AB 1900, authored by Assemblyman Mike Gatto, requires the California Public Utilities Commission (CPUC) to develop standards for constituents in biogas to protect human health and pipeline integrity and safety. In support of the CPUC standards development efforts, the Office of Environmental Health Hazard Assessment (OEHHA) and the Air Resources Board (ARB), in consultation with other State agencies, are to undertake certain actions. Specifically, OEHHA is tasked with compiling a list of constituents of concern (constituents) found in biogas that could pose a health risk and that are at levels that significantly exceed the concentrations of those constituents in natural gas. OEHHA is also to determine health protective levels for these constituents. ARB is tasked with developing realistic exposure scenarios and identifying the associated health risk to utility workers and gas end users; determining the concentrations of these constituents in biogas necessary to protect public health; and identifying monitoring, testing, reporting, and recordkeeping requirements necessary to ensure that health protective levels are maintained. BACKGROUND: Assembly Bill (AB) 32, the California Global Warming Solutions Act of 2006, requires California to reduce statewide GHG emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, the Air Resources Board (ARB) has developed a Cap-and-Trade program that limits statewide emissions from sources responsible for 85 percent of greenhouse gases and creates a financial incentive for clean and efficient technologies. Under the program, a portion of the allowances required for compliance are auctioned. The State portion of the proceeds from these auctions will be used to fund projects to reduce greenhouse gas emissions, consistent with State law. In September 2012, the Legislature passed and Governor Brown signed into law two bills – AB 1532 (Pérez, Chapter 807) and Senate Bill (SB) 535 (De León, Chapter 830) – that together establish a framework for developing an investment plan for projects and programs to be funded with Cap-and-Trade auction proceeds. SB 535 further requires that 25 percent of the proceeds that will be expended benefit disadvantaged communities and at least 10 percent of the proceeds expended be invested in projects located within those communities. The Department of Finance (Finance), in consultation with the ARB and other state entities, will develop and submit to the Legislature a three-year investment plan for the auction proceeds. The investment plan will identify the State’s greenhouse gas reduction goals and priority programs for investment of proceeds to support achievement of those goals. Funding will be appropriated to State agencies by the Legislature and Governor through the annual Budget Act, consistent with the plan. The Public Reports provide a sector-wide and facility-specific summary of the energy efficiency improvement projects identified by all of the reporting facilities. In addition, information on the estimated greenhouse gas, criteria pollutant, and toxics pollutant emission reductions and costs, as reported by the facilities, is included. The data presented in the reports is aggregated in a manner to be consistent with the public disclosure requirements under California Code of Regulations (CCR) §95610. The release of the Energy Efficiency Assessment Public Reports is Phase 1 of a multi-phase program. ARB staff will be scheduling a stakeholder meeting on the Refinery Sector Public Report in early July to receive public comments on the report. Phase 2: Develop and Release ARB Findings Report ARB staff will conduct a comprehensive review of the reported data, comparing projects across sectors and evaluating them against other available information, including the Department of Energy Industrial Technologies Program Best Practices. ARB staff will prepare a draft report with preliminary findings and recommendations covering all of the sectors. Phase 3: Develop Energy Efficiency Implementation Program The stakeholder meetings and the subsequent ARB Findings Report will be used as a starting point for discussion with all stakeholders on what actions and approaches could be taken to maximize on-site greenhouse gas, criteria, and toxic pollutants emission reductions. Background: On July 22, 2010, the Air Resources Board (ARB) approved the Energy Efficiency and Co-Benefit Assessment of Large Industrial Facilities (EEA Regulation). The regulation required the largest industrial sources in California to conduct a one-time assessment of fuel and energy consumption, and emissions of greenhouse gas, criteria pollutants, and toxic air contaminants. SACRAMENTO - The Air Resources Board today posted on its website the public discussion draft of the required update to the AB 32 Scoping Plan. The Scoping Plan describes the comprehensive range of efforts California must take to reduce greenhouse gas emissions to 1990 levels by 2020 and meet the state’s long-term goals to combat climate change. AB 32 requires the Scoping Plan to be updated every five years. The original Plan, first released in 2008, was developed on the principle that a balanced mix of strategies is the best way to cut emissions and grow California’s economy in a clean and sustainable direction. This draft update continues with that approach and focuses on three questions: • How have we done over the past five years? • What is needed to continue the prescribed course of action to 2020? • What steps must California now take to meet the state’s climate goals beyond 2020? California’s strategy to meet the goals of AB 32 is based on the continued implementation of adopted actions including Advanced Clean Cars, the 33% Renewables Portfolio Standard, statewide energy-efficiency initiatives, Cap-and-Trade, the Low Carbon Fuel Standard and other programs. They are designed to achieve significant reductions of greenhouse gases in every sector of California’s economy through improved energy efficiency, and by providing consumers with cleaner fuel choices. The discussion draft includes an analysis of progress to date, finding that California is on track to meet the AB 32 2020 goal of greenhouse gas reductions. An overview of the current science of climate change in the draft includes an expanded discussion of short-lived climate pollutants such as methane and black carbon. It also includes actions California must take to continue greenhouse gas reductions in six key focus areas: energy; transportation, land use, fuels and infrastructure; water; agriculture; natural and working lands; and, waste. The draft update is the result of a series of discussions and input over the past year by a broad range of state agencies and departments and the state Climate Action Team. In addition, four public workshops were held over the summer in Los Angeles, Fresno, Sacramento and San Francisco in an effort to consider comments prior to developing the draft. The release of the discussion draft update marks the beginning of a public comment period to help inform the Proposed Update to the Scoping Plan. Future steps in the development of the Proposed Update include a public workshop on October 15 in Sacramento (which will also be webcast), and a meeting of the Board at the end of October to hear from all stakeholders and provide further direction to staff on revisions to the discussion draft presentation to the ARB at its Board meeting at the end of October. Following the October Board meeting, the draft will be revised and then presented to the Board at its December meeting. The Board is anticipated to consider approval of the update in Spring of 2014. Because the 10-day comment period for these pathways overlaps with the holidays, we are extending the comment period on this posting in order to accommodate holiday vacation schedules. Comments will now be accepted until Wednesday, January 8, 2013 at 5:00 p.m. PST. To review the pathways or post a comment, go to http://www.arb.ca.gov/fuels/lcfs/2a2b/2a-2b-com.htm.
