Date: Wed, 4 Jan 2017 14:34:48 -0800 Subject: arbcombo -- On-line reporting (DOORS) is now available for fleets subject to the off-road Large Spark-Ignition (LSI) Engine Fleet Regulation From: rding@arb.ca.gov The Air Resources Board (ARB or Board) is pleased to announce the availability of the off-road Large Spark- Ignition Engine Fleet Requirements Regulation's (LSI Regulation) on-line reporting tool (DOORS). DOORS allows fleets to complete the initial reporting required by the Board approved July 2016 amendments to the LSI Regulation. ARB strongly encourages fleets to begin the reporting process early to ensure that there is sufficient time to label equipment. The reporting deadline for medium and large forklift fleets and non-forklift fleets is June 30, 2017. The DOORS reporting homepage can be accessed at: https://ssl.arb.ca.gov/ssldoors/doors_reporting/doors_login.html For assistance with reporting, or with other aspects of the LSI Regulation, please call (877)59-DOORS, or email doors@arb.ca.gov The LSI forklift and non-forklift equipment types subject to the upcoming reporting and labeling requirements include the following types of equipment used to comply with the Fleet Average Emission Limits (FAEL) of the LSI Regulation: * Forklifts in class 1, 2, 4, and 5, including electric. * Non-forklift industrial tow tractors, sweepers/scrubbers, and airport ground support equipment, including electric. Fleets with up to three forklifts and/or up to three non-forklifts are exempt from the regulation but can voluntarily report and label their LSI equipment. Once LSI equipment has been reported in DOORS an Equipment Identification Number (EIN) will be issued. The LSI Regulation reporting user guides, importing equipment guides, the amended regulation language, and other useful LSI regulation information are available at https://www.arb.ca.gov/lsi. Background The LSI Fleet Regulation applies to operators of forklifts, sweeper/scrubbers, industrial tow tractors, and airport GSE. These vehicles are found in approximately 2,000 LSI fleets in California in industries as diverse as manufacturing, wholesale, transportation and utilities, retail, services, and construction, as well as public agencies. The 2006 LSI rulemaking and 2010 amendments required operators of in-use fleets to achieve specific hydrocarbon + oxides of nitrogen FAEL standards that became more stringent over time, the lowest FAEL for large and medium fleets was to be achieved in 2013. The standards are also more stringent for forklifts than they are for non-forklift LSI equipment. Small fleets and in-field equipment are exempt from the LSI Fleet Regulation. In July 2016, ARB approved amendments to the LSI Fleet Regulation These amendments require operators to: * Submit an initial report by June 30, 2017, and then annually thereafter; * Label all affected equipment with an ARB issued EIN; and * Continue recordkeeping as they have been required to do pursuant to the existing regulation. The existing performance requirements, including FAEL standards, were not modified by the amendments and continue to remain in effect. The amendments will improve enforcement effectiveness and compliance rates of the LSI Fleet Regulation when they take effect, and provide ARB staff with the necessary data to inform a future control measure for accelerating deployment of zero emission technology in the LSI sector. The opportunity was approved by the Board as part of the Fiscal Year (FY) 2016-17 Funding Plan for Low Carbon Transportation and Fuels Investments and the Air Quality Improvement Program (AQIP). Up to $17 million is available for this project, which will provide greenhouse gas (GHG), criteria pollutant, and toxic air contaminant emission reduction benefits to disadvantaged communities. Along with the separate On-Road Advanced Technology Demonstration Project which was released on May 19, 2017, it is part of a $34 million allocation for advanced technology freight demonstrations. Eligible projects will be those that demonstrate advanced port equipment, zero-emission cargo handling equipment, zero-emission ground support equipment, and zero-emission freight locomotive equipment. Non-freight categories such as construction equipment, agricultural equipment, and passenger transportation equipment will also be eligible for a smaller portion of the funding, although the focus will be on technologies that are freight enabling. California-based public agencies such as air districts, ports, and local government entities or agencies as well as California-based non-profit organizations with expertise implementing large scale advanced technology demonstration projects and the requisite knowledge of advanced technology off-road operations may apply. Applications are due to CARB by 5:00 p.m., Thursday, September 7, 2017. CARB will hold an Applicant Teleconference to answer questions regarding this Grant Solicitation on Thursday, July 6, 2017. The Applicant Teleconference will provide an opportunity for potential applicants to ask clarifying questions regarding general application requirements. Please see details for the Applicant Teleconference below: Date: Thursday, July 6, 2017 Time: 10:00 a.m. to 12:00 p.m. (PST) Place: California Air Resources Board 9528 Telstar Avenue El Monte, California 91731 Call-in Number: 888-950-8046 International Number: 1-210-234-0044 Passcode: 5157729 The questions and answers from the Applicant Teleconference will be posted on the CARB website at: https://www.arb.ca.gov/msprog/aqip/meetings/meetings.htm. CARB staff will not be responding to questions regarding this solicitation except at the Applicant Teleconference. The Grant Solicitation and all associated documents may be found at: https://www.arb.ca.gov/msprog/aqip/solicitations.htm. For more information on Advanced Technology Demonstration Projects please visit: https://www.arb.ca.gov/msprog/aqip/demo.htm. More information about Low Carbon Transportation Investments and AQIP can be found at: https://www.arb.ca.gov/msprog/aqip/aqip.htm. Background The Advanced Technology Demonstration Projects under the Low Carbon Transportation Investments accelerate the introduction of advanced emission reducing technologies that are on the cusp of commercialization into the California marketplace. A public investment in these technologies helps to achieve significant emission reductions in GHGs, criteria pollutants, and toxic air contaminants. This commitment from the State encourages industry to expeditiously invent, develop, test, and introduce cutting edge emission reducing technologies. Advanced Technology Demonstration Projects also leverages public investment with private capital and ingenuity to reach beyond the current technological forefront and provides GHG, criteria pollutant, and toxic air contaminant emission reduction benefits to specific disadvantaged communities. Eligible disadvantaged communities are identified by the California Communities Environmental Health Screening Tool (CalEnviroScreen 2.0) which assesses all census tracts in the state to identify areas disproportionately burdened by and vulnerable to multiple sources of pollution. The LSI forklift and non-forklift equipment types subject to the upcoming reporting and labeling requirements include the following types of equipment used to comply with the Fleet Average Emission Limits (FAEL) of the LSI Regulation: •Forklifts in class 1, 2, 4, and 5, including electric; and •Non-forklift industrial tow tractors, sweepers/scrubbers, and airport ground support equipment, including electric. Fleets with up to three forklifts and/or up to three non-forklifts are exempt from the regulation but can voluntarily report and label their LSI equipment. Once LSI equipment has been reported in DOORS an Equipment Identification Number (EIN) will be issued. Fleets must label their equipment with the EIN. The LSI Regulation reporting user guides, importing equipment guides, the amended regulation language, and other useful LSI regulation information are available at https://www.arb.ca.gov/lsi CARB utilizes an on-line reporting tool (DOORS). DOORS allows fleets to easily complete the initial reporting required by the Board approved July 2016 amendments to the LSI Regulation. CARB strongly encourages fleets to begin the reporting process early to ensure that there is sufficient time to label equipment. The DOORS reporting homepage can be accessed at: https://ssl.arb.ca.gov/ssldoors/doors_reporting/doors_login.html For assistance with reporting, or with other aspects of the LSI Regulation, please call (877)59-DOORS, or email doors@arb.ca.gov Background The LSI Fleet Regulation applies to operators of forklifts, sweeper/scrubbers, industrial tow tractors, and airport GSE. These vehicles are found in approximately 2,000 LSI fleets in California in industries as diverse as manufacturing, wholesale, transportation and utilities, retail, services, and construction, as well as public agencies. The 2006 LSI rulemaking and 2010 amendments required operators of in-use fleets to achieve specific oxides of nitrogen + hydrocarbon FAEL standards that became more stringent over time, the lowest FAEL for fleets was to be achieved in 2013. The standards are also more stringent for forklifts than they are for non-forklift LSI equipment. Small fleets and in-field equipment are exempt from the LSI Fleet Regulation. In July 2016, CARB approved amendments to the LSI Fleet Regulation. These amendments require operators to: •Submit an initial report by June 30, 2017, and then annually thereafter; •Label all affected equipment with an ARB issued EIN; and •Continue recordkeeping as they have been required to do pursuant to the existing regulation. The existing performance requirements, including FAEL standards, were not modified by the amendments and continue to remain in effect. The amendments will improve enforcement effectiveness and compliance rates of the LSI Fleet Regulation when they take effect, and provide CARB staff with the necessary data to inform a future control measure for accelerating deployment of zero emission technology in the LSI sector. The VW Mitigation Trust is a component of a partial settlement with VW resulting from its use of illegal defeat devices in certain 2.0-liter and 3.0-liter model year 2009 to 2016 diesel cars sold in the State. The Mitigation Trust is enumerated in a Partial Consent Decree as Appendix D. The workshop will be held at the following date, time, and location: Date: Monday, October 9, 2017 Time: 9:00 a.m. to 4:00 p.m. (PST) Location: Cal/EPA Headquarters Byron Sher Auditorium, Second Floor 1001 I Street Sacramento, California 95814 During the workshop, staff will discuss and seek input on factors for developing California’s Beneficiary Mitigation Plan to guide VW Mitigation Trust monies in California, including: • Guiding principles for the use of the Mitigation Trust funds. • Potential eligible mitigation action categories to consider for funding. • The process for administering mitigation action projects. • Implementing Legislative direction (Senate Bill 92) on providing benefits to low-income and disadvantaged communities. For more information on this workshop, see the detailed workshop notice at https://www.arb.ca.gov/msprog/mailouts/msc1715/msc1715.pdf. If you have questions regarding the workshop, please contact Lisa Williams at (916) 324-7582 or lisa.williams@arb.ca.gov. Interested members of the public may also submit comments throughout the Beneficiary Mitigation Plan development process either by postal mail or electronically. Postal mail: Ms. Lisa Williams California Air Resources Board, Mailstop 5B P.O. Box 2815 Sacramento, California 95812-2815 Electronic submittal: https://www.arb.ca.gov/lispub/comm2/bcsubform.php?listname=vw-mititrust-pl-ws&comm_period=1 A new email listserv has been established for the VW Environmental Mitigation Trust for California. To continue to receive notices regarding this subject, please subscribe to the “vw-mititrust” listserv at https://www.arb.ca.gov/listserv/listserv_ind.php?listname=vw-mititrust. Background: In October 2016, the United States District Court for the Northern District of California approved a Partial Consent Decree (first Consent Decree) pertaining to the subject 2.0 liter VW diesel cars. A second Partial Consent Decree was approved by the Court in May 2017 that pertains to the subject 3.0-liter diesel cars and augments the first Consent Decree. The Consent Decrees partially resolve Clean Air Act and California state claims against VW for equipping its 2.0-liter and 3.0-liter diesel vehicles with defeat devices. The Mitigation Trust is enumerated in the first Partial Consent Decree as Appendix D. Appendix D is intended to mitigate past and future excess NOx emissions from the subject vehicles. Under the terms of the Consent Decree, VW must pay about $3 billion ($423 million for California) into a mitigation trust over a three-year period for eligible mitigation actions that consist mostly of scrap-and-replace projects, including supportive infrastructure for zero- and near zero-emission advanced technology replacements, for the heavy-duty sector. Before the State can expend any Trust funds, it must develop and submit to the Trustee, Wilmington Trust, N.A., a Beneficiary Mitigation Plan that describes the eligible mitigation actions to be funded; the recommended allocation percentages; the estimated emission benefits; and a consideration of potential impacts of the eligible mitigation actions on air quality in areas that bear a disproportionate share of the air pollution burden. In addition to the Consent Decree requirements, Senate Bill (SB) 92, passed in June 2017, further directs how California’s Mitigation Trust funds in Appendix D are to be spent. The legislation directs the designated Lead Agency for the Mitigation Trust to strive to ensure that at least 35 percent of California’s allocation benefit low-income or disadvantaged communities that are disproportionately impacted by air pollution. SB 92 also requires the Lead Agency – which the Governor has indicated will be CARB – to strive to ensure that the expenditures align with the state’s priorities and provide for public transparency before approval.
