We anticipate that these will be the last set of workshops prior to Board consideration of the proposed rule in April. We welcome and encourage your participation in the workshops. Staff is making revisions to the proposed regulatory language that we posted December 4, 2006 based on input gathered at the most recent set of workshops in December 2006. The purpose of the February workshops will be to discuss revised regulatory language and the expected cost and economic impact of the rule. At this time, the source of funding for the Showcase is provided through the Mobile Source Air Pollution Reduction Review Committee (MSRC) which reports to the South Coast Air Quality Management District (AQMD). Therefore, applicants to the Showcase will be limited to fleets, owners, and/or operators of off-road diesel construction vehicles within the AQMD. Applications for participation in the Showcase are expected to be available early March 2007. Funding is available for the following projects: • purchase of the cleanest available construction equipment for the horsepower category • repower with the cleanest available engine for the horsepower category, or • installation of a Level 3 retrofit. Section 44286 of the Health and Safety Code gives ARB the authority to reserve up to ten percent of Carl Moyer Program funding for multi-district projects. March 16, 2007, the ARB released a solicitation seeking projects that qualify for this multidistrict funding: projects that operate in more than one air district, or that impact air quality in more than one air district as a result of air pollutant transport. The new changes added since May 23, 2007 include the following: • Updated definition of alternative diesel fuel • Updated definition of diesel fuel • Change in small fleet definition to include fleets up to 2,500 hp • Special provision for non-profit training centers to be considered small fleets and for the Job Corps training program to be exempt from all but labeling and reporting requirements • Change to never require more than 20%/yr retrofit during compliance after the final target dates • A new appeals process for fleets that think retrofit is not safe in case the Executive Officer denies that claim • New requirement for fleets to report low-use vehicles indefinitely • Extending reporting requirements to 2026 for small fleets, 2021 for large/medium fleets • Removal of the three month grace period for out-of-state or new fleets that come to California • Allowing fleets that participate in demonstration projects to accumulate carryover retrofit credit, even if the device they demonstrate is not eventually verified • Allowing use of diesel replacement hp for electric vehicles that are not direct replacements for diesel • Requiring ARB to issue a Certificate of Reported Compliance with the In-Use Off-road Diesel Vehicle Regulation upon receipt of the required reporting data and upon confirming that the information reported shows that the reporting fleet is in compliance with the requirements of the regulation • Removal of the PM requirement as one of the conditions a large or medium fleet must meet when adding a new vehicle to the fleet after not meeting the fleet average requirement on the previous compliance date. ====================================================================== You are subscribed to the ordiesel mailing list. The regulation will significantly reduce particulate matter (PM) and oxides of nitrogen (NOx) emissions from the nearly 180,000 existing off-road diesel vehicles in California by requiring fleet owners to accelerate turnover to cleaner engines and install exhaust retrofits. Implementation of the regulation is expected to prevent approximately 4,000 premature deaths through the year 2030. The modifications to the regulation that were approved by the Board include: • A new appeals process for fleets in the event that the Executive Officer denies a request for a safety exemption from the retrofit requirements; • Removal of the three month grace period for out-of-state or new fleets that come to California; • Requiring the issuance of a Certificate of Reported Compliance to fleets upon receipt by ARB of the required reporting data showing compliance with the regulation; and • PM retrofit credit for the retirement of Tier 0 vehicles such that equivalent emission reductions are achieved; • Clarification of the appropriate tax exempt IRS code citations by adding reference to sections 501(c)(5), 501(c)(6), and 501(a); • Restructuring the regulatory language so that the PM and NOx requirements are contained in separate sections; and • The addition of new language creating a regional incentive based program (known as the SOON program) to achieve additional NOx reductions, including allowing any local air district the ability to opt in and allowing air districts to establish their own cost-effectiveness criteria in their guidelines. • Other minor clarifications. Finally, the Board asked staff to report back in early 2009, late 2010, early 2013, and early 2017 regarding implementation of the regulation. Once staff has modified the proposed regulatory language to reflect these changes, staff will release revised regulatory language and other supporting documentation to the public for a 15-day public comment period. Staff expects that the notice, revised regulatory language, and supporting documentation for this15-day public comment period will be available within the next month. As staff begins outreach and education activities related to implementation of the in-use off-road diesel vehicle regulation, staff will post announcements and training materials to this email list-serve. The Board also directed staff to make several additional changes to the regulatory language. Staff have developed draft regulatory language implementing the Board’s direction. To expedite the comment process, staff is releasing this draft regulatory language for informal public comment. Schedule Update: At the July 26, 2007, Air Resources Board (ARB) meeting, when the Board adopted the in-use off-road diesel regulation, the Board directed staff to make several changes to the regulation. On September 6, 2007, ARB staff released proposed regulatory language implementing the Board’s direction and requested informal feedback on that language. Staff appreciates the many stakeholders who provided informal feedback. Although staff had originally planned to release the 15-day package of regulatory changes for formal comment in September, staff is now taking time to carefully review and consider the numerous comments received. Staff therefore plans to formally release the 15-day package in October. After its release, the comment period on the package will be open for 15 days. After the 15-day package is released, staff will release an updated version of the fleet average calculator, which incorporates the regulatory changes in the 15-day package. The purpose of the survey is to better understand the age and use of diesel vehicles used in different operations such as long-haul, local delivery, and other types of operations. We are working on a proposal that would currently require all diesel trucks and buses subject to the regulation to meet 2007 engine standards by 2013 and 2010 engine standards by 2021. We would like any person, business or corporation that owns or is leasing, for twelve months or more, any diesel powered truck, bus, pickup, or other vehicle to complete the survey.
