This information and new resource documents are available on our website at: http://www.arb.ca.gov/gmbond. State funding for bond programs remains suspended pending effective resolution of the current fiscal year budget crisis and a restoration of the State’s ability to access the bond market. This affects the 1st round of $250 million in Fiscal Year 2007-08 funds awarded to local agencies under the Goods Movement Program. Although funds are appropriated to ARB as part of the State budget process, ARB must obtain the cash through the Pooled Money Investment Board. This Investment Board makes the decisions about how to raise funds for the State’s bond programs. In December 2008, ARB staff instructed local agencies implementing Prop 1B grants that these agencies must suspend entering into new contracts with equipment owners that would be funded from Prop 1B grant monies or expending funds for signed contracts because ARB is not authorized to approve payments until we have access to funds to cover the Prop 1B Program. This direction remains in effect. However, we are proceeding with the steps necessary to update the Program Guidelines and award the 2nd $250 million in Fiscal Year 2008-09 funds to local agencies so the Program can continue once bond funds are available. The Governor’s proposed budget for Fiscal Year 2009-10 includes the 3rd installment of $250 million for this Program as well. ARB staff is developing the proposed updates to the Program Guidelines, based on the November concept paper and public comments, plus additional changes in response to approval of the Statewide Truck and Bus Rule. We are planning to release the formal proposal in late February or early March, followed by Board consideration at a public hearing on March 26 at our Sacramento headquarters. At that hearing, staff will also seek Board approval to amend the existing grant agreements with local agencies for Fiscal Year 2007-08 funds. We need to modify the grant deadlines because of the funding delay and implement other changes requested by local agencies. Based on this schedule, we expect to request local agency applications in April for the 2nd round of Fiscal Year 2008-09 funds. We will then follow the same process as last year with a preliminary staff proposal for funding awards, public workshops, and Board consideration on June 25. The timing for equipment owners to access these funds through local agencies will depend on the availability of bond funding. We have rescheduled Board consideration of updates to the program guidelines from March to May 2009. The State budgets for fiscal years 2007-08, 2008-09, and 2009-10 each appropriated installments of $250 million to ARB for this program, providing a total of $750 million. As previously described, ARB must obtain the cash to implement this program via a loan from the Pooled Money Investment Board (PMIB), which makes the decisions about how and when to raise funds for all of the State’s bond programs. ARB’s initial loan request is pending with the PMIB and covers the 1st round of funding awarded to local agencies last year. PMIB had postponed its consideration of loan requests due to the budget crisis. With a budget plan in place, PMIB is evaluating how fast, and to what extent, it can restore the flow of bond money. The local agencies cannot move forward to sign contracts and pay out monies for cleaner equipment until ARB has access to the necessary funds. As we work through the PMIB process to access funding, staff is continuing to develop updates to the program guidelines. The updates will include changes since the November 2008 workshops to support alignment of truck incentives under the Prop. 1B, Carl Moyer, and AB 118 Air Quality Improvement programs. Once the Board adopts the Prop. 1B guidelines, staff will begin the public process to award the 2nd and 3rd installments (combined) of funding later this year. Tentative Milestones: March 26, 2009: Board hears informational update on truck incentives (funding status, alignment of programs within ARB and with air districts, Moyer vouchers, etc.) Late April 2009: ARB staff releases proposed Prop 1B/goods movement guidelines and staff report May 28-29, 2009: Board holds hearing to consider adoption of updated Prop 1B goods movement guidelines; Board also hears informational update on comprehensive truck outreach program June 2009: ARB staff releases Prop 1B/goods movement “Notice of Funding Availability” to request local agency applications for 2nd and 3rd installments of funding Fall 2009: Board awards roughly $475 million in combined 2nd and 3rd installments of Prop 1B/goods movement funds to local agencies (conditioned on ARB getting PMIB loans to support this bond program) When meeting notices and documents are available, they will be posted on our Program website at: http://www.arb.ca.gov/gmbond. At the May 28 Board meeting in Sacramento, staff will request Board support to make changes to the existing grant agreements between ARB and local agencies to implement the first round of $250 million in funding as these monies become available. The Board awarded this funding to local agencies back in May 2008, but the agencies have not been able to move forward due to the statewide suspension of bond funding. Limited funding is now becoming available to restart some of these projects. The grant agreements need to be modified to reflect the delay in bond funding and respond to other implementation issues. A detailed meeting notice discussing the proposed changes will be posted on the website during the week of May 4. We have deferred consideration of the new Program Guidelines, pending ARB’s ability to access the second and third rounds of bond funding (totaling $500 million). The address is http://www.arb.ca.gov/gmbond. The Board awarded over $246 million in first year funds for goods movement projects to local agencies in Spring 2008. These projects have been suspended since December 2008 due to the lack of bond funding. ARB has now received $110 million in bond monies to support these existing grant awards. The posted list indicates which local agency projects are receiving these initial funds. ARB will be formally notifying local agencies via letter that they are authorized to restart certain projects up to the specified dollar amounts. When the letters are sent, we will post them on the webpage. On May 28, 2009, the Board will consider staff’s proposal to make limited changes to the current Program Guidelines, support transfer of funds to backup projects, and amend the existing grant agreements to reflect the funding delay and other developments. Please see the meeting notice on the website for a description of these changes. Note: the May 28th Board item does not include the comprehensive update to the Program Guidelines that we are developing for the next funding cycles. Staff will hold public workshops in Summer 2009 to continue discussion on those updates. We expect to present the updated Guidelines to the Board in Fall 2009, followed by award of the next round of funding as bond monies become available. Truck owners and the local air districts/port implementing the designated incentive programs must take action by December 4, 2009 to qualify. ARB staff will issue a sticker by the end of 2009 to owners of drayage trucks receiving this extension and reflect the extension status in the State’s Drayage Truck Registry. The first emission requirement of the Drayage Truck Regulation takes effect in January 2010, at which time, drayage trucks need to meet emission standards based upon the truck’s engine model year. In many cases, a drayage truck will need to be replaced or retrofitted with a particulate matter filter. Due to delays in the availability of expected State bond funds, local agencies have been unable to approve and fund grant applications for drayage truck incentives under Prop. 1B and closely related programs until late 2009. This has delayed completion of truck replacements and retrofits using these funds. This temporary extension for a limited number of trucks provides sufficient time to complete the upgrades, while ensuring that the current fleet of more than 9,000 clean California-based trucks serving ports and rail yards continues to grow. This extension allows trucks awaiting a retrofit or replacement to ability to continue operation at California’s ports and rail yards until their truck is replaced or retrofitted - or April 30, 2010 – whichever comes first. This extension has been revised and updated! The revised extension now also applies to trucks awaiting privately financed replacements or retrofits. To receive this limited four month extension until April 30, 2009, trucks owners must: 1) Register their truck in the Drayage Truck Registry, and 2) Complete a simple cover sheet, and 3) Provide a copy of a purchase order or other acceptable documentation. The extension request must be received or postmarked on or before December 31, 2009. Additional detail can be found under ‘option B’ of the revised advisory.
