Background: The solid waste collection vehicle regulation (SWCV) regulation was considered by the Board in September 2003 and became effective under California law on July 20, 2004. The regulation applies to diesel trucks that haul waste for a fee that have a gross vehicle weight rating greater than 14,000 pounds. As of January 1, 2010 all 1960 to 2006 model year engines are required to have the best available control technology installed to reduce PM. The regulation is one of several regulations adopted by the Air Resources Board to reduce adverse health effects from particulate matter and smog-forming emissions from trucks operating in communities. Reducing emissions from in-use trucks and buses is necessary to meet federally imposed clean air standards and to reduce the adverse health effects from truck and bus pollution. The Truck and Bus Regulation applies to diesel fueled trucks and buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds that are privately owned, federally owned, and to publicly and privately owned school buses. Local and state government owned diesel fueled trucks and buses are already subject to other ARB in-use regulations. On December 17, 2010, the staff recommended amendments that would delay the initial requirement to install particulate matter (PM) retrofit filters by one year to January 1, 2012 and extended the time that vehicles would comply with PM filters installed. The amendments would also defer engine replacements for two years until January 1, 2015. Prior to 2020, replacements would be limited to 20 year old or older trucks that are not equipped with PM filters. By January 1, 2023, most vehicles would still need to have 2010 model year engines or equivalent. The California Global Warming Solutions Act of 2006 (AB 32) established requirements to achieve reductions of GHG emissions. This advisory only applies to vehicles subject to the following regulations: • Truck and Bus Regulation • Transit Fleet Vehicle Regulation • Urban Bus Regulation • Public Agency and Utility Fleet Regulation • Solid Waste Collection Vehicle Regulation • In-Use Off-Road Vehicle Regulation ARB is providing time for fleets affected by this to purchase and install other verified PM filters, or to allow for completion of approved modifications for PM filters that are removed by the manufacturer, without affecting fleet compliance or the ability of fleets to earn or retain early compliance credits. Under this advisory, if a PM filter manufacturer requires a verified PM filter to be removed from a particular engine family, the fleet owner will have 90 days or until January 31, 2012, whichever is longer, to take appropriate action. During this period, the fleet owner will be permitted to operate any affected vehicles in their original equipment manufacturer configuration without a PM filter. The fleet owner must keep records of the change as specified in the applicable regulation.
