Date: Thu, 6 Jan 2011 11:51:06 -0800 Subject: porttruck -- December 17, 2010, Board actions on Drayage Trucks From: msutherl@arb.ca.gov This email provides a brief informal summary of the Air Resources Board’s actions at the December 17, 2010, hearing to consider amendments that staff had proposed to the Drayage Truck Regulation. The Board considered written public comments and oral testimony at the hearing. The Board supported some, but not all, of the amendments that staff had proposed. The Board delegated the responsibility to the ARB Executive Officer to move forward with the supported amendments to complete the regulatory process and then make a final determination of whether those amendments should be adopted. Proposed Amendments that the Board Directed the Executive Officer to adopt: • The amendment to include noncompliant trucks operating off of port and rail yard grounds that engage in dray-off activities. • The amendment to sunset the Drayage Truck Regulation on December 31, 2016. However, staff will propose a later sunset date as part of the 15-day change package to support the retention of the Phase 2 requirement as described below. Proposed Amendment that the Board Directed the Executive Officer to adopt with modifications: • The amendment to include Class 7 drayage trucks. The Board directed that staff’s proposal be modified as follows: (a) to accelerate the filter requirement to January 1, 2012 for Class 7 drayage trucks in the South Coast Air Basin, and (b) to require Class 7 drayage trucks statewide to operate with a 2007 or newer emission standard engines by January 1, 2014. These modifications will be covered in the 15-day change package. Proposed Amendment that the Board did not support: • The amendment that would have delayed the current Phase 2 requirement (which mandates that drayage trucks are to operate with 2007+ standard engines by January 1, 2014). The Board found that the requirement should not be deleted from the regulation and is necessary to safeguard emission reductions and health benefits for communities near ports and rail yards and to provide regulatory consistency for truck owners who have already complied with Phase 2 requirements. Therefore, all drayage trucks will still be required to operate with 2007 or newer emission standard engines by January 1, 2014. The Drayage Truck Regulation is part of ARB’s ongoing efforts to reduce emissions and health risks from diesel-fueled engines and improve air quality associated with goods movement. The events include One-Stop Truck Events, Vehicle and Equipment Seller trainings, and a number of training classes. The events and training classes will provide information about statewide idling limits, Heavy-Duty Vehicle Inspection Program (HDVIP), engine labeling, Truck and Bus Regulation, Drayage Truck Regulation, Tractor and Trailer Greenhouse Gas Regulation, Transport Refrigeration Unit Regulation, and associated funding opportunities. The topics for each event may vary. For instance, certain training classes will focus on the Tractor-Trailer Greenhouse Gas regulation compliance planning and reporting, while others will provide information about the Truck and Bus regulation with a focus on agricultural vehicle extension reporting. Background The Air Resources Board has a long history of adopting regulations to reduce criteria pollutant and greenhouse gas emissions. In 1998, California identified diesel exhaust particulate matter (PM) as a toxic air contaminant based on its potential to cause cancer, premature death, and other health problems. Diesel engines also contribute to California's fine particulate matter (PM 2.5) air quality problems. Those most vulnerable are children whose lungs are still developing and the elderly who may have other serious health problems. In addition, in September 2007, the Board adopted a State Implementation Plan in coordination with local air districts to meet federal ambient air quality deadlines. The (SIP) identifies the reductions needed to attain national ambient air quality standards for ozone and PM2.5. The largest share of new emission reductions in the 2007 SIP is expected from trucks. A number of regulations are now in effect that that require diesel engine owners to take steps to reduce their engine emissions. All truck owners must maintain engines so that they do not smoke excessively, must limit unnecessary idling, and meet other state emission reduction requirements. Nearly all trucks and buses with a manufacturer’s gross vehicle weight rating greater than 14,000 pounds and transport refrigeration units that operate in California are required to have exhaust retrofits or to upgrade to cleaner engines early. The regulations are part of the state’s plan to meet federal ambient air quality standards and to protect public health. The California Global Warming Solutions Act of 2006 (AB 32) established requirements to achieve reductions of greenhouse gas (GHG) emissions. AB 32 requires the Air Resources Board (the Board or ARB) and other state agencies to adopt regulations and other requirements that would reduce statewide GHG emission levels to the equivalent of 1990 levels by 2020. From: tmanders@arb.ca.gov Important changes to the Drayage Truck Regulation:. On Wednesday, November 9, 2011, the Office of Administrative Law approved amendments to the Drayage Truck Regulation. These amendments became effective immediately. The two key changes to the regulation are: 1) Class 7 trucks are now Drayage Trucks with requirements in the regulation. These trucks have a manufacturer’s gross vehicle weight rating (GVWR) of 26,001-33,000 pounds and were previously considered exempt. Class 7 drayage trucks must now register in the Drayage Truck Registry and modernize their pre-2007 model year engines. Namely, Class 7 drayage trucks must install a retrofit for PM emissions by 1/1/2012 if operating in the South Coast Air Basin. Then, by 1/1/2014, all class 7 drayage trucks statewide must meet 2007 engine standards. 2) Dray off is now illegal. The regulation has been changed to include drayage trucks operating off of port or rail yard grounds that are transporting marine or rail cargos. This includes trucks hauling empty containers and bare chassis. Dray off activities can be reported to ARB enforcement at 626-459-4338. Also, the end of the year deadlines for 2004 model year engines and South Coast class 7 drayage trucks are fast approaching! Don’t wait until the end of the year and get caught in the rush. To be assured of port or rail entry after the first of the year, please register any new equipment in the Drayage Truck Registry AND contact your destination ports and rail yards to make sure you have met their local requirements as soon as possible. The Drayage Truck Regulation is part of ARB’s ongoing efforts to reduce emissions and health risks from diesel-fueled engines and improve air quality associated with goods movement. Please note that fleets which must report have until January 31, 2012 to complete their reporting. Please refer to the Truck and Bus Regulation User Guide at http://www.arb.ca.gov/msprog/onrdiesel/documents/tbuserguide.pdf for more information on how to report. There is no cost to report. Please be aware that the reporting requirements for fleets differ by gross vehicle weight rating (GVWR). Specifically: HEAVIER VEHICLES (GVWR more than 26,000 lbs) - No reporting is required for diesel truck owners that comply with the engine model year schedule and do not plan to use credits, and extensions. A fact sheet with the compliance requirements summary is available at http://www.arb.ca.gov/msprog/onrdiesel/documents/FSRegSum.pdf - Fleets that report by January 31, 2012 will have more flexibility to bring heavier vehicles into compliance. - Small fleets with three or fewer diesel vehicles must report all heavier trucks now if any have 1996 to 1999 model year engines of if you are an owner operator with a heavier low-mileage construction truck. Otherwise, you may wait until next year to report. LIGHTER VEHICLES (14,001 to 26,000 lbs) - No reporting is required, as clean-up requirements do not begin until January 1, 2015. Note that publicly and privately owned school buses have different clean-up requirements than other vehicles and do not need to be reported. Background On December 11, 2008, the Board approved for adoption the Truck and Bus regulation to control emissions from nearly all existing diesel powered heavy-duty trucks and buses operating in California. The regulation became effective under California law on January 8, 2010. The regulation applies to diesel fueled trucks and buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds that are privately owned, federally owned, and to publicly and privately owned school buses. Local and state government owned diesel fueled trucks and buses are already subject to other ARB regulations. Reducing emissions from in-use trucks and buses is necessary to meet federally imposed clean air standards and to reduce the adverse health effects from truck and bus pollution. On December 17, 2010, the staff recommended amendments, which are presently pending adoption, that would delay the initial requirement to install particulate matter (PM) retrofit filters by one year to January 1, 2012 and extend the time before a vehicle equipped with a PM filter would have to have an engine that meets 2010 model year emission standards. The amendments also defer engine replacements for vehicles without PM filters for two years until January 1, 2015. Prior to 2020, replacements are limited to 20 year old or older trucks that are not equipped with PM filters. By January 1, 2023, most vehicles will need to be equipped with an engine meeting 2010 model year emission standards.
