The Air Resources Board (ARB or Board) is pleased to announce the
availability of the off-road Large Spark- Ignition Engine Fleet
Requirements Regulation's (LSI Regulation) on-line reporting tool
(DOORS).  DOORS allows fleets to complete the initial reporting
required by the Board approved July 2016 amendments to the LSI
Regulation. ARB strongly encourages fleets to begin the reporting
process early to ensure that there is sufficient time to label
equipment. The reporting deadline for medium and large forklift
fleets and non-forklift fleets is June 30, 2017.

The LSI forklift and non-forklift equipment types subject to the
upcoming reporting and labeling requirements include the
following types of equipment used to comply with the Fleet
Average Emission Limits (FAEL) of the LSI Regulation: 

* Forklifts in class 1, 2, 4, and 5, including electric. 

* Non-forklift industrial tow tractors, sweepers/scrubbers, and
airport ground support equipment, including electric. 

Fleets with up to three forklifts and/or up to three
non-forklifts are exempt from the regulation but can voluntarily
report and label their LSI equipment. Once LSI equipment has been
reported in DOORS an Equipment Identification Number (EIN) will
be issued. 

The LSI Regulation reporting user guides, importing equipment
guides, the amended regulation language, and other useful LSI
regulation information are available at

Background 	

The LSI Fleet Regulation applies to operators of forklifts,
sweeper/scrubbers, industrial tow tractors, and airport GSE.
These vehicles are found in approximately 2,000 LSI fleets in
California in industries as diverse as manufacturing, wholesale,
transportation and utilities, retail, services, and construction,
as well as public agencies. The 2006 LSI rulemaking and 2010
amendments required operators of in-use fleets to achieve
specific hydrocarbon + oxides of nitrogen FAEL standards that
became more stringent over time, the lowest FAEL for large and
medium fleets was to be achieved in 2013.

The standards are also more stringent for forklifts than they are
for non-forklift LSI equipment. Small fleets and in-field
equipment are exempt from the LSI Fleet 

Regulation. In July 2016, ARB approved amendments to the LSI
Fleet Regulation These amendments require operators to: 

* Submit an initial report by June 30, 2017, and then annually
thereafter; 

* Label all affected equipment with an ARB issued EIN; and 

* Continue recordkeeping as they have been required to do
pursuant to the existing regulation. 

The existing performance requirements, including FAEL standards,
were not modified by the amendments and continue to remain in
effect. The amendments will improve enforcement effectiveness and
compliance rates of the LSI Fleet Regulation when they take
effect, and provide ARB staff with the necessary data to inform a
future control measure for accelerating deployment of zero
emission technology in the LSI sector.

The Air Resources Board (ARB) staff has released the Draft
Freight Hub Survey for Truck Stops for public comment.  

The Draft Freight Hub Survey for Truck Stops is the first in a
series of six freight hub surveys that will be released by ARB
this year. Each of the surveys will undergo a public comment
period before being finalized. The types of freight hubs being
surveyed during this effort include: truck stops, border
crossings, rail yards, airports, seaports, and warehouses and
distribution centers.  The purpose of these surveys is to collect
specific facility and equipment information from California based
freight hubs. The data gathered from these surveys will help ARB
staff better understand the activity that occurs at freight hubs
in California, assess the potential for emission reductions,
inform potential strategies for reducing those emissions, and
direct funding assistance efforts.

Background:  On July 17, 2015, Governor Brown issued Executive

Background:  The Low Carbon Transportation program is part of
California Climate Investments, a statewide program that puts
billions of Cap-and-Trade dollars to work reducing greenhouse gas
emissions, strengthening the economy and improving public health
and the environment—particularly in disadvantaged communities. 
California Climate Investments support CARB’s advanced
technology, clean transportation incentive programs which are
designed accelerate the transition to low carbon freight and
passenger transportation with a priority on providing health and
economic benefits to California’s disadvantaged communities.  The
Governor’s proposed FY 2017-18 Budget would direct $363 million
for CARB to continue Low Carbon Transportation investments.  

AQIP is a mobile source incentive program that focuses on

concurrent reductions in greenhouse gas emissions.  The
Governor’s proposed Budget includes $28.6 million for AQIP.

One of the pending consent decrees to resolve claims against
Volkswagen for equipping its diesel vehicles with defeat devices
would require the company to pay CARB $25 million to fund “the
ZEV-related aspects of the EFMP Plus Up Program or the
ZEV-related aspects of similar vehicle replacement programs.” 
CARB staff intends to include a proposal for how to spend this
$25 million in the FY 2017-18 Funding Plan contingent on court
approval of the consent decree.

Background:
Legislative mandates from the late 1980s and early 1990s required
CARB to develop regulatory programs to inspect heavy-duty
vehicles for excessive smoke emissions and for tampering.  These
programs, the HDVIP (also known as the roadside program) and the
PSIP (also known as the fleet program), remain in force today and
are currently CARB’s primary HD vehicle screening programs to
detect excess opacity emissions from in-use trucks.  While these
programs have been effective, they were established before the
use of diesel particulate filters (DPFs), which come new on 2007
and later model year engines.  Because of the widespread use of
DPFs and the need to ensure they are operating efficiently, CARB
now needs to update the HDVIP and PSIP regulations to reduce the
opacity limit to assist in identifying heavy-duty trucks with
broken DPFs and in need of repair, and to incorporate other
proposed program improvements.

The proposed amendments to the HDVIP and PSIP are also an
important first step in transitioning to a more robust
multi-pollutant HD I/M program that takes advantage of the
extensive capabilities of on-board diagnostic systems in newer
engines (2013 and later model year engines) for monitoring the
performance of nearly every emission-related engine component and
emission control component.  At the workshop, staff will also
briefly discuss its ongoing work in developing a comprehensive HD
I/M regulatory program, which it expects to present to the Board
for consideration in the 2020-timeframe.

ARB petition to U.S. EPA for more stringent locomotive emission
standards. 

On April 13, 2017, Air Resources Board Chair Mary Nichols
submitted a petition to U.S. EPA urging federal action to
establish more health-protective emission standards for
locomotives.  The focus of this request is to accelerate the
movement to zero- and near-zero emission locomotives.  Proposed
emission standards would cut toxic and smog-causing emissions by
85% for diesel particulate matter (PM) and 66% for oxides of
nitrogen (NOx) below current ‘Tier 4’ levels.  Newly manufactured
locomotives would also have some zero-emission mile capability,
reducing harmful diesel emissions in railyards, and benefitting
the disadvantaged communities around them. 

California is requesting that U.S. EPA respond by Summer, 2017.

Background:  New locomotives are regulated by U.S. EPA.  U.S. EPA
first established emission standards applicable to locomotives
and locomotive engines in 1998, and the standards were last

Background

In July 2016, California released the Action Plan.  The Action
Plan was developed in response to Governor Brown’s Executive
Order B-32-15 and led by the Secretaries of the California
Transportation Agency, California Environmental Protection
Agency, and the Natural Resources Agency.  It was an
unprecedented effort to identify State policies, programs,
investments, and pilot projects to achieve a freight transport
system that meets the State’s transportation, air quality,
climate, energy, and economic needs.  

The Action Plan includes a long-term 2050 Vision and Guiding
Principles for California’s future freight transport system;
Targets for 2030 to guide the State toward meeting the Vision;
opportunities to leverage State freight transport system
investments; actions to initiate over the next five years to make
progress towards the Targets and the Vision; potential pilot
projects to achieve on-the-ground progress in the near-term; and
additional concepts for further exploration and development, if
viable.

The Action Plan elements noted were the results of State agencies
implementing a more comprehensive look across the State’s
existing policies, programs, and investments to identify
opportunities to collaborate and innovate.  The Action Plan was
the result of significant input received through multi agency
stakeholder outreach conducted from July 2015 through spring
2016.

Projects funded under this solicitation will demonstrate
pre-commercial Intelligent Transportation Systems and Connected
Trucks, Advanced Engines and Powertrains, and Zero-Emission Short
and Regional Haul Trucks.  Eligible vehicle types will be limited
to Class 7 and Class 8 (GVWR >26,000 lbs.) on-road heavy
heavy-duty trucks focused on freight activities.

California-based public agencies such as air districts, ports,
and local government entities or agencies as well as
California-based non-profit organizations with expertise
implementing large scale advanced technology demonstration
projects and the requisite knowledge of advanced technology truck
operations may apply.

A key measure in CARB’s Revised Proposed 2016 State Strategy for
the State Implementation Plan (State SIP Strategy) is ensuring
that in-use heavy-duty vehicles continue to operate at their
cleanest possible level (Lower In-Use Emission Performance
Level).  Amendments to warranty provisions are an important part
of that measure.  The State SIP Strategy is critical for
attaining federal health-based air quality standards for ozone in
2023 and 2031 in the South Coast and San Joaquin Valley air
basins, as well as fine particulate matter standards in the next
decade.
  
CARB is considering lengthening the required warranty period for
HDVs because the current warranty period does not reflect
real-world longevity and because longer warranty periods would
result in lower NOx emissions.  Class 8 HDVs frequently operate
upwards of a million miles before major overhaul is needed, but
they are required to be warranted for only 100,000 miles under
CARB and U.S. EPA regulations.  Classes 4 through 7 HDVs also
have relatively short warranty periods compared to when major
overhaul is needed.  With longer required warranty periods,
manufacturers would need to design more durable emission control
systems and components.  A proposal for longer HDV emission
warranty periods is scheduled for Board consideration in December
2017.

The Large Spark-Ignition Engine Fleet Requirements Regulation
(LSI Regulation) requires specific equipment be initially
reported to the California Air Resources Board (CARB or Board) by
June 30, 2017 and labeled by July 30, 2017.  The LSI forklift and
non-forklift equipment types subject to the upcoming reporting
and labeling requirements include the following types of
equipment used to comply with the Fleet Average Emission Limits
(FAEL) of the LSI Regulation: 

•Forklifts in class 1, 2, 4, and 5, including electric; and 

•Non-forklift industrial tow tractors, sweepers/scrubbers, and
airport ground support equipment, including electric. 


Fleets with up to three forklifts and/or up to three
non-forklifts are exempt from the regulation but can voluntarily
report and label their LSI equipment.  Once LSI equipment has
been reported in DOORS an Equipment Identification Number (EIN)
will be issued. Fleets must label their equipment with the EIN.

guides, the amended regulation language, and other useful LSI

CARB utilizes an on-line reporting tool (DOORS). DOORS allows
fleets to easily complete the initial reporting required by the
Board approved July 2016 amendments to the LSI Regulation. CARB

Background 	

The LSI Fleet Regulation applies to operators of forklifts,
sweeper/scrubbers, industrial tow tractors, and airport GSE. 
These vehicles are found in approximately 2,000 LSI fleets in
California in industries as diverse as manufacturing, wholesale,
transportation and utilities, retail, services, and construction,
as well as public agencies.  The 2006 LSI rulemaking and 2010
amendments required operators of in-use fleets to achieve
specific oxides of nitrogen + hydrocarbon FAEL standards that
became more stringent over time, the lowest FAEL for fleets was
to be achieved in 2013. 

The standards are also more stringent for forklifts than they are
for non-forklift LSI equipment. Small fleets and in-field
equipment are exempt from the LSI Fleet Regulation. In July 2016,
CARB approved amendments to the LSI Fleet Regulation. These
amendments require operators to: 

•Submit an initial report by June 30, 2017, and then annually
thereafter; 

•Label all affected equipment with an ARB issued EIN; and 

•Continue recordkeeping as they have been required to do pursuant
to the existing regulation. 

The existing performance requirements, including FAEL standards,
were not modified by the amendments and continue to remain in
effect. The amendments will improve enforcement effectiveness and
compliance rates of the LSI Fleet Regulation when they take
effect, and provide CARB staff with the necessary data to inform
a future control measure for accelerating deployment of zero
emission technology in the LSI sector.

The California Air Resources Board (CARB) invites you to
participate in a public workshop to begin discussing concepts for
minimizing community health impacts from seaports, railyards, and
warehouses/distribution centers.   

Background

In March 2017, the Board heard public testimony on the South
Coast Air Quality Management District’s (SCAQMD’s) Plan and
CARB's Mobile Source Strategy for the State Implementation Plan
(SIP).  The Board adopted Resolutions 17-7 and 17-8, as well as
an addendum that provided additional direction to staff,
including: 

Within 12 months, “…staff shall return to the Board with concepts
for an indirect source rule to control pollution from large
freight facilities including ports, railyards, warehouses, and
distribution centers, as well as any identified alternatives
capable of achieving similar levels of emission reductions…”

This process will involve stakeholder outreach, including formal
workshops and informal meetings, to identify potential options
for reducing emissions from freight facilities and to understand
the relative pros and cons.  CARB staff will present concepts to
the Board in March 2018.

The California Air Resources Board (CARB) staff has released the
following three Draft Freight Hub Surveys for public comment:
Seaports, Class I Rail Yards, and Class III Rail Yards.  

The Draft Freight Hub Surveys for Seaports and Rail Yards are the
most recent in a series of surveys that will be released by CARB
this year. Each of the surveys will undergo a public comment
period before being finalized and distributed. The types of
facilities being surveyed are: truck stops, seaports, rail yards,
warehouses, and distribution centers. The purpose of this effort
is to collect specific facility and equipment information from
California based freight hubs. The data gathered will help CARB
staff better understand the activity that occurs at freight hubs
in California, assess the potential for emission reductions,
inform potential strategies for reducing those emissions, and
direct funding assistance efforts.

Historial

The FY 2017 18 Funding Plan will describe CARB’s proposed
investments from the following clean transportation incentive
funding sources. 

• The $28.64 million Air Quality Improvement Program (AQIP).

• $25 million Volkswagen settlement funding for the zero emission
vehicle (ZEV) aspects of vehicle replacement programs.

• The new $50 million Zero/Near Zero Emission Warehouse Program
created by Senate Bill (SB) 132 (Committee on Budget and Fiscal
Review, Chapter 7, Statutes of 2017).

• The $560 million proposed appropriation for Low Carbon
Transportation Program using Cap-and-Trade auction proceeds
currently pending before the Legislature.   

Additional proposed Cap-and-Trade auction proceeds funding for
two new CARB incentive programs is also pending before the
Legislature:  one to reduce agricultural sector emissions and
another for air districts to reduce emissions to achieve early
actions for the community emission reduction programs developed
pursuant to Assembly Bill (AB) 617 (Garcia, Chapter 136, Statutes
of 2017).  These new programs are outside of the scope of this
workshop and the FY 2017 18 Clean Transportation Incentives
Funding Plan.  CARB will launch separate public processes focused
for these new programs shortly.

Background:  

AQIP:  AQIP is a mobile source incentive program that focuses on
reducing criteria pollutant and diesel particulate emissions with
concurrent reductions in greenhouse gas emissions.  CARB was
appropriated $28.64 million for AQIP in the 2017 State Budget.

Volkswagen Settlement for ZEV Aspects of Vehicle Replacement
Programs:  CARB has entered into several partial consent decrees
with Volkswagen to resolve claims against the company for
equipping its diesel vehicles with illegal defeat devices.  One
of the partial consent decrees requires Volkswagen to pay CARB
$25 million to fund “the ZEV-related aspects of the EFMP Plus Up
Program or the ZEV-related aspects of similar vehicle replacement
programs.”  CARB was appropriated $25 million to implement this
part of the settlement in the 2017 State Budget.

Zero/Near-Zero Emission Warehouse Program:  CARB was appropriated
$50 million in one-time funding for a new Zero/Near Zero Emission
Warehouse Program.  These funds are to be used for a competitive
funding program to advance implementation of zero- and near zero
emission warehouses and technology with a requirement for a
one-to-one match resulting in $100 million for projects.  The
Legislature directed CARB to develop criteria for implementing
this program using the AQIP funding plan process.  

Low Carbon Transportation:  The Low Carbon Transportation Program
is part of California Climate Investments, a statewide program
that puts billions of Cap-and-Trade dollars to work reducing
greenhouse gas emissions, strengthening the economy and improving
public health and the environment—particularly in disadvantaged
communities.  California Climate Investments support CARB’s
advanced technology, clean transportation incentive programs
which are designed accelerate the transition to low carbon
freight and passenger transportation with a priority on providing
health and economic benefits to California’s disadvantaged
communities.  CARB’s potential Low Carbon Transportation
appropriation is still pending before the Legislature.

million allocation of the Volkswagen (VW) Environmental
Mitigation Trust (Mitigation Trust).  The VW Mitigation Trust is
a component of a partial settlement with VW resulting from its

model year 2009 to 2016 diesel cars sold in the State.  The

Background:  
In October 2016, the United States District Court for the
Northern District of California approved a Partial Consent Decree
(first Consent Decree) pertaining to the subject 2.0 liter VW
diesel cars.  A second Partial Consent Decree was approved by the
Court in May 2017 that pertains to the subject 3.0-liter diesel
cars and augments the first Consent Decree.  The Consent Decrees
partially resolve Clean Air Act and California state claims
against VW for equipping its 2.0-liter and 3.0-liter diesel
vehicles with defeat devices.  The Mitigation Trust is enumerated
in the first Partial Consent Decree as Appendix D.  Appendix D is
intended to mitigate past and future excess NOx emissions from
the subject vehicles.  Under the terms of the Consent Decree, VW
must pay about $3 billion ($423 million for California) into a
mitigation trust over a three-year period for eligible mitigation
actions that consist mostly of scrap-and-replace projects,
including supportive infrastructure for zero- and near
zero-emission advanced technology replacements, for the
heavy-duty sector.  Before the State can expend any Trust funds,
it must develop and submit to the Trustee, Wilmington Trust,
N.A., a Beneficiary Mitigation Plan that describes the eligible
mitigation actions to be funded; the recommended allocation
percentages; the estimated emission benefits; and a consideration
of potential impacts of the eligible mitigation actions on air
quality in areas that bear a disproportionate share of the air
pollution burden.  In addition to the Consent Decree
requirements, Senate Bill (SB) 92, passed in June 2017, further
directs how California’s Mitigation Trust funds in Appendix D are
to be spent.  The legislation directs the designated Lead Agency
for the Mitigation Trust to strive to ensure that at least 35
percent of California’s allocation benefit low-income or
disadvantaged communities that are disproportionately impacted by
air pollution.  SB 92 also requires the Lead Agency – which the
Governor has indicated will be CARB – to strive to ensure that
the expenditures align with the state’s priorities and provide
for public transparency before approval.
