TTY/TDD/Speech to Speech users may dial 711 for the California Relay Service. BACKGROUND: Assembly Bill (AB) 32, the California Global Warming Solutions Act of 2006, requires California to reduce statewide GHG emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, the Air Resources Board (ARB) has developed a Cap-and-Trade program that limits statewide emissions from sources responsible for 85 percent of greenhouse gases and creates a financial incentive for clean and efficient technologies. Under the program, a portion of the allowances required for compliance are auctioned. The State portion of the proceeds from these auctions will be used to fund projects to reduce greenhouse gas emissions, consistent with State law. In September 2012, the Legislature passed and Governor Brown signed into law two bills – AB 1532 (Pérez, Chapter 807) and Senate Bill (SB) 535 (De León, Chapter 830) – that together establish a framework for developing an investment plan for projects and programs to be funded with Cap-and-Trade auction proceeds. SB 535 further requires that 25 percent of the proceeds that will be expended benefit disadvantaged communities and at least 10 percent of the proceeds expended be invested in projects located within those communities. The Department of Finance (Finance), in consultation with the ARB and other state entities, will develop and submit to the Legislature a three-year investment plan for the auction proceeds. The investment plan will identify the State’s greenhouse gas reduction goals and priority programs for investment of proceeds to support achievement of those goals. Funding will be appropriated to State agencies by the Legislature and Governor through the annual Budget Act, consistent with the plan. ARB’s proposed regulation will provide a mechanism to ensure that incentive-funded mobile agricultural equipment projects implemented using Carl Moyer Program guidelines and administered by San Joaquin Valley Air Pollution Control District (SJVAPCD) result in emission reductions that are eligible for State Implementation Plan (SIP) credit. This proposed regulation would also allow an opt-in for any other air district in California that complies with the requirements of the proposed regulation to have mobile agricultural equipment emission reductions that result from incentive programs be eligible to be considered for SIP credit. To meet U.S. Environmental Protection Agency requirements for SIP creditability, the emission reductions must be surplus, quantifiable, enforceable, and permanent. The proposed regulation is intended to complement SJVAPCD’s proposed Rule 9610 which provides administrative requirements on local, state, and federal voluntary incentive programs in the San Joaquin Valley to ensure that emission reductions will be eligible to receive SIP credit. The proposed regulation requires that the mobile agricultural equipment incentive projects follow the Carl Moyer Program guidelines. To ensure accountability, ongoing program reviews and audits by the SJVAPCD will be required to verify project data, application information, emission reductions, destruction verification, and retention of application, inspection, destruction, and other project-related documentation consistent with the Carl Moyer Program guidelines. This proposed regulation will be presented for Board consideration in October 2013. The workshop will be held at the following date and time: Central Valley (workshop will also be webcast) Date: Tuesday, July 9, 2013 Time: 1:30 p.m. - 3:30 p.m. Location: San Joaquin Valley Air Pollution Control District 1990 E. Gettysburg Avenue Fresno, California 93726 Alternative locations with live video feed: SJVAPCD North (Modesto) SJVAPCD South (Bakersfield) 4800 Enterprise Way 34946 Flyover Court Modesto, California 95356 Bakersfield, California 93308 The workshop notice may be found on ARB's webpage at: http://www.arb.ca.gov/msprog/mailouts/mouts_13.htm The webcast can be accessed on the day of the workshop at: http://www.valleyair.org/webstreaming/webcast-meetings.htm For more information about the State Implementation Plan Credit from Mobile Agricultural Equipment Regulation, please go to: http://www.arb.ca.gov/ag/agtractor/agtractor.htm If you have questions regarding this workshop notice, please contact Ms. Lynsay Carmichael at lcarmich@arb.ca.gov or (916) 322-0407. Background: In the 2007 8-hour Ozone SIP, ARB committed to developing a measure to reduce emissions from in-use self-propelled off-road mobile agricultural equipment. ARB staff’s proposed approach for ensuring the emission reduction goals and commitments of the 2007 SIP are met is to take this proposed regulation to the Board in October 2013.
