Repowering a TRU ceases to qualify as a compliance option when the replacement engine is no cleaner than the old engine being replaced. Title 13 California Code Regulations (13 CCR), section 2477.5(i) stipulates that a replacement engine shall meet a more stringent emissions standard than the engine being replaced. To evaluate if this limitation applies to their TRUs, TRU owners need to determine what emission standard tier is met by the in-use engine being replaced and compare that to the tier standard that is met by the cleanest replacement engine that will fit and perform in the TRU. Examples follow: 1. Trailer TRUs or TRU generator sets equipped with MY 2008 through 2012 Tier 4i in-use engines rated at 25-50 hp: The only replacement engine that will fit and perform is another Tier 4i replacement engine, which does not result in a cleaner replacement engine. Therefore, the repower compliance option for MY 2008 to MY 2012 25-50 hp trailer TRU and TRU gen set engines fails to qualify in 2015. 2. TRUs equipped with MY 2008 and newer Tier 4 in-use engines rated at less than 25 hp: The only replacement engine that will fit and perform is another Tier 4 less than 25 hp replacement engine, which does not result in a cleaner replacement engine. Therefore, the repower compliance option for MY 2008 and newer less than 25 hp TRU engines fails to qualify in 2015. Please be aware of possible cases where TRUs manufactured in 2008 could still use the replacement engine compliance option if they are equipped with Tier 2 engines: Case 1: During the first quarter of 2008, TRU manufacturers may have installed MY 2007 engines that were manufactured in the last few months of 2007, which met Tier 2 emission standards. This lag is allowed for normal production, shipping, and inventory practices. Case 2: TRU OEMs may have installed “flexibility engines” into TRUs manufactured during the remainder of 2008 and possibly 2009 for a limited number of engines. Flexibility engines that were installed in TRUs manufactured in 2008 and 2009 have an effective model year of 2007 and met Tier 2 emission standards. Flexibility engines have emissions labels that include the following text: “SELLING OR INSTALLING THIS ENGINE FOR ANY PURPOSE OTHER THAN FOR THE EQUIPMENT FLEXIBILITY PROVISIONS OF 40 CFR 1039.625 MAY BE A VIOLATION OF FEDERAL LAW SUBJECT TO CIVIL PENALTY.” In-use engines that met Tier 2 can be replaced by replacement engines that meet the cleaner Tier 4i emission standards to qualify as a compliance option under 13 CCR section 2477.5(i). It should also be noted that the engine replacement compliance option is not very attractive for TRUs manufactured in 2008 that are equipped with MY 2007 engines or flexibility engines that have an effective model year of 2007 that must comply by the end of 2015. Those replacement engines’ effective model year is 2012, so the ULETRU compliance deadline would be December 31, 2019, which only results in about four years of compliance before the ULETRU in-use performance standard has to be met. For example, if a trailer TRU that was manufactured in 2008 is equipped with an MY 2007 original engine, the compliance date is December 31, 2015 (based on the unit manufacture year). If the owner chooses to repower the TRU with a Tier 4i replacement engine, the effective model year of the replacement engine is 2012 (the last year that Tier 4i was in effect), and compliance with ULETRU in-use standard would then be required by December 31, 2019 (seven years after the effective model year). In this example, the operational life of the replacement engine would only be about four years (from late 2015 to the end of 2019). What compliance options remain? Retrofitting with a Level 3 Verified Diesel Emissions Strategy (VDECS) may be something to consider because Level 3 VDECS meet the TRU Regulation’s ULETRU In-Use Performance Standard. Another option is to replace the unit with a new unit. The emissions from these units are a source of unhealthful air pollutants including particulate matter, toxic air contaminants, nitrogen oxides, carbon monoxide, and hydrocarbons, that all pose a potential threat to both public health and the environment. These units often congregate in large numbers at California distribution centers, grocery stores, and other facilities where they run for extended periods of time to ensure their perishable contents remain cold or frozen. These distribution and loading facilities are often in close proximity to schools, hospitals, and residential neighborhoods. In 2004, the TRU Airborne Toxic Control Measure (ATCM) was adopted by the Board to reduce diesel particulate matter emissions from TRUs and TRU gen set engines. Significant improvements in efficiency and the use of renewable fuels are also needed to meet the Governor’s 50 percent petroleum reduction target by 2030, and continued reductions in diesel PM and air toxics are necessary to protect public health. Achieving each of these goals will require a transition to zero and near-zero emission technologies in all mobile sources. The Draft Overview highlights technology and fuels that could help us achieve those goals, and covers several heavy-duty technology sectors, including: • trucks and buses • transport refrigeration units • locomotives • fuels – both conventional and alternative fuels • ocean-going vessels • commercial harbor craft (SCAQMD lead) • cargo handling equipment, and • aviation – including aircraft and ground support equipment This technology assessment is on-going and focuses not only on zero and near-zero emission technologies that will ultimately be necessary to meet long-term air quality and climate goals, but also on improvements to conventional technologies and gains in vehicle and freight system operational efficiency that could provide substantial near-term emissions reductions and help facilitate the transition to zero and near-zero emission technologies. The Draft Overview is now posted. More detailed draft assessments for each of the sectors listed above will be posted in 2015, as the drafts are completed. The draft sector reports will evaluate how each technology works, the fuels necessary to power each technology, as well as its state of market readiness, costs, environmental benefits, technology performance, and current deployment challenges. Transport refrigeration unit (TRU) fleets and refrigerated distribution centers that are interested in funding for zero emission TRs or DC infrastructure may be interested in a workshop webcast that is scheduled for Monday, April 27, 2015, from 2:00 p.m. to 4:00 p.m. to learn about ARB’s proposed Prop 1B funding guidelines update. Zero emission TRs are all-electric TRs, cryogenic TRs, or fuel cell-powered TRs that must be used with DC infrastructure. DC infrastructure includes electric power plugs that are compatible with (and would be used with) all-electric TRs, hybrid-electric TRUs, or TRUs equipped with electric standby. Infrastructure also includes cryogenic refrigeration fueling equipment leases that would be used with cryogenic TRs. Short-lived climate pollutants (SLCPs) include methane, tropospheric ozone, black carbon, and fluorinated gases. They are powerful climate forcers that remain in the atmosphere for a much shorter period of time than longer-lived climate pollutants, including carbon dioxide. Their relative potency, when measured in terms of how they heat the atmosphere, can be tens to thousands of times greater than that of carbon dioxide (CO2). Senate Bill 605 (Lara, Chapter 523, Statutes of 2014) requires ARB, in coordination with other state agencies and local air districts, to develop a SLCP Strategy by the end of 2015, to further reduce SLCP emissions in California. The Concept Paper presents initial ideas that will be considered and evaluated in the coming months by ARB staff, in coordination with other agencies, as it develops a SLCP Strategy pursuant to SB 605. The concepts included in this discussion draft do not represent commitments at this time, nor do they comprise an exhaustive list of elements or considerations that may be included in the Strategy or shape its development. The intent of the paper is to elicit new ideas and refine strategies to reduce emissions of SLCPs throughout the state. The Concept Paper will be discussed at a May 27, 2015, public workshop. The comments received on the Concept Paper will inform the development of a draft Strategy that ARB expects to release for public comment later this summer. Background To achieve its healthy air quality, climate, and sustainability goals, California must take effective, well-coordinated actions to transition to a zero emission transportation system for both passengers and freight. The freight transport system is a major economic engine for California, but also accounts for about half of toxic diesel particulate matter, 45 percent of the emissions of nitrogen oxides (NOx) that form ozone and fine particulate matter in the atmosphere, and 6 percent of the greenhouse gas emissions in California. These statistics include emissions from trucks, ships, locomotives, aircraft, harbor craft, and all types of equipment used to move freight at seaports, airports, rail yards, warehouses and distribution centers. Proposed amendments to the LSI Fleet Regulation are identified in the Sustainable Freight Strategy as a Near-Term ARB Measure. In 1998, ARB first adopted emission standards for new spark-ignited engines used in propane forklifts and other similar industrial equipment. These engines are referred to as LSI engines. In addition to forklifts, the LSI category includes airport ground support equipment (GSE), sweepers and scrubbers, generator sets, small irrigation pumps, and a variety of other similar equipment. The LSI Fleet Regulation applies to operators of forklifts, sweeper/scrubbers, industrial tow tractors, and airport GSE. These vehicles are found in approximately 2,000 LSI fleets in California in industries as diverse as manufacturing, wholesale, transportation and utilities, retail, services, and construction, as well as public agencies. The 2006 LSI rulemaking and 2010 amendments required operators of in-use fleets to achieve specific hydrocarbon + NOx fleet average emission level (FAEL) standards that became more stringent over time, the lowest FAEL for large and medium fleets was to be achieved in 2013. The standards are also more stringent for forklifts than they are for non-forklift LSI equipment. The stringency of the standards reflects the differences in availability of retrofit devices for the four categories of in-use LSI equipment as well as the greater ability of large fleets to incorporate zero and near zero-emission equipment into their operations. Please be aware that replacement engines may no longer be a compliance option because replacement engines must be cleaner than the old engine being replaced and there is no replacement engine that fits and functions that is cleaner than the old MY 2008 engine that needs to comply (see TRU Advisory 13-18, page 7 for more detailed explanation at: http://www.arb.ca.gov/diesel/tru/advisories.htm). Model year 2008 TRU engines must comply with the TRU Regulation’s in-use standards by December 31, 2015. To qualify for this compliance extension, the TRU must be registered in ARB’s Equipment Registration (ARBER) system, purchase orders must be placed before the purchase order deadlines, and compliance extension applications must be submitted by December 31st. The purchase order deadlines that apply to TRUs are: • For TRUs, and engine replacements: August 31st (four months ahead of the compliance deadline); and • For verified diesel particulate filter retrofits: October 31st (two months ahead of the compliance deadline). Replacement trailers should be ordered much sooner due to long lead times and the current manufacturing backlog. Owners must exercise due diligence in attempting to comply by the end of 2015. Due diligence means conducting the compliance process with a measure of prudence, responsibility, and diligence that is expected from, and ordinarily exercised by a reasonable and prudent person under the circumstances. For example, starting the research, budgeting, and financing well in advance of the compliance deadline, and purchasing the compliance technology before the purchase order deadline. The compliance extension application, with attached supporting documentation that demonstrates due diligence was used, must be received at ARB by December 31, 2015. All model year 2007 and older TRU engines (or units manufactured in 2007 or earlier) should already be in compliance now. Please note that trailer manufacture year and in-service dates are not used to determine TRU compliance dates. Deadline for Reefer Compliance Orders Approaches From: rhill@arb.ca.gov Order compliance technology now for your 2008 transport refrigeration units (TRU) and TRU generator sets to beat the purchase order deadlines. Order now to avoid penalties due to long lead times and backorders. Order new replacement TRUs and TRU generator sets by August 31, 2015, to meet December 31, 2015, deadline for model year 2008 engines/units. If you plan to replace a trailer, you may be too late due to backlogs at refrigerated trailer manufacturers. The California Air Resources Board (ARB) recommends that transport refrigeration unit (TRU or reefer) and TRU generator set owners take action to plan and order compliance options to ensure TRU model year 2008 engines (or units manufactured in 2008) comply with in-use performance standards by the end of 2015. Please be aware that replacement engines may no longer be a compliance option because replacement engines must be cleaner than the old engine being replaced and there is no replacement engine that fits and functions that is cleaner than an MY 2008 engine (see TRU Advisory 13-18, page 7 for more detailed explanation at: http://www.arb.ca.gov/diesel/tru/advisories.htm). The TRU Regulation allows compliance extensions if delivery or installation is delayed; but, to qualify for these extensions, the unit must be registered in ARB’s Equipment Registration (ARBER) system and purchase orders must be placed early enough to take into account large order backlogs, delivery, installation, holiday, and year-end compacted schedules. The TRU Regulation has the following purchase order deadlines: • For engine replacements and unit replacements: By the end of August -- four months ahead of the compliance deadline; and • For verified diesel particulate filter retrofits: By the end of October -- two months ahead of the compliance deadline. Owners must exercise due diligence in attempting to comply by the end of 2015. Due diligence means conducting the compliance process with a measure of prudence, responsibility, and diligence that is expected from, and ordinarily exercised by a reasonable and prudent person under the circumstances. For example, start the research, budgeting, and financing well in advance of the compliance deadline, and purchase the compliance technology before the purchase order deadline. The compliance extension application (with attached supporting documentation that demonstrates due diligence was used) must be received at ARB by December 31, 2015. All model year 2007 and older engines (or units manufactured in 2007 or earlier) should be in compliance now. Please note that trailer manufacture year and in-service dates are not used to determine compliance dates. Noncompliant model year 2007 and older TRU/TRU genset engines/units must not be operated in California unless they are brought into compliance immediately. Where can I get more information? Such technologies support ARB’s long term objective of transforming the on- and off-road mobile source fleet into one utilizing zero and near-zero emission technologies to meet air quality and climate change goals. Sources of information used in the draft assessment include an extensive list of published reports, research papers, and documented conversations with technology experts. The draft assessment discusses each technology by providing a basic description, the current state of development or commercial readiness, economics, potential emission reductions, advantages, and key performance parameter issues and deployment challenges. August 31st is the purchase order deadline for new replacement TRUs and TRU generator sets. Order now to avoid penalties due to manufacturer or installer delay. Model year 2008 engines/units must meet the TRU Regulation’s in-use performance standards by December 31, 2015. It is probably too late to order refrigerated trailers due to long backlogs at refrigerated trailer manufacturers. The California Air Resources Board (ARB) recommends that TRU and TRU generator set owners take action now to order compliance options to ensure TRU model year 2008 engines (or units manufactured in 2008) comply with in-use performance standards by the end of 2015. The TRU must be registered in ARB’s Equipment Registration (ARBER) system, and 3. An application for extension must be submitted to ARB with the required documentation by December 31st. Owners that place orders for Level 3 VDECS after October 31st will NOT qualify for this compliance extension if they discover they cannot comply by December 31st due to delays in delivery or installation. Owners must exercise due diligence in attempting to comply by the end of 2015. Due diligence means conducting the compliance process with a measure of prudence, responsibility, and diligence that is expected from, and ordinarily exercised by a reasonable and prudent person under the circumstances. For example, start the research, budgeting, and financing well in advance of the compliance deadline, and purchase the compliance technology before the purchase order deadline. The compliance extension application (with attached supporting documentation that demonstrates due diligence was used) must be received at ARB by December 31, 2015. Also, California law now requires freight brokers, forwarders, shippers, and receivers to only hire and dispatch TRU-equipped trucks, trailers, shipping containers, and railcars that are compliant with the TRU Regulation's in-use performance standards if the perishable load will travel on California highways or railways. All TRUs and TRU generator sets must now be in compliance with the in-use performance standards to be legally hired to transport perishable goods on California highways or railways. Short-lived climate pollutants (SLCPs) include methane, black carbon, and fluorinated gases. They are powerful climate forcers that remain in the atmosphere for a much shorter period of time than longer-lived climate pollutants, including carbon dioxide. Their relative potency, when measured in terms of how they heat the atmosphere, can be tens to thousands of times greater than that of carbon dioxide. Senate Bill 605 (Lara, Chapter 523, Statutes of 2014) requires ARB, in coordination with other state agencies and local air districts, to develop a SLCP Strategy by the end of 2015, to reduce SLCP emissions in California. The Draft Strategy describes ongoing and potential new measures to reduce SLCP emissions from major sources in the State, and describes current and future research needs for improving the SLCP emission inventory and better understanding potential mitigation measures. The Draft Strategy will be discussed at public workshops in October. From: rhill@arb.ca.gov The California Air Resources Board (ARB) reminds model year (MY) 2008 transport refrigeration unit (TRU) owners: If you want to qualify for compliance extensions, only about three and a half weeks remain before the purchase order deadline for ordering Level 3 verified diesel emissions control strategies (VDECS), such as diesel particulate filters (DPF) for retrofitting your engines. MY 2008 TRU and TRU generator set engines must comply with the TRU Regulation’s in-use performance standards by December 31, 2015. Please be aware that replacement engines may no longer be a compliance option because replacement engines must be cleaner than the old engine being replaced and there is no replacement engine that fits and functions that is cleaner than a MY 2008 engine (see TRU Advisory 13-18, page 7 for more detailed explanation at: http://www.arb.ca.gov/diesel/tru/advisories.htm). Also, be aware that orders for replacement units that are placed after August 31st will NOT be eligible for compliance extensions if delivery or installation will be completed after December 31st, 2015. The TRU Regulation does not allow compliance extensions if orders for VDECS, such as Level 3 DPFs, are placed after October 31, 2015 and installation is not completed by December 31st, 2015. However, if MY 2008 TRU owners order Level 3 DPFs before the end of October, installation by the end of 2015 is very likely possible. From: rhill@arb.ca.gov The California Air Resources Board (ARB) reminds model year (MY) 2008 TRU engine owners: If you want to qualify for compliance extensions, only one week remains before the purchase order deadline for ordering Level 3 verified diesel particulate filters (DPF) for retrofitting your reefer engines. MY 2008 transport refrigeration unit (TRU) and TRU generator set engines must comply with the TRU Regulation’s in-use performance standards by December 31, 2015. Please be aware that replacement engines may no longer be a compliance option because replacement engines must be cleaner than the old engine being replaced and there is no replacement engine that fits and functions that is cleaner than an MY 2008 engine (see TRU Advisory 13-18, page 7 for more detailed explanation at: http://www.arb.ca.gov/diesel/tru/advisories.htm). The TRU Regulation does not allow compliance extensions if orders for verified diesel emissions control strategies, such as Level 3 DPFs, are placed after October 31st and installation is not completed by December 31st, 2015. However, if MY 2008 TRU engine owners order verified diesel emissions control strategies (VDECS), such as Level 3 DPFs, by the end of October, installation by the end of 2015 is very likely possible. More importantly, if you order a Level 3 DPF before October 31st and delivery or installation is delayed so that you can’t comply by the end of 2015, you may qualify for a compliance extension. To qualify for compliance extension: • Purchase orders for Level 3 DPFs must be placed by October 31st, • The TRU must be registered in ARB’s Equipment Registration (ARBER) system, and • An application for extension must be submitted to ARB with the required documentation by December 31, 2015. Again, MY 2008 TRU engine owners that place orders for Level 3 VDECS AFTER October 31st will NOT qualify for this compliance extension if they discover they cannot comply by December 31st due to delays in delivery or installation. The notice would also say the hiring business entity now requires refrigerated carriers to: 1) certify to the hiring business entity that they (the carrier) will only dispatch TRUs that comply with the in-use performance standards; 2) register their TRUs in ARB's Equipment Registration (ARBER) system if they will travel on California highways or railways; 3) print out the ARBER certification page for each TRU; and 4) send the ARBER certification pages to the broker, forwarder, shipper, or receiver. From: rhill@arb.ca.gov Did you order compliance technology for your model year 2008 transport refrigeration unit (TRU) by the purchase order deadline, but delivery or installation will be delayed past the December 31, 2015 deadline?. December 31st is the compliance extension application deadline for TRUs. So, if you qualify for an extension, be sure to submit your application with attached supporting documentation to ARB by the December 31st deadline. To qualify for the compliance extension, you must have purchased compliance technology by the purchase order deadline. The TRU Regulation’s purchase order deadlines are as follows: • For reefer trailer, TRU unit replacements and TRU engine replacements: August 31st -- four months ahead of the compliance deadline; and • For verified diesel particulate filter retrofits: October 31st -- two months ahead of the compliance deadline. For model year 2008 engines/TRUs, owners must make a good-faith effort to comply by the end of 2015. If in-use compliance cannot be achieved by December 31, 2015, due to delays in delivery or installation, owners may apply for a compliance extension. The compliance extension application, with attached supporting documentation showing purchase order date was on or before the above applicable deadlines, must be received at ARB by December 31, 2015. The emissions from these units are a source of unhealthful air pollutants including particulate matter, toxic air contaminants, nitrogen oxides, carbon monoxide, and hydrocarbons, that all pose a potential threat to both public health and the environment. These units often congregate in large numbers at California distribution centers, grocery stores, and other facilities where they run for extended periods of time to ensure their perishable contents remain cold or frozen. These distribution and loading facilities are often in close proximity to schools, hospitals, and residential neighborhoods. In 2004, the TRU Airborne Toxic Control Measure (ATCM) was adopted by the Board to reduce diesel particulate matter emissions from TRUs and TRU gen set engines. During the workshop and separate webinar, interagency staff will provide an overview of the process for preparing the Action Plan and its envisioned content, as well as seek public input on what measures, incentives, and partnerships are needed to develop a sustainable freight transport system in California. Each workshop and webinar will follow the same format and show the same presentation. Staff will give a presentation at the Main location, which will be broadcast to satellite locations. Staff will be available at the satellite locations to assist with questions. Specific locations and workshop materials, including an agenda, will be forthcoming. The Action Plan will include specific recommendations, actions, investments, and milestones agencies can consider developing and build a sustainable freight transportation system that will demonstrate California’s private and public leadership in advancing statewide and national freight priorities, objectives, and goals, and accomplishing statewide goals, such as the targets identified in the Executive Order. The State will establish clear targets for improving freight efficiency and transitioning to zero-emission technologies in the freight transport system, while continuing to support California’s economy. The Action Plan will identify State policies, programs, and investments that can achieve those targets. The State will also initiate work on identifying corridor level freight pilot projects within the State’s primary trade corridors that achieve the targets set by the Executive Order by integrating advanced technologies, alternative fuels, freight and fuel infrastructure, and local economic development opportunities.
