Of the $226,950 collected, $170,400.75 went to the California Air Pollution Control Fund to support research to improve California’s air quality. In addition, $56,549.25 went to the Peralta Community College District to fund classes at participating California community colleges under the California Council for Diesel Education and Technology program. “The Air Resources Board has a long history of outreach to businesses to keep them informed about how to keep in compliance with state laws,” said Paul Jacobs, Chief of ARB’s Mobile Source Enforcement Branch. “When companies fail to make necessary changes or neglect to do what is required of them, we have to take action in order to protect public health.” Fines totaled $$226,950; none from this group exceeded $25,000. The five companies paying the highest amounts were: * Dole Fresh Fruit, fined $24,750 for failing to properly label its diesel-powered Transport Refrigeration Unit (TRU) generator sets according to ARB regulations. * Hendrickson Trucking Inc., fined $19,875 for failing to properly self-inspect its diesel trucks to assure the vehicles met state smoke emission standards. * Dynalectric Los Angeles, fined $15,750 for failing to properly self-inspect its diesel trucks to assure the vehicles met state smoke emission standards. * United Food Group LLC, fined $13,725 for failing to bring the company’s TRUs into compliance with state requirements, and for failing to properly self-inspect its diesel trucks to assure the vehicles met state smoke emission standards. * Harrison Trucking, Inc., fined $13,175 for failing to properly self-inspect its diesel fleet to ensure compliance with state smoke emission standards. Serial numbers for registered TRUs and gen sets - model year 2006 and newer - have been matched with serial numbers supplied by manufacturers. This updated data has revealed potentially miss-keyed information. In some instances this created conflicting information that requires fleet manager attention. Corrections to individual ARBER registrations may be necessary. If a unit’s serial number provided by the registrant does not match the serial number provided by the manufacturer, the TRU or gen set status may have been changed from “compliant” to “pending verification.” This has occurred to many applications and requires fleet managers to assure the accuracy of their supplied data. What needs to be done? Fleet managers must log into ARBER and check to see if any previously compliant TRUs or gen sets now have a “pending verification” status. Fleet managers with large numbers of units registered in ARBER may click on the “Reports” tab and download a complete list of their units in PDF or CSV format. If the compliance status for a unit is found to be “pending verification”, the unit’s serial number should be double-checked. Corrections may be submitted through the TRU Help Line at 1-888-878-2826. Photos of the unit label with serial number may need to be submitted. ARB staff is working with manufacturers to eliminate the pending-verification status for those cases where a valid serial number was entered. Why is this Important? This correction will be important to “for-hire” common carriers that will need to show that their TRUs are compliant in order to transport perishable goods on California highways. In addition, the in-use compliance date may be affected by these corrections. Beginning January 1, 2013, freight brokers, forwarders, shippers, or receivers will be required to only hire or contract with carriers that can show they can dispatch TRUs compliant with California’s in-use performance standards. The business entity that arranges, hires, or contracts with carriers must require that their carriers only dispatch TRU-equipped trucks, trailers, shipping containers, and railcars or gen sets that comply with the California’s in-use performance standards, if they travel on the state’s highways or railways. Carriers will need to provide proof-of-compliance to the hiring business entity before they can be hired. One way to show compliance is to be on ARB’s “100 Percent-Compliant Carrier List.” Carriers that have registered TRUs in ARBER that are all compliant with the TRU Regulation’s in-use standards will be listed on ARB’s “100 Percent-Compliant Carrier List.” Freight brokers, freight forwarders, shippers and receivers may look up a carrier by their company name or U.S. DOT motor-carrier number. They may also query ARBER for a complete list of 100 Percent-Compliant Carriers, or narrow the list to a city, county, or state/province. The beta test version of the “100 Percent-Compliant Carrier List” is at: https://arber.arb.ca.gov/publicTCCReports.arb Carriers are encouraged to examine the list and act now to clear up any discrepancies in their registration information. Many carriers still need to enter their U.S. DOT Motor Carrier Numbers in ARBER. Take action now to assure good standing when the new compliant-only hiring requirement goes into effect on January 1, 2013. Carriers based outside of California wishing to be placed on the list, should register their TRUs and gen sets in ARBER. ARBER will check the registration information before issuing a compliance certification. Registrants should be careful to enter complete and accurate information. In addition, when a TRU’s or TRU gen set’s compliance information changes, the carrier must update ARBER as soon as possible to assure current information is used to determine compliance status. For example, when an owner takes steps to bring a unit into compliance, they need to update ARBER to reflect that change. Huss MK series DPFs use active regeneration to burn off the collected diesel soot. This allows the filter to be mounted away from the engine, when necessary. Since there is not enough space in the TRU housing to mount the Huss DPF, a frame-rail mount, under the refrigerated van, was evaluated and approved. This mounting configuration meets all of the conditions in ARB’s verification Executive Order for MK-35 and MK-50 DPFs. Temperatures around the DPF, exhaust tubing, and the integrity of the installation have been monitored and approved. Model year 2005 TRU engines must comply with the TRU Regulation’s in-use performance standards by December 31, 2012. It is most likely too late to place orders for replacement engines or replacement units for delivery and installation by December 31st. However, if you order verified diesel emissions control strategies (VDECS), such as diesel particulate filters, by the end of October, installation by the end of 2012 is most likely possible. If you order VDECS in October and delivery or installation is delayed so that you can’t comply by the end of 2012, you may qualify for a compliance extension. To qualify for this extension, purchase orders for VDECS must be placed by October 31st and the TRU must be registered in ARB’s Equipment Registration (ARBER) system. Owners that place orders for VDECS after October 31st will not qualify for this compliance extension, even if they cannot comply by December 31st. Replacement engine availability may have improved so that repowering model year 2005 TRUs with new, cleaner engines may be possible by December 31, 2012, if you order now. Call your TRU engine dealers and installers now to place your replacement engine purchase orders while engines may still in stock and technicians and installation facilities may be available. Please be aware that the TRU Regulation’s purchase order deadline for replacement engines has passed, as of August 31, 2012; so, compliance extensions will not be granted for replacement engines purchased after that date if engine installation cannot be completed by December 31, 2012. That is why it is important for owners of model year 2005 TRUs to place their purchase orders for replacement engines as soon as possible, while engines may still in stock. If your TRU engine dealer and installer cannot commit to completing the engine repower by December 31, 2012, you may need to consider a different compliance option; and instead, you may need to place an order for a verified diesel emissions control strategy (VDECS), such as a diesel particulate filter. The purchase order deadline for VDECS is October 31, 2012. If you order your VDECS by October 31st, you may qualify for a compliance extension if delivery and installation are delayed and compliance is not possible by December 31, 2012. Repowering with a new, cleaner engine will not meet the required Ultra-Low Emissions TRU (ULETRU) in-use performance standard; however, repowering does reset the compliance date for meeting the ULETRU in-use standard to seven years after the replacement engine’s effective model year. Therefore, a model year 2012 replacement engine would still need to meet ULETRU by December 31, 2019, to remain in compliance after that date. If you elect to comply by retrofitting an in-use engine with a VDECS that meets ULETRU, please be sure to only order a Level 3 VDECS, which will reduce diesel PM emissions by at least 85 percent. Once a TRU meets the ULETRU in-use standard, there are no more-stringent in-use performance standards that apply. Also, beginning January 1, 2013, California law will require freight brokers, forwarders, shippers, and receivers to only hire and dispatch TRU-equipped trucks, trailers, shipping containers, and railcars that are compliant with the in-use performance standards if the perishable load will travel on California highways or railways. TRU Advisory 12-24 explains issues related to purchasing transport refrigeration units (TRU) equipped with flexibility engines after the Tier 4 Final (Tier 4f) new engine emissions standard for 25 to 50 horsepower (hp) engines goes into effect in 2013. Background: TRUs are refrigeration systems powered by integral diesel internal combustion engines designed to control the environment of temperature-sensitive products that are transported in trucks, trailers, shipping containers, and railcars. The emissions from these units are a source of unhealthful air pollutants including particulate matter, toxic air contaminants, nitrogen oxides, carbon monoxide, and hydrocarbons, and pose a potential threat to both public health and the environment. These units often congregate in large numbers at California distribution centers, grocery stores, and other facilities where they run for extended periods of time to ensure their perishable contents remain cold or frozen. These distribution and loading facilities are often in close proximity to schools, hospitals, and residential neighborhoods. In 2004, the TRU Regulation was adopted by the Board to reduce diesel particulate matter emissions from TRUs and TRU generator set engines. This guidance document explains requirements for the use of electric standby and hybrid electric systems (together referred to as E/S) as an option for compliance with California’s TRU regulations' in-use performance standards. A TRU’s compliance can be maintained beyond seven years if an E/S system is integrated into the equipment and used within the guidelines for an Alternative Technology. Also provided are specifications for businesses interested in providing electronic-tracking systems (ETS) to affected TRU owners. These requirements were added in the 2011 Amendments. Manual recordkeeping is required, beginning November 14, 2012. ETS includes automated monitoring, recordkeeping, and reporting, with GPS tracking, and is required beginning January 1, 2013, for 50 percent of a fleet’s TRUs that are complying with the TRU Regulation’s in-use standards by using E/S systems. The remaining 50 percent of a fleet’s E/S-equipped TRUs that are complying with the in-use standards by using E/S must be equipped with ETS by January 1, 2014. The letter reminds fleets that heavier vehicles with 2000 to 2004 model year engines that they must have verified soot filters and/or upgrades to newer vehicles by January 1, 2013. Similar requirements for vehicles with 1996 to 1999 model year engines became effective earlier this year. Vehicles may also be eligible for certain flexibility options. The letter can be found at: http://www.arb.ca.gov/msprog/truckstop/pdfs/enf-tb-letter2.pdf ARB intends to promptly enforce the January 1, 2013 requirements. Non-compliant vehicles may not be operated in California and will be assessed penalties that start at a minimum of $1,000 per violation per month and increase significantly over time. Do not delay in taking action to clean up your fleet - the installation of a PM filter may take a month or longer to accomplish; however, you may be able to significantly reduce penalties by taking action now.
