The compliance deadline for model year 2008 TRU and TRU generator set engines to meet the TRU Regulation’s in-use performance standards was December 31, 2015. Model year 2001 and older TRU and TRU generator set engines that previously met a less stringent in-use performance standard would also have to meet a more stringent in-use performance standard if they are to continue operating in California. Some TRU and TRU genset engines have not been brought into compliance by the December 31, 2015, deadline, so they cannot legally be hired to operate in California. Brokers, forwarders, shippers and receivers that hire refrigerated carriers that will operate in California must use due diligence in hiring only compliant carriers and must provide documents to the carriers they hire that show who hired them. Refrigerated carriers must only dispatch compliant equipment if it will operate in California and they must provide their drivers with documents showing who hired them. Drivers must, upon request by authorized personnel, provide those documents showing who hired them. The emissions from these units are a source of unhealthful air pollutants including particulate matter, toxic air contaminants, nitrogen oxides, carbon monoxide, and hydrocarbons, that all pose a potential threat to both public health and the environment. These units often congregate in large numbers at California distribution centers, grocery stores, cold storage warehouses, intermodal facilities, packing houses, and other facilities where they run for extended periods of time to ensure their perishable contents remain cold or frozen. These distribution and loading facilities are often in close proximity to schools, hospitals, and residential neighborhoods. In 2004, the TRU Airborne Toxic Control Measure (ATCM) was adopted by the Board to reduce diesel particulate matter emissions from TRUs and TRU gen set engines. Background: TRUs are refrigeration systems designed to control the environment of temperature sensitive products that are transported in trucks, trailers, shipping containers, and railcars. Most TRUs are powered by diesel engines that are located inside the unit housing. These engines emit diesel particulate matter, oxides of nitrogen, greenhouse gases, and other pollutants while in transit and during stationary operation. The concepts that will be discussed at the workshop focus on reducing the amount of time that TRUs operate using diesel power while refrigerated trucks, trailers and shipping containers are parked (stationary) at certain California facilities and other locations. These concepts affect TRUs, as well as the many types of facilities and locations where TRUs operate. These facility types and locations include, but are not limited to, grocery stores, grocery distribution centers, foodservice distribution centers, food manufacturing facilities, wholesale distribution centers, logistics facilities, cold storage warehouses, truck stops, port terminals and depots, intermodal facilities, airports, public rest areas, carrier terminals, rail yards, rail sidings, fairs and events, restaurants, and convenience stores. Staff believes that stationary TRU operations could be reduced by using vehicle tracking technologies (such as GPS) and transportation management systems and procedures to reduce the time spent waiting to load or unload refrigerated goods at distribution centers and cold storage warehouses. In addition, greater use of hybrid electric TRUs, which can be plugged into the electric power grid to run on electricity when parked, could reduce stationary engine operation. Also, cryogenic transport refrigerators (which use liquid air, nitrogen or carbon dioxide to cool cargo), or all electric shipping containers (plugged into the electric power grid) could be used for cold storage instead of conventional diesel engine powered TRUs. Implementation would be phased in between 2020 and 2030. This effort was initiated in April 2015 in response to ARB Board direction to staff to pursue the development of near term actions described in the Sustainable Freight: Pathways to Zero and Near Zero Emissions, Discussion Draft. One of those near-term actions is to develop and propose requirements that would reduce emissions from TRUs powered by diesel and other fossil fueled engines for cold storage and stationary operations. This action goes beyond the existing TRU Airborne Toxic Control Measure (ATCM), which was adopted in 2004 (and amended in 2010 and 2011) to reduce diesel particulate matter (PM) emissions from TRU engines. SLCPs include black carbon, methane, and fluorinated gases, including hydrofluorocarbons. The impacts of SLCPs are especially strong within the near term. Reducing these emissions can have an immediate beneficial impact on climate change. SLCP reductions are important to continuing and maintaining the greenhouse gas reductions called for by AB 32 (Nunez, Chapter 488, Statutes of 2006) and SB 605 (Lara, Chapter 523, Statutes of 2014), and to ensuring emissions meet the statewide greenhouse gas emission limit that AB 32 established. The Proposed Strategy is identified in the First Update to the Climate Change Scoping Plan as one of the recommended actions to achieve additional greenhouse gas emission reductions. SB 605 further requires ARB, in coordination with other State agencies and local air districts, to develop a strategy to further reduce SLCP emissions in California. A Draft Strategy was released for public comment on September 30, 2015. After considering comments received, ARB staff released the Proposed Strategy on April 11, 2016, which will be presented to the Board at a public meeting on May 19, 2016. The Board will not vote on the Proposed Strategy at this meeting; a second Board meeting will be scheduled for either late summer or early fall for the Board to consider approving a final SLCP Strategy, along with final environmental documents. Environmental Analysis ARB, as the lead agency for the Proposed Strategy, prepared a Draft Environmental Analysis (EA) in accordance with the requirements of the California Environmental Quality Act (CEQA) and ARB’s regulatory program certified by the Secretary of Natural Resources (California Code of Regulation, title 17, sections 60006-60008; California Code of Regulation, title 14, section 15251, subdivision (d)). The resource areas from the CEQA Guidelines Environmental Checklist were used as a framework for a programmatic environmental analysis of the reasonably foreseeable compliance responses resulting from implementation of the proposed measures discussed in the Proposed Strategy. The Draft EA provides an analysis of both the beneficial and adverse impacts and feasible mitigation measures for the reasonably foreseeable compliance responses associated with the proposed measures under each of the 17 environmental resource areas. Collectively, the Draft EA concluded implementation of these actions could result in the following short-term and long-term beneficial and adverse impacts: beneficial long-term impacts in reduced greenhouse gas emissions; less-than-significant impacts to air quality, biological resources, energy demand, geology and soils, greenhouse gases (short-term), hazards and hazardous materials, hydrology and water quality, resources related to land use planning, mineral resources, noise, population and housing, public services, and recreational services; and potentially significant and unavoidable adverse impacts to aesthetics, agriculture and forest resources, air quality, biological resources, cultural resources, geology and soils, hazards and hazardous materials, hydrology and water quality, resources related to land use planning, noise, transportation/traffic, and utilities and service systems. The potentially significant and unavoidable adverse impacts are primarily related to short-term construction-related activities, which explains why some resource areas are identified above as having both less-than-significant impacts and potentially significant impacts. The Board will not vote on the Proposed Strategy at this meeting; a second Board meeting will be scheduled for either late summer or early fall for the Board to consider approving a final SLCP Strategy, along with final environmental documents. Environmental Analysis ARB, as the lead agency for the Proposed Strategy, prepared a Draft Environmental Analysis (EA) in accordance with the requirements of the California Environmental Quality Act (CEQA) and ARB’s regulatory program certified by the Secretary of Natural Resources (California Code of Regulation, title 17, sections 60006-60008; California Code of Regulation, title 14, section 15251, subdivision (d)). The resource areas from the CEQA Guidelines Environmental Checklist were used as a framework for a programmatic environmental analysis of the reasonably foreseeable compliance responses resulting from implementation of the proposed measures discussed in the Proposed Strategy. The Draft EA provides an analysis of both the beneficial and adverse impacts and feasible mitigation measures for the reasonably foreseeable compliance responses associated with the proposed measures under each of the 17 environmental resource areas. Collectively, the Draft EA concluded implementation of these actions could result in the following short-term and long-term beneficial and adverse impacts: beneficial long-term impacts in reduced greenhouse gas emissions; less-than-significant impacts to air quality, biological resources, energy demand, geology and soils, greenhouse gases (short-term), hazards and hazardous materials, hydrology and water quality, resources related to land use planning, mineral resources, noise, population and housing, public services, and recreational services; and potentially significant and unavoidable adverse impacts to aesthetics, agriculture and forest resources, air quality, biological resources, cultural resources, geology and soils, hazards and hazardous materials, hydrology and water quality, resources related to land use planning, noise, transportation/traffic, and utilities and service systems. The potentially significant and unavoidable adverse impacts are primarily related to short-term construction-related activities, which explains why some resource areas are identified above as having both less-than-significant impacts and potentially significant impacts. Developed in response to Governor Brown’s Executive Order B-32-15, which calls for a single integrated action plan for California, the Draft Action Plan was drafted by the California State Transportation Agency, California Environmental Protection Agency, Natural Resources Agency, California Air Resources Board, California Department of Transportation, California Energy Commission and Governor’s Office of Business and Economic Development with broad stakeholder input. The Executive Order directs the state agencies to pursue a shared vision to “improve freight efficiency, transition to zero-emission technologies and increase the competitiveness of California’s freight system.” Benefits include meeting the state’s freight infrastructure, public health, air quality and climate goals. The Draft Action Plan responds to the Governor’s Executive Order by articulating one shared vision to improve the efficiency of California’s freight system while reducing its pollution, all the while bolstering the competitiveness of California’s goods movement system nationally and internationally. Each component is critical and the system depends on these interconnected facilities working in concert to move freight in and out of California to the rest of the nation and across the globe. California’s freight-dependent industries account for more than $740 billion in revenue and more than 5 million jobs in 2014. "This is an unprecedented effort to partner with the freight sector to help bolster the competitiveness of California's freight industry," said Governor Brown’s senior jobs adviser Mike Rossi. "The freight sector has already invested heavily in modernization and the Action Plan helps advance those efforts while reducing emissions through commercially viable and affordable technologies." While freight transport in California is a major economic engine for the state, emissions from ships, harbor craft, trucks, locomotives, cargo equipment, aircraft and other freight participants account for about half of toxic diesel particulate matter (PM 2.5), 45 percent of the emissions of nitrogen oxides (NOx) that form ozone and fine particulate matter in the atmosphere, and 6 percent of all greenhouse gas emissions in California. Many of these pollutants are emitted in close proximity to communities and pose health risks to nearby residents, highlighting the need for additional steps to protect public health. “The draft we are releasing today represents an unprecedented collaboration among government agencies, in keeping with the importance of the freight sector to our economy and our environment,” said CARB Chair Mary D. Nichols. “The plan commits to include all stakeholders at every step in the process, from refining goals and selecting pilot projects through implementation into the coming decade. Model year 2009 TRU engines must comply with the TRU Regulation’s in-use standards by December 31, 2016. Purchase orders for compliance equipment (e.g. replacement TRUs) or emissions control technology (e.g. diesel particulate filters) must be placed before the TRU Regulation’s purchase order deadlines to qualify for a compliance extension if delivery or installation is delayed until after December 31, 2016. To qualify for this compliance extension, the TRU must be registered in ARB’s Equipment Registration (ARBER) system, purchase orders must be placed before the purchase order deadlines, and compliance extension applications must be submitted by December 31st. The purchase order deadlines that apply to TRUs are: • For replacement TRUs: August 31st (four months ahead of the compliance deadline); and • For verified diesel particulate filter retrofits: October 31st (two months ahead of the compliance deadline). Replacement trailers should be ordered much sooner (i.e. now) due to long lead times and the current manufacturing backlog. Owners must exercise due diligence in attempting to comply by the end of 2016. Due diligence means conducting the compliance process with a measure of prudence, responsibility, and diligence that is expected from, and ordinarily exercised by a reasonable and prudent person under the circumstances. For example, starting the research, budgeting, and financing well in advance of the compliance deadline, and purchasing the compliance technology by the purchase order deadline. The compliance extension application, with attached supporting documentation that demonstrates due diligence was used, must be received at ARB by December 31, 2016. One compliance option to consider is hybrid electric TRUs and TRUs equipped with electric standby, which are often referred to as “eTRUs.” eTRUs are a compliance option, when used in a way that qualifies as Alternative Technology. For more details about these qualifications, please see ARB’s Guidelines for Electric Standby and Hybrid Electric Systems for Alternative Technology Compliance Strategies at: http://www.arb.ca.gov/diesel/tru/documents/guidance_electricstandby_ets.pdf . In addition to being a compliance option for the TRU Regulation, plugging in eTRUs while at loading docks or parking spots is a great way to reduce emissions, noise, and operating costs. Year five of the Proposition 1B: Goods Movement Emission Reduction Program (Prop 1B) is offering an option for reimbursement of up to $3,000 per electric power plug installed. Brown Jr., state agency leaders today released the California Sustainable Freight Action Plan, a comprehensive document that serves as a blueprint for transforming the state’s multi-billion dollar freight transport system into one that is environmentally cleaner, more efficient, and more economically competitive than it is today. The revised document is similar to the draft version issued in May 2016, but reflects new input provided by industry, labor, regional and local government, and community and environmental group stakeholders, who submitted more than 85 comments on the draft plan. “We listened to stakeholders, incorporated changes, and we will continue to consult with them as we put the Plan into action” said California Air Resources Board Chair Mary D. Nichols. “This dialogue -- and a commitment to shared responsibility for and ownership of this plan-- is the underpinning for the successful transformation of our freight transport system and the multiple benefits it will bring to our environment, communities and our economy.” Developed in response to Governor Brown’s Executive Order B-32-15, which calls for a single integrated action plan for California, the Action Plan was prepared by the California State Transportation Agency, California Environmental Protection Agency, California Natural Resources Agency, California Air Resources Board, California Department of Transportation, California Energy Commission and the Governor’s Office of Business and Economic Development, with broad stakeholder input. "The Sustainable Freight Action Plan reflects the hard work done by the partners to address the needs of the freight industry,” said Governor Brown’s senior jobs adviser Mike Rossi. “GO-Biz will continue working with our stakeholders in the business community to see that the Action Plan builds upon ongoing efforts to modernize the freight industry while reducing emissions and keeping it competitive through commercially viable and affordable technologies." Among the new additions to the final plan are placing more focus on key partnerships and a discussion of toxic hot spots. The California Air Resources Board (ARB) recommends that TRU and TRU generator set owners take action to order compliance options to ensure TRU MY 2009 engines (or units manufactured in 2009) comply with in-use performance standards by the end of 2016. Please be aware that replacement engines are no longer a compliance option because replacement engines must be cleaner than the old engine being replaced. There is no replacement engine that fits and functions that is cleaner than a MY 2008 engine (see TRU Advisory 13-18, page 7 for more detailed explanation at: https://www.arb.ca.gov/diesel/tru/advisories.htm). The TRU Regulation allows compliance extensions if delivery or installation is delayed; but, to qualify for these extensions, the TRU or TRU generator set must be registered in ARB’s Equipment Registration (ARBER) system and purchase orders must be placed early enough to take into account delivery, installation, holiday, and year-end compacted schedules. The purchase order deadlines are: • For TRU unit replacements: By the end of August -- four months ahead of the compliance deadline; and • For verified diesel particulate filter retrofits: By the end of October – two months ahead of the compliance deadline. Owners must exercise due diligence in attempting to comply by the end of 2016. Due diligence means conducting the compliance process with a measure of prudence, responsibility, and diligence that is expected from, and ordinarily exercised by a reasonable and prudent person under the circumstances. For example, start the research, budgeting, and financing well in advance of the compliance deadline, and purchase the compliance technology before the purchase order deadline. The compliance extension application (with attached supporting documentation that demonstrates due diligence was used) must be received at ARB by December 31, 2016. All model year 2008 and older TRU engines (or units manufactured in 2008 or earlier) should be in compliance now. Please note that trailer manufacture year and in-service dates are not used to determine TRU compliance dates. Noncompliant model year 2008 and older TRU engines/units must not be operated in California. Background: At the June 23, 2016 Board meeting, the Board approved the proposed FY 2016 17 Funding Plan which describes how ARB would spend $500 million in proposed Low Carbon Transportation and Fuels funding from the Greenhouse Gas Reduction Fund and $28.6 million for Air Quality Improvement Program (AQIP). At the time of the Board’s action, the Legislature had appropriated AQIP funds to ARB as part of the Budget Act of 2016 but had deferred action on the $500 million in Low Carbon Transportation and Fuels funding. Hence, the Low Carbon Transportation and Fuels elements of the Board-approved Funding Plan were contingent on appropriation of these funds. The Funding Plan included contingency provisions to address this budget uncertainty including direction that staff return with modifications to the plan in the event that the Legislature appropriated less than $400 million to ARB. On August 31, 2016, the Legislature appropriated $363 million to ARB for Low Carbon Transportation projects and provided direction on how these funds are used. The Legislature also approved an associated budget trailer bill which directs ARB to make a changes to the Clean Vehicle Rebate Project. Staff is proposing modifications to the FY 2016-17 Funding Plan to address the smaller budget appropriation and additional direction from the Legislature. MY 2009 TRU and TRU generator set engines must comply with the TRU Regulation’s in-use performance standards by December 31, 2016. Overall, the assessment finds that battery electric vehicles are beginning to penetrate the medium and heavy-duty vehicle markets and fuel cell electric vehicles are primarily in demonstration stages, although early commercial models are available for transit buses from two manufacturers. In addition, zero emission buses have similar performance and reliability as conventional buses and are in the early commercialization phase. Staff concluded that low-NOx engines would become commercially available soon. Therefore, ARB is currently in the process of working with stakeholders to develop an Advanced Clean Transit proposal and is also working on strategies to incorporate these advanced clean technologies in local delivery truck applications where suited. From: rhill@arb.ca.gov The California Air Resources Board (ARB) reminds model year (MY) 2009 TRU engine owners: If you want to qualify for compliance extensions, only one week remains before the purchase order deadline for ordering Level 3 verified diesel particulate filters (DPF) for retrofitting your reefer engines. MY 2009 transport refrigeration unit (TRU) and TRU generator set engines must comply with the TRU Regulation’s in-use performance standards by December 31, 2016. Please be aware that replacement engines are no longer a compliance option because replacement engines must be cleaner than the old engine being replaced and there is no replacement engine that fits and functions that is cleaner than an MY 2009 engine (see TRU Advisory 13-18, page 7 for more detailed explanation at: http://www.arb.ca.gov/diesel/tru/advisories.htm). The TRU Regulation does not allow compliance extensions if orders for verified diesel emissions control strategies, such as Level 3 DPFs, are placed after October 31st and installation is not completed by December 31st, 2016. However, if MY 2009 TRU engine owners order verified diesel emissions control strategies (VDECS), such as Level 3 DPFs, by the end of October, installation by the end of 2016 is very likely possible. More importantly, if you order a Level 3 DPF before October 31st and delivery or installation is delayed so that you can’t comply by the end of 2016, you may qualify for a compliance extension. To qualify for compliance extension: • Purchase orders for Level 3 DPFs must be placed by October 31st, • The TRU must be registered in ARB’s Equipment Registration (ARBER) system, and • An application for extension must be submitted to ARB with the required documentation by December 31, 2016. Again, MY 2009 TRU engine owners that place orders for Level 3 VDECS AFTER October 31st will NOT qualify for this compliance extension if they discover they cannot comply by December 31st due to delays in delivery or installation. The Rypos DPF/ULETRU is a Level 3+ diesel emission control strategy (DECS), capable of reducing emissions of particulate matter (PM) by 85 percent or more without increasing nitrogen dioxide emissions more than 20 percent of total nitrogen oxides. The RYPOS system consists of a diesel oxidation catalyst (DOC), an active exhaust filter and an automatic filter regeneration system. Specific engine models and families that may qualify are listed in the Engine Family List at ARB's Verification Procedure Website for the Rypos DPF/ULETRU at: http://www.arb.ca.gov/diesel/verdev/companies/rypos/uletru.htm (to be posted in the next few days). Rypos has completed all of the requirements for full verification, including extensive field demonstrations under worst-case conditions, showing reliable backpressure control. To qualify for retrofit with the Rypos DPF/ULETRU, TRU engines must be maintained in accordance with the engine and original equipment manufacturers’ specifications and meet all of the pre-installation compatibility assessment criteria established for the Rypos DPF/ULETRU. Background: At the June 23, 2016 Board meeting, the Board approved the proposed FY 2016-17 Funding Plan which describes how ARB would spend $500 million in proposed Low Carbon Transportation and Fuels funding from the Greenhouse Gas Reduction Fund and $28.6 million for Air Quality Improvement Program (AQIP). At the time of the Board’s action, the Legislature had appropriated AQIP funds to ARB as part of the Budget Act of 2016 but had deferred action on the $500 million in Low Carbon Transportation and Fuels funding. On August 31, 2016, the Legislature appropriated $363 million to ARB for Low Carbon Transportation projects and provided direction on how these funds are used. The Legislature also approved an associated budget trailer bill which directs ARB to make changes to the Clean Vehicle Rebate Project. At the October 20, 2016 Board meeting, the Board approved modifications to the FY 2016-17 Funding Plan to address the smaller budget appropriation and additional direction from the Legislature. Cap-and-Trade auction proceeds provide funding for ARB’s advanced technology, clean transportation incentive programs, expanding the types of projects ARB has funded through AQIP. These investments accelerate the transition to low carbon freight and passenger transportation, supporting the Governor’s climate change strategy pillar of a 50 percent reduction in petroleum use in vehicles by 2030 and the Administration’s goal to deploy 1.5 million zero emission vehicles in California by 2025. AQIP is a voluntary, mobile source incentive program that focuses on reducing criteria pollutant and diesel particulate emissions with concurrent reductions in greenhouse gas emissions. From: rhill@arb.ca.gov Did you order compliance technology for your model year 2009 transport refrigeration unit (TRU) by the purchase order deadline, but delivery or installation will be delayed past the December 31, 2016 deadline?. December 31st is the compliance extension application deadline for TRUs. So, if you qualify for an extension, be sure to submit your application with attached supporting documentation to ARB by the December 31st deadline. To qualify for the compliance extension, you must have purchased compliance technology by the purchase order deadline. The TRU Regulation’s purchase order deadlines are as follows: • For reefer trailer, TRU unit replacements and TRU engine replacements: August 31st -- four months ahead of the compliance deadline; and • For verified diesel particulate filter retrofits: October 31st -- two months ahead of the compliance deadline. For model year 2009 engines/TRUs, owners must make a good-faith effort to comply by the end of 2016. If in-use compliance cannot be achieved by December 31, 2016, due to delays in delivery or installation, owners may apply for a compliance extension. The compliance extension application, with attached supporting documentation showing purchase order date was on or before the above applicable deadlines, must be received at ARB by December 31, 2016. Background: On October 25, 2016, the U.S. EPA published the final federal Phase 2 GHG standards. The federal Phase 2 standards are the second phase of federal heavy–duty GHG standards and build upon the federal Phase 1 standards. The federal Phase 2 standards will significantly reduce carbon emissions and dramatically improve the fuel economy for heavy-duty tractors, helping reduce emissions that cause climate change. They establish national GHG emission standards that will begin in model year 2021 for new class 2b to 8 medium- and heavy-duty engines and tractors, and in 2018 model year for certain trailer types. The federal Phase 2 standards will be fully phased in by model year 2027. On December 11, 2008, the Board approved the Tractor-Trailer GHG regulation codified in sections 95300-95312 of title 17, California Code of Regulations, and later amended in 2010 and 2014. This regulation required owners of 53-foot or longer box-type trailers and owners of the heavy-duty tractors that pull them on California highways to utilize U.S. EPA SmartWay verified or designated technologies that will reduce GHG emissions and improve fuel efficiency. In December 2013, ARB staff harmonized the tractor requirements of the Tractor-Trailer GHG regulation with the requirements of the Phase 1 standards.
