BACKGROUND: Assembly Bill (AB) 32, the California Global Warming Solutions Act of 2006, requires California to reduce statewide GHG emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, the Air Resources Board (ARB) has developed a Cap-and-Trade program that limits statewide emissions from sources responsible for 85 percent of greenhouse gases and creates a financial incentive for clean and efficient technologies. Under the program, a portion of the allowances required for compliance are auctioned. The State portion of the proceeds from these auctions will be used to fund projects to reduce greenhouse gas emissions, consistent with State law. In September 2012, the Legislature passed and Governor Brown signed into law two bills – AB 1532 (Pérez, Chapter 807) and Senate Bill (SB) 535 (De León, Chapter 830) – that together establish a framework for developing an investment plan for projects and programs to be funded with Cap-and-Trade auction proceeds. SB 535 further requires that 25 percent of the proceeds that will be expended benefit disadvantaged communities and at least 10 percent of the proceeds expended be invested in projects located within those communities. The Department of Finance (Finance), in consultation with the ARB and other state entities, will develop and submit to the Legislature a three-year investment plan for the auction proceeds. The investment plan will identify the State’s greenhouse gas reduction goals and priority programs for investment of proceeds to support achievement of those goals. Funding will be appropriated to State agencies by the Legislature and Governor through the annual Budget Act, consistent with the plan. ARB staff is proposing to align with the federal regulation in order to provide California with the ability to certify engines and vehicles to the new standards as well as enforce them. On December 11, 2008, the Board approved the Tractor-Trailer GHG regulation codified in sections 95300-95312 of title 17, California Code of Regulations, and later amended it on December 17, 2010. This regulation reduces GHG emissions from long-haul tractor-trailer combinations by requiring them to utilize U.S. EPA SmartWay verified or designated technologies that will improve fuel efficiency. To harmonize the tractor requirements of the federal and California regulations, ARB staff is considering modifications to its Tractor-Trailer GHG regulation. ARB staff will be proposing optional NOx emission standards for California certified 2015 and later model year engines. If the optional standards are adopted, ARB’s existing incentive programs such as the Carl Moyer Memorial Air Quality Standards Attainment program could be modified to give preference to engines certified to the optional standards. On July 22, 2004, ARB adopted an ATCM to Limit Diesel-fueled Commercial Motor Vehicle Idling. This regulation is codified in section 2485 of title 13, California Code of Regulations, and was later amended on October 20, 2005 and December 11, 2008. ARB staff is proposing to extend responsibility for complying with the requirements of the idling ATCM to the owner of the vehicle. In addition, staff’s proposal would require California-based shippers and California-based brokers to share responsibility for compliance with the idling restrictions in the event that they utilized the services of motor carriers that violated the regulation and/or they did not settle their outstanding fines. The manufacturer delay extension specified in section 2025(p)(8) of the regulation excuses the owner from immediate compliance with applicable particulate matter (PM) filter requirements if the PM filter, engine, or vehicle originally equipped with a PM filter was purchased at least 4 months prior to the compliance deadline and has not been received due to a manufacturer delay. This advisory clarifies the length of the temporary extension and how compliance is determined. The regulation allows that an extension to the PM filter requirements can be granted if all available PM filters for a properly operating engine are not compatible with the engine, do not fit in available space, or cannot be safely operated on the vehicle. This extension remains in effect until January 1, 2018, or unless circumstances regarding the extension change including, but not limited to, PM filter feasibility and Occupational Safety and Health Administration (OSHA) requirements. The overall goal of these actions is to provide additional time for owners to complete specific good faith compliance efforts and to provide additional flexibility for many lower use vehicles and vehicles that operate solely in certain areas of the State. The advisory is available at: http://www.arb.ca.gov/msprog/onrdiesel/regulation.htm To qualify and use the compliance options described in the Advisory, truck owners must report specific information to ARB through the Truck Regulations Upload and Compliance Reporting System (TRUCRS) by January 31, 2014. ARB recognizes that many fleets are taking actions to comply with the January 1, 2014, deadline but may not be able to complete them on time. For such fleets, ARB is providing guidance to truck owners that are compliant for 2013 and have made good faith efforts to comply with the January 1, 2014, deadline by giving assurance that they will not be subject to enforcement action for non-compliance prior to July 1, 2014. In addition, at its October 24, 2013, meeting, the Board directed ARB staff to examine several potential changes to the regulation that could provide owners additional compliance flexibility. In developing these changes, staff will evaluate them to ensure that emission levels remain similar to what would be expected under the current regulation, and do not jeopardize a region’s ability to meet health-based federal air quality standards. Potential changes include increasing low-use vehicle thresholds, allowing owners to newly opt-in to a number of existing flexibility provisions, providing adjustments to the “NOx exempt” vehicle provisions, and granting additional time for fleets in certain areas to meet PM filter requirements. At its October 24, 2013, meeting, the Board directed ARB staff to develop a number of potential changes to the regulation that are intended to provide fleets additional flexibility in reducing their emissions and complying with the regulation. Background The regulation requires diesel truck and bus owners to take steps to reduce their engine emissions. The regulation is a part of the State's plan to meet federal ambient air quality standards and to protect public health, particularly near roadways and distribution centers where exposure frequently reaches unhealthy levels. Nearly all trucks and buses with a manufacturer's gross vehicle weight rating greater than 14,000 pounds that operate in California are required to be upgraded from 2012 to 2023 to reduce exhaust emissions. Most heavier trucks and buses (with a gross vehicle weight rating greater than 26,000 pounds) will be required to have a particulate matter filter by January 1, 2014. There are certain exceptions to these requirements for owners that have reported to use flexibility options allowed under the regulation.
