The ROAR is a signed statement affirming that the information reported is accurate. Beginning in 2012 for large fleets, 2016 for medium fleets, and 2018 for small fleets, the off-road regulation requires fleets to annually update and affirm their reporting information. In addition to the ROAR, the annual update must include reporting of engine hour meter readings for low-use vehicles and vehicles used for more than half their annual operating hours for agricultural operations. By January 1, 2013, BOTH sides of all vehicles subject to the Off-Road Regulation must be labeled with the equipment identification number (EIN). Additionally, the EIN labels on vehicles owned by captive attainment area fleets must be changed to white on a green background by January 1, 2013. Because captive attainment area fleets are potentially subject to lesser compliance requirements than those fleets operating in surrounding areas, the labels on vehicles owned by captive attainment area fleets must be changed in order to differentiate them from other vehicles not eligible for this provision. Captive Attainment Area Fleets are fleets or fleet portions in which all of the vehicles operate exclusively within the following counties: Alpine, Colusa, Del Norte, Glenn, Humboldt, Lake, Lassen, Mendocino, Modoc, Monterey, Plumas, San Benito, San Luis Obispo, Santa Barbara, Santa Cruz, Shasta, Sierra, Siskiyou, Trinity, Tehama, Yuba, and the portion of Sonoma County that lies within the boundaries of the North Coast Air Basin. Captive attainment area fleets are treated as small fleets even if their total horsepower (hp) exceeds the small fleet threshold of 2,500 hp. Amendments to the Off-Road Regulation approved in 2010 make both engines of many on-road two-engine vehicles subject to the regulation. The following two-engine vehicles and their engines are subject to the Off-Road Regulation and should already have been reported to ARB. If not yet reported, they must be reported immediately or face enforcement action: • Not already subject to the Fleet Rule for Public Agencies and Utilities; • Not a two-engine on-road sweeper; • Have a gross vehicular weight > 14,000 pounds; and • Have an auxiliary engine ≥ 50 brake horsepower that is permanently attached and integrated into the design of the vehicle. All two-engine cranes and water well drilling rigs continue to be subject to the regulation. Effective January 1, 2013, all vehicles subject to the Off-Road Regulation will be required to have both sides labeled with their Equipment Identification Number (EIN). All vehicles newly reported to ARB must now be labeled on both sides within 30 days of receiving the EIN and all previously reported vehicles must be labeled on both sides by January 1, 2013. The regulation was filed with the California Secretary of State in May 2007, at which time the requirements of the LSI Fleet Regulation came into effect and were fully enforceable except for those parts of the Regulation that required United States Environmental Protection Agency (U.S. EPA) authorization under the federal Clean Air Act. U.S. EPA granted California authorization on April 4, 2012. With the issuance of this authorization, those provisions are now enforceable as well. ARB anticipates that it will commence the enforcement process slowly, initially auditing a small number of facilities for training purposes. Full scale enforcement will commence following the completion of training near the end of this year. Under section 209(e)(2) of the federal Clean Air Act, California may enforce its own emission standards and other requirements related to the control of emissions from off-road engines and equipment not conclusively preempted by section 209(e)(1) – new locomotives and engines and new off-road engines less than 175 horsepower used in farm and construction equipment and vehicles – so long as it first applies for and receives authorization from the Administrator of U.S. EPA. Only diesel particulate matter (PM) filters or other devices that have been verified by the ARB to meet rigorous emission reduction and durability demonstration requirements can be used to comply. The letter reminds fleets that heavier vehicles with 2000 to 2004 model year engines that they must have verified soot filters and/or upgrades to newer vehicles by January 1, 2013. Similar requirements for vehicles with 1996 to 1999 model year engines became effective earlier this year. Vehicles may also be eligible for certain flexibility options. The letter can be found at: http://www.arb.ca.gov/msprog/truckstop/pdfs/enf-tb-letter2.pdf ARB intends to promptly enforce the January 1, 2013 requirements. Non-compliant vehicles may not be operated in California and will be assessed penalties that start at a minimum of $1,000 per violation per month and increase significantly over time. Do not delay in taking action to clean up your fleet - the installation of a PM filter may take a month or longer to accomplish; however, you may be able to significantly reduce penalties by taking action now.
