Settlements from the cases will benefit California community colleges and help fund air quality research and clean-air projects. The majority of the violations involved truck and bus fleets that failed to conduct the annual emissions tests that ensure clean-running engines, as required by law. “Businesses play a vital role in environmental protection,” said Paul Jacobs, Chief of ARB’s Mobile Source Enforcement Branch. “We work hard to establish and maintain good relationships so that we can educate business owners and keep them updated. However, if errors are made and air quality suffers as a result, we are required to take action.” Of the $383,375.00 collected, $326,275.50 went to the California Air Pollution Control Fund to support air quality projects and research to improve California's air quality. The Peralta Community College District received $56,130.75, and $968.75 went to the Palomar College Foundation, to fund emission education classes under the California Council for Diesel Education and Technology program. The five companies paying the highest amounts: - Foresthill Motorsports, LLC paid $155,000 for selling 29 motorcycles that were illegal for use in California. - Tahoe Truckee Disposal Co., Inc. paid $25,125 for failure to comply with diesel fleet self-inspection requirements, and neglecting to install required emission-reduction devices. - Alcal-Arcade Contracting, Inc. paid $21,075 for failing to self-inspect its diesel fleets and for not affixing emission control labels to engines. - Kenyon Plastering, Inc. paid $21,000 for failing to inspect its diesel fleet and for not affixing emission control labels to engines. - Redding Yamaha SeaDoo paid $20,000 for removing emissions control equipment from motorcycles, rendering them uncertified and illegal for sale in California. ARB investigators documented the sales of 932 illegal catalytic converters by the company, which is based in Carson, California. “Catalytic converters are integral to reducing smog-forming emissions from motor vehicles,” said ARB Enforcement Chief James Ryden. “When the equipment doesn’t comply with California standards, the health of the public is compromised.” Aftermarket catalytic converters for on- and off-road vehicles must be approved by ARB to be advertised, sold, offered for sale or installed in California. Faulty catalytic converters may result in vehicles failing smog checks, incurring expensive repairs for customers, and jeopardizing vehicle registration with the Department of Motor Vehicles. Enforcement of these regulations not only protects the environment and public health, but also protects against unfair business practices. The settlement will go to the California Air Pollution Control Fund to support projects and research to improve the state's air quality. Nichols. “The Board’s action today will create thousands of new jobs, transforming California into the advanced car capital of the world. California is now in pole position in the race to provide next-generation ultra-clean cars to the global car market.” The Advanced Clean Cars program combines the control of smog-causing pollutants and greenhouse gas emissions into a single coordinated package of requirements for model years 2017 through 2025. The new rules will clean up gasoline and diesel-powered cars, and deliver increasing numbers of zero-emission technologies, such as full battery electric cars, newly emerging plug-in hybrid electric vehicles and hydrogen fuel cell cars. The package will also ensure adequate fueling infrastructure is available for the increasing numbers of hydrogen fuel cell vehicles planned for deployment in California. The Advanced Clean Cars program has been in development over the past three years and is composed of four separate, but related components. An overview of the program is included further below. The rules are designed to preserve consumer choice while ensuring the development of a full range of environmentally superior cars from compacts to SUVs and pickups. These vehicles will continue to deliver the performance, utility and safety vehicle owners have come to expect with significant savings thanks to reduced operating costs. Many of the technologies that reduce climate change emissions also significantly reduce the operating costs of passenger vehicles on a month-to-month basis for consumers. Benefits of Advanced Clean Cars Program: Consumer Savings: California drivers will save $5 billion in operating costs in 2025, and $10 billion by 2030 when more advanced cars are on the road. In 2025, average consumers will see nearly $6,000 in fuel cost savings over the life of the car, nearly triple the estimated per vehicle cost. Based on typical financing for a new vehicle, savings accrue the minute the car drives off the lot. Fight Smog: The rules deliver a 75 percent reduction in smog-forming emissions from new vehicles by 2025 (compared to 2014 levels). Fight Climate Change: Greenhouse gas emissions from new cars will be cut 34 percent from 2016 levels. By 2025, greenhouse gases will be reduced by 52 million tons, the equivalent of taking 10 million cars off the road for a year. The package will result in a cumulative reduction of more than 870 million metric tons of greenhouse gases through 2050. Deliver Next-Generation Cars: Zero-emission or plug-in hybrid vehicles will account for one in seven new cars sold in California in 2025 (15.4 percent). More than 1.4 million zero-emission and plug-in hybrid vehicles will be on the road in California by 2025. Create Jobs: Overall savings generated by the proposed rules will result in an additional 21,000 jobs in California in 2025, rising to 37,000 in 2030. _________________________________ OVERVIEW: THE ADVANCED CLEAN CAR PROGRAM The Advanced Clean Cars program has been in development over the past three years and is composed of four separate, but related components: Greenhouse gas standard for cars and light trucks, model years 2017-2025 The greenhouse gas standard approved today builds on California’s first-in-the-nation standard that was later adopted in 2010 by the federal government as part of a national program. The new rules strengthen the greenhouse gas standard for 2017 models and beyond. They were developed in tandem with the federal government over the past three years, including an unprecedented joint fact-finding process with shared engineering and technical studies. The current California program constitutes a separate set of rules with minor variations due to separate legal structures but is designed to parallel the proposed federal joint rulemaking the Obama administration announced last summer. Once the proposed federal standards are adopted, they will be deemed sufficient for compliance in California. This responds to the desire for a streamlined set of rules for new cars and light trucks and creates a single national program for manufacturers that addresses both greenhouse gas and fuel economy standards. The new standard drops greenhouse gas emissions to 166 grams per mile, a reduction of 34 percent compared to 2016 levels. This will be achieved through existing technologies, the use of stronger and lighter materials, and more efficient drivetrains and engines. Reducing Smog-Forming Emissions California will need to reduce smog-forming pollution by an additional 75 percent from 2014 levels to help meet more stringent federal air quality standards expected in the next few years. Since California continues to have the nation’s worst air quality, and has more than 26 million cars on the road, it is necessary to further reduce smog-forming pollution from cars. This regulation will drive the development of the cleanest cars yet that use diesel, gasoline, or gas-electric hybrid internal combustion engines. (Note: The above two regulations are bundled into a single document under the title “LEV III“.) Zero Emissions Vehicle (ZEV) Regulation The ZEV regulation will result in over 1.4 million ZEVs on the road by 2025 (15.4 percent of new vehicle sales in that year) in order to be on track to reach the 2050 greenhouse gas reduction goal. A transitional model – the plug-in hybrid car – will play a significant role over the next 20 years, but by mid-century, 87 percent of cars on the road will need to be full zero-emission vehicles to achieve climate goals. The ZEV regulation builds on the program in place since 1990 and is designed to rapidly increase ZEV production to early commercial volumes, establishing a sustainable and growing market for these advanced technology vehicles. This will place California on a path to reduce greenhouse gas emissions by 80 percent by 2050, a goal adopted by many nations and believed necessary to stabilize climate temperature. Clean Fuels Outlet This regulation is designed to support the commercialization of zero-emission hydrogen fuel cell vehicles planned by vehicle manufacturers by 2015, which will require increased numbers of hydrogen fueling stations. Construction of the new stations will provide a convenient fueling infrastructure, first within the major metropolitan areas, but ultimately throughout the state. The number of stations will grow as vehicle manufacturers sell more fuel cell vehicles. The mandatory reporting tool builds on ARB’s existing reporting tool. The re-design was developed in close collaboration with the United States Environmental Protection Agency The new version aligns the two agencies’ systems, though some slight differences remain because of California’s emission reduction requirements. ARB worked closely with U.S. EPA in redesigning the state reporting tool to reach the greatest consistency possible with federal emissions reports while achieving the goals of California’s Global Warming Solutions Act, AB 32. The new system is called the California Electronic Greenhouse Gas Reporting Tool, or Cal e-GGRT. ”The harmonization of these two reporting systems is a key step in easing industry compliance with the requirements of AB 32,” said ARB Chairman Mary D. Of the $226,950 collected, $170,400.75 went to the California Air Pollution Control Fund to support research to improve California’s air quality. In addition, $56,549.25 went to the Peralta Community College District to fund classes at participating California community colleges under the California Council for Diesel Education and Technology program. “The Air Resources Board has a long history of outreach to businesses to keep them informed about how to keep in compliance with state laws,” said Paul Jacobs, Chief of ARB’s Mobile Source Enforcement Branch. “When companies fail to make necessary changes or neglect to do what is required of them, we have to take action in order to protect public health.” Fines totaled $$226,950; none from this group exceeded $25,000. An investigation by the Air Resources Board showed that Donaldson sold 103 filter systems that did not include a back pressure monitor, a device essential to the performance of both the filter and the engine of the vehicle. “Reducing diesel exhaust is critical to safeguard the health of Californians,” said ARB Enforcement Chief James Ryden. “Any equipment that does not comply with the state’s standards cannot operate legally.” As a corrective measure, Donaldson voluntarily mounted a service campaign to upgrade the systems sold in California with a back pressure monitor and other modifications. Of the $103,000 paid by the company, $77,250 went to the California Air Pollution Control Fund to support projects and research to improve the state's air quality. The San Joaquin Valley Air Pollution Control District received $25,750 to support a project that retrofits school buses with diesel filters. Diesel exhaust contains a variety of harmful gases and over 40 other known cancer-causing compounds. In 1998, California identified diesel particulate matter as a toxic air contaminant based on its potential to cause cancer, premature death and other health problems. An ARB investigation revealed that between January 1, 2010 and September 30, 2011, the company sold 100 catalytic converters not permitted for sale or use in California. “Since their widespread adoption in the 1970s, catalytic converters have drastically reduced smog-forming emissions,” said ARB Enforcement Chief James Ryden. “They are a vital weapon in the fight for clean air, and they must meet California’s strict standards.” Aftermarket catalytic converters for on- and off-road vehicles must be approved by ARB to be advertised, sold, offered for sale or installed in California. Enforcement of these regulations not only protects the environment and public health, but also guards against unfair business practices. Faulty catalytic converters may result in smog check failures, which lead to expensive repairs for customers, and can jeopardize registration with the Department of Motor Vehicles. The settlement will be paid in monthly installments to the California Air Pollution Control Fund, which supports projects and research to improve the state's air quality. Smog is a combination of smoke and other particulates, ozone, hydrocarbons, nitrogen oxides and other chemically reactive compounds which, under certain conditions of weather and sunlight, may result in a murky brown haze. The primary source of smog in California is motor vehicles. These emissions may exacerbate respiratory ailments and negatively affect other serious health conditions. ARB provided a two-month extension from the original January 31, 2012, reporting deadline to give fleet owners more time to submit their information before widespread enforcement of the regulation begins. “We encourage all business owners to act immediately and contact us now with any questions. Waiting until the last minute – or even a few days before the deadline – should be avoided since our information hotlines are already extremely busy,” said Tony Brasil, Chief of the Heavy Duty Diesel Implementation Branch. Truck owners can report their fleet information online by visiting www.arb.ca.gov/truckstop. The March 30 deadline does not extend to particulate matter (PM) filter and other compliance requirements that began January 1, 2012. The Truck and Bus Regulation provides flexibility for owners of heavier trucks and buses (those with a Gross Vehicle Weight Rating greater than 26,000 lbs.) with several options to reduce diesel emissions. They can: Follow a schedule that requires 1996-1999 model year engines be retrofitted with a diesel PM filter by January 1, 2012, with truck replacements starting January 1, 2015 for older trucks (this option has no reporting requirements). Delay installing a particulate filter on 1996-1999 trucks that have a Gross Vehicle Weight Rating of more than 26,000 lbs. if they own a small fleet. A small fleet is one that has 1 – 3 vehicles with a GVWR of more than 14,000 lbs. (Truck owners must report to take advantage of this option.) Take advantage of other flexible compliance options in the regulation for vehicles with a GVWR of more than 26,000 lbs. (Truck owners must also report to utilize these options.) Release #:12-16 Date:04/25/2012 ARB PIO: (916) 322-2990 CONTACT: Dimitri Stanich 916-322-2825 dstanich@arb.ca.gov Shipping companies fined $111,000 for air quality violations Failed to use cleaner fuel when near California coast SACRAMENTO - The California Air Resources Board announced today that it has fined Dojima Marine and Korkyra Shipping $55,500 each for failing to use cleaner-burning fuel when less than 24 nautical miles from California’s shores. “Burning dirty bunker fuel produces unacceptable amounts of particulate matter and sulfur dioxide,” said ARB Enforcement Chief James Ryden. “Requiring ships to burn cleaner fuel provides significant benefits for California’s coastal communities by reducing asthma triggers and airborne carcinogens.” Dojima Marine and Korkyra Shipping cooperated and acknowledged that their individual ships operated in regulated California waters using heavily polluting bunker fuel rather than the required cleaner marine distillate. The money will go to the California Air Pollution Control Fund to support projects and research to improve the state's air quality. The clean fuel requirement, adopted in 2008, reduced diesel-particulate matter from ships blowing over the state by 15 tons per day, an 83 percent reduction of the previously uncontrolled emissions from ships. The required shift to cleaner fuel also cut sulfur oxide emissions by 40 tons per day, a 95 percent reduction, and nitrogen oxide emissions by 11 tons per day, a 6 percent reduction. In 1998, ARB identified diesel particulate matter as a Toxic Air Contaminant based on its potential to cause cancer and other health problems, including premature death and a number of heart and lung diseases. Exposure to diesel PM is a health hazard, particularly to children whose lungs are still developing, and the elderly who may have other serious health problems. Health risks from diesel PM are highest in areas of concentrated emissions, such as near ports, rail yards, freeways, or warehouse distribution centers. Small fleets consist of 20 or fewer box-type trailers and can include both dry- and refrigerated-van trailers. “We have worked hard to streamline the reporting process and make it as convenient as possible for business owners,” said Stephan Lemieux, manager of ARB’s on-road heavy duty diesel section. “By providing the necessary information well in advance of the July 1, 2012 deadline, small fleet owners will avoid the usual last-minute registration rush. They will know with certainty that they have flexibility in complying with the rule and can take more time to meet its requirements if they need to.” Currently, all 2011 and newer trailers must comply when used in California, with certain exceptions. Small fleet owners of 2010 and older model year trailers may choose one of two methods to bring their trailer fleets into compliance. They can: * Ensure their fleet is equipped with U.S. EPA “SmartWay” verified aerodynamic equipment on their trailers, including side skirts and trailer tails, by January 1, 2013, or * They may report by July 1, 2012 to take advantage of the optional phase-in plan, which allows small fleets four years to comply. Regardless of which method owners choose, they must also install fuel efficient, low-rolling resistance tires on their trailer fleets by January 1, 2017. Aerodynamic technologies such as those included in the SmartWay program are designed to help reduce fuel consumption, saving owners money and helping to reduce our nation’s dependence on foreign oil. The program will deliver anticipated savings of about three billion gallons of diesel fuel by 2020 from nationwide operations. As a result, fleet owners can expect to see a quick return on their investment in trailer aerodynamic equipment and fuel efficient tires within one year at current diesel fuel prices, if they travel 100,000 highway miles per year. The rule is also expected to help combat climate change by reducing carbon dioxide emissions nationwide by 33 million metric tons by 2020. The Air Resources Board will consider the proposed regulations at its regular meeting on June 28, 2012. “Linking with Quebec is a significant advance in California’s efforts to fight climate change and steer our economy toward a clean energy future,” said ARB Chairman Mary D. Nichols. “Linking provides more options to California businesses and lays the groundwork for other partners to join with us. This sends a strong message to two national governments that now is the time to support innovation, energy efficiency and the development of clean technologies.” “Climate change is a global issue that must be addressed by all levels of government. By being among the first in North America, with California, to participate in the carbon market, our businesses will be in good shape to excel in a carbonless economy,” said Quebec minister for Sustainable Development, Environment and Parks, Pierre Arcand. “The cap-and-trade system is acknowledged as one of the most efficient and least costly economic tools available to reduce greenhouse gas emissions and is an important instrument in our transition to a green and prosperous economy. Quebec is optimistic that its linking with California will be followed by many other partners. ” he added. The proposed linkage is another indication of the wide range of action taking place in the international arena as an increasingly large number of other states and nations are taking steps to fight climate change and reduce greenhouse gases. Starting next year 34 emissions trading programs will serve as the primary vehicle to drive greenhouse gas reductions in Norway, Iceland, Switzerland, Australia, New Zealand and 27 European Union members, along with California and Quebec. South Korea’s program will begin in 2015. Just last month Mexico also passed climate change legislation. California’s cap-and-trade program, adopted in October, 2010 was designed to link with other cap-and-trade programs. Over the past five years California has been working with several states and Canadian provinces within the Western Climate Initiative on approaches to linking their emission trading. AB 32 called for regional associations. It is expected that in the future other partners, notably Ontario and British Columbia may join. Quebec is the first to be proposed for linkage as its own program is sufficiently advanced and has equally rigorous reductions and reporting rules as California. Quebec has roughly one-sixth the amount of greenhouse gas emissions from industrial and other sources as does California. The draft linkage regulations provide guidelines to ensure that California and Quebec carbon allowances are interchangeable at auction and can be used for compliance purposes in one another’s programs. The regulations also provide joint, enforceable standards for development and use of carbon offsets, as well as a range of steps to ensure the security of the market. The proposed linkage regulations establish a sound framework for further investment in clean energy technology, businesses and jobs. By expanding the size of the carbon market, linking with Quebec will provide increased liquidity to the carbon market and provides businesses in California with additional benefits and more options. More capital in the market helps expand the investment framework, providing additional support for businesses to choose investment in clean technologies, helping transform California’s economy away from its dependence on fossil fuels and toward a clean energy future. ARB investigators found that the Imperial Irrigation District neglected to install particulate filters on its trucks, and to record smoke emissions, as required by California law. The district also failed to report its diesel equipment being used in off-road activities. “To preserve the quality of California’s air, we must all work to curtail the emissions of diesel-powered vehicles,” said ARB Enforcement Chief James Ryden. “Businesses and public agencies alike are held to the same standards.” The ARB requires all operators of diesel equipment to: Install best available emissions control technology, based on the model year of the engine; Periodically test and record smoke emissions; and, Report all off-road vehicles in use, and label them with engine identification numbers. The Imperial Irrigation District has agreed to retrofit all vehicles, and submit proof of compliance to ARB. The district will also instruct employees operating diesel equipment to abide by idling regulations. Of the $45,000 paid, $34,000 will go to the California Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $11,000 will go to the Palomar Community College Foundation to support their diesel technology program and, specifically, instruction in diesel engine service and maintenance. Diesel exhaust contains a variety of harmful gases and over 40 other known cancer-causing compounds. In 1998, California identified diesel particulate matter as a toxic air contaminant based on its potential to cause cancer, premature death and other health problems. "We have known for years that black carbon hurts our lungs and shortens people's lives. The new science tells us that by controlling these compounds we can also make a significant difference in averting some of the worst effects of global climate change,” said Chairman of the California Air Resources Board Mary D. Nichols. Short-lived climate pollutants include black carbon (the black soot portion of health-damaging fine particle pollution), methane (the primary constituent of natural gas and also emitted by livestock), and hydrofluorocarbons (industrial chemicals used in refrigeration and air conditioning). Unlike carbon dioxide which stays in the atmosphere for about a hundred years, these three have a relatively short atmospheric lifetime ranging from a few days to a few decades. Even so, they tend to have strong and immediate global warming influences. Actions to reduce emissions of these short-lived climate pollutants will produce a relatively rapid reduction in their contribution to climate change. California has been addressing fine particle pollution from diesel engines over the past ten years to reduce health risks. Findings presented today indicated a fifty percent reduction of these compounds in ambient air over the past twenty years. “It is encouraging to see that ARB’s diesel regulations, while designed to improve public health are also addressing climate change,” added Nichols. California also has measures in place under AB 32 to reduce emissions from large commercial refrigeration units, an approach that reduces emissions of hydrofluorocarbons into the atmosphere. In addition, the findings presented today also support ongoing efforts by ARB to address methane emissions in the agricultural sector as part of a comprehensive energy strategy. A professor in the Department of Environmental Sciences and the Interdepartmental Program in Environmental Toxicology at University of California, Riverside, she joined the Air Pollution Research Center at UC Riverside as an Assistant Research Chemist in 1982. Dr. Arey’s area of expertise is the atmospheric chemistry of volatile and semi-volatile organic compounds, especially polycyclic aromatic hydrocarbons, an area in which she is one of the world’s leading authorities with nearly 100 journal publications on this topic alone (out of almost two hundred total). She is a member of the World Health Organization’s Task Group for Environmental Health Criteria, and participates in a working group for the International Agency for Research on Cancer evaluating carcinogenic risks to humans. For the last two decades Dr. Arey has been a UC Riverside graduate advisor to students who have successfully completed their degrees and are employed in pharmaceutical firms and regulatory agencies throughout the United States. Dr. Judy Chow – for her work in the area of science and technology: Dr. Chow has 35 years of experience and leadership as a research scientist. She is the Nazir and Mary Ansari Chair in Entrepreneurialism and Science and Research Professor in the Division of Atmospheric Sciences at the Desert Research Institute in Reno, Nevada. She joined DRI in 1985, after she received her Doctor of Science degree from Harvard University. Dr. Chow is internationally known for her expertise in characterizing and quantifying complex atmospheric particles, establishing analytical techniques and instruments for monitoring and analyzing the chemical composition of ambient PM2.5 and PM10, and for her communication and knowledge transfer in PM monitoring, analysis, modeling, and controls to state, local, and international applications. She has published more than 320 peer-reviewed articles and acted as editor and reviewer for numerous technical journals. Dr. Chow is founder and leader of the Environmental Analysis Facility of the Desert Research Institute. The facility assesses chemical and physical characteristics of airborne particles. She has designed measurement strategies for, and participated in, major health and exposure studies in Mexico, China, and the United States. Dr. Chow has been appointed to: the National Research Council's Board of Environmental Studies and Toxicology, the Department of Energy's Atmospheric Radiation Measurement Science Board, and the U.S. EPA Ambient Air Monitoring and Methods Subcommittee of the Clean Air Scientific Advisory Committee. Ms. Jananne Sharpless – for her work in the area of environmental policy: Ms. Sharpless has worked in the public policy arena for 35 years. She served as both Cabinet Secretary for the Environment - predecessor agency to Cal EPA - and Chair of the California Air Resources Board (ARB) between 1985 and 1991, and after the California Environmental Protection Agency was established, she continued her chairmanship of ARB until the end of 1993, and served as a California Energy Commissioner between 1994 and 1999. Ms. Sharpless currently operates a consulting firm, and is on the Board of Directors of the Western Electricity Coordinating Council. She has provided historic leadership on clean air and clean energy issues in California laying the groundwork for transitioning California to the next generation of clean alternative fuels and technologies. During her tenure at ARB, Ms. Sharpless was instrumental in the adoption of standards for cleaner-burning gasoline and low and zero-emission vehicles. In 1990, she presided over the adoption of the first Zero Emission Vehicle (ZEV) Mandate that required ZEVs be sold in California. For the past 18 years, she has served as Chair of the Health Effects Task Force of Breathe California as well as on the Advisory Board to UC Davis’s Institute of Transportation Studies. She served on the U.S. Department of Energy Advisory Board, Sacramento Transportation and Air Quality Collaborative, and the California League of Conservation Voters. Ms. Sharpless has received notable awards for her efforts: the Clean Air Award and the Phillip S. Tow Government Award from the American Lung Association; and the Clean Air Award from the South Coast Air Quality Management District; and, the Richard Beatty Mellon Award from the Air and Waste Management Association. The Haagen-Smit Clean Air Award was named after Dr. Arie Haagen-Smit, ARB’s first chairman, known to many as the “father” of air pollution control. SACRAMENTO: Today the Air Resources Board approved $27 million for its Air Quality Improvement Program, a statewide effort to provide incentives for the purchase of advanced-technology passenger cars and heavy-duty trucks. ARB will use the majority of those funds for its California Clean Vehicle Rebate Project to provide incentives for the purchase of zero-emission and plug-in hybrid passenger cars. Complementing this investment will be up to an additional $5 million dollars from the California Energy Commission. “This unique incentive program makes ultra-clean cars affordable for more Californians, helps slash smog-forming pollution and cuts greenhouse gas emissions. By expanding the market for the world’s most advanced technology vehicles California remains the global center for clean cars, and generates a wide range of new jobs to manufacture, service and fuel them,” said ARB Chairman Mary D. Nichols. There will also be an additional $10 million in incentives for hybrid and zero-emission trucks and buses. Another $2 million of funding will be used for advanced-technology demonstration projects supporting the commercialization of new vehicle and equipment technologies to help pave the way for healthier air for California. Since this program began in 2008 there have been more than 7,500 passenger cars and over a thousand trucks or buses that have received incentives through the Air Quality Improvement Program. The program is designed to accelerate the number of ultra-clean vehicles sold in California and help establish a sustainable market. The program also supports the comprehensive Advanced Clean Car regulation ARB adopted earlier this year. That regulatory package builds on California’s already tough standards to reduce smog-forming and greenhouse gas emissions, including a separate requirement that one in seven new cars sold in 2025 in California be zero emission. SACRAMENTO - The California Air Resources Board today approved amendments to the state’s cap and trade program to enhance efficiency and further increase market security. The main changes clarify the required information and procedures involved in registering for the program. The changes add additional elements to ensure the identity of market participants, providing an increased measure of security to the program. Other amendments will help prevent theft of allowances, and provide more detail about how the auction and reserve sale will operate. The Air Resources Board also directed staff to take the necessary steps specified in the budget trailer bill legislation adopted yesterday to enable California to link its cap and trade program with Quebec’s. The trailer bill requires findings by the Governor regarding the stringency of Quebec’s program. “We are satisfied that Quebec’s cap and trade program is as stringent as California’s, and we will continue to work toward linkage with all deliberate speed, making sure we fulfill all the conditions of the language in the trailer bill,” said Air Resources Board Chairman, Mary D. Nichols. Taking this additional step will not affect the timing of California’s program roll out, with the first California cap and trade auction taking place on November 14, 2012. The two-month extension pertains to owners of 20 or fewer 2010 and older model year 53-foot or longer box-type trailers that operate on California highways. Small fleets can include both dry and refrigerated van trailers. “While we have granted businesses more time to report their data, we are still encouraging owners to register as soon as they have gathered the necessary information,” said Stephan Lemieux, manager of ARB’s on-road heavy-duty diesel section. “We have made the process as user-friendly as possible, so there is no reason to put it off until the last minute.” Small fleet owners of 2010 and older model year trailers may choose one of two methods to bring their trailer fleets into compliance. The deadline extension applies to the second option, below. Owners can: Ensure their fleet is equipped with United States Environmental Protection Agency “SmartWay” verified aerodynamic equipment on their trailers, including side skirts and trailer tails, by January 1, 2013, or They may report by September 1, 2012, to take advantage of the optional phase-in plan, which allows small fleets up to four years to comply. Regardless of which method owners choose, they must also install fuel efficient, low-rolling resistance tires on their trailer fleets by January 1, 2017. For a list of accepted SmartWay verified equipment and to learn more about the SmartWay program, fleet owners can visit U.S. EPA SmartWay Equipment. To report online at Tractor-Trailer GHG Reporting, owners will need to have some key information handy, including the trailer vehicle identification numbers, makes and model years, and license plate numbers. For refrigerated van trailers, the transport refrigeration unit (TRU) model year and engine model year are both required. Aerodynamic technologies such as those included in the SmartWay program are designed to help reduce fuel consumption, saving owners money and helping to reduce our nation’s dependence on foreign oil. The program will deliver anticipated savings of about three billion gallons of diesel fuel by 2020 from nationwide operations. As a result, fleet owners can expect to see a quick return on their investment in trailer aerodynamic equipment and fuel efficient tires within one year at current diesel fuel prices, if they travel 100,000 highway miles per year. The investigation of these violations was conducted with the U.S. Environmental Protection Agency and the U.S. Department of Justice based on similar conduct outside of California. The settlement calls for the Illinois-based company to pay a total of $2.55 million in penalties nationwide for violations of the Clean Air Act. California’s $510,000 portion is based on its share of the engines sold. Caterpillar, which manufactures construction equipment and diesel and natural gas engines, also agreed to recall and correct noncompliant engines and to reduce excess smog-forming and diesel emissions. Caterpillar recalled the affected engines from August 2002 to April 2005. In 2010, in accordance with the federal Consent Decree, the company reopened and continued the recalls until December 31, 2011. The federal government’s claims were resolved in 2011. The state’s recent agreement concludes California’s portion of the investigation. “This was a complex case that demonstrates successful cooperation between different agencies with overlapping jurisdictions,” said ARB Executive Officer James Goldstene. “The result is cleaner air and the assurance that a major player in this competitive manufacturing field is now playing by the appropriate rules.” In addition to shipping engines without proper emission controls, Caterpillar also failed to comply with reporting and engine-labeling requirements. Release #:12-30 Date:07/06/2012 ARB PIO: (916) 322-2990 CONTACT: Dimitri Stanich 916-322-2825 dstanich@arb.ca.gov Lawson Products settles air quality violations with $126,000 Consumer products manufacturer self-reports violations; steps up to rectify problems SACRAMENTO - The Air Resources Board today accepted $126,000 from Lawson Products to settle clean-air violations caused by the company’s sales of consumer products that exceeded the legal limits of smog-causing and toxic air contaminants. Lawson discovered the non-compliant products during an internal -audit in 2009, reported the infractions to the ARB, and worked with the state agency to assure no other violations would occur. “While the illegal emissions are regrettable, the efforts made by Lawson to fix the problems are commendable,” said ARB Enforcement Chief Jim Ryden. “We took the company’s forthright behavior into account in assessing the final settlement.” In the 2009 audit Lawson, which is based in Chicago, discovered several products they sold in California did not comply with state clean air regulations for so-called volatile organic compounds and toxic air contaminants. Lawson supplies chemical, automotive and specialty coating products for commercial, institutional, and maintenance, repair and operations customers. Further examination coordinated with the ARB revealed more violations. Because the company reported the issues to the ARB, however, the penalty was significantly reduced. State regulations limit use of volatile organic compounds because when mixed with other pollutants and exposed to sunlight they can create ozone and particulate matter, the main ingredients of smog. Both ozone and particulate matter are a health threat exacerbating cardiopulmonary diseases. Toxic air contaminants are compounds recognized by the state as causing or contributing to an increase in deaths or serious illnesses, or posing hazards to human health. Health effects occur at extremely low amounts and it is typically difficult to identify levels which do not produce adverse health effects. For this reason these compounds are banned from use in consumer products. ARB reduces emissions of volatile organic compounds and toxic air contaminants from the widest possible range of sources in order to comply with the federal Clean Air Act. To date, ARB consumer-product regulations have eliminated 225 tons per day of volatile organic compound emissions compared to 1990 levels. However, ARB estimates that emissions from consumer products continue to produce 245 tons per day, about 12 percent of the state’s total burden of these smog-forming compounds. That step is registration in the Compliance Instrument Tracking System Service, or CITSS (pronounced ‘kits’). CITSS will track each allowance when it is purchased, traded, resold and finally retired by a regulated party to meet its greenhouse gas reduction obligation. A tracking system account is also needed in order to participate in the upcoming auction of greenhouse gas allowances. Each carbon allowance is a permit to emit one metric ton of carbon dioxide, the most prevalent greenhouse gas. The auction, to be held in November 2012, is part of the program developed under AB 32 to reduce greenhouse gas emissions by the state’s largest industries, and energy generators and importers. Starting in 2013, some 600 facilities around the state will need to comply with the cap-and-trade regulation. Facilities must hold a sufficient number of allowances to cover their annual greenhouse gas emissions through 2020. Since the total number of allowances issued drops by between two and three percent each year, overall emissions throughout the state will also drop. The decision as to how to reduce its greenhouse gas emissions is left up to each facility, providing maximum flexibility while also driving innovation in clean energy technologies. The initial registration function announced today will be followed in September by the next phase in the tracking system: the ability for ARB to create and distribute allowances in CITSS, and for registered account holders to transfer allowances between CITSS accounts. Preparations are now underway for a practice auction in August to test the elements of the auction platform and its related systems, including the CITSS registration system. The first auction will be held on November 14, 2012. All those wishing to participate in the November auction must register in CITSS no later than August 1, 2012 in order to allow adequate time for their registration to be processed. The province of Quebec is paralleling California’s action today by turning on a CITSS registration program for regulated facilities and interested parties for its provincial cap and trade program. "Our goal this month is to do everything in our power to make sure truckers know the rules and that they understand how to comply," said ARB Executive Officer James Goldstene. "All our diesel regulations were adopted with one thing in mind - protecting public health. Focusing on enforcement gives us the chance not only to educate drivers on why the regulations are important but also to ensure that truck owners investing in cleaner equipment are on a level playing field with those who are not playing by the rules.” State measures aimed at cleaning up diesel vehicles include requirements to report fleet information to ARB, employ fuel-saving technology, install diesel soot filters and replace or upgrade aging engines and transport refrigeration units. Working in conjunction with the California Highway Patrol and other allied agencies, ARB will deploy inspectors throughout the state, focusing on trade hubs, weigh stations, ports, railyards and major points of entry into the state. The campaign is also geared to provide advice and educational materials including information and fact sheets on how to follow regulations, maintain equipment properly, and grants and funding that may be available now and in the future to help purchase clean trucks and related equipment. Sacramento-Californians can now locate the major sources of greenhouse gases and easily examine the emissions of each facility with a new mapping tool introduced today by the Air Resources Board. “Knowing the exact quantity of greenhouse gas every major source pumps into the atmosphere is the foundation of an effective cap-and-trade program,” said Mary D. Nichols, ARB Chairman. “Thanks to our rigorous reporting program we know the amount of greenhouse gases each source emits down to the ton. This new application provides an easy way to pinpoint those sources on a map, and allows everyone to see at a glance how it compares to other facilities in the same county, or throughout the state.” The new application links ARB’s database of the state’s largest sources of greenhouse gases with Google’s mapping technology, including satellite photography that shows details of each facility. The Google Earth module features a graphic representation of the relative size of each facility’s annual greenhouse gas emissions in relation to others throughout the state. The application allows viewers to choose which sources they wish to see by sector (such as only choosing cement manufacturers, refineries, or power stations) and also displays specific counties, air basins and air districts. The application also shows six out-of-state facilities that provide some of the electricity imported into California. The United States Environmental Protection Agency recently released a national mapping tool to display major greenhouse gas emitters, however, that application does not yet feature the Google Earth capabilities. For the past three years, some 625 facilities in California with emissions exceeding 25,000 tons of greenhouse gas emissions a year have been reporting their annual emissions to ARB. The results are independently verified by greenhouse gas emissions verifiers, trained and accredited by ARB. (California’s is the only system in the nation to require third-party verification of greenhouse gas reporting.) This accurate and verified mandatory emissions reporting is the foundation of California’s cap-and-trade greenhouse gas emissions reduction program. The total number of tons of greenhouse gas emissions each company reports is equivalent to the number of permits (known as allowances) it must provide to ARB. In the beginning of the program, starting in 2013, the majority of those allowances are provided by ARB free of charge. The remainder needed to cover a company’s annual emissions can be bought at an auction held four times each year by ARB, or on the open market where companies that have made reductions offer surplus allowances for sale. Over time, the total number of allowances ARB issues drops about two or three percent from one year to the next. This effectively limits and then lowers year over year the amount of greenhouse gases that all the major sources in the state can emit. Accurate and verified reporting demonstrates precisely how companies statewide are meeting the lowered cap on emissions. SACRAMENTO: Today the Air Resource Board’s Office of Emergency Response showcased the agency’s ability to assist California’s emergency and public-health officials confronting air-quality emergencies. ARB has on-call a mobile emergency air-monitoring team dedicated to reducing public health threats from air-quality emergencies. These air-quality experts are trained to use advanced modeling tools and specialized mobile air-monitors to quickly and accurately assess toxic threats caused by explosions and fires. “ARB’s chemists, meteorologists and engineers stand ready on a moment’s notice to provide minute-by-minute air-quality monitoring to help local officials develop tactical emergency responses, and protect public health,” said ARB Chairman Mary D. Nichols. In the past ARB’s emergency response team has been used during gas pipeline explosions as well wildfire assessments. It is expected to be used more frequently in the future. A recent study released by the California Energy Commission finds that, due to climate change, the state can expect extreme weather that will contribute to more severe fire seasons. Knowledge of what is in the plume of smoke and which direction the wind is carrying it can make evacuation and shelter decisions more targeted and effective. ARB’s emergency response team will also serve those responding to industrial accidents and fires. The team, in coordination with California’s emergency management structure, will assist by capturing air samples, determining their contents, recommending protective measures, and accounting for wind direction to identify evacuation areas. The funding is provided through a program that provides small businesses with financial assistance to obtain loans or lease-to-own arrangements so they can purchase newer, cleaner trucks ahead of schedule for state clean truck and bus regulations. “The success of this program means that truck owners are serious about using the financing options available to them to prepare for the truck regulations we have in place,” said ARB Chairman Mary D. Nichols. “California residents get to enjoy cleaner air and more hardworking truckers are prepared to comply with ARB’s clean air regulations.” “Reaching the $100 million mark represents a milestone in providing truckers with an affordable way to reduce emissions, increase fuel efficiency and save themselves money,” said State Treasurer Bill Lockyer. “We have helped diesel truck owners through our loan guarantee program that may not have otherwise received financing to upgrade their vehicles. It’s a win-win for truckers and the environment.” The loan assistance program provides loans and lease-to-own opportunities (known as Terminal Rental Adjustment Clause or ‘TRAC’ leases) to the small business owner that has 100 or fewer employees and generates $10 million or less in annual revenue primarily in California. The program—officially known as “Providing Loan Assistance for California Equipment” or PLACE provides additional funding opportunities to small businesses in today’s tight credit market. So far the program has been instrumental in issuing 1,511 purchasing loans and 88 leases, totaling 1599 financing agreements. These funds helped purchase 1,671 clean trucks and 183 exhaust retrofits (installing special filters on older trucks that capture 85 percent of the soot in the exhaust). The loan guarantee programs are designed to assist truckers who are prepared to comply ahead of schedule for two separate regulations: the statewide clean Truck and Bus regulation; and the Heavy Duty (Tractor Trailer) Vehicle Greenhouse Gas Reduction regulation. Both were adopted in 2008 and are part of the state’s overall commitment to cut toxic diesel emissions 85 percent by 2020. Diesel Exhaust contains a variety of harmful gases and over 40 other known cancer causing compounds. California identified diesel particulate matter as a toxic air contaminant based on its potential to cause cancer, premature death and other health problems. The California Air Resources Board today announced that Ryder System, Inc., a provider of transportation and supply chain management solutions, paid $1,000,000 for failure to conduct testing and maintain complete records of required annual opacity tests on heavy-duty vehicles in its California fleet in 2008 and 2009. Annual opacity tests, performed to determine whether a truck produces visible smoke from its exhaust, and related record-keeping are required under California law. Records reviewed by ARB enforcement staff indicated that Ryder failed to conduct tests and maintain records of the tests on vehicles that were in service for four or more years. This was Ryder’s first ARB violation in its 53 years of operating in California. The one-million dollar settlement ($1,031,000 precisely) is in two parts. The first, a $773,000 payment, will go to the California Air Pollution Control Fund, established to mitigate various sources of pollution through education and the advancement and use of cleaner technology. The remaining $258,000 will fund investments to upgrade a maintenance facility to service trucks that are powered by natural gas. The maintenance facility, located in West Sacramento, will be open to the public for use by commercial transportation fleets. “Strong processes and proper documentation demonstrating compliance with the State of California’s regulations are essential to verifying that all businesses are complying with the law,” said ARB Enforcement Chief James Ryden. “Ryder has a long history of working collaboratively with our organization to ensure environmental compliance of its operations in California. The Air Resources Board announced today that its month-long multi-agency campaign to ensure that trucks traveling on California’s roadways are obeying state air pollution laws was a huge success. With assistance from the California Highway Patrol, Caltrans and the California Department of Food and Agriculture, ARB staff inspected 4,053 trucks at roughly 40 locations throughout the state during August, noting an overall compliance rate of more than 80 percent. Trucks were inspected for compliance with many air pollution laws including those requiring owners of certain model year vehicles to install diesel soot filters to reduce harmful diesel emissions. In particular, for 1996-1999 model year trucks – the first model years required to currently be in compliance under the comprehensive Truck and Bus regulation passed in 2008 – the compliance rate was 90 percent. This includes those truck owners who met the regulatory requirements by either registering their vehicles with ARB to take advantage of flexibility in the regulation, or who had already installed diesel soot filters. “We’re pleased to see such a high level of compliance,” said ARB Executive Officer James Goldstene. “While ARB will continue to dedicate significant resources to assist fleets in complying with California’s clean truck requirements, owners and operators should understand that our enforcement efforts will continue throughout the year, and that our goal is to make every month a ‘clean truck month.’ The word is out that ARB is fairly enforcing these critically important regulations and working to ensure a level playing field for everyone in the trucking industry.” Overall, a total of 817 citations were given during the four-week effort. Of that total, 212 were for violations of the Transport Refrigeration Unit rule, 191 for non-compliance with the Bus and Truck rule, 187 for idling infractions, and 174 for Emissions Certification Labels violations. To help educate drivers and reinforce the importance of obeying air pollution laws and proper vehicle maintenance, ARB staff distributed more than 4,600 information packets in English and Spanish. The month-long effort received extensive media coverage, with a focus on the enforcement efforts in Fresno, Otay Mesa (at the Mexican border) and the Port of Oakland. ARB experts were interviewed on mainstream radio and television newscasts, on a variety of satellite radio programs geared toward truckers, in local newspapers and in trade press publications popular in the trucking industry. In all, news media and online sources produced 37 stories about the effort. Environmental groups, community organizations and industry all expressed support for “Gear Up for Clean Truck Month,” lauding its goals to enforce a wide range of mobile source regulations all focused on cleaning up diesel emissions, improving air quality and protecting public health in the most feasible cost-efficient manner. Vehicle owners may want to take note of impending deadlines in order to place equipment orders and prepare for compliance with a variety of regulations. Deadlines coming up quickly for diesel vehicles include: December 31, 2012: • Transport Refrigeration Units with 2005 model year engines must be replaced with Ultra-Low-Emission TRUs. January 1, 2013: • Under the Truck and Bus regulation, diesel truck fleets must either install diesel soot filters (or upgrade equipment) on trucks with 2000 to 2004 model year engines or meet phase-in option requirements. • For vehicles covered under the Drayage Truck Regulation, 2005-2006 engine model year trucks greater than 33,000 lbs. gross vehicle weight rating must have diesel soot filters. • Tractor-Trailer Greenhouse Gas regulation: - Fleets with 20 or fewer affected trailers must register if they want to use a compliance option that will allow them up to four additional years to participate in the Small Fleet Compliance Plan. - Low-rolling resistance tires are required for 2010 model year and older tractors that pull 53 foot-long box-type trailers. - SmartWay aerodynamic requirements must be met by all 53-foot or longer box-type trailers not using a phase-in option. Of that total, 212 were for violations of the Transport Refrigeration Unit rule, 191 for non-compliance with the Bus and Truck rule, 187 for idling infractions, and 174 for Emissions Certification Labels violations. To help educate drivers and reinforce the importance of obeying air pollution laws and proper vehicle maintenance, ARB staff distributed more than 4,600 information packets in English and Spanish. The month-long effort received extensive media coverage, with a focus on the enforcement efforts in Fresno, Otay Mesa (at the Mexican border) and the Port of Oakland. ARB experts were interviewed on mainstream radio and television newscasts, on a variety of satellite radio programs geared toward truckers, in local newspapers and in trade press publications popular in the trucking industry. In all, news media and online sources produced 37 stories about the effort. Environmental groups, community organizations and industry all expressed support for “Gear Up for Clean Truck Month,” lauding its goals to enforce a wide range of mobile source regulations all focused on cleaning up diesel emissions, improving air quality and protecting public health in the most feasible cost-efficient manner. Vehicle owners may want to take note of impending deadlines in order to place equipment orders and prepare for compliance with a variety of regulations. Deadlines coming up quickly for diesel vehicles include: December 31, 2012: • Transport Refrigeration Units with 2005 model year engines must be replaced with Ultra-Low-Emission TRUs. Authorized by AB 2289 (Eng, 2010), the new test takes advantage of the advanced monitoring On-Board Diagnostic (OBD) systems that are standard equipment on all newer vehicles. Instead of measuring tailpipe emissions while simulating driving conditions in a shop, the new test will review OBD data collected during actual operation to identify vehicles with high emissions. “By utilizing the On-Board Diagnostic system already built into all newer cars, owners can be assured that they are getting the most accurate measure of their vehicles condition at the lowest possible cost,” said ARB Chairman Mary Nichols. “The move away from tailpipe testing and the expensive equipment required by shops will benefit consumers, service providers and the environment.” Older vehicles will continue to be inspected using tailpipe emissions but stations will be subject to new performance and evaluation standards. Only stations meeting the tough new standards will be rated as “STAR Certified” and permitted to inspect 1999 and older vehicles. The changeover to the new testing requirements will take place over the next year: Starting January 1, 2013: • All 1999 model-year and older vehicles (the model years most likely to have high emissions) will be directed to new STAR inspection stations. September 1, 2013: •All 2000 model-year and newer vehicles will be inspected using the OBD-based test. As part of the report on the new Smog Check program, the Board also reviewed the effectiveness of the state’s voluntary vehicle retirement programs. These programs, administered by the Bureau of Automotive Repairs and local air pollution control districts, provide financial incentives to scrap older vehicles and vehicles that require costly repairs. Over the past two fiscal years, these programs have resulted in the retirement of over 82,000 high emitting vehicles. Retiring older vehicles is an important tool in California’s air quality efforts as vehicles that are over 20 years old account for only 6% of all miles traveled but are responsible for over 40% of daily smog forming emissions. PIO Contact: Stanley Young syoung@arb.ca.gov 916-322-2990 916-956-9409 (cell) A study of 40 child care facilities in California found that the levels of most pollutants were similar to those measured in other studies of California schools and residences and generally considered below the levels of health concern. That included levels of pesticides. A few chemicals exceeded health guideline levels, especially formaldehyde, but there are a variety of simple steps that can significantly lower exposure to them. “This first-of-its-kind study helps point to relatively simple actions child care facilities can take to minimize exposure to contaminants," said ARB chairman Mary D. Nichols. "Thanks to actions by ARB over the past four years, child-care centers can also be assured of finding furniture and wood products that fully comply with regulations that limit or eradicate formaldehyde in their manufacture." The study is notable because it is the first to provide a detailed analysis of environmental contaminants and exposures for children in daycare centers. The comprehensive study of twenty daycare centers each in Alameda and Monterey counties was carried out by Asa Bradman and his research team from the Center for Environmental Research and Children’s Health at UC Berkeley. Field work was conducted in 2010 and 2011. The measurements included indoor air monitoring along with an analysis of floor dust samples from each facility. Thirty-five of the facilities had levels of formaldehyde that exceeded California health guidelines. Furniture and building materials made from composite wood products such as hardwood plywood, particleboard and medium density fiberboard are typically the primary indoor sources. Those sources are currently being addressed by ARB’s regulation, adopted in 2008, which set the toughest standards in the world for the amount of formaldehyde released from composite wood sold or used in furniture in California. Because of the phasing in of the regulation and allowance for sell-through of older products made with those composite wood materials, some products sold since 2008 may still emit relatively high levels of formaldehyde into indoor spaces. To reduce exposure in future construction or when purchasing new furnishings, however, consumers should look for furnishings and building materials certified as “California 93120 Compliant-Phase 2”, or California certified as ULEF (ultra-low-emitting formaldehyde) or NAF (no added formaldehyde). Formaldehyde is also found in many other sources in indoor settings, including some carpets and carpet pads; paints and coatings; permanent press clothing, furniture fabrics, and draperies; personal care products; and indoor combustion sources such as gas ranges and fireplaces. To further reduce levels of indoor formaldehyde, request and purchase products which contain little or no formaldehyde. The use of ventilation systems and opening windows also helps reduce indoor levels of formaldehyde and contaminants released from some cleaning products. Particle levels were elevated in the air in some facilities, and lead was found in floor dust, although not at levels expected to contribute to lead poisoning. Acetaldehyde was elevated in the air samples of some facilities, as were some cleaning product chemicals. Additional steps that child care facilities can take to reduce indoor air exposures are: • Clean frequently to minimize dust, using a vacuum cleaner with a HEPA filter or a wet mop for hard surface floors. This helps to reduce both the larger airborne particles and floor dust contaminants such as lead and flame retardants, as well as allergy and asthma triggers such as pollen and dust mite particles. • Clean out cabinets and garages to eliminate older pesticides, solvents and cleaning products that may leak, in order to help reduce indoor levels of pesticides and harmful chemicals. • Assure adequate ventilation to bring in outdoor air. Birchwood sold Casey Gun Scrubber Solvent/ Degreaser in California. The product exceeded the state’s limits for chemicals known as volatile organic compounds which contribute to the formation of smog. The product also contained trichloroethylene, a toxic air contaminant that is strictly prohibited from use in ‘General Purpose Degreasers’. “ARB is vigilant about ensuring that products sold to consumers in California meet the standards for smog-causing chemicals,” said ARB Enforcement Chief Jim Ryden. “It is equally important that the General Purpose Degreasers do not contain toxic chemicals.” The settlement of $500,000 will be paid in four installments of $125,000 directly to the California Air Pollution Control Fund as civil penalties. The first installment was paid in August with future payments due on or before the anniversary of the settlement. Nichols. “It is the culmination of two years of close cooperation with the Obama Administration to develop strong standards that will save consumers money at the pump, move us away from our dependence on petroleum and help clean our air.” The approved amendment, known as a “deem to comply” measure, acknowledges that the federal vehicle standard satisfies California’s requirements. Approval of the amendment marks the fulfillment of a commitment California made in the summer of 2011 to auto manufacturers and the Obama administration to accept the proposed federal standards as equivalent to its own. The greenhouse gas standards under the California Low Emission Vehicle (LEV III) standard, like the federal program, will be in effect for the 2017 through 2025 model years and are designed to reduce greenhouse gas emissions by 35 percent over that period. Many of the technologies that reduce climate change and tailpipe emissions also significantly improve fuel economy, which will result in these cleaner cars costing less to operate than today’s cars. The full package of California regulations, including tailpipe standards for smog-causing pollution and a mandate for specific numbers of zero emission vehicles will save California drivers $5 billion dollars in operating costs in 2025, and $10 billion dollars by 2030 when more advanced cars are on the road. In addition, in 2025, average consumers will see nearly $6,000 in fuel cost savings over the life of the car. As the new year begins, heavy duty trucks and buses (more than 26,000 lbs. gross vehicle weight rating) with 2000 – 2004 model year engines will likely need diesel soot filters as required by the state’s Truck and Bus Regulation. The rule is part of California’s Diesel Risk Reduction Plan, which includes a suite of regulations designed to reduce harmful diesel emissions from a wide variety of sources. In 2011, similar requirements took effect for 1996 – 1999 model year engines. There are exceptions (low-mileage or emergency vehicles, etc.), however, the majority of registered trucks and buses in this vehicle category will need to take steps to comply with the regulation. “Our efforts to reach out to the trucking industry have yielded positive results,” said ARB’s Enforcement Division Chief James Ryden. “We have enforcement and compliance assistance teams all over the state who regularly inspect vehicles and educate owners, and recently, we’ve been pleased to note a compliance rate of more than 80 percent.” Ryden specifically cited “Gear Up for Clean Truck Month” in August 2012, where teams of ARB and California Highway Patrol officers stepped up enforcement efforts and inspected more than 4,000 trucks at 40 different locations, including CHP weigh stations, random roadside areas, distribution centers, fleet facilities, truck stops and other sites where trucks and buses are present. Business owners should note that non-compliant vehicles (including out-of-state vehicles) may not be legally operated in California. Penalties start at a minimum of $1,000 per violation per month and will increase significantly over time. In addition, non-compliance can result in a Department of Motor Vehicle registration block on your truck or bus, and/or having your vehicle impounded by CHP until it is in compliance. Nichols. “They’ve driven public policy with their innovative ideas, and educated our communities on the importance of air quality. All three have achieved sustained results through excellence in engaging with the general public, stakeholders and experts to make significant contributions to cleaner air and a healthier California.” The 2012 recipients are: Mr. Tom Cackette – for his work in the area of environmental policy. Mr. Cackette has been with the ARB since 1982, and serves as its Chief Deputy Executive Officer, managing several of ARB’s key programs. Prior to coming to ARB, Mr. Cackette served as a legislative lobbyist for ARB and worked eight years for the U.S. EPA’s Motor Vehicle Emissions Laboratory in a variety of technical, management, and policy positions. He holds a Master’s of Science degree in Engineering. Mr. Cackette is most notably recognized for his guidance and perseverance in mobile source control regulations for the ARB, many of which have influenced national and international policies. These include Low-Emission Vehicle and Zero-Emission Vehicle regulations, as well as establishing heavy-duty vehicle standards with diesel manufacturers that dramatically reduced pollutants. Mr. Cackette was instrumental in establishing groundbreaking funding incentives to assist in the development and success of these regulations and standards geared to clean air vehicle technologies that continue California’s tradition of trailblazing clean transportation policies. His accomplishments have transcended geographical boundaries and his leadership and vision are embedded in the countries and continents where clean transportation policies carry California’s imprint. Though he is retiring from ARB this year, his work and passion to clean up air pollution from vehicles and improve California’s air quality will be a long-standing legacy. Ms. Andrea M. Hricko – for her work in the area of public education. Ms. Hricko is a Professor of Clinical Prevention Medicine at the Keck School of Medicine at the University of Southern California, as well as the Director of the Community Outreach and Education Program of the Southern California Environmental Health Sciences Center (a partnership between USC and UCLA.) Ms. Hricko also directs the Community outreach and Translation Core of the USC/UCLA Children’s Environmental Health Center. She has a Masters of Public Health from the University of North Carolina and has spent more than 40 years in the public health field. Her professional experience includes serving as Deputy Assistant Secretary for the U.S. Department of Labor’s Mine Safety and Health Administration. She is a contributing author for the journal Environmental Health Perspectives and an Emmy Award winning writer/producer of consumer and environmental stories for KCBS-TV in Los Angeles. Her current work involves environmental justice topics surrounding public health impacts from goods movement in the ports of Long Beach and Los Angeles. Ms. Hricko serves on the U.S. EPA National Environmental Justice Committee’s Working Group on Ports and Goods Movement, the Governor of California’s Cabinet-Level Goods Movement Action Plan Integrating Work Group and the Southern California Association of Governments’ Goods Movement Task Force. She is also the founder of “The Impact Project” a nationwide community academic partnership focused on reducing the health impacts of international trade. Ms. Hricko is an inspiration for empowering community-based organizations to educate their communities and local policymakers about health effects of air pollution and how to advocate for cleaner air and better land use decision making. Dr. Ronald O. Loveridge – for his work in the area of environmental policy. Dr. Loveridge has served on the Air Resources Board for eight years. He has been the Mayor of Riverside since 1994 and has served on the South Coast Air Quality Management District Governing Board since 1995. Before becoming Mayor, Dr. Loveridge was a member of the Riverside City Council from 1979 to 1994. He is also an Associate Professor in Political Science at the University of California Riverside, where he has taught since 1965. Dr. Loveridge has a Master’s and Doctorate in political science from Stanford University. Dr. Loveridge was President of the League of California Cities, and a member of the Regional Council of the Southern California Association of Governments. He has been honored by the American Lung Association for his leadership in protecting public health from air pollution. In 2005 he received the National Association of Regional Councils Tom Bradley Award for his outstanding leadership and commitment to improving transportation and maintaining the region’s preferred quality of life. As Mayor he implemented a Strategic Action Plan to make Riverside a Model Clean Air City in 2002. In 2005 Riverside was recognized with an annual award by the South Coast AQMD as a Model Clean Air Community. In 2005 he appointed a Clean Air Task Force for the city that in 2007 put forth a “Sustainable Riverside Policy Statement” detailing eight main directives including urban forestry, solar initiatives, alternative transportation modes, green building efforts, and water and air quality improvements. In 2009 Riverside was officially designated the first “Emerald City” by California Department of Conservation Director Bridgett Luther. Dr. Loveridge has been a long standing champion of plug-in electric vehicles and community readiness. As a member of both the Air Resources Board and the South Coast Air Quality Management District Governing Board, he played a key role as liaison between environmental groups, local governments, community residents and the railroads, helping to identify mitigation measures and resolve critical issues at high-risk rail yards. Dr. Loveridge is on the Advisory Board of the non-profit organization Riverside County, Clean Air Now, which since 1969 is the oldest most effective volunteer advocacy group for clean air in Southern California. The Haagen-Smit Clean Air Award was named after Dr. Arie Haagen-Smit, ARB’s first chairman known to many as the “father” of air pollution control. His research concluded that most of California’s smog resulted from photochemistry- the reaction of sunlight with industrial and motor vehicle exhaust to create ozone. This breakthrough became the foundation upon which today’s air pollution standards are based. An investigation revealed that Champion Brands supplied Champion Chain Lube Multi- Purpose Spray Grease, a consumer product that exceeded California’s limits for smog-causing pollutants, known as ‘volatile organic compounds.’ Some volatile organic compounds are known to cause cancer. The company also disclosed to ARB that an additional product, Champion Lube Spray Grease, also exceeded California’s limits for Multi- Purpose Lubricants. “We need to address every major source of pollution that contributes to smog formation,” said ARB Enforcement Chief Jim Ryden. “Companies must do their part to protect public health by complying with California law and limiting the amount of volatile organic compounds in the products they manufacture, and sell to consumers.” The settlement of $50,755 will be paid in four installments directly to the California Air Pollution Control Fund as civil penalties. On June 22, an initial payment of $12,688.75 was received following the signing of the settlement agreement. Three additional payments will be made prior to December 31, 2012. Champion Brands agreed that it would not sell, supply, offer for sale, or manufacture for sale in California any consumer product in violation of California’s air quality standards. Both products have since been reformulated to meet California’s regulations for multi- purpose lubricants. The Air Resources Board has also accredited specially trained third-party offset verifiers. "Today's announcement marks an important milestone in the progress of California's climate program,” said Air Resources Board Chairman Mary D. Nichols. “By authorizing real, permanent offsets from farms, forests, and businesses that are not covered by cap-and-trade, we can reduce the costs of compliance with the program and encourage investments in sustainable practices throughout the California economy." Carbon offsets reduce greenhouse gas emissions in sectors such as agriculture and forestry that are not included directly under the cap-and-trade regulation. For example, forests can be managed to ensure that they increase the total amount of carbon stored in the trees, thus removing additional carbon dioxide from the atmosphere. Each offset credit equals one metric ton of carbon dioxide and, if issued by the Air Resources Board, can be used by companies and facilities to comply with the cap-and-trade regulation for up to eight percent (8%) of each covered entity’s compliance obligation. In this sense, they are the equivalent of a California carbon allowance and, like those compliance instruments, can also be freely sold or traded. To meet the rigorous requirements of the cap-and-trade regulation every carbon offset credit must be ‘additional,’ that is, over and above any reductions already required by law or regulation. They must also be real, verifiable, quantifiable, enforceable and permanent. The Air Resources Board currently has approved protocols (methods of accounting to measure the number of tons of reductions achieved) for four types of offset projects: • Forestry • Urban forestry • Dairy manure digesters • Destruction of Ozone Depleting Substances Registries: Approved offset project registries are authorized to provide their services under the Air Resources Board compliance protocols. Those services include listing and reviewing projects and issuing registry offset credits which may later be submitted to the Air Resources Board for final evaluation and issuance of Air Resources Board compliance offset credits. The American Carbon Registry is based in Sacramento; the Climate Action Reserve is based in Los Angeles. Verification: The Air Resources Board has trained and certified more than 60 independent, third-party verifiers to serve as partners in evaluating the quality of any offset projects submitted for approval. Eleven verification bodies have also been certified. Verification is conducted by teams of accredited verifiers from accredited verification bodies. Verifiers must work through the accredited verification bodies. Accredited third-party verifiers have extensive backgrounds in related areas before they qualify for Air Resources Board training, including appropriate field and auditing experience as well as the scientific and engineering knowledge required for verification. Third-party verifiers must then go through Air Resources Board training and pass a specialized test. After the quantity of carbon offsets generated by a registered project is verified, the Air Resources Board reviews the findings prior to issuing compliance offset credits. If the Air Resources Board approves those offsets, they may be used to comply with California’s cap-and-trade regulation. He will replace Tom Cackette, who is retiring at the end of the year. “Alberto is a perfect fit for this demanding position,” said Goldstene. “He brings an exceptionally strong background in academic research and publications and has played a leadership role in ARB's world-renowned programs that have advanced automotive emissions control technology.” Dr. Ayala has more than two decades of managerial experience in the development and implementation of air quality monitoring and air pollution control measures, including a wide range of vehicle-related regulations. Most recently, Dr. Ayala was the Chief of the Monitoring and Laboratory Division where he was responsible for ambient air quality and GHG monitoring, measurement methods development, analysis of motor vehicle exhaust, and management of the vapor recovery program and ARB’s air emergency response efforts. He has also developed evaporative control regulations for several types of off-road equipment. In previous roles he conducted cutting-edge evaluations of heavy-duty diesel and natural gas engines, managed the Carl Moyer incentive program and developed a control program for motor vehicle air conditioning replacement refrigerants. Dr. Ayala received his Ph.D. in Mechanical Engineering from UC Davis, is an Adjunct Professor at West Virginia University, has published extensively, and is an active member of industry organizations such SAE International and the Coordinating Research Council. The 2014 Honda Plug-In Hybrid Accord produces only 20 milligrams of combined smog-forming emissions per mile. This makes it the first gasoline-powered car in California to meet what is known as the SULEV20 standard, the most stringent in the nation and one-third cleaner (in terms of smog-forming pollution) than the previous lowest state standard. In addition, this Honda model has lower greenhouse gas emissions than the fleet average standard required by all cars in 2025, the equivalent of a 50-percent reduction from current required levels. “Once again, Honda is the first to comply with ARB’s most stringent standard,” said Tom Cackette, ARB’s Deputy Executive Office and head of the mobile source program. “Honda has demonstrated that a dedicated commitment to the environment and advanced engineering at every level of the company can deliver the cleanest cars well ahead of schedule.” Honda has a history of being the first manufacturer to comply with California’s strict emission standards. In 1995, the 1996 Civic was the first certified Low Emission Vehicle (LEV) gasoline vehicle. In 1997, the 1998 Accord was the first ultra-low emission vehicle (ULEV) gasoline vehicle. The following year, in 1999, the 2000 Accord was the first certified Super Ultra-low Emission Vehicle (SULEV) gasoline vehicle. In 2001, the 2001 Civic GX powered by compressed natural gas was the first certified Advanced Technology Partial Zero-Emission Vehicle (AT PZEV). In 2002, the 2003 Civic Hybrid was the first certified Advanced Technology Partial Zero-Emission Vehicle. (AT PZEV) hybrid vehicle. The Executive Order allowing Honda to sell the newly certified ultra-clean cars in California was signed on December 21, following a detailed examination of emissions and performance test results. Honda began production of the car that same day. As a result of the advanced technology in its design, the full-size sedan model achieves 124 MPGe city / 105 MPGe highway in hybrid mode, and 47 MPG city / 46 MPG highway in standard (gas only) mode. The low emissions standards that this Honda model meets are part of the state’s Advanced Clean Cars package of regulations, adopted in January 2012, that will ensure increasingly cleaner cars for sale in the state, and provide for increased choices of zero-emission vehicles. When fully in force in 2025, the new set of standards will reduce smog-causing pollutants from low-emission vehicles 75 percent from current levels, and greenhouse gases by 34 percent. This will result in less overall vehicle emissions and cleaner air, along with more efficient cars that will ultimately require less fossil fuel to operate. An investigation by the ARB revealed that the transit district did not comply with the Transit Fleet Vehicle rule by neglecting to install legally required emission reduction devices by the appropriate compliance dates. In addition, the company failed to properly self-inspect their diesel trucks as required under the Periodic Smoke Inspection Program to assure the trucks met state smoke emission testing standards. “These programs are in place to allow businesses to hold themselves accountable,” said ARB Enforcement Chief Jim Ryden. “Clean air should be a priority for all businesses in California, including transit fleet operators.” Under the settlement agreement, the district agreed to pay $35,250.00 on October 25, with $26,437.50 going to the California Air Pollution Control Fund. The remaining $8,812.50 will go to Peralta Community College District to fund emissions education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology program. San Joaquin Regional Transit District also agreed that it would comply with the requirements of the Transit Fleet Vehicle rule and the Periodic Smoke Inspection Program. Contact: Dave Clegern Phone: 916-322-2990 dclegern@arb.ca.gov Sacramento—The United States Environmental Protection Agency today gave the green light to California to set in place its Advanced Clean Cars package of regulations. This sets the stage for a new generation of ultra-clean cars starting in 2017 that slash smog-forming and greenhouse gas emissions and pave the way for increased numbers of zero-emission vehicles through 2025 and beyond. Today’s announcement by U.S.E.P.A. also clears the way for other states covering up to 40 percent of new car sales nationally to adopt California’s standards as their own.. This will ensure that the latest technologies will further reduce smog-forming emissions nearly to zero and boost the numbers of zero-emission vehicles sold through 2025. “This decision by the federal government recognizes California’s important role under the Clean Air Act to set the toughest vehicle emissions standards in the nation, ,” said Air Resources Board Chairman Mary D. Nichols. “It also allows other states to adopt California’s package of clean car regulations, helping clean up the air and save consumers nationwide billions of dollars at the pump.” The Advanced Clean Car package includes the Low Emission Vehicle standard (LEV III) regulation, designed to reduce smog-causing pollutants in gasoline powered vehicles 75 percent by 2025 from 2017 levels. This standard will also reduce greenhouse gas emissions from those same vehicles by 34 percent, a figure that parallels federal regulations. California’s Zero Emission Vehicle (ZEV) standard will drive a shift from gasoline engines to a wider variety of fuel sources, including plug-in hybrids, electric and fuel cell vehicles. These vehicles approach or achieve zero greenhouse gas emissions. By 2025 the ZEV regulations are expected to put 1.4 million of these vehicles on the road in California, and make them 15 percent of annual new vehicle sales, with further dramatic growth expected through 2050 and beyond. The ZEV regulation keeps California at the forefront of the national effort to produce the cleanest cars. States continuing or adding California’s ZEV requirements will ensure their consumers get the latest plug-in hybrid and ultimately fuel cell vehicles that are revolutionizing the marketplace, and dramatically reducing greenhouse gas emissions. Cleaner cars mean cleaner air and a better environment. Cars are California’s largest source of air pollution and greenhouse gases. California’s Advanced Clean Car Program will continue to drive new vehicle technology, accelerating the next generation of clean cars that are already commercially available. Economically, California drivers will save $5 billion in operating costs in 2025, and $10 billion by 2030 when more advanced cars are on the road. In 2025, average consumers will see nearly $6,000 in fuel cost savings over the life of the car, nearly triple the estimated per vehicle cost. ARB PIO (916) 322-2990 CONTACT: Antonio Leaks aleaks@arb.ca.gov SACRAMENTO – The Air Resources Board announced that O’Reilly Automotive, a specialty retailer of automotive aftermarket parts, equipment and accessories, and Technical Chemical Company, a manufacturer of automotive chemicals and products, paid a combined total of $63,000 to settle clean air violations. Between December 2008 and May 2009, O’Reilly automotive sold O’Reilly Carb & Choke Cleaner, a consumer product that contained chemicals that contribute to the formation of smog that exceeded the limit for Carburetor Cleaners for cars in California. The product was manufactured for O’Reilly by Technical Chemical. Technical Chemical manufactured the product containing more smog-forming chemicals than permitted in California for sale outside the state, however, a labeling mistake led to the sale of the non-compliant product in California. Since O’Reilly and Technical Chemical were both responsible for the violation, the penalty was split between the two parties. “The Air Resources Board is diligent in taking the necessary actions to limit these smog-forming chemicals in automotive products that consumers use,” said ARB Enforcement Chief James Ryden. Under the settlement, a payment of $31,500 each from O’Reilly and Technical Chemical (half of $63,000 penalty) was paid directly to the California Air Pollution Control Fund as civil penalties. In addition, both companies agreed that they would not sell, supply, offer for sale, or manufacture for sale in California any consumer product in violation of California’s standards for carburetor cleaners.
