BACKGROUND: The California Cap on Greenhouse Gas Emissions and Market-Based Compliance Mechanisms Regulation was adopted by the California Air Resources Board in October of 2011 and formally went into effect January 1, 2012. Subarticles 13 and 14 of the regulation describe the compliance offset program and the approval of Early Action Offset Credits. Included in these subarticles is a requirement for third-party verification of all GHG emission reductions and GHG removal enhancements before any ARB offset credits may be issued. Only ARB accredited offset verifiers may provide offset verification services under the compliance offset program. Accordingly, ARB has established a program to accredit offset verifiers that meet the regulation’s requirements. To become an accredited offset verifier, the applicant must submit a completed Verifier Application to ARB along with the required documentation. Once the verifier applications have been reviewed by ARB and determined to have the potential to meet the minimum qualifications listed in the regulation, the verifier applicant will be notified how to register for ARB approved training courses. ARB and Future Perfect will conduct training on June 18-22 and June 25-29 in Sacramento, California. Future dates will be announced when available. California is working with WCI Partner jurisdictions and WCI, Inc. to develop systems to support the common goals of developing a regional program and the implementation of state and provincial GHG trading programs, including California’s cap-and-trade program. One of the systems being developed is the Compliance Instrument Tracking System Service (CITSS). The CITSS is the record of ownership of compliance instruments; records information related to accounts; enables and records compliance instrument transfers; facilitates compliance verification; and supports market oversight through the collection of relevant information. There are two primary components to the CITSS in the first release: user registration and account application. User registration is required in the CITSS prior to applying for entity compliance instrument accounts. Compliance instrument accounts must be established before an entity can apply to participate in the November GHG allowance auction. Today, July 9, 2012, the CITSS is being released for Cap-and-Trade User Registration and Compliance Instrument Account Application activities. The California Global Warming Solutions Act of 2006 (AB 32), which authorized the use of a market-based compliance mechanism such as a cap-and-trade program, required ARB to minimize emissions leakage to the extent feasible. AB 32 further defines emissions leakage as a reduction in emissions of greenhouse gases within the State that is offset by an increase in emissions of greenhouse gases outside the State. Leakage is possible when a business in California incurs regulatory costs not incurred by out-of-State businesses. In Resolution 11-32, the Board directed ARB staff to continue to review information concerning the emissions intensity, trade exposure, and in-State competition of industries in California, and to recommend to the Board changes to the leakage risk determinations and allowance allocation approach, if needed, prior to the allocation of allowances for the second compliance period. At this workshop, staff and researchers will discuss planned ARB-sponsored research efforts to establish baselines from which to measure leakage, along with models upon which to simulate potential leakage. One study will examine how changes in relative energy prices have historically impacted plant output, emissions, and employment. A second study will examine and document recent trends in trade flows in emissions-intensive, trade-exposed industries and estimate how trade flows have historically responded to changes in relative (domestic versus foreign) operating costs. Staff will also discuss a proposal to collect facility-level economic data from covered industrial entities necessary for the timely measurement and monitoring of potential emissions leakage related to the Cap-and-Trade Program. Staff will further discuss a possible proposal for increases in the percentages of the assistance factors generated from leakage risk calculations. Any potential changes to assistance factors will require regulatory amendments, and will therefore not be in place until 2013 at the earliest. On July 9, 2012, the Compliance Instrument Tracking System Service (CITSS) was released for Cap-and-Trade User Registration and Compliance Instrument Account Application activities. The CITSS can be accessed at: https://www.wci-citss.org Many covered entities have not initiated the user registration and account application process. Entities that are required to consign allowances to the November Auction and covered industrial entities eligible for free allocation of allowances in November 2012 must have an account in the CITSS to consign or receive allowances. Additionally, entities and individuals that intend to participate in November 2012 auction must have an approved account in the CITSS prior to completing the separate Auction application which will be available from September 14th through October 15th. Both representatives must complete and submit required hard copy documentation required for user registration. 3. The entity must complete and submit account application forms and hard copy documentation. 6. Receive approval of the account application from the California Registrar. Representatives of covered entities have two (2) options for submitting the user registration hard copy documentation. The Cap-and-Trade Regulation allows covered entities to use a limited number of ARB offset credits to fulfill up to 8% of their compliance obligation. Offset credits are tradable compliance instruments that represent verified GHG emission reductions or removal enhancements made in sectors and sources not covered by the Cap-and-Trade Program. The Board has adopted four Compliance Offset Protocols: Livestock Projects, Ozone Depleting Substances Projects, U.S. Forest Projects, and Urban Forest Projects. The release of the updated webpages, guidance document, and forms will assist participants in the Compliance Offset Program with complying with all regulatory requirements for issuance of ARB offset credits.
