For the potential amendments to tractor-trailer GHG regulation, please go to: https://www.arb.ca.gov/listserv/listserv_ind.php?listname=hdghg. Contact: We welcome and encourage your participation in this workshop. If you have any questions regarding the proposed California Phase 2 or potential regulatory changes to Tractor-Trailer GHG Regulation, please contact Mr. Alex Santos, Staff Air Pollution Specialist, at (626) 575-6682 or by email at alex.santos@arb.ca.gov or Ms. Mitzi Magtoto, Air Resources Engineer, at (916) 323-8975 or by email at mitzi.magtoto@arb.ca.gov. Background: On October 25, 2016, the U.S. EPA published the final federal Phase 2 GHG standards. The federal Phase 2 standards are the second phase of federal heavy–duty GHG standards and build upon the federal Phase 1 standards. The federal Phase 2 standards will significantly reduce carbon emissions and dramatically improve the fuel economy for heavy-duty trucks, helping reduce emissions that cause climate change. They establish national GHG emission standards that will begin in model year 2021 for new class 2b to 8 medium- and heavy-duty engines and tractors, and in 2018 model year for certain trailer types. The federal Phase 2 standards will be fully phased in by model year 2027. On December 11, 2008, the Board approved the Tractor-Trailer GHG regulation codified in sections 95300-95312 of title 17, California Code of Regulations, and later amended in 2010 and 2014. This regulation required owners of 53-foot or longer box-type trailers and owners of the heavy-duty tractors that pull them on California highways to utilize U.S. EPA SmartWay verified or designated technologies that will reduce GHG emissions and improve fuel efficiency. In December 2013, ARB staff harmonized the tractor requirements of the Tractor-Trailer GHG regulation with the requirements of the Phase 1 standards. California is in a drought emergency. Directions to Cal/EPA headquarters and public transit can be found at: http://www.calepa.ca.gov/EPAbldg/location.htm. If you have questions regarding the workshop, please contact Katherine Garrison at (916) 322-1522 or Katherine.Garrison@arb.ca.gov. Background: Promoting the development and use of zero-emission airport transportation will help ARB achieve the emission reduction strategies outlined in the Mobile Source Strategy, Draft State Implementation Plan and the Sustainable Freight Action Plan. Vehicles such as airport shuttle buses that operate on fixed routes, have stop-and-go operations, maintain low average speeds, and are centrally maintained and fueled are ideal candidates for targeting zero-emission electric technologies. Additionally, experience gained from demonstrating the viability zero-emission operation in these fleets will benefit other heavy-duty on-road markets and enable cleaner transportation in other fields. The overall goals of this effort will: • Complement existing programs to achieve NOx and GHG emission reductions through the use of zero-emission technology. • Increase the penetration of the first wave of zero-emission heavy-duty technology into transportation applications at airports, such as buses that transport passengers to and from car parking lots and airport terminals as well as those that transport passengers to airport car rental facilities. This workshop will be held at the following time and location: Date: Wednesday, February 22, 2017 Time: 1:00 p.m. to 3:00 p.m. Place: Cal/EPA Headquarters Building, Sierra Hearing Room 1001 I Street, Sacramento, California 95814 The workshop will also be available via webcast for stakeholders unable to attend in person and can be accessed at the following link on the day of the workshop: https://video.calepa.ca.gov/. Additionally, experience gained from demonstrating the viability of zero-emission operation in these fleets will benefit other heavy-duty on-road markets and enable cleaner transportation in other fields. The draft documents are available at https://www.arb.ca.gov/msprog/offroad/sore/sore.htm. ARB will hold a public workshop to discuss the draft 15-day changes to the ARB SORE evaporative emissions regulation amendments presented to the Board in November 2016. The draft 15-day changes will clarify certification and compliance requirements, provide testing and certification flexibility for manufacturers, and ensure compliance of all SORE with the evaporative emission standards. The workshop will consist of a presentation by staff lasting approximately 30 minutes, followed by a question and answer session. Background: SORE are spark-ignited engines rated at 19 kilowatts or less. They are used in applications such as lawn and garden, industrial, construction and mining, logging, airport ground support, commercial utility equipment, farm equipment, golf carts, and specialty vehicles. Amendments to the SORE evaporative emissions regulations were presented to the Board in November 2016 to address the high non-compliance rate observed in ARB and industry validation testing from model years 2008 through 2015, update the certification test fuel to match that sold in California gasoline stations, and enable manufacturers to obtain ARB and U.S. EPA certification for fuel tanks based on a common set of test results. The Board approved the amendments and directed staff to make 15-day changes in response to industry comments. Participants are encouraged to attend in person. The workshop will be webcast to accommodate those who are unable to attend in person. The webcast will be available at: http://www.aqmd.gov/home/library/webcasts. The workshop agenda and an electronic copy of the staff presentation will be posted by February 28 on ARB’s website at: https://www.arb.ca.gov/msprog/offroad/sore/sore.htm. The meeting will be held at the following time and place: Date: Thursday, April 6, 2017 Time: 9:30 a.m. to 4 p.m. Place: Cal/EPA Headquarters Building Coastal Hearing Room, Second Floor 1001 I Street Sacramento, California 95814 A meeting notice for the workshop is posted at: https://www.arb.ca.gov/msprog/aqip/meetings/meetings.htm. This meeting will be webcast for those unable to attend in person. The broadcast can be accessed on the day of the workshop at https://video.calepa.ca.gov/. CARB staff plans to post a discussion document outlining its draft recommendations on project categories, funding allocations, and project criteria for the Funding Plan several days before the workshop on CARB’s Low Carbon Transportation/AQIP website. The discussion document will include an agenda. For more information about these programs, please go to: https://www.arb.ca.gov/aqip/. If you have questions regarding the workshop, please contact Andrew Panson at (916) 323-2809 or andrew.panson@arb.ca.gov. Background: The Low Carbon Transportation program is part of California Climate Investments, a statewide program that puts billions of Cap-and-Trade dollars to work reducing greenhouse gas emissions, strengthening the economy and improving public health and the environment—particularly in disadvantaged communities. California Climate Investments support CARB’s advanced technology, clean transportation incentive programs which are designed accelerate the transition to low carbon freight and passenger transportation with a priority on providing health and economic benefits to California’s disadvantaged communities. The Governor’s proposed FY 2017-18 Budget would direct $363 million for CARB to continue Low Carbon Transportation investments. AQIP is a mobile source incentive program that focuses on reducing criteria pollutant and diesel particulate emissions with concurrent reductions in greenhouse gas emissions. The Governor’s proposed Budget includes $28.6 million for AQIP. One of the pending consent decrees to resolve claims against Volkswagen for equipping its diesel vehicles with defeat devices would require the company to pay CARB $25 million to fund “the ZEV-related aspects of the EFMP Plus Up Program or the ZEV-related aspects of similar vehicle replacement programs.” CARB staff intends to include a proposal for how to spend this $25 million in the FY 2017-18 Funding Plan contingent on court approval of the consent decree. The workshop will include discussions on how best to advance the market for advanced clean truck technologies primarily in local truck and last mile delivery applications. The discussion will include an overview of a potential regulatory concept that would apply to chassis manufacturers, a detailed discussion with the investor-owned utilities about the SB 350 proposals to remove barriers for transportation electrification, a draft fleet survey questionnaire, and a continued discussion on costs. This public workshop is open to the public and in-person participation is strongly encouraged. The workshop will be held at the following time and place: Date: Tuesday, April 25, 2017 Time: 10:00 am to 4:00 pm Place: Cal/EPA Headquarters Building, Coastal Hearing Room 1001 I Street, Sacramento, California 95814 Directions: https://goo.gl/maps/x1iswHHwiJT2 The workshop notice is available at https://www.arb.ca.gov/msprog/mailouts/mouts_17.htm The workshop will also be available via webcast for stakeholders who are unable to attend in person and can be accessed on the day of the workshop at https://video.calepa.ca.gov/ Staff’s presentation, meeting agenda, and other meeting materials will be posted in advance of the workshop on CARB’s Advanced Clean Truck website at www.arb.ca.gov/msprog/actruck/actruck.htm The workshop will be structured to discuss the transportation electrification topics in the morning and the regulatory concept discussion beginning at 1:00 pm. Pacific Gas and Electric Company, San Diego Gas & Electric Company, and Southern California Edison Company submitted applications to the CPUC in January, proposing programs aimed at accelerating transportation electrification as directed under SB 350. Some of their proposals target medium- and heavy-duty vehicles. The CPUC plans to give an overview of those specific programs and seeks feedback on the proposals from customers in those sectors. Information about the SB 350 transportation electrification applications can be found at www.cpuc.ca.gov/sb350te Background: These strategies support CARB’s efforts to protect public health for the millions of Californians that still breathe unhealthy air, reduce exposure to air toxics in disadvantaged communities, and meet California’s greenhouse gas emission reduction targets as part of the global action needed to slow global warming and achieve climate stabilization. Background: In 2007, Governor Schwarzenegger signed into law the California Alternative and Renewable Fuel, Vehicle Technology, Clean Air, and Carbon Reduction Act of 2007, Assembly Bill (AB) 118 (Núñez Statutes of 2007, Chapter 750). AB 118 created AQIP, a voluntary incentive program administered by CARB, to fund clean vehicle and equipment projects, air quality research, and workforce training. The Trade-Up Pilot Project is funded entirely through AQIP, which is targeted to reduce criteria pollutants and air toxics, often with greenhouse gas emission reduction co-benefits. Emissions from mobile agricultural equipment are among a number of significant sources of air pollution in the San Joaquin Valley Air Basin, and reducing these emissions is necessary to meet federal health-based air quality standards. ARB incentive programs and regulations are already reducing emissions from a wide variety of diesel engines in the San Joaquin Valley Air Basin, however, a continuing transition to the cleanest technologies is needed in order to meet air pollution standards in 2023 and 2032. Existing local, State, and federal agricultural equipment incentives are currently helping growers purchase new equipment in exchange for scrapping old equipment. A trade-up incentive for incrementally cleaner, used equipment may hold potential as a new incentive pathway for growers with high-emitting equipment that are not able to take advantage of current programs. Staff will discuss proposed amendments that would: 1) reduce the current 40 percent opacity limit; 2) require opacity testers who perform paid opacity testing services to be trained to ensure compliance with the SAE J1667 snap acceleration test procedures; and 3) implement web-based fleet reporting requirements using a phase-in schedule. Staff also will briefly discuss its ongoing efforts to develop a comprehensive inspection and maintenance (I/M) program for heavy-duty (HD) vehicles with a gross vehicle weight rating over 14,000 pounds for implementation in the post-2020 timeframe. The workshop will be held at the following location and time, and will be webcast for those unable to attend in person. This is the third and final public workshop before staff is scheduled to present the proposed amendments to the Board at the October 26-27, 2017, public meeting in Riverside, California. Date: Wednesday, May 17, 2017 Time: 1:30 p.m. – 4:30 p.m. Location: CalEPA Headquarters Building Sierra Hearing Room, 2nd floor 1001 I Street Sacramento, California 95814 The broadcast can be accessed on the day of the workshop at: https://video.calepa.ca.gov/. For more information and to view the public workshop notice, please visit the program website at: http://www.arb.ca.gov/msprog/hdim/hdim.htm. Staff will also post the workshop presentation to this website before the workshop begins. If you wish to continue receiving information on the proposed opacity regulatory amendments or on the HD I/M regulatory development process, please sign up for the new HD I/M list serve: http://www.arb.ca.gov/listserv/listserv_ind.php?listname=hdim. For more information on the existing HDVIP and PSIP, please visit the program website at: http://www.arb.ca.gov/enf/hdvip/hdvip.htm Background: Legislative mandates from the late 1980s and early 1990s required CARB to develop regulatory programs to inspect heavy-duty vehicles for excessive smoke emissions and for tampering. These programs, the HDVIP (also known as the roadside program) and the PSIP (also known as the fleet program), remain in force today and are currently CARB’s primary HD vehicle screening programs to detect excess opacity emissions from in-use trucks. While these programs have been effective, they were established before the use of diesel particulate filters (DPFs), which come new on 2007 and later model year engines. Because of the widespread use of DPFs and the need to ensure they are operating efficiently, CARB now needs to update the HDVIP and PSIP regulations to reduce the opacity limit to assist in identifying heavy-duty trucks with broken DPFs and in need of repair, and to incorporate other proposed program improvements. The proposed amendments to the HDVIP and PSIP are also an important first step in transitioning to a more robust multi-pollutant HD I/M program that takes advantage of the extensive capabilities of on-board diagnostic systems in newer engines (2013 and later model year engines) for monitoring the performance of nearly every emission-related engine component and emission control component. At the workshop, staff will also briefly discuss its ongoing work in developing a comprehensive HD I/M regulatory program, which it expects to present to the Board for consideration in the 2020-timeframe. Transforming the State’s transportation sector to support widespread electrification requires increasing access for all residents, including low-income and those living in disadvantaged communities, across a broad spectrum of clean mobility options. SB 350 directs the California Air Resources Board (CARB or Board) to examine the barriers low income residents must overcome to increase access to zero-emission and near zero emission transportation and develop recommendations on how to overcome these barriers. CARB undertook a public process and directly engaged local community members, including low-income residents, to determine the main barriers to clean transportation access. CARB framed the results of this effort as a guidance document, which provides a pathway to overcome barriers to clean transportation and mobility options. The guidance document, formally titled, Low-Income Barriers Study, Part B: Overcoming Barriers to Clean Transportation Access for Low Income Residents (Draft SB 350 Clean Transportation Access Guidance Document), and supporting Appendices are now available for public review and comment at: https://www.arb.ca.gov/transoptions The Draft SB 350 Clean Transportation Access Guidance Document is an initial step in identifying the main barriers and providing initial recommendations as a framework to address them moving forward. Recommendations include steps that the Legislature, communities, State and local planning, transportation, and air quality agencies can take to overcome specific barriers and begin to formulate innovative, meaningful solutions. Many of the recommendations build upon current actions State and local agencies are implementing to increase access to transportation electrification for all Californians. CARB is seeking public input on the Draft SB 350 Clean Transportation Access Guidance Document. To submit written feedback, please contact Ms. Ashley Dunn, Air Pollution Specialist, at (626) 459-4385 or by email at ashley.dunn@arb.ca.gov. To facilitate an ongoing public process, CARB will hold a public roundtable meeting in the next two months. Further details for the roundtable will be announced soon and posted on the project webpage provided above. Please make sure you are subscribed to the following project listserv to receive details on this meeting: https://www.arb.ca.gov/listserv/listserv_ind.php?listname=transoptions CARB also plans to provide an informational update to the Board in Spring 2017. Staff will update the Board on key findings in the Draft SB 350 Clean Transportation Access Guidance Document, present initial recommendations, and summarize public comments received. CARB intends to publish a final guidance document in late Summer 2017. Continued coordination and engagement across the State is critical for building continued understanding and solutions for increased clean transportation access for all residents, including low-income residents. CARB will continue coordinating with the California Energy Commission (CEC), transportation agencies, and key stakeholders in developing implementable actions, and ensuring progress is made to achieve the goals of transportation electrification, including increased access for low-income residents and disadvantaged communities. Further information about this effort is available at: https://www.arb.ca.gov/transoptions Background: Transportation electrification is the cornerstone of California’s future towards meeting both air quality and climate goals, along with ensuring economic prosperity and energy security needs. SB 350 plays an important role in ensuring the State is taking positive steps forward to promote widespread electrification across transportation and mobility options and in turn increasing clean transportation access for all residents. Portions of SB 350 are intended to address legislative findings that there is insufficient understanding of the barriers to access for low-income customers to: - Zero-emission and near zero-emission transportation options - All forms of renewable energy being generated in the State - Energy efficiency investments As a result, CARB was directed to develop and publish a study, in consultation with CEC and with input from other relevant state agencies and the public, on barriers for low-income customers to access zero-emission and near-zero-emission transportation options, including those in disadvantaged communities as well as recommendations on how to increase access. Similarly, CEC was directed to develop and publish a study on barriers for low-income customers to energy efficiency and weatherization investments, including those in disadvantaged communities as well as recommendations on how to increase access to energy efficiency and weatherization investments to low-income customers. The results of these efforts are two separate, but related, reports that provide recommendations intended to have a transformative effect on access to clean energy and transportation investments for low-income residents, including in disadvantaged communities. In December 2016, CEC published their study, formally titled, Low-Income Barriers Study, Part A: Overcoming Barriers to Energy Efficiency and Renewables for Low-Income Customers and Small Business Contracting Opportunities in Disadvantaged Communities, which is available at: http://www.energy.ca.gov/sb350/barriers_report/documents/index.html Contact: For more information on the on the Draft SB 350 Clean Transportation Access Guidance Document, please contact Ms. Ashley Dunn, Air Pollution Specialist, at (626) 459-4385 or by email at ashley.dunn@arb.ca.gov. At the workshop, staff will also briefly present its ongoing work in developing a comprehensive HD I/M regulatory program, which it expects to present to the Board for consideration in the 2020-timeframe. If you have questions on the subject matter of the workshop, please contact Jason Hill-Falkenthal at (916) 322-4683 or via email at Jason.Hill-Falkenthal@arb.ca.gov. This is one of a suite of CARB funded pilot projects that, together with committed partners, are employing innovative solutions to bring the benefits of clean transportation to disadvantaged and lower-income communities that are most impacted by pollution. The Financing Assistance Pilot Project is intended to encourage and accelerate the adoption of zero-emission and near zero-emission, on-road light-duty vehicles in lower-income households. The higher cost of advanced technology clean vehicles can be a significant barrier to vehicle ownership for many lower-income consumers. The goal for this project is to help improve access to affordable financing mechanisms, including a vehicle price buy-down coupled with a low interest loan to qualified lower-income consumers to purchase advanced technology clean vehicles. The current funding available for FY 2016-17 is $6 million, with a funding split of up to $5 million for a Statewide project and up to $1 million for local projects. The scope of a Statewide project is a project that is at least regional or multi-regional in size to begin with and by design has plans to expand throughout California. The Statewide project is available to lower-income consumers with an emphasis to outreach to lower-income consumers in disadvantaged communities. The local project(s) can be a region of the state, air basin, or county. The local project primarily benefits or serves a specific disadvantaged community but is open to lower-income consumers. This pilot project is funded by the Low Carbon Transportation program and is part of California Climate Investments, a statewide program that puts billions of Cap-and-Trade dollars to work reducing greenhouse gas emissions, strengthening the economy and improving public health and the environment—particularly in lower-income and disadvantaged communities This solicitation is open to federal, state or local government entities or agencies, and California nonprofit organizations with expertise in the implementation of financing programs, grant programs, and general knowledge of CARB’s clean vehicle programs. Specifically, staff’s presentation will focus on the need for longer HDV emission warranty periods in California. The workshop will be held at the following location and times. Date: Wednesday, July 12, 2017 Time: 10:00 a.m. – 1:00 p.m. Location: South Coast Air Quality Management District Auditorium 21865 Copley Drive Diamond Bar, California 91765 A link to the workshop location is provided below: Location: https://goo.gl/maps/iz4RqCogjg62 For more information on this workshop, see the workshop notice at: https://www.arb.ca.gov/msprog/mailouts/msc1712/msc1712.pdf For more information on the HDV warranty program, as well as information on the development of other HD Low-NOx control measures, please visit our website at: https://www.arb.ca.gov/msprog/hdlownox/hdlownox.htm If you have questions on the subject matter of this workshop, please contact Mr. Jeff Lowry at (626) 575-6841, or via email at jlowry@arb.ca.gov. If you wish to receive information regarding HDV warranty regulatory amendments in the future, please sign up for the HD Low-NOx list serve “hdlownox” at the following link: https://www.arb.ca.gov/listserv/listserv.php Background: A key measure in CARB’s Revised Proposed 2016 State Strategy for the State Implementation Plan (State SIP Strategy) is ensuring that in-use heavy-duty vehicles continue to operate at their cleanest possible level (Lower In-Use Emission Performance Level). Amendments to warranty provisions are an important part of that measure. The State SIP Strategy is critical for attaining federal health-based air quality standards for ozone in 2023 and 2031 in the South Coast and San Joaquin Valley air basins, as well as fine particulate matter standards in the next decade. CARB is considering lengthening the required warranty period for HDVs because the current warranty period does not reflect real-world longevity and because longer warranty periods would result in lower NOx emissions. Class 8 HDVs frequently operate upwards of a million miles before major overhaul is needed, but they are required to be warranted for only 100,000 miles under CARB and U.S. EPA regulations. Classes 4 through 7 HDVs also have relatively short warranty periods compared to when major overhaul is needed. With longer required warranty periods, manufacturers would need to design more durable emission control systems and components. A proposal for longer HDV emission warranty periods is scheduled for Board consideration in December 2017. The Board ultimately approved the guideline revisions after a hearing on April 27, 2017. The revised guideline documents are available at https://www.arb.ca.gov/msprog/moyer/guidelines/current.htm. The new 2017 Moyer Program Guidelines include changes in the following key areas: - Increased and expanded cost-effectiveness limits, especially for the cleanest technologies; - Infrastructure as a new funding category; - Expanded co-funding flexibility; - Updated calculation methods, including deterioration and updated emission factors; - Revisions to project criteria that expand opportunities for advanced technologies and larger fleets. The revised guidelines have been divided into two volumes. Volume I contains the Program Overview, Program Administration, and Project Criteria. Volume II contains the On-Road Voucher Incentive Program, Off-Road Voucher Incentive Program, and the Agricultural Assistance Program. Background: The Moyer Program provides grant funding for the incremental cost of cleaner-than-required engines, equipment, and emission reduction technologies. The Moyer Program complements California’s regulatory program by funding emission reductions that are surplus, i.e., early and/or in excess of what is required by regulation. Agenda: https://arb.ca.gov/msprog/hdlownox/files/workshop071217/warrantyws_agenda.pdf Presentation: https://arb.ca.gov/msprog/hdlownox/files/workshop071217/warrantyws_presentation.pdf We invite you to participate in the public workshop. The workshop will be held at the following location and time. Amendments to the Tractor-Trailer GHG regulation may include more stringent emission reduction requirements on 53-foot or longer box-type trailers and new emission reduction requirements on other types of trailers (e.g., box-type less than 53 feet long, tankers, container chassis, and flat beds). This workshop is described further in the workshop notice at https://www.arb.ca.gov/msprog/mailouts/msc1716/msc1716.pdf. Specific topics to be discussed include the California Phase 2 certification process, the California warranty process, and updates on areas where California may differ from the federal Phase 2 program. Date: Thursday, August 31, 2017 Time: 9:30 a.m. to 5:00 p.m. Place: Cal/EPA Headquarters Building Coastal Hearing Room 1001 I Street, Second Floor Sacramento, California 95814 This workshop will be available via webcast at https://video.calepa.ca.gov/ for those unable to attend in person. For more information about the proposed California Phase 2 GHG standards, please go to: http://www.arb.ca.gov/msprog/onroad/caphase2ghg/caphase2ghg.htm. For the potential amendments to tractor-trailer GHG regulation, please go to: https://www.arb.ca.gov/listserv/listserv_ind.php?listname=hdghg. Background: In December 2013, California harmonized with the federal Phase 1 requirements. Adoption of the federal Phase 1 rule provided CARB the ability to certify new heavy-duty vehicles and engines and enforce those requirements in the State. In addition, CARB’s adoption of the Phase 1 requirements provided nationwide consistency for vehicle and engine manufacturers. At the same time, CARB amended the TTGHG regulation to align with the Phase 1 rule by sunsetting the 2014 and subsequent model year tractor requirements. Building on the success of the federal Phase 1 rule, in August 2016, U.S. EPA and NHTSA jointly adopted the federal Phase 2 rule, which is more stringent than Phase 1. The federal Phase 2 rule is phased-in over the 2018 through 2027 model years. The structure of the federal Phase 2 rule is generally similar to Phase 1, establishing GHG emission standards for tractors, vocational vehicles, and heavy-duty pickups and vans, and the engines used in tractors and vocational vehicles. However, the federal Phase 2 rule also establishes standards for certain trailers used in combination with tractors. The trailer types included in Phase 2 are box-type trailers (dry van and refrigerated van trailers of all lengths), flat bed trailers, tank trailers, and container chassis. The trailer requirements include aerodynamic improvements and tire requirements for box-type trailers, but only tire requirements for the other trailer types. Although this marks the first time trailers have been regulated at the federal level, trailers have been regulated in California since 2010. On December 22, 2016, the Truck Trailer Manufacturer Association (TTMA) filed a lawsuit that challenges and seeks to vacate the trailer provisions of the federal Phase 2 rule that apply to trailers. That lawsuit however, does not affect California’s authority to establish standards for trailers hauled by heavy-duty tractors. The agenda and presentation, as well as notice, can be accessed at: https://www.arb.ca.gov/msprog/onroad/caphase2ghg/caphase2ghg.htm. The workshop will be held at the following date, time, and location: Date: Thursday, August 31, 2017 Time: 9:30 a.m. to 5:00 p.m. (PST) Place: Cal/EPA Headquarters Building Coastal Hearing Room 1001 I Street, Second Floor Sacramento, California 95814 This workshop will also be available via webcast for stakeholders unable to attend in person and can be accessed at the following link on the day of the workshop: https://video.calepa.ca.gov/. Background: In December 2013, California harmonized with the federal Phase 1 GHG standards for medium- and heavy-duty engines and vehicles (the Phase 1 rule). Adoption of the federal Phase 1 rule provided CARB the ability to certify new heavy-duty vehicles and engines and enforce those requirements in the State. In addition, CARB’s adoption of the Phase 1 standards provided nationwide consistency for vehicle and engine manufacturers. At the same time, CARB amended the Tractor-Trailer GHG regulation to align with the Phase 1 rule by sunsetting the 2014 and subsequent model year tractor requirements. Building on the success of the federal Phase 1 rule, in October 2016, the United States Environmental Protection Agency (U.S. EPA) and the National Highway Traffic Safety Administration (NHTSA) jointly adopted the federal Phase 2 rule, which is more stringent than Phase 1. On December 22, 2016, the Truck Trailer Manufacturer Association filed a lawsuit that challenges and seeks to vacate the trailer provisions of the federal Phase 2 rule that apply to trailers. On August 17, 2017, U.S. EPA/NHTSA announced they will reconsider the trailer provisions of the federal Phase 2 rule. The lawsuit and reconsideration of the trailer provisions however, does not affect California’s authority to establish standards for trailers hauled by heavy-duty tractors. Additional proposed Cap-and-Trade auction proceeds funding for two new CARB incentive programs is also pending before the Legislature: one to reduce agricultural sector emissions and another for air districts to reduce emissions to achieve early actions for the community emission reduction programs developed pursuant to Assembly Bill (AB) 617 (Garcia, Chapter 136, Statutes of 2017). These new programs are outside of the scope of this workshop and the FY 2017 18 Clean Transportation Incentives Funding Plan. CARB will launch separate public processes focused for these new programs shortly. The meeting will be held at the following time and place: Date: Wednesday, October 4, 2017 Time: 9:30 am to 4:30 pm Place: Cal/EPA Headquarters Building Sierra Hearing Room, Second Floor 1001 I Street Sacramento, California 95814 A meeting notice for the workshop is posted at: https://www.arb.ca.gov/msprog/aqip/meetings/meetings.htm. This meeting will be webcast for those unable to attend in person. The broadcast can be accessed on the day of the workshop at https://video.calepa.ca.gov/. Staff plans to post a draft Funding Plan outlining its proposals on project categories, funding allocations, and project criteria for this funding about a week before the workshop on CARB’s Low Carbon Transportation/AQIP website at https://www.arb.ca.gov/aqip/. The draft document will include a workshop agenda. Staff’s presentation will be posted on this website the morning of the workshop. If you have questions regarding the workshop, please contact Andrew Panson at (916) 323-2809 or andrew.panson@arb.ca.gov. Background: AQIP: AQIP is a mobile source incentive program that focuses on reducing criteria pollutant and diesel particulate emissions with concurrent reductions in greenhouse gas emissions. CARB was appropriated $28.64 million for AQIP in the 2017 State Budget. Volkswagen Settlement for ZEV Aspects of Vehicle Replacement Programs: CARB has entered into several partial consent decrees with Volkswagen to resolve claims against the company for equipping its diesel vehicles with illegal defeat devices. One of the partial consent decrees requires Volkswagen to pay CARB $25 million to fund “the ZEV-related aspects of the EFMP Plus Up Program or the ZEV-related aspects of similar vehicle replacement programs.” CARB was appropriated $25 million to implement this part of the settlement in the 2017 State Budget. Zero/Near-Zero Emission Warehouse Program: CARB was appropriated $50 million in one-time funding for a new Zero/Near Zero Emission Warehouse Program. These funds are to be used for a competitive funding program to advance implementation of zero- and near zero emission warehouses and technology with a requirement for a one-to-one match resulting in $100 million for projects. The Legislature directed CARB to develop criteria for implementing this program using the AQIP funding plan process. Low Carbon Transportation: The Low Carbon Transportation Program is part of California Climate Investments, a statewide program that puts billions of Cap-and-Trade dollars to work reducing greenhouse gas emissions, strengthening the economy and improving public health and the environment—particularly in disadvantaged communities. California Climate Investments support CARB’s advanced technology, clean transportation incentive programs which are designed accelerate the transition to low carbon freight and passenger transportation with a priority on providing health and economic benefits to California’s disadvantaged communities. CARB’s potential Low Carbon Transportation appropriation is still pending before the Legislature. A second Partial Consent Decree was approved by the Court in May 2017 that pertains to the subject 3.0-liter diesel cars and augments the first Consent Decree. The Consent Decrees partially resolve Clean Air Act and California state claims against VW for equipping its 2.0-liter and 3.0-liter diesel vehicles with defeat devices. The Mitigation Trust is enumerated in the first Partial Consent Decree as Appendix D. Appendix D is intended to mitigate past and future excess NOx emissions from the subject vehicles. Under the terms of the Consent Decree, VW must pay about $3 billion ($423 million for California) into a mitigation trust over a three-year period for eligible mitigation actions that consist mostly of scrap-and-replace projects, including supportive infrastructure for zero- and near zero-emission advanced technology replacements, for the heavy-duty sector. Before the State can expend any Trust funds, it must develop and submit to the Trustee, Wilmington Trust, N.A., a Beneficiary Mitigation Plan that describes the eligible mitigation actions to be funded; the recommended allocation percentages; the estimated emission benefits; and a consideration of potential impacts of the eligible mitigation actions on air quality in areas that bear a disproportionate share of the air pollution burden. In addition to the Consent Decree requirements, Senate Bill (SB) 92, passed in June 2017, further directs how California’s Mitigation Trust funds in Appendix D are to be spent. The legislation directs the designated Lead Agency for the Mitigation Trust to strive to ensure that at least 35 percent of California’s allocation benefit low-income or disadvantaged communities that are disproportionately impacted by air pollution. SB 92 also requires the Lead Agency – which the Governor has indicated will be CARB – to strive to ensure that the expenditures align with the state’s priorities and provide for public transparency before approval.
