The Air Resources Board granted an extension for Engine Control Systems’ Purifilter PlusTM as a Level 3 Plus passively and actively regenerated diesel emission control system for use with certain on-road vehicles with model years between 1994 and 2010, certified by the United States Environmental Protection Agency. Approved engines are certified to particulate matter emission levels equal to or less than 0.1 grams per brake horsepower-hour, and may or may not be equipped with exhaust gas recirculation systems (EGR). The extension excludes EGR engines certified with diesel oxidation catalysts. Purifilter PlusTM uses a catalyzed silicon carbide wall-flow filter for passive regeneration and electric heating elements for active regeneration. It achieves at least an 85 percent reduction in emissions of diesel particulate matter. The Air Resources Board (ARB) granted an extension for HUSS Umwelttechnik GmbH’s (HUSS) FS-MK Series Diesel Particulate Filter (FS-MK) for both on-road and off-road applications. The verification includes certain off-road diesel engines up to and including model year 2010. ARB also modified the executive order for on-road applications for engines certified with maximum horsepower ratings no more than 810 and which are not certified with external exhaust gas recirculation (EGR) although select engines with internal EGR are approved. HUSS does not permit swapping of filters among vehicles or equipment. Re-designation of the entire system may only be done within a common ownership fleet and with HUSS’ approval. Re-designations must be in compliance with the California Code of Regulations, Title 13, Section 2706, and HUSS’ Re-designation Policy. The FS-MK system uses a silicon carbide wall-flow filter with a fuel burner for regeneration to achieve an 85 percent reduction in particulate matter emissions. The Air Resources Board (ARB) granted an extension for ECS Limited’s Purifilter PlusTM and PurifilterTM Systems to include an upgraded backpressure monitor design. The extension for Purifilter also includes certain on-road engines with model years 1996 and 1997, certified by the United States Environmental Protection Agency (federal engines). The approved federal engines are certified to particulate matter emission levels equal to or less than 0.1 grams per brake horsepower-hour, and are not certified with exhaust gas recirculation. Purifilter PlusTM and PurifilterTM both include a catalyzed silicon carbide wall-flow filter for passive regeneration. Purifilter PlusTM also includes electric heating elements for active regeneration. Both systems achieve at least an 85 percent reduction in emissions of diesel particulate matter. The Air Resources Board (ARB) has extended the verification of the Cleaire LongMile system to include additional on-road heavy-duty diesel engines. Engines with low certified emission levels of oxides of nitrogen which include a diesel oxidation catalyst (DOC) are now included in the verification. The LongMile system reduces emissions of diesel particulate matter by at least 85 percent and is designated as a Level 3 Plus system. The primary components of the LongMile include a DOC, a non-catalyzed sintered metal diesel particulate filter, an electronic control system, and a backpressure monitor. The draft proposal can be found on the following webpage, http://www.arb.ca.gov/msprog/mailouts/mouts_11.htm. The ARB is planning on proposing modifications to the California SORE regulations in order to harmonization its test procedures with the U.S. Environmental Protection Agency’s (U.S. EPA) rules. The proposal will sunset the current test procedures with the 2012 model year, and adopt portions of U.S. EPA’s Parts 1054 and 1065, of Title 40, Code of Federal Regulations (published on November 8, 2010). Because California has different air quality goals than the rest of the country, some portions of Parts 1054 and 1065 have been either modified as necessary for California’s purposes or excluded entirely. For example, U.S. EPA and ARB have different emission credit programs. Accordingly, ARB has excluded portions of U.S. EPA’s provisions that refer to their credit program. The ARB proposal is scheduled to be considered for adoption at the December 2011 Board Hearing. In addition to proposing adoption of these harmonizing modifications, ARB is proposing to change the SORE certification exhaust test fuel to a ten-percent ethanol blend (E10). This change is being considered so that the certification test fuel used for California’s off-road gasoline-fueled engine and equipment categories remains consistent with the planned E10 changes to the on-road motor vehicle certification test fuel requirements. Please note that because the ARB is in only the early stages of considering this modification, the attached documents do not specifically reflect this proposed change. Nevertheless, we are seeking comments from interested parties on this important issue. The Air Resources Board (ARB) has released a draft of the proposed amendments to the California tier 4 off-road compression-ignition (CI) engine test procedures. The basis of these test procedures are the U.S. Environmental Protection Agency’s (U.S. EPA’s) nonroad CI engine regulations contained in title 40 Code of Federal Regulations (40 CFR) Parts 1039, 1065, and 1068, and which ARB adopted originally on October 20, 2005. The released ARB draft proposal reflects both the amendments that U.S. EPA has made to Parts 1039, 1065, and 1068 since 2005, as well as ARB’s proposed amendments for aligning with those federal amendments. Except for draft amendments of Table 1b (Tier 4 Exhaust Emission Standards) and Table 2b (Upper Limit for Tier 4 Family Emission Limits (FELs) and Alternative Allowances), from title 13, California Code of Regulations (13 CCR) §2423, a draft of the other amendments that will be proposed to the California tier 4 off-road CI engine regulations in 13 CCR §2420 is not included with this release. However, such amendments are forthcoming and will reflect the amendments being proposed in the draft test procedures proposal. Specifically, ARB is planning on proposing modifications to the California tier 4 off-road CI engine regulations in order to increase the level of harmonization with the current U.S. EPA regulations. The proposal will retire the current test procedures (i.e., Part I-C, adopted October 20, 2005) with the 2010 model year, and create new Parts I-D, I-E, and I-F. The proposed Part I D amends the Part 1039-portion of Part I-C by adopting portions of U.S. EPA’s Part 1039, of 40 CFR, as last modified in Vol. 75 of the Federal Register, Pg. 37977 (76 FR 37933), on June 28, 2011. The proposed Part I-E adopts U.S. EPA’s 40 CFR Part 1065, as last modified in 76 FR 37977, on June 28, 2011, as a replacement for the Part 1065-portion of Part I-C; and, the proposed Part I-F amends the Part 1068-portion of Part I-C by adopting portions of U.S. EPA’s 40 CFR Part 1068, as last modified in 76 FR 37977, on June 28, 2011. Although not included in the draft proposal (except for the above mentioned Tables 1b and 2b), staff is also planning on amending the applicable sections of 13 CCR to reflect the draft test procedures amendments described herein. Background In 2001, the U.S. EPA adopted 40 CFR, Part 1065, as a “united” test procedure for both “nonroad” engines and equipment and on-highway heavy-duty CI engines. The test procedures in Part 1065 essentially replaced those previously used in Part 89 for nonroad CI engines. Since its initial adoption, Part 1065 has been amended repeatedly to both improve and expand its applicability for other nonroad engine categories. Federal nonroad CI engines certified for tier 4 standards must be tested using Part 1065. Use of Part 1065 was optional for tier 3 and earlier model engines. In addition, U.S. EPA adopted Part 1039, which is the “standard-setting” part for nonroad CI engines. Besides the actual emission standards, Part 1039 contains other provisions, such as certification protocols, credit-generation allowances, etc. Also adopted was Part 1068, which contains the general compliance provisions. California adopted Part 1065 originally in 2005 in conjunction with its adoption of the tier 4 off-road CI engine emission standards. Since 2005, U.S. EPA has adopted several amendments to its nonroad CI engine regulations (i.e., to Parts 1039, 1065, and 1068). In May 2009, off-road CI engine manufacturers formally asked ARB to maintain full alignment and harmonization with the federal regulations in order to avoid performing separate testing and certification processes and thereby reduce their burden of compliance. Since that time, ARB has worked cooperatively with these manufacturers in developing harmonizing amendments to its off-road tier 4 CI engine regulations and test procedures without changing the stringency of California’s current emission standards. OAL has until December to approve the regulations and file them with the Secretary of State. Background The Air Resources Board adopted a number of regulations that require diesel engine owners to reduce their engine emissions. These regulations are part of the State’s plan to meet federal ambient air quality standards and to protect public health. Between now and 2023, nearly all trucks and buses that operate in California and have a manufacturer’s gross vehicle weight rating greater than 14,000 pounds must upgrade to reduce exhaust emissions. Similar requirements will also become effective in the next several years affecting owners and operators of certain off-road equipment (including equipment used in construction, industrial, and airport operations). To comply with these requirements, fleet owners can upgrade existing engines by installing particulate matter (PM) filter retrofits or other Verified Diesel Emission Control Strategies (VDECS), or by upgrading to cleaner engines. In addition, the California Global Warming Solutions Act of 2006 (AB 32) established requirements to achieve reductions of greenhouse gas (GHG) emissions. AB 32 requires the Air Resources Board (the Board or ARB) and other state agencies to adopt regulations and other requirements that would reduce statewide GHG emission levels to the equivalent of 1990 levels by 2020. The Tractor-Trailer GHG rulemaking is one of 44 early action measures identified by the Board and requires certain tractor and trailer combinations to use low-rolling resistance tires and aerodynamic technology. Please be aware that the reporting requirements for fleets differ by gross vehicle weight rating (GVWR). Specifically: HEAVIER VEHICLES (GVWR more than 26,000 lbs) - No reporting is required for diesel truck owners that comply with the engine model year schedule and do not plan to use credits, and extensions. Background On December 11, 2008, the Board approved for adoption the Truck and Bus regulation to control emissions from nearly all existing diesel powered heavy-duty trucks and buses operating in California. The regulation became effective under California law on January 8, 2010. The regulation applies to diesel fueled trucks and buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds that are privately owned, federally owned, and to publicly and privately owned school buses. Local and state government owned diesel fueled trucks and buses are already subject to other ARB regulations. Reducing emissions from in-use trucks and buses is necessary to meet federally imposed clean air standards and to reduce the adverse health effects from truck and bus pollution. On December 17, 2010, the staff recommended amendments, which are presently pending adoption, that would delay the initial requirement to install particulate matter (PM) retrofit filters by one year to January 1, 2012 and extend the time before a vehicle equipped with a PM filter would have to have an engine that meets 2010 model year emission standards. The amendments also defer engine replacements for vehicles without PM filters for two years until January 1, 2015. Prior to 2020, replacements are limited to 20 year old or older trucks that are not equipped with PM filters. By January 1, 2023, most vehicles will need to be equipped with an engine meeting 2010 model year emission standards. The Air Resources Board (ARB) has modified the engine family list to the HUSS Umwelttechnik GmbH’s (HUSS) FS-MK Filter System Series Diesel Particulate Filter (FS-MK Filter System)for off-road applications. The modification includes additional engines that meet the terms and conditions of the Executive Order. The verification includes certain off-road diesel engines up to and including model year 2011. The FS-MK Filter System uses a silicon carbide wall-flow filter with a fuel burner for regeneration to achieve an 85 percent reduction in particulate matter emissions.
