DOORS allows fleets to complete the initial reporting required by the Board approved July 2016 amendments to the LSI Regulation. ARB strongly encourages fleets to begin the reporting process early to ensure that there is sufficient time to label equipment. The reporting deadline for medium and large forklift fleets and non-forklift fleets is June 30, 2017. The DOORS reporting homepage can be accessed at: https://ssl.arb.ca.gov/ssldoors/doors_reporting/doors_login.html For assistance with reporting, or with other aspects of the LSI Regulation, please call (877)59-DOORS, or email doors@arb.ca.gov The LSI forklift and non-forklift equipment types subject to the upcoming reporting and labeling requirements include the following types of equipment used to comply with the Fleet Average Emission Limits (FAEL) of the LSI Regulation: * Forklifts in class 1, 2, 4, and 5, including electric. * Non-forklift industrial tow tractors, sweepers/scrubbers, and airport ground support equipment, including electric. Fleets with up to three forklifts and/or up to three non-forklifts are exempt from the regulation but can voluntarily report and label their LSI equipment. Once LSI equipment has been reported in DOORS an Equipment Identification Number (EIN) will be issued. The LSI Regulation reporting user guides, importing equipment guides, the amended regulation language, and other useful LSI regulation information are available at https://www.arb.ca.gov/lsi. Background The LSI Fleet Regulation applies to operators of forklifts, sweeper/scrubbers, industrial tow tractors, and airport GSE. These vehicles are found in approximately 2,000 LSI fleets in California in industries as diverse as manufacturing, wholesale, transportation and utilities, retail, services, and construction, as well as public agencies. The 2006 LSI rulemaking and 2010 amendments required operators of in-use fleets to achieve specific hydrocarbon + oxides of nitrogen FAEL standards that became more stringent over time, the lowest FAEL for large and medium fleets was to be achieved in 2013. The standards are also more stringent for forklifts than they are for non-forklift LSI equipment. Small fleets and in-field equipment are exempt from the LSI Fleet Regulation. In July 2016, ARB approved amendments to the LSI Fleet Regulation These amendments require operators to: * Submit an initial report by June 30, 2017, and then annually thereafter; * Label all affected equipment with an ARB issued EIN; and * Continue recordkeeping as they have been required to do pursuant to the existing regulation. The existing performance requirements, including FAEL standards, were not modified by the amendments and continue to remain in effect. The amendments will improve enforcement effectiveness and compliance rates of the LSI Fleet Regulation when they take effect, and provide ARB staff with the necessary data to inform a future control measure for accelerating deployment of zero emission technology in the LSI sector. On April 13, 2017, Air Resources Board Chair Mary Nichols submitted a petition to U.S. EPA urging federal action to establish more health-protective emission standards for locomotives. The focus of this request is to accelerate the movement to zero- and near-zero emission locomotives. Proposed emission standards would cut toxic and smog-causing emissions by 85% for diesel particulate matter (PM) and 66% for oxides of nitrogen (NOx) below current ‘Tier 4’ levels. Newly manufactured locomotives would also have some zero-emission mile capability, reducing harmful diesel emissions in railyards, and benefitting the disadvantaged communities around them. California is requesting that U.S. EPA respond by Summer, 2017. From: lquattro@arb.ca.gov The Large Spark-Ignition Engine Fleet Requirements Regulation (LSI Regulation) requires specific equipment be initially reported to the California Air Resources Board (CARB or Board) by June 30, 2017 and labeled by July 30, 2017. The LSI forklift and non-forklift equipment types subject to the upcoming reporting and labeling requirements include the following types of equipment used to comply with the Fleet Average Emission Limits (FAEL) of the LSI Regulation: •Forklifts in class 1, 2, 4, and 5, including electric; and •Non-forklift industrial tow tractors, sweepers/scrubbers, and airport ground support equipment, including electric. Fleets with up to three forklifts and/or up to three non-forklifts are exempt from the regulation but can voluntarily report and label their LSI equipment. Once LSI equipment has been reported in DOORS an Equipment Identification Number (EIN) will be issued. Fleets must label their equipment with the EIN. The LSI Regulation reporting user guides, importing equipment guides, the amended regulation language, and other useful LSI regulation information are available at https://www.arb.ca.gov/lsi CARB utilizes an on-line reporting tool (DOORS). DOORS allows fleets to easily complete the initial reporting required by the Board approved July 2016 amendments to the LSI Regulation. The standards are also more stringent for forklifts than they are for non-forklift LSI equipment. Small fleets and in-field equipment are exempt from the LSI Fleet Regulation. In July 2016, CARB approved amendments to the LSI Fleet Regulation. These amendments require operators to: •Submit an initial report by June 30, 2017, and then annually thereafter; •Label all affected equipment with an ARB issued EIN; and •Continue recordkeeping as they have been required to do pursuant to the existing regulation. The existing performance requirements, including FAEL standards, were not modified by the amendments and continue to remain in effect. The Draft Freight Hub Surveys for Seaports and Rail Yards are the most recent in a series of surveys that will be released by CARB this year. Each of the surveys will undergo a public comment period before being finalized and distributed. The types of facilities being surveyed are: truck stops, seaports, rail yards, warehouses, and distribution centers. The purpose of this effort is to collect specific facility and equipment information from California based freight hubs. CARB staff are co-hosting the following meetings to talk with residents living in communities near seaports, railyards, warehouses, and distribution centers about regulatory actions already underway and the development of new concepts to reduce the air pollution and health impacts from freight. Background In March 2017, the Board heard public testimony on the South Coast Air Quality Management District’s (SCAQMD’s) Plan and CARB's Mobile Source Strategy for the State Implementation Plan (SIP). The Board adopted Resolutions 17-7 and 17-8, as well as an addendum that provided additional direction to staff, including: Within 12 months, “…staff shall return to the Board with concepts for an indirect source rule to control pollution from large freight facilities including ports, railyards, warehouses, and distribution centers, as well as any identified alternatives capable of achieving similar levels of emission reductions…” This process will involve stakeholder outreach, including formal workshops and informal meetings, to identify potential options for reducing emissions from freight facilities and to understand the relative pros and cons. CARB staff will present concepts to the Board in March 2018. These CARB freight-related activities will also support the upcoming work to implement Assembly Bill 617 (C. Garcia, Statutes of 2017), which will establish guidance for the development and implementation of community reduction plans focused on reducing exposures in the neighborhoods most impacted by pollution. Additional proposed Cap-and-Trade auction proceeds funding for two new CARB incentive programs is also pending before the Legislature: one to reduce agricultural sector emissions and another for air districts to reduce emissions to achieve early actions for the community emission reduction programs developed pursuant to Assembly Bill (AB) 617 (Garcia, Chapter 136, Statutes of 2017). These new programs are outside of the scope of this workshop and the FY 2017 18 Clean Transportation Incentives Funding Plan. CARB will launch separate public processes focused for these new programs shortly. Background: AQIP: AQIP is a mobile source incentive program that focuses on reducing criteria pollutant and diesel particulate emissions with concurrent reductions in greenhouse gas emissions. CARB was appropriated $28.64 million for AQIP in the 2017 State Budget. Volkswagen Settlement for ZEV Aspects of Vehicle Replacement Programs: CARB has entered into several partial consent decrees with Volkswagen to resolve claims against the company for equipping its diesel vehicles with illegal defeat devices. One of the partial consent decrees requires Volkswagen to pay CARB $25 million to fund “the ZEV-related aspects of the EFMP Plus Up Program or the ZEV-related aspects of similar vehicle replacement programs.” CARB was appropriated $25 million to implement this part of the settlement in the 2017 State Budget. Zero/Near-Zero Emission Warehouse Program: CARB was appropriated $50 million in one-time funding for a new Zero/Near Zero Emission Warehouse Program. These funds are to be used for a competitive funding program to advance implementation of zero- and near zero emission warehouses and technology with a requirement for a one-to-one match resulting in $100 million for projects. The Legislature directed CARB to develop criteria for implementing this program using the AQIP funding plan process. Low Carbon Transportation: The Low Carbon Transportation Program is part of California Climate Investments, a statewide program that puts billions of Cap-and-Trade dollars to work reducing greenhouse gas emissions, strengthening the economy and improving public health and the environment—particularly in disadvantaged communities. California Climate Investments support CARB’s advanced technology, clean transportation incentive programs which are designed accelerate the transition to low carbon freight and passenger transportation with a priority on providing health and economic benefits to California’s disadvantaged communities. The Consent Decrees partially resolve Clean Air Act and California state claims against VW for equipping its 2.0-liter and 3.0-liter diesel vehicles with defeat devices. The Mitigation Trust is enumerated in the first Partial Consent Decree as Appendix D. Appendix D is intended to mitigate past and future excess NOx emissions from the subject vehicles. Under the terms of the Consent Decree, VW must pay about $3 billion ($423 million for California) into a mitigation trust over a three-year period for eligible mitigation actions that consist mostly of scrap-and-replace projects, including supportive infrastructure for zero- and near zero-emission advanced technology replacements, for the heavy-duty sector. Before the State can expend any Trust funds, it must develop and submit to the Trustee, Wilmington Trust, N.A., a Beneficiary Mitigation Plan that describes the eligible mitigation actions to be funded; the recommended allocation percentages; the estimated emission benefits; and a consideration of potential impacts of the eligible mitigation actions on air quality in areas that bear a disproportionate share of the air pollution burden. In addition to the Consent Decree requirements, Senate Bill (SB) 92, passed in June 2017, further directs how California’s Mitigation Trust funds in Appendix D are to be spent. The legislation directs the designated Lead Agency for the Mitigation Trust to strive to ensure that at least 35 percent of California’s allocation benefit low-income or disadvantaged communities that are disproportionately impacted by air pollution. SB 92 also requires the Lead Agency – which the Governor has indicated will be CARB – to strive to ensure that the expenditures align with the state’s priorities and provide for public transparency before approval.
