U.S. EPA grants California Air Resources Board (ARB) authorization to enforce the Transport Refrigeration Unit (TRU) Airborne Toxic Control Measure (ATCM). On January 9, 2009, U.S. EPA approved ARB’s request for authorization to enforce the TRU ATCM, also known as a waiver from preemption. This decision was published in the Federal Register on January 16, 2009 (see Federal Register, Vol. 74, No. 11, Friday January 16, 2009, Notices, pages 3030 – 3033). This decision affects not only persons in California, but also persons outside the State who would need to comply with California’s TRU ATCM regulations to enter California with TRU engines. Therefore, this action has national applicability. ARB has delayed the enforcement of the first phase of the TRU ATCM’s in-use performance standards for six months after this waiver approval. Therefore, the six-month enforcement grace period for TRU engine model years 2001 and older will end on July 16, 2009, and enforcement of the in-use performance standards for these model years will begin on July 17, 2009. Release 09-04 FOR IMMEDIATE RELEASE January 21, 2009 Dimitri Stanich (916)322-2825 (916) 716-8047 www.arb.ca.gov U.S. EPA grants ARB waiver for transport refrigeration units Measure will protect health of trucking industry employees SACRAMENTO: Last week, California received a waiver from U.S. EPA that allows the state to enforce regulations that cut toxic diesel emissions from tens of thousands of refrigeration units mounted on big rigs. Concern had been raised that the late in coming waiver would not be granted and therefore the regulations would not be enforceable. The regulations require all TRU engines on the road in California, about 40,000 at any given time, even those travelling from outside the state, have emission control technology no older than seven years. This can be achieved by the addition of new emission control mechanisms or the purchase of a new engine. For more information engine owners are encouraged to contact the ARB. Once fully implemented in 2020, the regulation will eliminate 2,000 tons of diesel particulate matter emitted into California's air, significantly protecting the health of those that work and live around these engines. Recent research has shown that those who work around diesel engines endure the brunt of the health impacts from this exhaust. Adopted in February 2004, these regulations are part of ARB's strategy to reduce particulate matter from diesel engines. Diesel particulate matter was listed as a toxic air contaminant in 1998 triggering a requirement to reduce public exposure. Toxic air contaminant classification are compounds found to cause or contribute to deaths or serious illness, or pose a present or potential hazard to human health. Diesel PM constitutes 70 percent of the airborne carcinogens in California's air. The Air Resources Board is a department of the California Environmental Protection Agency. ARB's mission is to promote and protect public health, welfare, and ecological resources through effective reduction of air pollutants while recognizing and considering effects on the economy. The ARBER Administrator anticipates accepting batch upload test files (in XML) during the week of February 2nd (pending the outcome of the current beta test underway). If you have hundreds of TRUs or TRU generator sets to register under the ATCM, the batch upload process will allow you to submit one file in XML for ARB identification numbers (IDNs) and operator reports. Updates of compliance information and operator reports can also be run through the batch upload process. You will automatically receive an ARB Identification Number (IDN) and Owner Operator Number (OON) in an output file when the file executes. If you are interested in using batch upload to register on ARBER, you must have a programmer who is familiar with XML coding. The programmer must prepare the file for uploading and validate it against the ARBER schema. The grace period for model year 2001 and older TRU engines ends July 17, 2009. Questions related to this grace period are answered. The California Air Resources Board (ARB) has verified the Rypos DPF/LETRU (Level 2 Plus) diesel particulate filter, which can be used to comply with the Low-Emission Transport Refrigeration Unit (LETRU) In-Use Performance Standard on most trailer transport refrigeration units (TRU) using 2002 and older model year engines. Compliance information related to the TRU Airborne Toxic Control Measure is available at: http://www.arb.ca.gov/diesel/tru.htm The Rypos DPF/LETRU consists of active flow-through filters made out of an electrically conductive sintered metal fiber medium. It is microprocessor controlled with a backpressure control system, an electrical control circuit, and a backpressure warning indicator. TRU owners should read about the specific conditions for which the DPF/LETRU has been approved in the Executive Order (EO), which has been posted on ARB’s Verification Procedure – Level 2 webpage at http://www.arb.ca.gov/diesel/verdev/level2/level2.htm. If you are registering or plan to register your Transport Refrigeration Units (TRUs) or TRU Generator Sets (gensets) on the ARB Equipment Registration (ARBER) system, please note: The system will be down for several minutes tonight at 7 pm Pacific Standard Time. Operator Reports: If you have a California-based facility from which you operate TRUs owned by yourself or by another party, you must comply with the Operator Report requirements of the TRU ATCM by March 16, 2009. Currently the ARBER system does not accept facility registrations without inputting an IDN. Due to the delay experienced by some equipment owners in registering their TRUs or TRU generator sets, some California-based Operators will not have all, or any, of the IDNs needed to complete their Operator Reports by the March 16 deadline. As previously announced, the California Air Resources Board (ARB or Board) will conduct a public workshop on March 23, 2009, from 9:00am to 11:00am Pacific Time, in Sacramento, CA (and via webcast) at the CalEPA Headquarters. The purpose of the workshop is to discuss draft regulatory concepts of a rule that would prohibit the use of internal combustion engine-powered transport refrigeration units (TRU) used for extended cold storage at California facilities. Extended cold storage is tentatively defined as 24 or more hours of "switch-on" time. On December 11, 2008, the Board approved Goods Movement Efficiency Measures as part of the Climate Change Scoping Plan pursuant to the California Global Warming Solutions Act of 2006 (AB 32). The draft rule being proposed at this workshop was included as one of these measures. The California Air Resources Board (ARB) has verified the Proventia Group's Bobtail FTF as a Level 2 Plus flow-through-filter. The Bobtail FTF reduces diesel particulate matter at least 50 percent, plus it complies with the 20 percent NO2 limit. This verification allows this VDECS to be used to comply with the Transport Refrigeration Unit (TRU) Airborne Toxic Control Measure’s (ATCM) Low-Emission TRU In-Use Performance Standard (LETRU) on Thermo King truck TRUs using less than 25 hp 1987 through 2002 model year engines of the following Yanmar models: 3TNE66-TK, 3TNE66KC-ETK, 3TNE72-TK, and 3TNE72KC-ETK. The Proventia Bobtail FTF consists of a catalyzed knitted wire mesh flow-through filter with backpressure warning indicator. Rumors - Fact or Fiction? If you hear a rumor about the California Air Resources Board’s (ARB) Transport Refrigeration Unit (TRU) regulation, please check the TRU Website at http://www.arb.ca.gov/diesel/tru.htm to verify authenticity. Also, be sure that you are signed up for the TRU list serve so that you can stay informed on the latest news about the TRU regulation. Rumor #1: An additional compliance extension has been approved. Truth #1: This rumor is not true. However, a six month grace period is currently in effect until July 16, 2009, for meeting the in-use performance standards. For details, see TRU Advisory 08-15-R3 at the TRU Website at: http://www.arb.ca.gov/diesel/tru.htm Good Faith Compliance If you have not already complied, ARB strongly recommends that you place your emissions control technology orders as soon as possible but by June 1, 2009, at the latest, to be considered for good-faith compliance efforts in the event that there is a supply bottleneck. Verified retrofit emissions control systems and parts, and replacement engines (new and remanufactured) are currently in stock, with next-day shipping being quoted. Stock will run out soon and three-month delivery lead times are likely. ARB will begin enforcement after July 16, 2009. Parties that have not made good-faith effort to comply may be subject to penalties. Rumor #2: If you register after the March 16, 2009, registration deadline, ARB will automatically issue you a citation with penalties. Truth #2: This rumor is not true. ARB has no automatic citation plan for those registering late. If you missed the registration deadline, please expedite your registration application. ARB has verified the Dinex DiSiC (Level 3 Plus) diesel particulate filter, which can be used to comply with the Low-Emission Transport Refrigeration Unit (LETRU) and Ultra-Low Emission Transport Refrigeration Unit (ULETRU) In-Use Performance Standards on most trailer TRUs using 1999 through 2005 model year engines. Compliance information related to the Transport Refrigeration Unit (TRU) Airborne Toxic Control Measure is available at: http://www.arb.ca.gov/diesel/tru.htm The Dinex DiSiC consists of a catalyzed silicon carbide filter substrate in a filter assembly module, inlet, outlet, exhaust tubes, flexible parts, mounting brackets, and insulation. An electronic monitoring system measures and logs exhaust temperature, backpressure, and alarms. The warning system includes a series of LED lights to provide backpressure warning for filter cleaning. The California Air Resources Board (ARB or Board) has delayed two compliance deadlines for the Transport Refrigeration Unit (TRU) Airborne Toxic Control Measure (ATCM): 1. The TRU registration and operator report requirements deadline for California based TRUs has been extended until July 31, 2009 (previously delayed from January 31, 2009, until March 16, 2009). Enforcement of the registration requirements will begin in August 2009. 2. The deadline for meeting the Low-Emission TRU (LETRU) In-Use Performance Standards for 2001 and older TRU engines has been delayed until December 31, 2009, (previously delayed from December 31, 2008, until July 16, 2009). Enforcement of the in-use performance standards will begin in January 2010, for all model year 2002 and older engines. ARB is extending these deadlines because as the close of the grace period approached, it became clear that several thousand TRUs were not in position to comply by mid July. The reasons for this include: lack of timely action by TRU owners, higher costs for compliance than originally anticipated, some retrofit systems not becoming available until May 2009, tightening of credit, and longer lead times for delivery of systems. Given these factors, ARB has determined that a two phase enforcement schedule would allow for more complete registration and provide some additional time for pre-2002 TRUs to come into compliance in an orderly manner. Lead times are typically three to four months for most compliance technologies, so orders should be placed by September 1, 2009, in order to ensure compliance by December 31, 2009. Reminder! July 31, 2009, is the deadline for registering California-based transport refrigeration units (TRU) and TRU generator (gen) sets with the California Air Resources Board (ARB). California-based TRUs and TRU gen sets are TRUs and TRU gen sets equipped on trucks, trailers, shipping containers, or railcars that a reasonable person would find to be regularly assigned to terminals within California. You may register your TRUs and TRU generator sets online at the Air Resources Board Equipment Registration (ARBER) system. ARBER may be accessed using your web browser at: http://www.arb.ca.gov/arber/arber.htm. Registration is free. Instructions and help screens are provided in the left navigation bar of this website. Please call the TRU Help Line at 1-888-878-2826 if you need assistance. Please be aware that enforcement of the TRU registration requirement begins August 2009. Citations will be issued to all noncompliant TRU owners and operators. Penalties will be up to $500 per nonregistered, California-based TRU but can possibly be more for serious cases. Ticketed TRU owners will also be subject to full audits by ARB for all applicable diesel engine regulations. Please also be aware that model year 2002 or older TRU engines, must be fully compliant with the in-use standards by December 31, 2009. Since lead times can be three to four months and may change with supply and demand, it is recommended that orders for compliance technology be placed by September 1st. Beginning January 2010, all noncompliant equipment will be cited and a penalty up to $1,000 per unit will be assessed, but can possibly be more for serious cases. The revised document is posted at the TRU Website at: http://www.arb.ca.gov/diesel/tru.htm. Look for this document under the “Compliance Assistance Contacts” heading. The new Financing Options list includes information about the California Capital Access Program (CalCAP) that is implemented under the California Pollution Control Financing Authority. This is a small business loan program. See eligibility and how the program works at: http://www.treasurer.ca.gov/cpcfa/calcap.asp A list of 54 participating lending institutions is at: http://www.treasurer.ca.gov/cpcfa/calcap/institutions.pdf CalCAP forms can be accessed at: http://www.treasurer.ca.gov/cpcfa/cal_cap.asp Enforcement of Registration Requirement Underway ARB’s Enforcement Division has started inspections statewide to enforce the registration requirements of the TRU Airborne Toxic Control Measure (ATCM). All California-based TRUs are now required to be registered in the ARB Equipment Registration (ARBER) database. The registration deadline was July 31, 2009. There is no registration fee. If you missed that date, please expedite your submittals to avoid penalties. Any unregistered California-based TRUs found by enforcement staff will be issued citations, subject to a fine of up to $500 for first time violators, and required to register within 30 days. If inspectors find a high noncompliance rate with a particular fleet, they will follow-up with a comprehensive fleet-wide audit and check for compliance for all applicable ARB programs. These audits will also include accuracy checks on the registration information submitted to the ARBER database. TRU Advisory 08-06-R4 explains how to register a TRU; this includes what information is needed, where to find the information, and how to submit the information to ARB. TRU Advisories are at: http://www.arb.ca.gov/diesel/tru/advisories.htm In-Use Performance Standard Enforcement Begins January 2010 In January 2010, ARB Enforcement Division staff will start field inspections of the TRU “In-Use Performance Standards” to make certain they are compliant with applicable engine emissions standards through the use of TRUs that are less then seven years old, new engine repowers, or engine exhaust retrofits. Violations of these “hardware” requirements will carry a fine of up to $1000 for first time violators. ARB strongly recommends that TRU owners take the necessary steps now to bring TRUs into compliance before the end of the year. The California Air Resources Board (ARB) has added a “Check TRU Compliance Status” button to the Transport Refrigeration Unit (TRU) Website. The public may use this link to search the ARB Equipment Registration (ARBER) system for the compliance status of TRUs and TRU generator sets and provide comments or provide tips on violations about specific TRUs. ARB will monitor these comments/tips and follow up with enforcement action, if warranted. The TRU Website is at: http://www.arb.ca.gov/diesel/tru.htm The user must provide at least one search field, which may be one of the following: ARB IDN: The Air Resources Board Identification Number (ARB IDN) is unique 8-digit number with one check-digit or letter (nine total digits must be entered) that follows the letters "ARB". ARB IDNs are issued by ARB for TRUs that are registered in ARBER. Only California-based TRUs are required to have an ARB IDN. IDNs are voluntary for out-of-state-based TRUs and TRU generator sets. The ARB IDN must be affixed to both sides of the TRU housing. VIN: The Vehicle Identification Number (VIN) is a unique serial number composed of numbers and letters assigned by the vehicle manufacturer. On a truck-mounted TRU, the truck's VIN is located on the driver's side dashboard, readable through the windshield. On a trailer-mounted TRU, the trailer's VIN is located on a plate that is permanently affixed to the trailer, typically on the driver's side, exterior front wall. License Plate Number: The license plate number is located on the front and rear of a truck and on the rear of a trailer. Railcar Reporting Mark: The Railcar Reporting Mark is a unique equipment number located on both sides of a railcar. The Railcar Reporting Mark includes three to four alpha characters followed by six numeric digits. Railcar Reporting Marks may be used instead of ARB IDNs on the TRU housing. Do not enter any spaces. BIC Code: The Bureau International des Containers et du Transport Intermodal (BIC) code is a unique equipment number located on a TRU generator set or both sides of a refrigerated shipping container. If you are a TRU operator that operates, maintains, garages, or dispatches from a terminal located in California, then an Operator Report was due on July 31, 2009. Basic Information on Operator Reports is available at the TRU website under the “Operator Report” heading at: http://www.arb.ca.gov/diesel/tru.htm. Instructions and help for submitting an Operator Report are available at: http://www.arb.ca.gov/arber/registration.htm. Operator Reports are not required from independent third-party maintenance and repair facilities. A “terminal” is defined as any place where a TRU or TRU gen set equipped truck, trailer, shipping container, railcar or TRU gen set is regularly garaged, maintained, operated, or dispatched from, including a dispatch office, cross-dock facility, maintenance shop, business, or private residence. If you are unsure whether you need to submit an Operator Report, please call ARB’s toll-free TRU Help Line at 1-888-878-2826 (1-888-TRU-ATCM). Terminal operators that are found to be delinquent in submitting an Operator Report during a compliance inspection will be subject to penalties up to $300 per violation. The California Air Resources Board’s (ARB) Transport Refrigeration Unit (TRU) Airborne Toxic Control Measure (ATCM) requires California-based TRU owners to register their TRUs with ARB by July 31, 2009. Owners may register online, using ARB’s Equipment Registration (ARBER) system. Further information about the TRU ATCM and the requirements discussed herein may be found at the TRU Website at: http://www.arb.ca.gov/diesel/tru.htm. Online registrations may be completed at the ARBER website at: http://www.arb.ca.gov/arber/arber.htm. If you have registered your TRU in ARBER and subsequently bring that TRU into compliance with the in-use performance standards, you must update the compliance information in ARBER. Failure to update this information within 30 days of compliance is a violation that is subject to penalties up to $300 per violation. There are three cases where registration information updates are necessary as a result of complying with the TRU ATCM in-use performance standards: 1. Model year 2001 or older engines: If the unit was noncompliant with the in-use performance standards at the time of registration, ARBER did not issue an ARB Identification Number (IDN). Applicants were required to carry the ARBER certification page with the TRU to show the ARB inspector that partial compliance with the registration requirement had been achieved. Model year 2001 and older units must comply with the in-use performance standards by December 31, 2009. ARB urges you to comply now so that you don’t miss the compliance deadline. There will be no further delays in this deadline. After a TRU is brought into compliance, the owner has 30 days to complete the registration process by updating the compliance information in ARBER so that an IDN is issued on the new certification page. Until the owner provides information about how the TRU was brought into compliance, the TRU is not fully compliant with the registration requirement. The owner then has 30 days to affix the IDN to both sides of the TRU housing (see TRU Advisory 08-10-R1 at: http://www.arb.ca.gov/diesel/tru/advisories.htm). The new certification page must be carried with the TRU until the owner affixes the IDN. Thirty days after the IDN is issued, ARB inspectors will not accept ARBER certification pages instead of the IDN being affixed to the TRU housing. 2. Model year 2002 engines: These engines must also meet the in-use performance standards by December 31, 2009. There will be no delays in this deadline. ARB urges you to comply now so that you don’t miss the compliance deadline. These model year TRUs were issued IDNs when they submitted a complete registration application, because they were in compliance until the applicable in-use performance standard deadline (December 31, 2009). After compliance with the in-use standard is achieved, the owner has 30 days to update ARBER by providing information about how the TRU was brought into compliance. 3. Model year 2003 and newer TRU engines: These engines have the same compliance requirements as described in case #2, above, but compliance deadlines are December 31st of the seventh year after the model year. In addition, the operator of a California terminal where TRUs are garaged, operated, maintained, or dispatched from must submit an Operator Report to ARBER by July 31, 2009. After ARBER issues IDNs, the operator has 30 days to update the Operator Report by adding the new IDNs that are assigned to a terminal. Operator Report updates may be completed online by logging into ARBER. Failure to update the Operator Report within 30 days of being issued and IDN may result in citations and penalties up to $300 per violation. ARB will begin enforcement of the In-Use Performance Standards after December 31, 2009. TRUs that are found to be noncompliant with the in-use standards will be subject to penalties up to $500 per violation. There will be no grace periods for late ordering. The California Air Resources Board’s (ARB) Transport Refrigeration Unit (TRU) Airborne Toxic Control Measure (ATCM) requires all TRUs that operate in California to meet in-use performance standards by December 31st of the seventh year after the engine model year. Several compliance options are available, such as retrofitting the engine with the required level of verified diesel emission control strategy or using an Alternative Technology in a way that eliminates the TRU engine operation at all facilities. So far, however, the majority of TRU owners are electing to repower their TRUs with a new engine. Repowering a TRU with a new or remanufactured engine just resets the compliance requirements and compliance deadline to seven years after the replacement engine’s model year (MY). State and federal laws require that a replacement engine must be at least as clean or cleaner than the original engine. In fact, the engine manufacturer must be able to show that the replacement engine is the cleanest engine available with the appropriate physical or performance characteristics to repower the equipment. The engine manufacturer or their agent (e.g. original equipment manufacturer or dealer) must take possession of the original engine and confirm that it has been destroyed. For the purposes of complying with the TRU ATCM, a new or remanufactured replacement engine that meets Tier 2 off-road standards has a 2007 effective model year, which is the last year that Tier 2 was in effect. The effective model year of a Tier 2 replacement engine is not the year the replacement engine was manufactured or the year of the repower. Since the Tier 2 replacement engine has an effective model year of 2007, this engine must meet the TRU ATCM’s Ultra-Low-Emission TRU (ULETRU) In-Use Performance Standard by December 31, 2014, which is now only five years away. Please be aware that the useful life for a Tier 2 engine repower is shorter than the useful life of a repower that uses an engine that meets the current interim Tier 4 (Tier 4i) standards. ARB will soon publish a TRU Advisory that further clarifies the issues related to using prior-tier replacement engines that are used to comply with the TRU ATCM. ARB’s Equipment Registration (ARBER) system will be upgraded to calculate the correct “Compliant Until” date where Tier 2 replacement engines have been used. Affected owners will then be notified of the correct ULETRU compliance date. Also be aware that all TRUs that operate in California that are equipped with MY 2002 and older engines must meet the Low-Emission TRU (LETRU) In-Use Performance Standard or use an Alternative Technology by December 31, 2009. ARB will begin enforcement of the LETRU In-Use Performance Standards after December 31, 2009. TRUs that are found to be noncompliant with the in-use standards will be subject to penalties up to $500 per violation. There will be no grace periods for late ordering. ARB held a public meeting on December 9, 2009, to receive an update on implementation of the separate Truck and Bus Rule. The Board directed its staff to return in April 2010 with a new provision that would provide truck fleets more flexibility in cleaning up their diesel emissions under the state's Truck and Bus Rule, in light of the recession's effect on the industry. The Board’s action was specific to the Truck and Bus Rule. It does not affect the implementation of the TRU ATCM that was adopted to quickly reduce the health risk from diesel soot in impacted communities near distribution centers, truck stops, rail yards, ports, and delivery points starting in 2009. California Air Resources Board NEWS RELEASE FOR IMMEDIATE RELEASE Dec. 22, 2009 CONTACTS: Mary Fricke (916) 322-2990 Karen Caesar (626)575-6728 www.arb.ca.gov California Truckin’ Q&A Transport Refrigeration Unit (TRU) and Generator Sets Airborne Toxic Control Measure Transport Refrigeration Units, or TRUs, are temperature-control systems powered by diesel engines that refrigerate or heat perishable products hauled in various containers, such as semi-trailers, truck vans, shipping containers and rail cars. All TRUs, regardless of where they are based, must meet in-use performance standards to operate in California. ARB has collected a few of the most commonly asked questions and provided answers below. Why do we need to cut emissions from TRUs? TRU engines spew diesel exhaust, a toxic air contaminant, into the communities where they operate such as truck stops and distribution centers. Diesel exhaust has been known to cause cancer, heart disease and respiratory problems. What are the basic requirements of the TRU regulation? • There are specific requirements for engines and terminals. California-based TRUs and TRU generator sets should have been registered with ARB’s equipment registration system by July 31, 2009. Although the deadline has passed, owners are still encouraged to contact ARB to register their engines. Registration for TRUs based outside California is voluntary but is highly recommended because it will streamline the inspection process and get trucks back on the road more quickly. Registration for out of state engines is continually accepted. Information about this process can be found at the TRU Website at: http://www.arb.ca.gov/diesel/tru.htm. When a completed registration application is submitted and the TRU is found to be in compliance, ARB will issue an identification number, or IDN. The owner is required to attach the IDN to both sides of the TRU within 30 days of the issue date. For instructions on how to attach the IDN, go to: http://www.arb.ca.gov/diesel/tru/documents/advisory_08_10_r1.pdf • Terminal operators where TRUs or TRU generator sets are operated, garaged, maintained or dispatched should also have submitted an operator report by July 31, 2009. The report consists of the terminal’s physical address, contact information and a list of the IDNs that the operator assigns to that terminal. What do I need to do to get my current engine in compliance with the regulation? TRU owners and operators can comply with the regulation by retrofitting the engine with a verified diesel particulate filter, or by installing an alternative technology that eliminates diesel emissions. The ARB TRU website has more information on filters at: http://www.arb.ca.gov/diesel/tru.htm#mozTocId341892 . Examples of alternative technologies include hybrid-electric standby (see TRU Advisory 08-02 at: http://www.arb.ca.gov/diesel/tru/documents/advisory_08_02.pdf) and hybrid -cryogenic (see TRU Advisory 08-13 at: http://www.arb.ca.gov/diesel/tru/documents/advisory_08_13.pdf). Replacing a TRU engine with a newer one may also be an option, but this technology only extends compliance with the regulation for an additional seven years beyond that newer engine’s model year. Are there any plans to delay the TRU regulation? No. There are several compliance options available provided owners order them with enough time to meet the regulatory deadlines. ARB delayed enforcement of the initial phase of the regulation, granting model year 2001 and older an additional 12 months to comply which delayed enforcement until Dec. 31, 2009. How is the regulation going to be enforced? ARB inspection teams will be at distribution centers, scales, border crossings, truck stops, ports, intermodal facilities, and other locations where TRUs operate to perform inspections. ARB will issue citations if a TRU is found to be noncompliant and penalties for registration violations will be up to $500 per violation. Failure to meet the in-use performance standards may be up to $1,000 per violation. Additionally, penalties may even be greater if the violation continues uncorrected or if there is company history of noncompliance. Owners may request a settlement conference to appeal the citation or request a penalty adjustment. Is there financial assistance available? A list of financing options is provided on the TRU Website under the “Compliance Assistance Contacts” heading at http://www.arb.ca.gov/diesel/tru.htm. Some of the organizations listed offer small business loans. Retrofit device manufacturers, such as Rypos, offer lease programs and financing to purchase diesel particulate filters. TRU owners should contact their local air district to find out about other financial assistance programs at http://www.arb.ca.gov/msprog/moyer/contacts.htm. Companies considering purchases of equipment that go beyond the TRU regulation should consider applying for assistance through the Carl Moyer Program. The Carl Moyer Program is intended to generate surplus emission reductions that are not required by law for at least three years. These grants may not be used to comply with regulations. Funding is limited and awarded to the most cost-effective proposals. Release 09-115 FOR IMMEDIATE RELEASE December 22, 2009 Dimitri Stanich 916-322-2825 www.arb.ca.gov General Produce Company fined $30,900 for reporting violations SACRAMENTO - The California Air Resources Board fined General Produce Company $30,900 last month for reporting violations during 2006 at its Sacramento, Calif. facility. General Produce failed to submit a one-time report for their transportation refrigeration units at their facility, as required by law. TRUs are refrigeration systems that are powered by diesel engines that control the environment of temperature-sensitive products in refrigerated trucks, trailers, railcars and shipping containers. "Companies that fail to submit the reports required in this and other diesel fleet regulations set the stage for further non-compliance and continued production of harmful emissions; they also create an unfair advantage over compliant companies," said ARB Enforcement Chief James Ryden. Facilities with 20 or more cold storage loading docks are required to monitor, keep records and report activities that create emissions from diesel-powered refrigeration units mounted on trucks, trailers, shipping containers and rail cars. These activities take place during the loading and unloading of perishables goods at distribution centers around the state. General Produce paid $30,900 in penalties: $23,175 went to the California Air Pollution Control Fund for projects and research to improve California's air quality. The remaining $7,725 went to participating Community Colleges through out the state to fund emissions education classes. Diesel exhaust contains a variety of harmful gases and over 40 other known cancer-causing compounds. In 1998, California identified diesel particulate matter as a toxic air contaminant based on its potential to cause cancer, premature death and other health problems. The California Air Resources Board (ARB) Transport Refrigeration Unit (TRU) and TRU Generator Set Airborne Toxic Control Measure (ATCM) requires model year 2002 and older TRU engines to meet in-use performance standards by December 31, 2009. Model year 2003 and subsequent model year TRU engines are required to meet the TRU ATCM’s in-use standards by December 31st of the seventh year after the engine model year. There will be no further delays or extensions in the compliance dates. Many TRU owners have already complied with these in-use standards but are now concerned about other TRU owners who have not come into compliance. Because they want fair competition, a growing number have asked ARB how they can report their noncompliant competitors. In addition, people that live and work near places where TRUs operate are concerned about the toxic air contaminants that are emitted from these diesel engines and have asked how they can report smoking TRU engines.
