BACKGROUND: Assembly Bill (AB) 32, the California Global Warming Solutions Act of 2006, requires California to reduce statewide GHG emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, the Air Resources Board (ARB) has developed a Cap-and-Trade program that limits statewide emissions from sources responsible for 85 percent of greenhouse gases and creates a financial incentive for clean and efficient technologies. Under the program, a portion of the allowances required for compliance are auctioned. The State portion of the proceeds from these auctions will be used to fund projects to reduce greenhouse gas emissions, consistent with State law. In September 2012, the Legislature passed and Governor Brown signed into law two bills – AB 1532 (Pérez, Chapter 807) and Senate Bill (SB) 535 (De León, Chapter 830) – that together establish a framework for developing an investment plan for projects and programs to be funded with Cap-and-Trade auction proceeds. SB 535 further requires that 25 percent of the proceeds that will be expended benefit disadvantaged communities and at least 10 percent of the proceeds expended be invested in projects located within those communities. The Department of Finance (Finance), in consultation with the ARB and other state entities, will develop and submit to the Legislature a three-year investment plan for the auction proceeds. The investment plan will identify the State’s greenhouse gas reduction goals and priority programs for investment of proceeds to support achievement of those goals. Funding will be appropriated to State agencies by the Legislature and Governor through the annual Budget Act, consistent with the plan. California regulations (Title 17, California Code of Regulations, sections 95340 to 95346) require distributors and sellers of sulfur hexafluoride (SF6) in California to submit annual sales data to ARB no later than March 30 of the following year. These data must provide information on individual transactions including the intended use by transaction. Data for the 2012 calendar year must be reported by March 30, 2013. We thank those who have already sent in their reports. For those distributors and sellers who have not yet done so, a spreadsheet form for recording sales data can be found at http://www.arb.ca.gov/cc/sf6nonelec/sf6nonelec.htm. In addition, research users of SF6 in California must report their usage in the state and other data as outlined in Section 95345 of the regulation. For those researchers who have not yet sent in their information, please do so via letter or email documentation. Please submit required information to Winston Potts, Air Resources Engineer, wpotts@arb.ca.gov, or Ariel Fideldy, Air Resources Technician, afideldy@arb.ca.gov, on or before March 30, 2013. These reports will verify and quantify California sales and usage of SF6 and ensure requirements are met. In implementing the California Global Warming Solutions Act of 2006 (AB 32), the Air Resources Board (ARB) has adopted three measures regulating the use of sulfur hexafluoride in California. These three separate measures regulate use of SF6 in three separate areas: • Semiconductor Applications http://www.arb.ca.gov/cc/semiconductors/semiconductors.htm • Electric Utility Applications (Gas Insulated Switchgear) http://www.arb.ca.gov/cc/sf6elec/sf6elec.htm • Non-Electricity and Non-Semiconductor Applications http://www.arb.ca.gov/cc/sf6nonelec/sf6nonelec.htm The current notice is being sent as a reminder to SF6 users in non-electricity and non-semiconductor applications that use, possession, and sale of sulfur hexafluoride (SF6) in the State of California, are with very few exceptions prohibited under “Regulation for Reducing Sulfur Hexafluoride Emissions”, sections 95340 to 95346, title 17, California Code of Regulations, as approved by the California Air Resources Board in February 2009. Examples of prohibited uses include but are not limited to: underground storage tank and distribution system leak testing, most laboratory fume hood testing, airborne tracer testing, and as a cover gas during magnesium casting. Section 95341(a) of the regulation explicitly identifies a specific list of uses as exempt from the prohibition. Section 95341(b) of the regulation allows some uses to be granted temporary or permanent exemption from the prohibition through promulgation of an Executive Order by the ARB. To receive an exemption through Executive Order, users must submit an application demonstrating grounds for the exemption that are consistent with the grounds identified in the regulation. If you are using SF6 for any prohibited purpose without a valid exemption from the California Air Resources Board, you are in violation of this regulation and subject to enforcement actions, penalties and fines as provided under “Enforcement”, section 95344 title 17, California Code of Regulations. If you are purchasing or using SF6 in California, then section 95345 of the regulation describes record keeping and reporting requirements based on your particular use. If you are distributing SF6, then distributors located outside of California must report all sales to entities within the state, and distributors based in California are required to report all sales of SF6 within and outside of California. These sales include, but are not limited to, businesses in the semiconductor industry, the electricity sector, and exempt applications. SACRAMENTO - The Air Resources Board today posted on its website the public discussion draft of the required update to the AB 32 Scoping Plan. The Scoping Plan describes the comprehensive range of efforts California must take to reduce greenhouse gas emissions to 1990 levels by 2020 and meet the state’s long-term goals to combat climate change. AB 32 requires the Scoping Plan to be updated every five years. The original Plan, first released in 2008, was developed on the principle that a balanced mix of strategies is the best way to cut emissions and grow California’s economy in a clean and sustainable direction. This draft update continues with that approach and focuses on three questions: • How have we done over the past five years? • What is needed to continue the prescribed course of action to 2020? • What steps must California now take to meet the state’s climate goals beyond 2020? California’s strategy to meet the goals of AB 32 is based on the continued implementation of adopted actions including Advanced Clean Cars, the 33% Renewables Portfolio Standard, statewide energy-efficiency initiatives, Cap-and-Trade, the Low Carbon Fuel Standard and other programs. They are designed to achieve significant reductions of greenhouse gases in every sector of California’s economy through improved energy efficiency, and by providing consumers with cleaner fuel choices. The discussion draft includes an analysis of progress to date, finding that California is on track to meet the AB 32 2020 goal of greenhouse gas reductions. An overview of the current science of climate change in the draft includes an expanded discussion of short-lived climate pollutants such as methane and black carbon. It also includes actions California must take to continue greenhouse gas reductions in six key focus areas: energy; transportation, land use, fuels and infrastructure; water; agriculture; natural and working lands; and, waste. The draft update is the result of a series of discussions and input over the past year by a broad range of state agencies and departments and the state Climate Action Team. In addition, four public workshops were held over the summer in Los Angeles, Fresno, Sacramento and San Francisco in an effort to consider comments prior to developing the draft. The release of the discussion draft update marks the beginning of a public comment period to help inform the Proposed Update to the Scoping Plan. Future steps in the development of the Proposed Update include a public workshop on October 15 in Sacramento (which will also be webcast), and a meeting of the Board at the end of October to hear from all stakeholders and provide further direction to staff on revisions to the discussion draft presentation to the ARB at its Board meeting at the end of October. Following the October Board meeting, the draft will be revised and then presented to the Board at its December meeting. The Board is anticipated to consider approval of the update in Spring of 2014.
