DOORS allows fleets to complete the initial reporting required by the Board approved July 2016 amendments to the LSI Regulation. ARB strongly encourages fleets to begin the reporting process early to ensure that there is sufficient time to label equipment. The reporting deadline for medium and large forklift fleets and non-forklift fleets is June 30, 2017. The DOORS reporting homepage can be accessed at: https://ssl.arb.ca.gov/ssldoors/doors_reporting/doors_login.html For assistance with reporting, or with other aspects of the LSI Regulation, please call (877)59-DOORS, or email doors@arb.ca.gov The LSI forklift and non-forklift equipment types subject to the upcoming reporting and labeling requirements include the following types of equipment used to comply with the Fleet Average Emission Limits (FAEL) of the LSI Regulation: * Forklifts in class 1, 2, 4, and 5, including electric. * Non-forklift industrial tow tractors, sweepers/scrubbers, and airport ground support equipment, including electric. Fleets with up to three forklifts and/or up to three non-forklifts are exempt from the regulation but can voluntarily report and label their LSI equipment. Once LSI equipment has been reported in DOORS an Equipment Identification Number (EIN) will be issued. The LSI Regulation reporting user guides, importing equipment guides, the amended regulation language, and other useful LSI regulation information are available at https://www.arb.ca.gov/lsi. Background The LSI Fleet Regulation applies to operators of forklifts, sweeper/scrubbers, industrial tow tractors, and airport GSE. These vehicles are found in approximately 2,000 LSI fleets in California in industries as diverse as manufacturing, wholesale, transportation and utilities, retail, services, and construction, as well as public agencies. The 2006 LSI rulemaking and 2010 amendments required operators of in-use fleets to achieve specific hydrocarbon + oxides of nitrogen FAEL standards that became more stringent over time, the lowest FAEL for large and medium fleets was to be achieved in 2013. The standards are also more stringent for forklifts than they are for non-forklift LSI equipment. Small fleets and in-field equipment are exempt from the LSI Fleet Regulation. In July 2016, ARB approved amendments to the LSI Fleet Regulation These amendments require operators to: * Submit an initial report by June 30, 2017, and then annually thereafter; * Label all affected equipment with an ARB issued EIN; and * Continue recordkeeping as they have been required to do pursuant to the existing regulation. The existing performance requirements, including FAEL standards, were not modified by the amendments and continue to remain in effect. The amendments will improve enforcement effectiveness and compliance rates of the LSI Fleet Regulation when they take effect, and provide ARB staff with the necessary data to inform a future control measure for accelerating deployment of zero emission technology in the LSI sector. Background: On October 25, 2016, the U.S. EPA published the final federal Phase 2 GHG standards. The federal Phase 2 standards are the second phase of federal heavy–duty GHG standards and build upon the federal Phase 1 standards. The federal Phase 2 standards will significantly reduce carbon emissions and dramatically improve the fuel economy for heavy-duty trucks, helping reduce emissions that cause climate change. They establish national GHG emission standards that will begin in model year 2021 for new class 2b to 8 medium- and heavy-duty engines and tractors, and in 2018 model year for certain trailer types. The federal Phase 2 standards will be fully phased in by model year 2027. On December 11, 2008, the Board approved the Tractor-Trailer GHG regulation codified in sections 95300-95312 of title 17, California Code of Regulations, and later amended in 2010 and 2014. This regulation required owners of 53-foot or longer box-type trailers and owners of the heavy-duty tractors that pull them on California highways to utilize U.S. EPA SmartWay verified or designated technologies that will reduce GHG emissions and improve fuel efficiency. The opportunity was approved by the Board as part of the Fiscal Year (FY) 2016-17 Funding Plan for Low Carbon Transportation and Fuels Investments and the Air Quality Improvement Program (AQIP). Up to $17 million is available for this project, which will provide greenhouse gas (GHG), criteria pollutant, and toxic air contaminant emission reduction benefits to disadvantaged communities. Along with the separate On-Road Advanced Technology Demonstration Project which was released on May 19, 2017, it is part of a $34 million allocation for advanced technology freight demonstrations. Eligible projects will be those that demonstrate advanced port equipment, zero-emission cargo handling equipment, zero-emission ground support equipment, and zero-emission freight locomotive equipment. Non-freight categories such as construction equipment, agricultural equipment, and passenger transportation equipment will also be eligible for a smaller portion of the funding, although the focus will be on technologies that are freight enabling. From: lquattro@arb.ca.gov The Large Spark-Ignition Engine Fleet Requirements Regulation (LSI Regulation) requires specific equipment be initially reported to the California Air Resources Board (CARB or Board) by June 30, 2017 and labeled by July 30, 2017. The LSI forklift and non-forklift equipment types subject to the upcoming reporting and labeling requirements include the following types of equipment used to comply with the Fleet Average Emission Limits (FAEL) of the LSI Regulation: •Forklifts in class 1, 2, 4, and 5, including electric; and •Non-forklift industrial tow tractors, sweepers/scrubbers, and airport ground support equipment, including electric. Fleets with up to three forklifts and/or up to three non-forklifts are exempt from the regulation but can voluntarily report and label their LSI equipment. Once LSI equipment has been reported in DOORS an Equipment Identification Number (EIN) will be issued. Fleets must label their equipment with the EIN. Background: In December 2013, California harmonized with the federal Phase 1 requirements. Adoption of the federal Phase 1 rule provided CARB the ability to certify new heavy-duty vehicles and engines and enforce those requirements in the State. In addition, CARB’s adoption of the Phase 1 requirements provided nationwide consistency for vehicle and engine manufacturers. At the same time, CARB amended the TTGHG regulation to align with the Phase 1 rule by sunsetting the 2014 and subsequent model year tractor requirements. Building on the success of the federal Phase 1 rule, in August 2016, U.S. EPA and NHTSA jointly adopted the federal Phase 2 rule, which is more stringent than Phase 1. The federal Phase 2 rule is phased-in over the 2018 through 2027 model years. The structure of the federal Phase 2 rule is generally similar to Phase 1, establishing GHG emission standards for tractors, vocational vehicles, and heavy-duty pickups and vans, and the engines used in tractors and vocational vehicles. However, the federal Phase 2 rule also establishes standards for certain trailers used in combination with tractors. The trailer types included in Phase 2 are box-type trailers (dry van and refrigerated van trailers of all lengths), flat bed trailers, tank trailers, and container chassis. The trailer requirements include aerodynamic improvements and tire requirements for box-type trailers, but only tire requirements for the other trailer types. Although this marks the first time trailers have been regulated at the federal level, trailers have been regulated in California since 2010. On December 22, 2016, the Truck Trailer Manufacturer Association (TTMA) filed a lawsuit that challenges and seeks to vacate the trailer provisions of the federal Phase 2 rule that apply to trailers. Background: In December 2013, California harmonized with the federal Phase 1 GHG standards for medium- and heavy-duty engines and vehicles (the Phase 1 rule). Adoption of the federal Phase 1 rule provided CARB the ability to certify new heavy-duty vehicles and engines and enforce those requirements in the State. In addition, CARB’s adoption of the Phase 1 standards provided nationwide consistency for vehicle and engine manufacturers. At the same time, CARB amended the Tractor-Trailer GHG regulation to align with the Phase 1 rule by sunsetting the 2014 and subsequent model year tractor requirements. Building on the success of the federal Phase 1 rule, in October 2016, the United States Environmental Protection Agency (U.S. EPA) and the National Highway Traffic Safety Administration (NHTSA) jointly adopted the federal Phase 2 rule, which is more stringent than Phase 1. The federal Phase 2 rule is phased-in over the 2018 through 2027 model years. The structure of the federal Phase 2 rule is generally similar to Phase 1, establishing GHG emission standards for tractors, vocational vehicles, and heavy-duty pickups and vans, and the engines used in tractors and vocational vehicles. However, the federal Phase 2 rule also establishes standards for certain trailers used in combination with tractors. The trailer types included in Phase 2 are box-type trailers (dry van and refrigerated van trailers of all lengths), flat bed trailers, tank trailers, and container chassis. The trailer requirements include aerodynamic improvements and tire requirements for box-type trailers, but only tire requirements for the other trailer types. Although this marks the first time trailers have been regulated at the federal level, trailers have been regulated in California since 2010. On December 22, 2016, the Truck Trailer Manufacturer Association filed a lawsuit that challenges and seeks to vacate the trailer provisions of the federal Phase 2 rule that apply to trailers. On August 17, 2017, U.S. EPA/NHTSA announced they will reconsider the trailer provisions of the federal Phase 2 rule. The lawsuit and reconsideration of the trailer provisions however, does not affect California’s authority to establish standards for trailers hauled by heavy-duty tractors. Background: In October 2016, the United States District Court for the Northern District of California approved a Partial Consent Decree (first Consent Decree) pertaining to the subject 2.0 liter VW diesel cars. A second Partial Consent Decree was approved by the Court in May 2017 that pertains to the subject 3.0-liter diesel cars and augments the first Consent Decree. The Consent Decrees partially resolve Clean Air Act and California state claims against VW for equipping its 2.0-liter and 3.0-liter diesel vehicles with defeat devices. The Mitigation Trust is enumerated in the first Partial Consent Decree as Appendix D. Appendix D is intended to mitigate past and future excess NOx emissions from the subject vehicles. Under the terms of the Consent Decree, VW must pay about $3 billion ($423 million for California) into a mitigation trust over a three-year period for eligible mitigation actions that consist mostly of scrap-and-replace projects, including supportive infrastructure for zero- and near zero-emission advanced technology replacements, for the heavy-duty sector. Before the State can expend any Trust funds, it must develop and submit to the Trustee, Wilmington Trust, N.A., a Beneficiary Mitigation Plan that describes the eligible mitigation actions to be funded; the recommended allocation percentages; the estimated emission benefits; and a consideration of potential impacts of the eligible mitigation actions on air quality in areas that bear a disproportionate share of the air pollution burden. In addition to the Consent Decree requirements, Senate Bill (SB) 92, passed in June 2017, further directs how California’s Mitigation Trust funds in Appendix D are to be spent. The legislation directs the designated Lead Agency for the Mitigation Trust to strive to ensure that at least 35 percent of California’s allocation benefit low-income or disadvantaged communities that are disproportionately impacted by air pollution. SB 92 also requires the Lead Agency – which the Governor has indicated will be CARB – to strive to ensure that the expenditures align with the state’s priorities and provide for public transparency before approval.
