortlived.htm The website also contains a link for submitting written comments. An agenda and presentation will be posted before the workshop. California is in a drought emergency. Visit www.SaveOurH2O.org for water conservation tips. The information posted will include the 2013 GHG emission inventory data; supporting documentation including an analysis of emissions trends; as well as an evaluation of the 2013 GHG data reported pursuant to the Mandatory Greenhouse Gas Reporting Regulation (MRR). The 2013 GHG emission inventory data and supporting documentation will be available at ARB’s GHG Emission Inventory website at: http://www.arb.ca.gov/cc/inventory/inventory.htm The evaluation of the 2013 MRR data will be available at both the Cap-and-Trade and Mandatory GHG Reporting websites: http://www.arb.ca.gov/cc/capandtrade/capandtrade.htm http://www.arb.ca.gov/cc/reporting/ghg-rep/ghg-rep.htm In addition to the evaluation of the 2013 MRR data, staff will post updated emissions data summary spreadsheets for the 2010, 2011, and 2012 data reporting years, to reflect minor revisions. BACKGROUND: ARB is responsible for developing and maintaining California’s inventory of GHG emissions. An updated GHG emission inventory is published annually to reflect current data. The new GHG inventory covers years 2000 to 2013. The emission estimates are statewide estimates that rely on state, regional or national data sources, and on aggregated facility-specific emissions data reported pursuant to the MRR. Accompanying the GHG inventory data is the “Trends of Emissions and Other Indicators” report, which explains trends in statewide GHG emissions from major sectors. More information can be found at: http://www.arb.ca.gov/cc/inventory/inventory.htm The California Cap on Greenhouse Gas Emissions and Market-Based Compliance Mechanisms Regulation (Regulation) was adopted by the California Air Resources Board in October of 2011, and formally went into effect January 1, 2012. Entities subject to the Regulation will have a compliance obligation for their GHG emissions beginning on January 1, 2013. The Regulation was amended in early 2013 to link the California and Québec programs beginning January 1, 2014. More information about the California Cap-and-Trade Program is available here: http://www.arb.ca.gov/cc/capandtrade/capandtrade.htm. The Global Warming Solutions Act of 2006 (Assembly Bill 32, or AB 32) requires ARB to adopt regulations for the mandatory reporting of GHG emissions. The Regulation for the Mandatory Reporting of Greenhouse Gas Emissions went into effect on January 1, 2009. Over 700 entities, including facilities, fuel suppliers, and electric power importers, are required to report their GHG emissions data to ARB. Emissions data reports from entities with 25,000 metric tons carbon dioxide equivalent or greater emissions must be verified by ARB-accredited third-party verifiers. The information in the emissions data reports is used to support ARB’s climate change programs, including California’s Cap-and-Trade Program. The California Natural Resources Agency, the California Department of Food and Agriculture, and the California Air Resources Board will conduct a public symposium to discuss the development of strategies to achieve Governor Edmund G. Brown Jr’s 2030 greenhouse gas reduction goals. Natural Resources Secretary John Laird, Agriculture Secretary Karen Ross and Air Resources Board Executive Officer Richard Corey will speak at the event. Additional representatives from these and other state agencies and the Governor’s Office may also attend and participate. WHEN: Wednesday, August 5, 2015, 9 a.m. – 4 p.m. WHERE: Byron Sher Auditorium, Cal/EPA Headquarters 1001 I St., Sacramento, CA 95814 Directions and public transit options: http://www.calepa.ca.gov/epabldg/location.htm Live webcast: http://www.calepa.ca.gov/broadcast This symposium will discuss strategies to secure and enhance carbon storage on natural and working lands, including farms, rangelands, forests and wetlands throughout California. Topics include protecting and managing land to minimize greenhouse gas emissions and increase carbon sequestration rates and opportunities to develop synergies that promote resource stewardship and contribute to greenhouse gas emission reductions in other sectors. Background This symposium is one of a series of public forums soliciting stakeholder input on five key climate change strategy pillars that Governor Brown identified in his January 2015 inaugural address. The pillars recognize that several major areas of the California economy will need to reduce their emissions to meet the 2030 target. The five pillars are: (1) reducing today’s petroleum use in cars and trucks by up to 50 percent; (2) increasing from one-third to 50 percent our electricity derived from renewable sources; (3) doubling the efficiency savings achieved at existing buildings and making heating fuels cleaner; (4) reducing the release of methane, black carbon, and other short lived climate pollutants; and (5) managing farm and rangelands, forests and wetlands so they can store carbon. The meeting is open to the public and full participation by all parties is encouraged: Date: Thursday, October 1, 2015 Time: 10:00 am – 4:00 pm Location: California Secretary of State Building (Main Office) Auditorium 1500 11th I Street Sacramento, California 95814 The meeting will build on the recent Governor’s Climate Change Pillars symposia, to seek public input on the strategies for achieving the reduction mandate. The 2030 Scoping Plan will also help expand on the post-2020 GHG reductions outlined in the First Update to the Climate Change Scoping Plan. Directions to the California Secretary of State Main Office building can be found at: http://www.sos.ca.gov/business-programs/driving-directions-sacramento/ . Background In 2006, the Legislature passed the California Global Warming Solutions Act of 2006 (Assembly Bill 32 [AB 32]; Stats. 2006, chapter 488). AB 32 created a comprehensive, multi-year program to reduce GHG emissions in California. AB 32 required ARB to develop and approve a Scoping Plan that describes the approach the State will take to reduce GHGs to achieve the goal of reducing emissions to 1990 levels by 2020. The Scoping Plan was first approved by the Board in 2008 and, per AB 32, must be updated every five years to evaluate the mix of AB 32 policies to ensure that California is on track to achieve the 2020 GHG reduction goal. The 2013 First Update to the Climate Change Scoping Plan defined ARB’s climate change priorities for the next five years and laid the groundwork to start the transition to the post-2020 goals set forth in Executive Orders S-3-05 and B-16-2012. The 2013 Update also recommended the need for a 2030 mid-term target to establish a continuum of action to reduce emissions, not just for stated limits in 2020 or 2050, but also every year in between. The 40 percent below 1990 levels mid-term target set by Executive Order B-30-15 is critical to help frame the additional suite of policy measures, regulations, planning efforts, and investments in clean technologies and infrastructure needed to continue driving down emissions. Workshop Materials An agenda and presentation material will be made available prior to the public meeting. Additional regional workshops are being planned for Los Angeles, the Central Valley, and the Bay Area in the fall. Details will follow. The meeting materials can be found at the ARB’s Climate Change website at http://www.arb.ca.gov/cc/cc.htm. Live Video/Audio Webcast The meeting will be webcast for those unable to attend in person. Information on submitting questions or comments will be provided during the webcast for remote participants. Additional details to access the webcast will be made available prior to the meeting. Short-lived climate pollutants (SLCPs) include methane, black carbon, and fluorinated gases. They are powerful climate forcers that remain in the atmosphere for a much shorter period of time than longer-lived climate pollutants, including carbon dioxide. Their relative potency, when measured in terms of how they heat the atmosphere, can be tens to thousands of times greater than that of carbon dioxide. Senate Bill 605 (Lara, Chapter 523, Statutes of 2014) requires ARB, in coordination with other state agencies and local air districts, to develop a SLCP Strategy by the end of 2015, to reduce SLCP emissions in California. The Draft Strategy describes ongoing and potential new measures to reduce SLCP emissions from major sources in the State, and describes current and future research needs for improving the SLCP emission inventory and better understanding potential mitigation measures. The Draft Strategy will be discussed at public workshops in October. Comments received on the Draft Strategy will inform the development of a Proposed Strategy, which will be will presented to the Board in late 2015. ARB welcomes broad participation of stakeholders, experts, and interested parties throughout this process. The Draft Strategy can be found at ARB's Short-Lived Climate Pollutant website at: http://www.arb.ca.gov/cc/shortlived/shortlived.htm The website also contains a link for submitting written comments on the Draft Strategy. An agenda and presentation will be posted before the meetings. ARB staff plans to continue work on the Cap-and-Trade Adaptive Management process over the next several months and plans to hold additional public meetings in early 2016 to solicit public input. Staff intends to present a final proposed Adaptive Management Process to the Board in spring/early summer 2016. Background Adaptive management is a process of information gathering, review and analysis, and response that promotes flexible public agency decision-making. This process is appropriate where complex systems are involved, where the effects of an agency’s actions might play out over an extended period of time. Adaptive management is consistent with ARB’s long-standing approach to program implementation that incorporates on-going evaluation of how programs and regulations are implemented on the ground, regular updates to the Board, and adjustments to program implementation and regulatory requirements, as necessary. ARB committed to use the adaptive management approach as an integral part of implementing the Cap-and-Trade program in order to address unanticipated adverse air quality impacts that could result from the program. DATE: Monday, December 14, 2015 TIME: 9:30 a.m. to 5:00 p.m. PLACE: CalEPA Headquarters Building Byron Sher Auditorium 1001 I Street Sacramento, California 95814 This workshop is part of the public process to develop the State’s Clean Power Plan compliance proposal and 2016 amendments to the Cap-and-Trade Regulation related to the electricity sector. Staff will present policy options and modeling results and seek stakeholder input regarding California’s potential strategy for Clean Power Plan compliance. The staff presentation will include initial approaches and results for electricity sector carbon emissions analysis consistent with the Clean Power Plan, and options for continued analysis, as well as initial discussion for how California’s compliance plan may interact with regional electricity and carbon markets. Staff will also discuss potential modifications to the Cap and Trade and Mandatory Greenhouse Gas Reporting Regulations, including modifications which may be effective in the post-2020 Program, and to permitting programs, which may be proposed in 2016 to enable Clean Power Plan compliance. Staff anticipates that the Cap-and-Trade Regulation will play a large role in the Clean Power Plan compliance plan. These amendments may include changes to reporting and verification deadlines, compliance periods, changes needed to address federal plan “backstop” requirements, and treatment of imported electricity. A staff white paper on many of these issues is available on ARB’s Power Plants webpage at: http://www.arb.ca.gov/cc/powerplants/powerplants.htm Staff will also present Cap and Trade Regulation goals for the upcoming amendment process and seek input from stakeholders on potential Regulation amendments that will apply to the Program’s third compliance period and to the post 2020 Program. Third compliance period amendments to be discussed by staff at this meeting will include changes to the Renewable Portfolio Standard adjustment for compliance obligations. Staff does not plan to discuss proposals for post 2020 electrical distribution utility allocation until early 2016. Finally, staff will discuss potential amendments or processes related to the electricity sector including the recent mandates of SB 350 for the electricity sector. Environmental Analysis Pursuant to the California Environmental Quality Act (CEQA) and ARB’s Certified Regulatory Program (Cal. Code Regs., tit. 14, §15251(d); Cal. Code Regs., tit. 17, §§ 60000–60008), staff is reviewing the Clean Power Plan and Cap and Trade Regulatory Amendments to determine if the proposed project will result in any potentially significant adverse environmental impacts. An environmental analysis (EA) will be released for a 45-day public review and comment period with the proposed Clean Power Plan and Cap and Trade Regulatory Amendments to be released in the spring. Comments received at this public workshop will be considered when preparing the CEQA document. A copy of the presentation and other workshop materials will be available on ARB’s Power Plants webpage at: http://www.arb.ca.gov/cc/powerplants/powerplants.htm and Cap and Trade Workshops and Meetings webpage at: http://www.arb.ca.gov/cc/capandtrade/meetings/meetings.htm Materials will be posted by December 14, 2015, at 8:00 a.m. All interested stakeholders are invited to attend. A live webcast of the workshop will be available at: http://www.calepa.ca.gov/broadcast/?BDO=1 Remote participants will be able to submit e-mail questions during the workshop at an address provided in the presentation. Background Cap-and-Trade Regulation The Board first formally adopted the Regulation in October 2011, and subsequently approved limited amendments to the Regulation in June 2012, October 2013, April 2014, September 2014, and most recently June 2015. The upcoming 2016 amendments will seek to improve Program efficiency, update the Regulation using the latest information, and chart post-2020 implementation of the Program. More information about ARB’s Cap-and-Trade Program is available at: http://www.arb.ca.gov/cc/capandtrade/capandtrade.htm Clean Power Plan On August 3, 2015, U.S. EPA’s Administrator signed its Clean Power Plan, which sets carbon dioxide emissions limits for many existing electric generating units. These regulations are based on section 111(d) (42 U.S.C. § 7411(d)) of the federal Clean Air Act. The Plan was published in the Federal Register on October 23, 2015. States must develop compliance plans to meet these limits and compliance plans are due in September 2016 (with the option to seek extensions). ARB is developing California’s compliance plan in consultation with the California Energy Commission and the California Public Utilities Commission, California’s air districts, and other partners. The first report provides a detailed summary of covered entity compliance status for the first compliance period (2013-2014) of the California Cap-and-Trade Program. The second report is the Summary of Transfers Registered in CITSS by California and Québec Entities in 2014, which provides details on the number of completed transfers, the quantity of compliance instruments transferred between market participants, and the weighted average prices of the transfers. The two reports will be posted at: http://www.arb.ca.gov/cc/capandtrade/capandtrade.htm. BACKGROUND: The California Cap on Greenhouse Gas Emissions and Market-Based Compliance Mechanisms Regulation (Regulation) was adopted by the California Air Resources Board in October of 2011, and formally went into effect January 1, 2012. Entities subject to the Regulation have a compliance obligation for their greenhouse gas emissions beginning on January 1, 2013. The Regulation was amended in early 2013 to link the California and Québec programs beginning January 1, 2014. The first compliance period status report will contain a detailed list of covered entities and a tabulation of the compliance instruments they submitted to meet their obligations for the first compliance period. On November 4, 2014, covered entities were required to surrender compliance instruments to cover 30% of their 2013 emissions. ARB published a report for 2013 compliance at: http://www.arb.ca.gov/cc/capandtrade/2013compliancereport.xlsx. On November 2, 2015, covered entities were required to surrender compliance instruments to cover the remaining 70% of their 2013 emissions, and 100% of their 2014 emissions. For this compliance surrender, both vintage 2013 and 2014 allowances were eligible for compliance use. Covered entities also may have used offset credits up to the quantitative usage limit specified in section 95854 of the Regulation (up to eight percent). Future vintage year allowances generally could not be used to satisfy the first compliance period obligation, with the limited exception of certain entities who have received 2015 and 2016 true-up allowances as described in section 95894 of the Regulation. The second data report tabulates the transfers of compliance instruments made through the Compliance Instrument Tracking System Service (CITSS) in 2014. For transfers of allowances, the table provides a breakdown by vintage and whether the transfer was priced or unpriced. Most transactions between independent market participants, such as bilateral transactions or transactions cleared on the Intercontinental Exchange (ICE), are conducted at a price that is entered into the transfer request in CITSS. However, there are numerous transactions made without an explicit price. These include, for example, transfers between corporate associates, between an electric distribution utility and a generator as part of a power purchase agreement, between publicly-owned utilities, or as part of an agreement that transfers compliance instruments with other products. The table contains a separate accounting of transfers of offsets, again with a breakdown between priced and unpriced transfers. Offsets transfers are further broken down by project type. Additional Information If you have any questions about the information in this email or the information contained in the tables, please contact Jason Gray, Manager, Market Monitoring Section, at (916) 324-3507 or jason.gray@arb.ca.gov. These potential updates may include changes to the treatment of biofuels and other sources to better align the inventory methods with changes to national and international accounting methods. A copy of the presentation and other workshop materials will be available on Scoping Plan webpage at: http://www.arb.ca.gov/cc/scopingplan/scopingplan.htm Materials will be posted by January 15, 2016, at 8:30 a.m. All interested stakeholders are invited to attend. A live webcast of the workshop will be available at: http://www.calepa.ca.gov/broadcast/?BDO=1 Remote participants will be able to submit e-mail questions during the workshop at an address provided in the presentation. Background Scoping Plan In 2006, the Legislature passed the California Global Warming Solutions Act of 2006 (Assembly Bill 32 [AB 32]; Stats. The 2013 Update also recommended the need for a 2030 mid-term target to establish a continuum of action to reduce emissions, not just for stated limits in 2020 or 2050, but also in between. The 40 percent below 1990 levels mid-term target set by Executive Order B-30-15 is critical to help frame the additional suite of policy measures, regulations, planning efforts, and investments in clean technologies and infrastructure needed to continue driving down emissions. More information about the Scoping Plan is available at: http://www.arb.ca.gov/cc/scopingplan/scopingplan.htm California Greenhouse Gas Emission Inventory Program The Global Warming Solutions Act of 2006 (AB 32) requires that the California Air Resources Board (ARB) determine the statewide 1990 greenhouse gas (GHG) emission level and approve a statewide greenhouse gas emissions limit, equal to the 1990 level, to be achieved by 2020.
