These investments accelerate the transition to low carbon freight and passenger transportation, supporting the Governor’s climate change strategy pillar of a 50 percent reduction in petroleum use in vehicles by 2030 and the Administration’s goal to deploy 1.5 million zero emission vehicles in California by 2025. The FY 2014-15 State budget appropriated $200 million to ARB for Low Carbon Transportation projects to reduce greenhouse gas emissions with a target that at least half the investments benefit disadvantaged communities. The FY 2015-16 State budget appropriated another $95 million. ARB expects to receive another appropriation for Low Carbon Transportation investments from the Greenhouse Gas Reduction Fund in the FY 2016-17 State Budget. ARB staff intends to develop a joint Funding Plan for the Low Carbon Transportation and AQIP for the FY 2016-17 funding cycle as it has done in the past two budget cycles. AQIP is a voluntary, mobile source incentive program that focuses on reducing criteria pollutant and diesel particulate emissions with concurrent reductions in greenhouse gas emissions. AQIP has an annual budget of about $25 million. ARB focuses AQIP investments on technology advancing projects that support California’s long-term air quality and climate change goals in addition to providing immediate emission benefits. In recent years, the majority of AQIP funds have gone towards the Truck Loan Assistance Program which helps small business truckers to secure financing for newer trucks or diesel exhaust retrofits in advance of compliance deadlines for ARB’s in-use truck and bus regulation. Their relative potency in terms of how they heat the atmosphere can be tens to thousands of times greater than CO2. SLCPs include black carbon, methane, and fluorinated gases, including hydrofluorocarbons. The impacts of SLCPs are especially strong within the near term. Reducing these emissions can have an immediate beneficial impact on climate change. SLCP reductions are important to continuing and maintaining the greenhouse gas reductions called for by AB 32 (Nunez, Chapter 488, Statutes of 2006) and SB 605 (Lara, Chapter 523, Statutes of 2014), and to ensuring emissions meet the statewide greenhouse gas emission limit that AB 32 established. The Proposed Strategy is identified in the First Update to the Climate Change Scoping Plan as one of the recommended actions to achieve additional greenhouse gas emission reductions. SB 605 further requires ARB, in coordination with other State agencies and local air districts, to develop a strategy to further reduce SLCP emissions in California. A Draft Strategy was released for public comment on September 30, 2015. After considering comments received, ARB staff released the Proposed Strategy on April 11, 2016, which will be presented to the Board at a public meeting on May 19, 2016. The Board will not vote on the Proposed Strategy at this meeting; a second Board meeting will be scheduled for either late summer or early fall for the Board to consider approving a final SLCP Strategy, along with final environmental documents. Environmental Analysis ARB, as the lead agency for the Proposed Strategy, prepared a Draft Environmental Analysis (EA) in accordance with the requirements of the California Environmental Quality Act (CEQA) and ARB’s regulatory program certified by the Secretary of Natural Resources (California Code of Regulation, title 17, sections 60006-60008; California Code of Regulation, title 14, section 15251, subdivision (d)). The resource areas from the CEQA Guidelines Environmental Checklist were used as a framework for a programmatic environmental analysis of the reasonably foreseeable compliance responses resulting from implementation of the proposed measures discussed in the Proposed Strategy. The Draft EA provides an analysis of both the beneficial and adverse impacts and feasible mitigation measures for the reasonably foreseeable compliance responses associated with the proposed measures under each of the 17 environmental resource areas. Collectively, the Draft EA concluded implementation of these actions could result in the following short-term and long-term beneficial and adverse impacts: beneficial long-term impacts in reduced greenhouse gas emissions; less-than-significant impacts to air quality, biological resources, energy demand, geology and soils, greenhouse gases (short-term), hazards and hazardous materials, hydrology and water quality, resources related to land use planning, mineral resources, noise, population and housing, public services, and recreational services; and potentially significant and unavoidable adverse impacts to aesthetics, agriculture and forest resources, air quality, biological resources, cultural resources, geology and soils, hazards and hazardous materials, hydrology and water quality, resources related to land use planning, noise, transportation/traffic, and utilities and service systems. The potentially significant and unavoidable adverse impacts are primarily related to short-term construction-related activities, which explains why some resource areas are identified above as having both less-than-significant impacts and potentially significant impacts. Because trucking emissions are such a significant source of GHG and criteria pollutant emissions, achieving reductions within the trucking sector is a key component in the strategy to meet California’s climate and air quality goals. Their relative potency in terms of how they heat the atmosphere can be tens to thousands of times greater than CO2. SLCPs include black carbon, methane, and fluorinated gases, including hydrofluorocarbons. The impacts of SLCPs are especially strong within the near term. Reducing these emissions can have an immediate beneficial impact on climate change. SLCP reductions are important to continuing and maintaining the greenhouse gas reductions called for by AB 32 (Nunez, Chapter 488, Statutes of 2006) and SB 605 (Lara, Chapter 523, Statutes of 2014), and to ensuring emissions meet the statewide greenhouse gas emission limit that AB 32 established. The Proposed Strategy is identified in the First Update to the Climate Change Scoping Plan as one of the recommended actions to achieve additional greenhouse gas emission reductions. SB 605 further requires ARB, in coordination with other State agencies and local air districts, to develop a strategy to further reduce SLCP emissions in California. A Draft Strategy was released for public comment on September 30, 2015. After considering comments received, ARB staff released the Proposed Strategy on April 11, 2016, which will be presented to the Board at a public meeting on May 19, 2016. The Board will not vote on the Proposed Strategy at this meeting; a second Board meeting will be scheduled for either late summer or early fall for the Board to consider approving a final SLCP Strategy, along with final environmental documents. Environmental Analysis ARB, as the lead agency for the Proposed Strategy, prepared a Draft Environmental Analysis (EA) in accordance with the requirements of the California Environmental Quality Act (CEQA) and ARB’s regulatory program certified by the Secretary of Natural Resources (California Code of Regulation, title 17, sections 60006-60008; California Code of Regulation, title 14, section 15251, subdivision (d)). The resource areas from the CEQA Guidelines Environmental Checklist were used as a framework for a programmatic environmental analysis of the reasonably foreseeable compliance responses resulting from implementation of the proposed measures discussed in the Proposed Strategy. The Draft EA provides an analysis of both the beneficial and adverse impacts and feasible mitigation measures for the reasonably foreseeable compliance responses associated with the proposed measures under each of the 17 environmental resource areas. Collectively, the Draft EA concluded implementation of these actions could result in the following short-term and long-term beneficial and adverse impacts: beneficial long-term impacts in reduced greenhouse gas emissions; less-than-significant impacts to air quality, biological resources, energy demand, geology and soils, greenhouse gases (short-term), hazards and hazardous materials, hydrology and water quality, resources related to land use planning, mineral resources, noise, population and housing, public services, and recreational services; and potentially significant and unavoidable adverse impacts to aesthetics, agriculture and forest resources, air quality, biological resources, cultural resources, geology and soils, hazards and hazardous materials, hydrology and water quality, resources related to land use planning, noise, transportation/traffic, and utilities and service systems. The potentially significant and unavoidable adverse impacts are primarily related to short-term construction-related activities, which explains why some resource areas are identified above as having both less-than-significant impacts and potentially significant impacts. Background: At the June 23, 2016 Board meeting, the Board approved the proposed FY 2016 17 Funding Plan which describes how ARB would spend $500 million in proposed Low Carbon Transportation and Fuels funding from the Greenhouse Gas Reduction Fund and $28.6 million for Air Quality Improvement Program (AQIP). At the time of the Board’s action, the Legislature had appropriated AQIP funds to ARB as part of the Budget Act of 2016 but had deferred action on the $500 million in Low Carbon Transportation and Fuels funding. Hence, the Low Carbon Transportation and Fuels elements of the Board-approved Funding Plan were contingent on appropriation of these funds. The Funding Plan included contingency provisions to address this budget uncertainty including direction that staff return with modifications to the plan in the event that the Legislature appropriated less than $400 million to ARB. The solicitation includes the option for new Grant Agreements for each of the following two fiscal years (FY 2017-18 and FY 2018-19). Contingent upon Board approval to implement the modifications to the FY 2016-17 Funding Plan for the Low Carbon Transportation Investments and Air Quality Improvement Program (Funding Plan), the current funding available is $78 million for CVRP and up to $3 million for the Public Fleet Pilot Project, with a total of up to $81 million. The inclusion of the Public Fleet Pilot Project is specifically contingent upon the Board allocating up to $3 million to the Public Fleet Pilot Project. CVRP is intended to encourage and accelerate zero- and near-zero emission, on-road light-duty vehicle deployment and technology innovation. This project currently provides rebates for California purchasers and lessees of up to $6,500 for fuel cell electric vehicles (FCEVs), up to $4,000 for battery-electric vehicles (BEVs), up to $3,000 for plug-in hybrid electric light-duty vehicles (PHEVs), and up to $900 for zero-emission motorcycles (ZEMs) on a first-come, first-served basis. These rebate amounts have not been updated to reflect recently adopted legislation and are subject to change. In addition, the Public Fleet Pilot Project provides increased incentives for public fleets located in or serving disadvantaged communities. Rebates offered to public fleets located in or serving disadvantaged communities are up to $15,000 for FCEVs, $10,000 for BEVs, and $5,250 for PHEVs. This solicitation is open to federal, state or local government entities or agencies, and California nonprofit organizations with expertise implementing a grant program and general knowledge of ARB’s clean vehicle programs. In addition to lower NOx standards, other elements are being considered in an effort to improve the in-use performance of heavy-duty vehicles. ARB is considering lengthening the required warranty period for heavy-duty vehicle emission control systems primarily because the warranty period does not reflect the real world longevity of heavy-duty vehicles. Class 8 vehicles frequently operate upwards of a million miles before major overhaul is needed, but they are required to be warranted for only 100,000 miles under ARB and U.S. EPA regulations. Classes 4 through 7 vehicles also have relatively short warranty periods. With longer required warranty periods, manufacturers would need to design more durable emission control systems and components. In addition to lengthening the warranty period, ARB also intends to strengthen and enhance the current Emission Warranty and Information Reporting requirements to more readily enact corrective action on the part of the manufacturer, based upon warranty rates. A proposal to revise both the warranty period and the warranty rates/corrective action requirements for heavy-duty vehicles is scheduled to be heard by the Board in December 2017. The NTE in-use compliance program is currently the primary method used for ensuring in-use compliance with the heavy-duty engine emission standards. The NTE testing requirements were first introduced as part of the 1998 Consent Decrees with U.S. EPA, ARB, and heavy-duty engine manufacturers. Manufacturers have to demonstrate compliance within the NTE control area of the engine map by measuring emissions using Portable Emissions Measurement Systems. However, the NTE control area includes a number of conditions that exclude regions in the engine map associated with low load operation, including the region below 30 percent maximum torque and/or 30 percent maximum power. Engine operations within the NTE control area for fewer than 30 consecutive seconds and engine operations that result in exhaust aftertreatment temperatures below 250 degrees Celsius are also excluded from the NTE analysis. Because of these current limitations, the current in-use compliance program is not adequate for ensuring that emissions are controlled during the majority of in-use operations, including low load conditions. ARB is currently considering modifying the testing protocol in order to effectively assess in-use compliance under essentially all driving conditions. ARB is also considering revising the durability demonstration provisions within the certification requirements for heavy-duty engines. The durability demonstration program requires manufacturers to demonstrate compliance with emission standards over the useful life of the engine. ARB staff are concerned that the current durability demonstration program does not accurately represent the in-use deterioration of aftertreatment emission control systems. Furthermore, the useful life over which compliance with the durability provisions is demonstrated is significantly lower than the full life or mileage before first rebuild, resulting in excess emissions due to deteriorated engines and components. Therefore, ARB is considering revising the useful life period as well, resulting in the need to revise the durability demonstration process to account for a longer useful life. Background: At the June 23, 2016 Board meeting, the Board approved the proposed FY 2016-17 Funding Plan which describes how ARB would spend $500 million in proposed Low Carbon Transportation and Fuels funding from the Greenhouse Gas Reduction Fund and $28.6 million for Air Quality Improvement Program (AQIP). At the time of the Board’s action, the Legislature had appropriated AQIP funds to ARB as part of the Budget Act of 2016 but had deferred action on the $500 million in Low Carbon Transportation and Fuels funding. On August 31, 2016, the Legislature appropriated $363 million to ARB for Low Carbon Transportation projects and provided direction on how these funds are used. The Legislature also approved an associated budget trailer bill which directs ARB to make changes to the Clean Vehicle Rebate Project. At the October 20, 2016 Board meeting, the Board approved modifications to the FY 2016-17 Funding Plan to address the smaller budget appropriation and additional direction from the Legislature. Cap-and-Trade auction proceeds provide funding for ARB’s advanced technology, clean transportation incentive programs, expanding the types of projects ARB has funded through AQIP. These investments accelerate the transition to low carbon freight and passenger transportation, supporting the Governor’s climate change strategy pillar of a 50 percent reduction in petroleum use in vehicles by 2030 and the Administration’s goal to deploy 1.5 million zero emission vehicles in California by 2025. AQIP is a voluntary, mobile source incentive program that focuses on reducing criteria pollutant and diesel particulate emissions with concurrent reductions in greenhouse gas emissions. AQIP has an annual budget of about $25 million. ARB focuses AQIP investments on technology advancing projects that support California’s long-term air quality and climate change goals in addition to providing immediate emission benefits. In recent years, the majority of AQIP funds have gone towards the Truck Loan Assistance Program which helps small business truckers to secure financing for newer trucks or diesel exhaust retrofits in advance of compliance deadlines for ARB’s in-use truck and bus regulation. The solicitation includes the option for new Grant Agreements for each of the following two fiscal years: • FY 2017-18 • FY 2018-19 The current funding available for FY 2016-17 is $13 million for HVIP and $23 million for Low NOx Engine Incentives for a total of $36 million. HVIP is intended to encourage and accelerate the deployment of new hybrid and zero-emission trucks and buses in California. HVIP provides vouchers for California purchasers and lessees of up to $95,000 for zero-emission trucks and buses, and up to $30,000 for eligible hybrid trucks, and buses on a first-come, first-served basis. In addition, HVIP provides increased incentives for fleets located in or serving disadvantaged communities. These fleets qualify for vouchers up to $110,000 for zero-emission trucks and buses. ARB’s optional low NOx standards allow manufacturers the ability to certify heavy-duty vehicle engines to NOx emission levels that are up to 90 percent lower than today’s mandatory diesel emission standards. Incentivizing deployment of these engines coupled with renewable fuels is an important strategy for achieving greenhouse gas and criteria pollutant emission reductions in the heavy-duty sector. Implemented through HVIP, the low NOx engine incentive project is intended to fund the incremental cost of a heavy-duty vehicle engine above the purchase and installation costs of a conventional heavy-duty vehicle engine with the same fuel type and other characteristics. A maximum of $25,000 per engine incentive is available for the certified 8.9 liter natural gas engine that utilizes 100 percent renewable fuel, enforceable by a three year renewable fuel contract. Background: On October 25, 2016, the U.S. EPA published the final federal Phase 2 GHG standards. The federal Phase 2 standards are the second phase of federal heavy–duty GHG standards and build upon the federal Phase 1 standards. The federal Phase 2 standards will significantly reduce carbon emissions and dramatically improve the fuel economy for heavy-duty tractors, helping reduce emissions that cause climate change. They establish national GHG emission standards that will begin in model year 2021 for new class 2b to 8 medium- and heavy-duty engines and tractors, and in 2018 model year for certain trailer types. The federal Phase 2 standards will be fully phased in by model year 2027. On December 11, 2008, the Board approved the Tractor-Trailer GHG regulation codified in sections 95300-95312 of title 17, California Code of Regulations, and later amended in 2010 and 2014. This regulation required owners of 53-foot or longer box-type trailers and owners of the heavy-duty tractors that pull them on California highways to utilize U.S. EPA SmartWay verified or designated technologies that will reduce GHG emissions and improve fuel efficiency. In December 2013, ARB staff harmonized the tractor requirements of the Tractor-Trailer GHG regulation with the requirements of the Phase 1 standards. Mail-Out #MSC 16-19 includes the updated table which will go into effect on January 1, 2017. Mail-Out #MSC 16-19 can be found at: http://www.arb.ca.gov/msprog/mailouts/mouts_16.htm. All approved updates are incorporated into the latest TIMBER Supplemental Documents and can be found at: http://www.arb.ca.gov/msprog/moyer/guidelines/current.htm. There have been two revisions to the funding table in the Carl Moyer Truck Improvement/Modernization Benefiting Emission Reductions (TIMBER) Program Supplemental Documents. The first revision increases the cost-effectiveness limit to the current Carl Moyer Program cap of $18,260 per ton which reduces usage requirements at some funding levels. The second revision affects applicants opted in to the Small Fleet option of the Statewide Truck and Bus Regulation: As of January 1, 2017, trucks under this compliance path with engine model years 1999 and older will have only two years of surplus remaining prior to the January 1, 2020, compliance deadline. In order to accommodate the shortened surplus period for these trucks, an additional column has been added to the funding table on page 45. Trucks under this option with engine model years 2000 and newer will continue to receive the same funding amounts as trucks opted in to the NOx Exempt Area extension. Beginning January 1, 2017, owners of only one unfiltered truck will no longer be eligible for TIMBER funding. This is either because they will have less than one full year of surplus (Log Truck Phase-in) or because they are past their deadline to filter (NOx Exempt).
