On December 9, 2005, the ARB verified the TermiNOx™ emission control system from Lubrizol Engine Control Systems for applications that meet the criteria included in the interim verification letter. To view the letter, go to our new verification page, http://www.arb.ca.gov/msprog/offroad/orspark/verdev.htm, and click on the interim verification letter link. On December 8, 2005, the ARB issued a "Notice of Decision Not to Proceed with the Adoption of Emission Standards and Test Procedures for New 2007 and Later Off-Road Large Spark-Ignition (LSI) Engines and Fleet Requirements for Users of Off-Road LSI Engines.” The text of this notice stated that the proposed rulemaking had been withdrawn and that a new rulemaking for LSI would be undertaken in the near future. A few stakeholders subsequently asked if the notice meant that staff were shelving efforts to control emissions from LSI engines and equipment. The short answer is no. The ARB is constrained to complete rulemaking activities within one year of noticing a Board hearing for that rulemaking. For us, that one-year deadline would have been May 5, 2006. Our desire to expand our outreach efforts made the May 5 deadline problematic. The effect of the notice of decision not to proceed is to stop the regulatory clock for the activities associated with the May 6, 2005 rulemaking and to let stakeholders know that the proposal developed under that rulemaking will move forward, albeit with the clock starting anew in February 2006, concurrent with the LSI item being re-noticed for an April 27, 2006 Board hearing.
