The draft proposal can be found on the following webpage, http://www.arb.ca.gov/msprog/mailouts/mouts_11.htm. The ARB is planning on proposing modifications to the California SORE regulations in order to harmonization its test procedures with the U.S. Environmental Protection Agency’s (U.S. EPA) rules. The proposal will sunset the current test procedures with the 2012 model year, and adopt portions of U.S. EPA’s Parts 1054 and 1065, of Title 40, Code of Federal Regulations (published on November 8, 2010). Because California has different air quality goals than the rest of the country, some portions of Parts 1054 and 1065 have been either modified as necessary for California’s purposes or excluded entirely. For example, U.S. EPA and ARB have different emission credit programs. Accordingly, ARB has excluded portions of U.S. EPA’s provisions that refer to their credit program. The ARB proposal is scheduled to be considered for adoption at the December 2011 Board Hearing. In addition to proposing adoption of these harmonizing modifications, ARB is proposing to change the SORE certification exhaust test fuel to a ten-percent ethanol blend (E10). This change is being considered so that the certification test fuel used for California’s off-road gasoline-fueled engine and equipment categories remains consistent with the planned E10 changes to the on-road motor vehicle certification test fuel requirements. Please note that because the ARB is in only the early stages of considering this modification, the attached documents do not specifically reflect this proposed change. Nevertheless, we are seeking comments from interested parties on this important issue. These amendments will be part of proposals for major amendments to the California SORE and Tier 4 off-road compression-ignition (CI) engine regulations and test procedures intended to provide greater alignment with the applicable federal nonroad small SI engine and nonroad CI engine regulations and test procedures. OAL has until December to approve the regulations and file them with the Secretary of State. Background The Air Resources Board adopted a number of regulations that require diesel engine owners to reduce their engine emissions. These regulations are part of the State’s plan to meet federal ambient air quality standards and to protect public health. Between now and 2023, nearly all trucks and buses that operate in California and have a manufacturer’s gross vehicle weight rating greater than 14,000 pounds must upgrade to reduce exhaust emissions. Similar requirements will also become effective in the next several years affecting owners and operators of certain off-road equipment (including equipment used in construction, industrial, and airport operations). To comply with these requirements, fleet owners can upgrade existing engines by installing particulate matter (PM) filter retrofits or other Verified Diesel Emission Control Strategies (VDECS), or by upgrading to cleaner engines. In addition, the California Global Warming Solutions Act of 2006 (AB 32) established requirements to achieve reductions of greenhouse gas (GHG) emissions. AB 32 requires the Air Resources Board (the Board or ARB) and other state agencies to adopt regulations and other requirements that would reduce statewide GHG emission levels to the equivalent of 1990 levels by 2020. The Tractor-Trailer GHG rulemaking is one of 44 early action measures identified by the Board and requires certain tractor and trailer combinations to use low-rolling resistance tires and aerodynamic technology. Background The Off-Road regulation was approved in 2007, and is intended to significantly reduce emissions of diesel particulate matter (PM) and oxides of nitrogen (NOx) from the over 150,000 in-use off-road diesel vehicles that operate in California by requiring their owners to modernize their fleets and install exhaust retrofits. The LSI fleet regulation was approved in 2006, and is intended to reduce hydrocarbon and oxides of nitrogen (HC+NOx) emissions from the nearly 90,000 LSI vehicles operating in California by accelerating the introduction of new clean vehicles and the retrofit or retirement of uncontrolled in-use vehicles. On December 17, 2010, ARB staff recommended amendments to both regulations that were subsequently adopted by the Board and approved by the Office of Administrative Law on December 14, 2011. The amended Off-Road regulation delays the initial compliance date for all fleets by four years, provides a path to compliance without any required retrofits, simplifies the regulation, and lowers the cost of the regulation significantly while still maintaining progress toward clean air. The amendments also include additional minor modifications to clarify or simplify regulatory provisions. The amended LSI fleet regulation adds and modifies several definitions, reinstitutes the limited hours of use provisions, broadens compliance extension flexibility, and makes other minor clarifications. Although the amended Off-Road regulation is now in effect, the Air Resources Board (ARB) will not be enforcing the performance requirements of this regulation until authorization is received from the United States Environmental Protection Agency (U.S. EPA). However, please note that the reporting, labeling, idling, and disclosure requirements of the Off-Road regulation are in effect and currently being enforced throughout California.
