The 2006 LSI rulemaking and 2010 amendments required operators of in-use fleets to achieve specific hydrocarbon + oxides of nitrogen FAEL standards that became more stringent over time, the lowest FAEL for large and medium fleets was to be achieved in 2013. The standards are also more stringent for forklifts than they are for non-forklift LSI equipment. Small fleets and in-field equipment are exempt from the LSI Fleet Regulation. In July 2016, ARB approved amendments to the LSI Fleet Regulation These amendments require operators to: * Submit an initial report by June 30, 2017, and then annually thereafter; * Label all affected equipment with an ARB issued EIN; and * Continue recordkeeping as they have been required to do pursuant to the existing regulation. These investments are financing programs and projects that further the objectives of Assembly Bill 32, the California Global Warming Solutions Act of 2006 (Nunez, Statutes of 2006), by reducing greenhouse gas emissions in the State; delivering benefits to disadvantaged and low-income communities; and maximizing, where feasible, economic, health, and environmental co-benefits. The Greenhouse Gas Reduction Fund holds the State’s portion of auction proceeds, generated by California’s Cap-and-Trade Program. The Governor and Legislature determine which State agencies and programs will receive appropriations from this Fund to invest in projects that reduce greenhouse gases. Greenhouse Gas Reduction Fund programs are administered by over a dozen State agencies and each agency is responsible for administering its own program. To learn more about the agencies and their programs, please visit www.arb.ca.gov/auctionproceeds. SB 535 and AB 1550: SB 535 directs the Secretary for Environmental Protection to identify disadvantaged communities for investment of Cap-and-Trade auction proceeds. AB 1550 requires that a minimum of 25 percent of the proceeds be invested in projects that are located within and benefiting individuals living in disadvantaged communities. CalEPA plans to use the latest version of the CalEnviroScreen tool to inform the identification of disadvantaged communities. The Office of Environmental Health Hazard Assessment recently released CalEnviroScreen Version 3.0, which ranks communities based on numerous indicators that reflect pollution burdens and population characteristics, at http://oehha.ca.gov/calenviroscreen/report/calenviroscreen-30. Additionally, AB 1550 requires a minimum of 5 percent of funds be invested in projects that benefit low-income households or communities statewide; and another 5 percent to projects that benefit low-income households or communities that are within a ½ mile of disadvantaged communities. ARB Funding Guidelines: State law also requires ARB to develop guidance for all State agencies that receive appropriations from the Greenhouse Gas Reduction Fund, including guidance on reporting, quantification methods, and maximizing benefits to disadvantaged communities. ARB released the most recent Funding Guidelines in December 2015. The passage of AB 1550 modifies the existing SB 535 Greenhouse Gas Reduction Fund investment requirements for disadvantaged communities, and provides new funding targets for low-income households and low-income communities. As a result, ARB must update the Funding Guidelines to reflect the new requirements. California is in a drought emergency. The intent of the SCS is to better integrate land use and transportation policies to meet long-term sustainability goals. To help guide these regional planning efforts, CARB is required to establish regional GHG emission reduction targets for 2020 and 2035. CARB adopted initial targets for the MPO regions in 2010. CARB is required to update the targets at least every eight years, and may revise them every four years. In August 2014, CARB staff released a preliminary draft staff report on the status of SB 375 efforts and factors that ARB could consider during development of the methodology to update the targets. CARB staff discussed this preliminary draft staff report at three public workshops during September 2014 and presented the report to the Board in October 2014. From: lquattro@arb.ca.gov The Large Spark-Ignition Engine Fleet Requirements Regulation (LSI Regulation) requires specific equipment be initially reported to the California Air Resources Board (CARB or Board) by June 30, 2017 and labeled by July 30, 2017. The LSI forklift and non-forklift equipment types subject to the upcoming reporting and labeling requirements include the following types of equipment used to comply with the Fleet Average Emission Limits (FAEL) of the LSI Regulation: •Forklifts in class 1, 2, 4, and 5, including electric; and •Non-forklift industrial tow tractors, sweepers/scrubbers, and airport ground support equipment, including electric. Fleets with up to three forklifts and/or up to three non-forklifts are exempt from the regulation but can voluntarily report and label their LSI equipment. Once LSI equipment has been reported in DOORS an Equipment Identification Number (EIN) will be issued. Fleets must label their equipment with the EIN. The LSI Regulation reporting user guides, importing equipment guides, the amended regulation language, and other useful LSI regulation information are available at https://www.arb.ca.gov/lsi CARB utilizes an on-line reporting tool (DOORS). DOORS allows fleets to easily complete the initial reporting required by the Board approved July 2016 amendments to the LSI Regulation.
