This extension will provide fleets that have not already registered to use a compliance option under the regulation to participate in the extended phase-in option that started in 2011 (Option 2) of the Large Fleet Compliance Plan. Background The Tractor-Trailer Greenhouse Gas Regulation (Regulation) applies to 53-foot or longer dry van or refrigerated van trailers (box-type trailers) and the tractors that pull them on California highways. The Regulation requires tractor-trailers operating in California to use tractors and box-type trailers that utilize certain aerodynamic equipment and low rolling resistance tires, as verified by the U.S. Environmental Protection Agency SmartWay program, to meet specified fuel efficiency improvements. The regulation establishes specific compliance deadlines for trailers based on fleet size and model year. Specifically, large fleets (with 21 or more trailers) may either: • Bring all their pre-2011 model year trailers into compliance by January 1, 2013, or • Phase-in compliance over several years, if they registered by the registration deadline. BACKGROUND: The Global Warming Solutions Act of 2006 (Chapter 488, Statutes of 2006 [AB 32, Núñez/Pavley]), requires California to reduce statewide greenhouse gas emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, ARB has developed a cap-and-trade program. The program establishes a statewide emissions limit on sources responsible for 85 percent of greenhouse gases and creates a financial incentive for investment in clean and efficient technologies. Under the program, a portion of allowances required for compliance will be auctioned. Strategic investment of auction funds can further the purposes of AB 32 and deliver long-term economic, environmental, and clean energy benefits. The first auction is scheduled for November 2012 and auctions will be held on a quarterly basis thereafter through 2020. This extension will provide certain fleets that have not already registered to use a compliance option under the regulation to participate in the extended phase-in option of the Small Fleet Compliance Plan that begins in 2013. Background The Tractor-Trailer Greenhouse Gas Regulation (regulation) applies to 53-foot or longer dry van or refrigerated van trailers (box-type trailers) and the tractors that pull them on California highways. The regulation requires tractor-trailers operating in California to use tractors and box-type trailers that utilize certain aerodynamic equipment and low rolling resistance tires, as verified by the U.S. Environmental Protection Agency SmartWay program, to meet specified fuel efficiency improvements. The regulation establishes specific compliance deadlines for trailers based on fleet size and model year. The Advisory notifies owners of 2010 and older affected tractors that these tractors must comply with the January 1, 2013, tires deadline by using SmartWay verified tires (new or retread). However, the Advisory also clarifies that owners may continue to use non-SmartWay verified tires manufactured before January 1, 2013, until the end of the tire’s useful tread life, or until January 1, 2015, whichever comes first. Any new or retreaded tire manufactured and installed on an affected tractor after January 1, 2013, must be a SmartWay verified tire. After January 1, 2015, all tires on affected tractors must be SmartWay verified. Background The Tractor-Trailer GHG Regulation (regulation) applies to 53-foot or longer dry van or refrigerated van trailers (box-type trailers) and the tractors that pull them on California highways. After January 1, 2013, any tire on an affected tractor that must be replaced or retreaded must be a SmartWay verified low rolling resistance tire. Only diesel particulate matter (PM) filters or other devices that have been verified by the ARB to meet rigorous emission reduction and durability demonstration requirements can be used to comply. Diesel PM filters that have been verified by the ARB are listed at http://www.arb.ca.gov/diesel/verdev/vt/cvt.htm. Be sure to check that any device you are considering is on this list. The letter reminds fleets that heavier vehicles with 2000 to 2004 model year engines that they must have verified soot filters and/or upgrades to newer vehicles by January 1, 2013. Similar requirements for vehicles with 1996 to 1999 model year engines became effective earlier this year. Vehicles may also be eligible for certain flexibility options. The letter can be found at: http://www.arb.ca.gov/msprog/truckstop/pdfs/enf-tb-letter2.pdf ARB intends to promptly enforce the January 1, 2013 requirements. Non-compliant vehicles may not be operated in California and will be assessed penalties that start at a minimum of $1,000 per violation per month and increase significantly over time. Do not delay in taking action to clean up your fleet - the installation of a PM filter may take a month or longer to accomplish; however, you may be able to significantly reduce penalties by taking action now. From: clchang@arb.ca.gov The California Air Resources Board has issued Regulatory Advisory Mail-Out MSC# 12-26 to explain how the low rolling resistance tire requirements of the regulation will be implemented for (1) tractors that use 2 or more open shoulder drive tires and (2) 2011 and newer model year tractors and trailers that use retreaded tires. The regulation requires tractors that use 2 or more open shoulder drive tires to use SmartWay verified low rolling resistance tires by January 1, 2013. This advisory clarifies that tractors using new non-SmartWay open shoulder drive tires that were manufactured prior to January 1, 2013, can continue to use those tires for the useful life of that tread, or until January 1, 2015, whichever comes first. Any new open shoulder drive tire manufactured after January 1, 2013, must be a SmartWay verified low rolling resistance tire. This advisory also clarifies that tractors using non-SmartWay open shoulder retreaded tires manufactured prior to January 1, 2014, to continue to use those tires for the useful life of that tread, or until January 1, 2016, whichever comes first. Any open shoulder retreaded drive tire retreaded after January 1, 2014, must be capped with a SmartWay verified low rolling resistance retread material on any casing. The regulation requires 2011 model year and newer tractors and trailers to use SmartWay verified low rolling resistance tires beginning January 1, 2010. This advisory clarifies that 2011 model year and newer tractors and trailers using retreaded tires comprised of SmartWay casing capped with any retread material prior to January 1, 2013, can continue to use those tires for the useful life of the tread or until January 1, 2015 for tractors and January 1, 2017 for trailers, whichever comes first. Any tire retreaded after January 1, 2013 must be capped with a SmartWay verified low rolling resistance retread material on any casing. Background The Tractor-Trailer GHG Regulation (regulation) applies to 53-foot or longer dry van or refrigerated van trailers (box-type trailers) and the tractors that pull them on California highways. The regulation requires tractor-trailers operating in California to use tractors and box-type trailers that utilize certain aerodynamic equipment and low rolling resistance tires, as verified by the U.S. EPA SmartWay program, to meet specified fuel efficiency improvements.
