One of the proposed changes is to incorporate a process for ensuring expeditious implementation of all feasible measures by requiring an annual review and formal determination regarding the control measures in districts’ attainment plans. State law currently requires districts to update their attainment plans on a three-year cycle and to submit a progress report to ARB annually. The law also requires the districts to annually publish a rulemaking calendar identifying which control measures will be considered for adoption that year. The rulemaking calendar may include only those measures that are contained in the districts’ plan. This means that any new measures identified between the three-year plan updates first must be incorporated into the plan before they can be added to the rulemaking calendar. The proposed changes would require an annual determination of whether the plan still contains all feasible measures for sources under district authority and, if not, to add the new measures to the plan and the rulemaking calendar.
