This includes good faith efforts that truck owners and operators have taken prior to January 1, 2014. Truck owners and operators also have until January 31, 2014, to take advantage of the following extended opt-in periods outlined in the November 2013 Regulatory Advisory: • Existing low-mileage agriculture vehicles • Existing low-mileage construction trucks • Existing PM phase-in requirements • Low-use exemption • NOx exempt areas Truck owners and operators that need to demonstrate to motor carriers, brokers and dispatchers that they are in compliance with the regulation should note that the quickest way to obtain a verification certificate is to report on-line. Reports received through the mail can take several weeks to process before a certificate can be issued. Motor carriers, brokers and dispatchers If a fleet owner does report to ARB, they have until January 31 of each compliance year to do so. Therefore, it is not necessary for motor carriers, brokers, and dispatchers to obtain a certificate to verify compliance from January 1 to January 31 of each compliance year. However, the responsible hiring party should obtain a written statement from the vehicle owner that verifies that their fleet is in compliance with the Truck and Bus regulation during the month of January in lieu of a certificate. This statement may also be used to confirm compliance for fleets that do not report and are using the engine model year schedule. The responsible hiring party must perform due diligence by confirming that compliance statements are factual in the contract. If you become aware that one or more vehicles in a fleet do not comply, then you cannot continue to use the services of the fleet. The appendices to the report, including the Environmental Analysis will be released at a later date. This Proposed First Update is a key step in the implementation of AB 32, the California Global Warming Solutions Act of 2006. AB 32 requires the Scoping Plan to be updated at least every five years. In October 2013, ARB released a discussion draft for stakeholder review and comment. The Scoping Plan guides development and implementation of California’s groundbreaking greenhouse gas emission reduction programs. The Air Resources Board is required to update the Scoping Plan every five years. The 2013 Scoping Plan update lays out the remaining steps to the 2020 limits set by AB 32. It moves the process forward with an approach which cuts across economic sectors to combine greenhouse gas reductions with reductions of smog-causing pollutants. It also describes the need to extend key reduction programs now underway. The 2013 update lays the scientific and technological foundation to ensure sustainable midterm and long-term emission reductions as well as public health and economic goals. To achieve these goals California will need to continue building on the AB 32 framework over the coming decades. The update also lays out a set of new actions that will move the state farther along the path to a low-carbon, sustainable future. Some of the actions are near-term, while others are focused on longer-term efforts that will provide major benefits well into the future. Every major economic sector in the state must play an increasing role in this cross-cutting effort to reduce greenhouse gases and smog. Success will require the creation of new policies in some sectors, and expanding and refining existing policies in others. The update identifies eight key sectors for ongoing action: • Energy • Transportation, fuels, land use and infrastructure • Agriculture • Water • Waste management • Natural lands • Short-Lived Climate Pollutants (such as methane and black carbon) • Green Buildings The 2013 update incorporates the latest scientific consensus which indicates the need for accelerated emissions reductions in the coming decades to achieve climate stabilization. This update calls for a midterm statewide greenhouse gas reduction target, and specific reduction targets for each of the key sectors to guide California’s path toward an 80 percent reduction by 2050. The Emerging Leaders initiative is an intensive training program for small companies that have the potential for quick growth and job creation. This seven-month executive educational series includes classroom time and provides the opportunity for small business owners to work with experienced mentors, and develop connections with their peers, city leaders, and financial communities. Local recruitment for the 2014 training cycle is now underway at selected SBA district offices, and classes are scheduled to begin in April 2014. The number of participating cities has grown to 27, and includes Fresno and Los Angeles. If you are an interested small business owner and want to apply to the 2014 training cycle, be sure to first look at the participant eligibility requirements. Since 2008 the initiative has trained more than 2,000 promising small business owners in underserved communities, and continues its impact to help small business owners grow and create jobs. Nearly 400 businesses graduated in 2013 – the largest graduating class since Emerging Leaders began. One such graduate is Eric Franklin, president and CEO of EriMax Inc., an information technology and acquisition management company in Maryland that handles large-scale contracts for the federal government. This 2012 Emerging Leaders graduate now employs 74, up from 35 in 2009. The business has focused on expanding into new areas through partnering and subcontracting. In previous years, its focus was procuring prime contracts. Franklin is also a graduate of the SBA’s 8(a) Business Development Program that helps small, disadvantaged businesses compete in the marketplace. After participants in the Emerging Leaders training graduate, companies have reported they were awarded federal, state, local and tribal contracts, worth more than $1 billion. Sixty-two percent of surveyed participants reported an increase in revenue while 72 percent of those surveyed reported maintaining or creating new jobs in their communities. The amendments are designed to provide new flexibility to truckers working to clean up their aging diesel fleets while better protecting the important emission benefits the regulation provides. The Board will consider the proposed amendments at its April 2014 meeting. In developing these amendments, staff focused on three objectives: •Protecting emission reductions by providing lower cost compliance options to small fleets, low mileage fleets, and certain rural fleets. •Providing new opportunities for fleets to access public incentive funds. •Recognizing fleets that made early investments to comply. To achieve these objectives and benefits, staff is proposing amendments to the regulation to provide additional regulatory flexibility to small fleets, lower mileage fleets and fleets in certain areas that have made substantial progress towards cleaner air. If approved, the amendments would better protect the emissions benefits of the regulation that are necessary to meet California’s air quality obligations under the federal Clean Air Act, as well as the goals of the ARB’s Diesel Risk Reduction Plan. The proposed changes include: •A longer phase-in period for diesel particulate matter (PM) requirements for trucks that operate exclusively in certain rural areas with cleaner air. •Additional time and a lower cost route for all small fleet owners to meet their PM compliance requirements, while reopening opportunities for these fleet owners to apply for and receive public incentive funding. •A compliance route for owners currently unable to qualify for a loan to finance required upgrades. •Adjusted schedules for low-use vehicles and certain work trucks. •Recognition of fleet owners who took action to comply by providing additional “useable life” for retrofit trucks and reducing near-term compliance requirements. The regulation requires newer heavier trucks and buses to meet PM filter requirements beginning January 1, 2012. Lighter and older heavier trucks must be replaced starting January 1, 2015. Background: Vapor recovery systems at service stations have been used in California since the 1970s. In 2008, ARB adopted regulations requiring EVR for ASTs. The AST EVR regulations include three modules: Standing Loss Control (SLC) to reduce emissions resulting from the daily heating and cooling of stored fuel, Phase I EVR to control emissions during transfer of fuel from delivery trucks into ASTs, and Phase II EVR to control emissions during fueling of vehicles from ASTs. The regulations established April 1, 2013 and July 1, 2014 as dates for existing ASTs to comply with SLC and Phase I EVR, respectively. The compliance deadline for Phase II has not been established due to lack of certified equipment. On February 28, 2014, ARB issued an AST EVR Regulatory Advisory that provides certain AST owners/operators with interim relief from the requirement to upgrade their tanks with Phase I EVR. The purpose of these workshops is to inform interested parties about the AST EVR Regulatory Advisory and to solicit feedback that can be incorporated into the November 2014 regulatory amendments. April 25, 2014 SACRAMENTO - The California Air Resources Board today adopted amendments to its Truck and Bus Regulation that will provide new flexible compliance options to owners of aging diesel fleets and recognize fleet owners that have made investments to comply, while also protecting air quality. The changes approved at today’s Board hearing provide additional regulatory flexibility to small fleets, lower use vehicles, and fleets in rural areas that have made substantial progress towards cleaner air. Fleets that have invested in cleaner, compliant equipment and trucks will be able to use credits longer and any vehicles retrofit by 2014 do not have to be replaced until 2023. “We recognize the enormous investments that many businesses have already made to clean up their equipment and abide by the terms of the regulation,” said ARB Chairman Mary D. Nichols, “but we are also aware that, particularly for many rural areas of the state, economic recovery has been painfully slow and funding for improvements scarce." “By providing limited additional time for certain fleets to comply, we believe that we’ll have higher compliance rates overall. It’s a difficult balance but we believe that this is a fair approach that offers flexibility to those who need it, while also rewarding those business owners who have already upgraded their vehicles to meet the requirements of the regulation.” Nichols also said that the amendments, while potentially delaying compliance for some, will still protect air quality, preserving 93% of the NOx (oxides of nitrogen) and diesel particulate matter (PM) benefits of the original regulation. The amendments include: • A longer phase-in period for diesel PM requirements for trucks that operate exclusively in certain rural areas with cleaner air; • Additional time and incentive funding opportunities for small fleets; • A new compliance option for owners who cannot currently afford compliance; • Expansion of the low-use exemption and the construction truck extension; • Recognition of fleet owners who have already complied by providing additional “useable life” for retrofit trucks and reducing near-term compliance requirements. The amendments will still ensure that, by 2020, nearly every truck in California will have a PM filter, consistent with the goals of the Diesel Risk Reduction Plan. The Regulation was amended in 2010 to provide economic relief to truckers affected by the recession, particularly small fleets, by delaying the first compliance requirements by one year and extending the time the truck could be operated before needing to be replaced. • Approximately 1 million trucks operate annually on California highways. Roughly 625,000 are based out of state. Of the remaining 400,000 registered in California, about half are in small fleets of three or less. • The Regulation currently requires most heavy trucks in California to install soot filters or upgrade to newer models with filters by Jan. 1, 2014, and that nearly all trucks have them installed by Jan. 1, 2016. • For small fleets (three or fewer vehicles), Jan. 1, 2014, was a critical compliance milestone because for the first time at least one vehicle in each fleet needed to comply. • At its October 2013 meeting, the Board heard an update on the Regulation and agreed with staff’s proposal to move forward with a number of near-term strategies to provide flexibility while not compromising the overall reduction and health benefits to be achieved by the Regulation. • The changes were developed after some stakeholders voiced concerns regarding their ability to comply with the Regulation at the October 2013 Board hearing. The First Update released today includes additional clarification and edits to reflect comments received by ARB over the past several months. The First Update defines ARB's climate change priorities for the next five years and lays the groundwork to start the transition to achieve California's longer-term climate goals. EO G-14-017 lists all of the abrasives currently certified for permissible dry blasting outside of a permanent building. Several new abrasives have been certified, and some previously listed abrasives have been decertified for nonpayment of fees. Certifications for abrasives listed on EO G-14-017 expire on either August 31, 2014, or August 31, 2015. EO G-14-017 may be accessed on ARB's webpage: http://www.arb.ca.gov/ba/certabr/eo/eo.htm. Mold release agents are used to prevent the fiberglass or plastic from sticking to the mold. Concrete and concrete overlay stamping involve stamping a pattern into concrete to give it the appearance of stone. Release agents are used between the curing concrete and the mats with the pattern to be stamped to prevent the concrete from sticking to the mat. A release agent is also used in asphalt manufacturing plants and when asphalt is being applied to roads to prevent the asphalt from building up and sticking to equipment and tools. EPA Region IX and the South Coast Air Quality Management District (SCAQMD) sponsored a project conducted by the Institute for Research and Technical Assistance (IRTA), a nonprofit organization, to identify, develop, test and demonstrate low-VOC, low toxicity alternatives to the high VOC content materials used as release agents in these applications. IRTA tested and demonstrated alternatives including water-based release agents, petroleum based lubricants, lubricants based on soy, and vegetable oil containing soy and canola oil recycled from restaurants. IRTA analyzed and compared the cost of using the alternatives. The project has been completed and the SCAQMD plans to develop regulations requiring the use of low-VOC alternatives over the next year or so. Background The Air Resources Board (ARB or Board) approved amendments to the Truck and Bus Regulation (regulation) at its April 24-25, 2014 meeting. The approved amendments are intended to better ensure that the air quality benefits originally envisioned by the regulation will be achieved by providing additional compliance flexibility to vehicle owners. The regulation requires diesel truck and bus owners to take steps to reduce their engine emissions. The regulation is a part of the State's plan to meet federal ambient air quality standards and to protect public health, particularly near roadways and distribution centers where toxic emission exposures can be high. Nearly all trucks and buses with a manufacturer's gross vehicle weight rating greater than 14,000 pounds that operate in California are required to be upgraded between 2012 and 2023 to reduce exhaust emissions. Most heavier trucks and buses with a gross vehicle weight rating greater than 26,000 pounds were required to have a particulate matter (PM) filter by January 1, 2014. There are certain exceptions to these requirements for owners that have reported to use flexibility options allowed under the regulation. These include, but are not limited to, certain agricultural and limited-use work trucks, low-use vehicles, and vehicles operated in certain rural areas. January 1 of every compliance year, fleet owners that use flexibility options in the regulation must identify which vehicles will use a particular extension and provide any additional information required. We encourage fleets to report early, before the January 31, 2015 reporting deadline. Background The regulation requires diesel truck and bus owners to take steps to reduce their engine emissions. The regulation is a part of the State's plan to meet federal ambient air quality standards and to protect public health, particularly near roadways and distribution centers where exposure frequently reaches unhealthy levels. Nearly all trucks and buses with a manufacturer's gross vehicle weight rating greater than 14,000 pounds that operate in California are required to be upgraded from 2012 to 2023 to reduce exhaust emissions. Most heavier trucks and buses (with a gross vehicle weight rating greater than 26,000 pounds) are required to have a particulate matter filter by January 1, 2014. There are certain exceptions to these requirements for owners that have reported to use flexibility options allowed under the regulation. These include, but are not limited to, certain agricultural and limited-use work trucks, low-use vehicles, and vehicles operated in certain rural areas. California is in a drought emergency.
