The events include One-Stop Truck Events, Vehicle and Equipment Seller trainings, and a number of training classes. The events and training classes will provide information about statewide idling limits, Heavy-Duty Vehicle Inspection Program (HDVIP), engine labeling, Truck and Bus Regulation, Drayage Truck Regulation, Tractor and Trailer Greenhouse Gas Regulation, Transport Refrigeration Unit Regulation, and associated funding opportunities. The topics for each event may vary. For instance, certain training classes will focus on the Tractor-Trailer Greenhouse Gas regulation compliance planning and reporting, while others will provide information about the Truck and Bus regulation with a focus on agricultural vehicle extension reporting. Background The Air Resources Board has a long history of adopting regulations to reduce criteria pollutant and greenhouse gas emissions. In 1998, California identified diesel exhaust particulate matter (PM) as a toxic air contaminant based on its potential to cause cancer, premature death, and other health problems. Diesel engines also contribute to California's fine particulate matter (PM 2.5) air quality problems. Those most vulnerable are children whose lungs are still developing and the elderly who may have other serious health problems. In addition, in September 2007, the Board adopted a State Implementation Plan in coordination with local air districts to meet federal ambient air quality deadlines. The (SIP) identifies the reductions needed to attain national ambient air quality standards for ozone and PM2.5. The largest share of new emission reductions in the 2007 SIP is expected from trucks. A number of regulations are now in effect that that require diesel engine owners to take steps to reduce their engine emissions. All truck owners must maintain engines so that they do not smoke excessively, must limit unnecessary idling, and meet other state emission reduction requirements. Nearly all trucks and buses with a manufacturer’s gross vehicle weight rating greater than 14,000 pounds and transport refrigeration units that operate in California are required to have exhaust retrofits or to upgrade to cleaner engines early. The regulations are part of the state’s plan to meet federal ambient air quality standards and to protect public health. The California Global Warming Solutions Act of 2006 (AB 32) established requirements to achieve reductions of greenhouse gas (GHG) emissions. AB 32 requires the Air Resources Board (the Board or ARB) and other state agencies to adopt regulations and other requirements that would reduce statewide GHG emission levels to the equivalent of 1990 levels by 2020. This rulemaking was filed with the Secretary of State and due to the request for an early effective date, the regulatory action became effective March 7, 2011. Enforcement of the in-use performance standards for model year 2003 TRU engines begins March 31, 2011. In March 2005, ARB requested the U. S. Environmental Protection Agency (USEPA) to grant authorization to ARB to adopt and enforce the TRU ATCM pursuant to the Clean Air Act. USEPA granted California authorization on January 16, 2009. ARB amended section 2477 of title13 of the California Code of Regulations to (1) allow the owners of model year 2003 TRU in the 25 hp and greater category and model year 2003 TRU and 2004 TRU in the less than 25 hp category to use the low-emission TRU in-use standard (enforcement begins March 31, 2011), (2) clarify that the operational life of flexibility engines installed before the effective date of these amendments is seven years from the year of engine manufacture, and (3) add new reporting requirements for TRU original equipment manufacturers. OAL approved this regulatory action pursuant to section 11349.3 of the Government Code. The California Air Resources Board (ARB) Transport Refrigeration Unit (TRU) and TRU Generator Set Airborne Toxic Control Measure (ATCM) requires TRU engines to meet in-use performance standards. For model year 2003 and older, the compliance dates have already passed. Therefore, if steps have not been taken to achieve compliance, these model year engines are in violation with State law and should be cited and penalized. Model year 2004 and subsequent model year engines must comply by December 31st of the seventh year after the engine model year. So MY 2004 engines must be compliant by December 31, 2011. Many TRU owners have already complied with the TRU ATCM’s in-use standards but are now concerned about other TRU owners who have not come into compliance. Because they want fair competition, a growing number have asked ARB how they can report their noncompliant competitors. In addition, people that live and work near places where TRUs operate are concerned about the toxic air contaminants that are emitted from these diesel engines and have asked how they can report smoking TRU engines. TRU engines that have visible emissions are most likely not compliant with the in-use standards and should be reported. Huss’ MK 35 and MK 50 DPFs are capable of reducing emissions of diesel particulate matter (PM) by 85 percent or more. Level 3 PM control meets the Ultra-Low-Emission TRU In-Use Performance Standard that is required for model year 2004 and newer TRUs with 25 horsepower and greater engines by December 31, 2011. These DPFs were previously conditionally verified, pending completion of field durability tests. These durability tests have been completed, as well as more extensive field demonstration testing on a variety of TRU applications. The Huss MK 35 and MK 50 DPFs are now fully verified for use on bobtail and trailer TRU applications. The HUSS MK 35 and MK 50 DPFs consist of an active exhaust filter system and an automatic filter regeneration system. The system has three modules with silicon carbide filter material that uses a diesel burner for regeneration. Specific conditions for which the MK 35 (for 0 to 25 hp TRU engines) and MK 50 (for 26 to 50 hp TRU engines) DPFs have been approved may be found (within a few days) on the ARB Verification Procedure website for Level 3 diesel emissions control strategies at http://www.arb.ca.gov/diesel/verdev/level3/level3.htm. The list of compatible TRU engines (by model year, manufacturer, engine family, and displacement) is also listed in the Attachment listed at the above link. TRUs are refrigeration systems powered by diesel internal combustion engines designed to control the environment of temperature-sensitive products that are transported in trucks, trailers, shipping containers, and railcars. These units operate at distribution centers, grocery stores and other facilities which are often in close proximity to residential neighborhoods. The emissions from TRUs pose a potential threat to both public health and the environment. In 2004, the TRU Airborne Toxic Control Measure (ATCM) was adopted to reduce diesel particulate matter (PM) emissions from TRU engines. The Air Resources Board (ARB) has released a draft of the proposed amendments to the California tier 4 off-road compression-ignition (CI) engine test procedures. The basis of these test procedures are the U.S. Environmental Protection Agency’s (U.S. EPA’s) nonroad CI engine regulations contained in title 40 Code of Federal Regulations (40 CFR) Parts 1039, 1065, and 1068, and which ARB adopted originally on October 20, 2005. The released ARB draft proposal reflects both the amendments that U.S. EPA has made to Parts 1039, 1065, and 1068 since 2005, as well as ARB’s proposed amendments for aligning with those federal amendments. Except for draft amendments of Table 1b (Tier 4 Exhaust Emission Standards) and Table 2b (Upper Limit for Tier 4 Family Emission Limits (FELs) and Alternative Allowances), from title 13, California Code of Regulations (13 CCR) §2423, a draft of the other amendments that will be proposed to the California tier 4 off-road CI engine regulations in 13 CCR §2420 is not included with this release. However, such amendments are forthcoming and will reflect the amendments being proposed in the draft test procedures proposal. Specifically, ARB is planning on proposing modifications to the California tier 4 off-road CI engine regulations in order to increase the level of harmonization with the current U.S. EPA regulations. The proposed Part I D amends the Part 1039-portion of Part I-C by adopting portions of U.S. EPA’s Part 1039, of 40 CFR, as last modified in Vol. 75 of the Federal Register, Pg. 37977 (76 FR 37933), on June 28, 2011. The proposed Part I-E adopts U.S. EPA’s 40 CFR Part 1065, as last modified in 76 FR 37977, on June 28, 2011, as a replacement for the Part 1065-portion of Part I-C; and, the proposed Part I-F amends the Part 1068-portion of Part I-C by adopting portions of U.S. EPA’s 40 CFR Part 1068, as last modified in 76 FR 37977, on June 28, 2011. Although not included in the draft proposal (except for the above mentioned Tables 1b and 2b), staff is also planning on amending the applicable sections of 13 CCR to reflect the draft test procedures amendments described herein. Since its initial adoption, Part 1065 has been amended repeatedly to both improve and expand its applicability for other nonroad engine categories. Federal nonroad CI engines certified for tier 4 standards must be tested using Part 1065. Use of Part 1065 was optional for tier 3 and earlier model engines. In addition, U.S. EPA adopted Part 1039, which is the “standard-setting” part for nonroad CI engines. Besides the actual emission standards, Part 1039 contains other provisions, such as certification protocols, credit-generation allowances, etc. Also adopted was Part 1068, which contains the general compliance provisions. California adopted Part 1065 originally in 2005 in conjunction with its adoption of the tier 4 off-road CI engine emission standards. Since 2005, U.S. EPA has adopted several amendments to its nonroad CI engine regulations (i.e., to Parts 1039, 1065, and 1068). In May 2009, off-road CI engine manufacturers formally asked ARB to maintain full alignment and harmonization with the federal regulations in order to avoid performing separate testing and certification processes and thereby reduce their burden of compliance. As announced at the June 29, 2011, public workshop, ARB staff has evaluated the potential public health risks associated with the current seven year operational life of TRU engines and found it to be unacceptably high to receptors located near distribution centers. Staff has learned that TRU engine activity at distribution centers is greater than understood to be in the 2004 rulemaking. Therefore, extending the operational life of Model Year (MY) 2004 and newer TRU engines beyond seven years would increase the duration of the public’s exposure to diesel PM emissions and delay the reduction of public health risks near the facilities where TRUs congregate in large numbers. Given this, ARB staff is not proposing to extend the operational life of MY 2004 and newer TRU engines. ARB staff will be presenting this proposal to the Board at the Board’s October 2011 public hearing. If the Board, after considering all of the information presented at the hearing, concurs with staff’s proposal, then MY 2004 and newer TRU engines would be required to meet the in-use performance standards, as specified in the current TRU ATCM, by December 31st of the seventh year after the engine model year. Specifically: • MY 2004 engines rated at 25 hp and greater must meet the Ultra-Low-Emission TRU (ULETRU) standard by December 31, 2011; and • MY 2004 engines in the less than 25 horsepower (hp) category must meet either the ULETRU or the Low-Emissions TRU (LETRU) in-use performance standard by December 31, 2011. What Should Owners of Model Year 2004 Engines Do to Comply? Owners of TRUs and TRU gen sets equipped with MY 2004 engines should make compliance decisions now and order compliance technology as soon as possible so that compliance with the in-use performance standard is achieved by December 31, 2011. Orders should be placed early, taking into consideration the delivery and installation lead times, which can be several months under normal circumstances. Owners should also take into consideration potential delays due to the holiday season and high demand due to approaching compliance deadlines. What Should Owners of Model Year 2005 and Newer Engines Do to Comply? Going forward, MY 2005 and newer TRU engines of any horsepower category must meet ULETRU by December 31st of the seventh year after the engine model year, as currently required by the TRU ATCM. Of the $223,295.00 collected, approximately $172,000 went to the California Air Pollution Control Fund to support air quality projects and research to improve California's air quality. Roughly $52,000 went to the Peralta Community College District to fund emission education classes at participating California community colleges under the California Council for Diesel Education and Technology program. “Businesses play a vital role in environmental protection,” said Paul Jacobs, Chief of ARB’s Mobile Source Enforcement Branch. “We work hard to establish and maintain good relationships so that we can educate business owners and keep them updated. However, if errors are made and air quality suffers as a result, we are required to take action.” Fines totaled $223,295.00; none from this group exceeded $30,000. The five companies paying the highest amounts were: * County of Imperial, Department of Public Works, fined $27,000.00 for failure to properly self-inspect its diesel trucks to assure the vehicles met state smoke emission standards, as required under the Periodic Smoke Inspection Program (PSIP). * Marquez Brothers International Inc., fined $24,000 for failure to comply with diesel fleet self-inspection requirements, and for violations of the Transport Refrigeration Unit (TRU) regulation. * Brotherhood Trucking Inc., fined $17,617.50 for failing to properly self-inspect its diesel fleets and dispatching drayage trucks that either did not meet emission standards or were not entered into the Drayage Truck Registry. * West Coast Refrigerated Trucking Inc., fined $15,750 for failing to properly inspect its diesel fleet and for not upgrading all its TRU engines as required by the TRU regulation. * Peninsula Coast Joint Powers Board, fined $15,500 for failing to properly self-inspect its diesel fleet and for not meeting emissions requirements for NOx and PM as required by the Fleet Rule for Transit Agencies. The Board sustained the seven year operational life for model year (MY) 2004 and newer reefer engines because there is concern that the cancer risk near distribution centers where reefers congregate is too high. As a result, owners of MY 2004 reefer engines must order compliance equipment soon in order to comply by the end of 2011. One amendment that was adopted allows compliance dates to be extended for a limited time if compliance equipment has been ordered, but there is a delay in delivery or installation that prevents compliance by the deadline. TRU owners must make their compliance commitments early enough to take into account delivery, installation, holiday, and year-end lead times. Specifically, for MY 2004 engines, owners must make a good-faith effort to comply by the end of 2011. Purchase orders for compliance equipment need to be placed as soon as possible. If MY 2004 compliance cannot be achieved by December 31, 2011, due to delays in delivery or installation, reefer owners may apply for an extension. To qualify for this extension, the reefer must be registered in ARBER and an extension application with supporting documentation must be received at ARB by December 31, 2011. In the next few weeks, ARB staff will provide additional guidance on how to apply for an extension, including the documentation (for example, a purchase order that shows the date the order was placed and an updated delivery/installation schedule) that must be submitted with the application. Please note that extensions will be considered on a case-by-case basis. A similar amendment allows compliance dates to be extended up to a year if there is no suitable compliance option for a particular reefer model, also on a case by case basis. OAL has until December to approve the regulations and file them with the Secretary of State. Background The Air Resources Board adopted a number of regulations that require diesel engine owners to reduce their engine emissions. These regulations are part of the State’s plan to meet federal ambient air quality standards and to protect public health. Between now and 2023, nearly all trucks and buses that operate in California and have a manufacturer’s gross vehicle weight rating greater than 14,000 pounds must upgrade to reduce exhaust emissions. Similar requirements will also become effective in the next several years affecting owners and operators of certain off-road equipment (including equipment used in construction, industrial, and airport operations). To comply with these requirements, fleet owners can upgrade existing engines by installing particulate matter (PM) filter retrofits or other Verified Diesel Emission Control Strategies (VDECS), or by upgrading to cleaner engines. In addition, the California Global Warming Solutions Act of 2006 (AB 32) established requirements to achieve reductions of greenhouse gas (GHG) emissions. AB 32 requires the Air Resources Board (the Board or ARB) and other state agencies to adopt regulations and other requirements that would reduce statewide GHG emission levels to the equivalent of 1990 levels by 2020. The Tractor-Trailer GHG rulemaking is one of 44 early action measures identified by the Board and requires certain tractor and trailer combinations to use low-rolling resistance tires and aerodynamic technology. The Rypos DPF/ULETRU can be used to comply with ARB’s Ultra-Low-Emission TRU (ULETRU) In-Use Performance Standard on certain trailer TRUs using 2003 and newer model year engines. Compliance information related to the TRU Airborne Toxic Control Measure is available at: http://www.arb.ca.gov/diesel/tru/tru.htm The RYPOS DPF/ULETRU is an active diesel exhaust filter system. It consists of a filter housing, electrical control circuit, and filter cartridges made of sintered metal fibers. The RYPOS DPF/ULETRU uses controlled electric heating for reliable regeneration of the filter cartridges. A diesel oxidation catalyst (DOC) attached between the engine exhaust manifold and the inlet of the filter is added to remove the soluble organic fraction (SOF) while reducing carbon monoxide (CO), and total hydrocarbon emissions (THC). It is microprocessor controlled with a backpressure control system, an electrical control circuit, and a backpressure warning indicator. TRU owners should read about the specific conditions for which the DPF/ULETRU has been approved in the Executive Order (EO), which will be posted within a few days on ARB’s Verification Procedure – Level 3 webpage at http://www.arb.ca.gov/diesel/verdev/level3/level3.htm. Please be aware that the reporting requirements for fleets differ by gross vehicle weight rating (GVWR). Specifically: HEAVIER VEHICLES (GVWR more than 26,000 lbs) - No reporting is required for diesel truck owners that comply with the engine model year schedule and do not plan to use credits, and extensions. Background On December 11, 2008, the Board approved for adoption the Truck and Bus regulation to control emissions from nearly all existing diesel powered heavy-duty trucks and buses operating in California. The regulation became effective under California law on January 8, 2010. The regulation applies to diesel fueled trucks and buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds that are privately owned, federally owned, and to publicly and privately owned school buses. Local and state government owned diesel fueled trucks and buses are already subject to other ARB regulations. Reducing emissions from in-use trucks and buses is necessary to meet federally imposed clean air standards and to reduce the adverse health effects from truck and bus pollution. On December 17, 2010, the staff recommended amendments, which are presently pending adoption, that would delay the initial requirement to install particulate matter (PM) retrofit filters by one year to January 1, 2012 and extend the time before a vehicle equipped with a PM filter would have to have an engine that meets 2010 model year emission standards. The amendments also defer engine replacements for vehicles without PM filters for two years until January 1, 2015. Prior to 2020, replacements are limited to 20 year old or older trucks that are not equipped with PM filters. By January 1, 2023, most vehicles will need to be equipped with an engine meeting 2010 model year emission standards. Time is running out to place orders for compliance technology. Applications for extension must be submitted by December 31, 2011, with documentation that shows the date that compliance equipment was ordered. Documentation must also include the supplier’s statement of estimated delivery and expected installation date.
