DOORS allows fleets to complete the initial reporting required by the Board approved July 2016 amendments to the LSI Regulation. ARB strongly encourages fleets to begin the reporting process early to ensure that there is sufficient time to label equipment. The reporting deadline for medium and large forklift fleets and non-forklift fleets is June 30, 2017. The DOORS reporting homepage can be accessed at: https://ssl.arb.ca.gov/ssldoors/doors_reporting/doors_login.html For assistance with reporting, or with other aspects of the LSI Regulation, please call (877)59-DOORS, or email doors@arb.ca.gov The LSI forklift and non-forklift equipment types subject to the upcoming reporting and labeling requirements include the following types of equipment used to comply with the Fleet Average Emission Limits (FAEL) of the LSI Regulation: * Forklifts in class 1, 2, 4, and 5, including electric. * Non-forklift industrial tow tractors, sweepers/scrubbers, and airport ground support equipment, including electric. Fleets with up to three forklifts and/or up to three non-forklifts are exempt from the regulation but can voluntarily report and label their LSI equipment. Once LSI equipment has been reported in DOORS an Equipment Identification Number (EIN) will be issued. The LSI Regulation reporting user guides, importing equipment guides, the amended regulation language, and other useful LSI regulation information are available at https://www.arb.ca.gov/lsi. Background The LSI Fleet Regulation applies to operators of forklifts, sweeper/scrubbers, industrial tow tractors, and airport GSE. These vehicles are found in approximately 2,000 LSI fleets in California in industries as diverse as manufacturing, wholesale, transportation and utilities, retail, services, and construction, as well as public agencies. The 2006 LSI rulemaking and 2010 amendments required operators of in-use fleets to achieve specific hydrocarbon + oxides of nitrogen FAEL standards that became more stringent over time, the lowest FAEL for large and medium fleets was to be achieved in 2013. The standards are also more stringent for forklifts than they are for non-forklift LSI equipment. Small fleets and in-field equipment are exempt from the LSI Fleet Regulation. In July 2016, ARB approved amendments to the LSI Fleet Regulation These amendments require operators to: * Submit an initial report by June 30, 2017, and then annually thereafter; * Label all affected equipment with an ARB issued EIN; and * Continue recordkeeping as they have been required to do pursuant to the existing regulation. The existing performance requirements, including FAEL standards, were not modified by the amendments and continue to remain in effect. The amendments will improve enforcement effectiveness and compliance rates of the LSI Fleet Regulation when they take effect, and provide ARB staff with the necessary data to inform a future control measure for accelerating deployment of zero emission technology in the LSI sector. The compliance deadline for model year 2009 TRU and TRU generator set engines to meet the TRU Regulation’s in-use performance standards was December 31, 2016. Model year 2002 and older TRU and TRU generator set engines that previously met a less stringent in-use performance standard would also have to meet a more stringent in-use performance standard by December 31, 2016, if they continue operate in California. ARB is aware that some TRU and TRU genset engines have not been brought into compliance by the December 31, 2016, deadline, so they cannot legally be hired to operate in California. Brokers, forwarders, shippers and receivers that hire refrigerated carriers that will operate in California must use due diligence in hiring only compliant carriers and must provide documents to the carriers they hire that show who hired them. Refrigerated carriers must only dispatch compliant equipment if it will operate in California and they must provide their drivers with documents showing who hired them. Drivers must, upon request by authorized personnel, provide those documents showing who hired the carrier. The Draft Freight Hub Survey for Truck Stops is the first in a series of six freight hub surveys that will be released by ARB this year. Each of the surveys will undergo a public comment period before being finalized. The types of freight hubs being surveyed during this effort include: truck stops, border crossings, rail yards, airports, seaports, and warehouses and distribution centers. The purpose of these surveys is to collect specific facility and equipment information from California based freight hubs. The data gathered from these surveys will help ARB staff better understand the activity that occurs at freight hubs in California, assess the potential for emission reductions, inform potential strategies for reducing those emissions, and direct funding assistance efforts. The federal Phase 2 standards are the second phase of federal heavy–duty GHG standards and build upon the federal Phase 1 standards. The federal Phase 2 standards will significantly reduce carbon emissions and dramatically improve the fuel economy for heavy-duty trucks, helping reduce emissions that cause climate change. They establish national GHG emission standards that will begin in model year 2021 for new class 2b to 8 medium- and heavy-duty engines and tractors, and in 2018 model year for certain trailer types. The federal Phase 2 standards will be fully phased in by model year 2027. On December 11, 2008, the Board approved the Tractor-Trailer GHG regulation codified in sections 95300-95312 of title 17, California Code of Regulations, and later amended in 2010 and 2014. This regulation required owners of 53-foot or longer box-type trailers and owners of the heavy-duty tractors that pull them on California highways to utilize U.S. EPA SmartWay verified or designated technologies that will reduce GHG emissions and improve fuel efficiency. AQIP is a mobile source incentive program that focuses on reducing criteria pollutant and diesel particulate emissions with concurrent reductions in greenhouse gas emissions. The Governor’s proposed Budget includes $28.6 million for AQIP. One of the pending consent decrees to resolve claims against Volkswagen for equipping its diesel vehicles with defeat devices would require the company to pay CARB $25 million to fund “the ZEV-related aspects of the EFMP Plus Up Program or the ZEV-related aspects of similar vehicle replacement programs.” CARB staff intends to include a proposal for how to spend this $25 million in the FY 2017-18 Funding Plan contingent on court approval of the consent decree. On April 13, 2017, Air Resources Board Chair Mary Nichols submitted a petition to U.S. EPA urging federal action to establish more health-protective emission standards for locomotives. The focus of this request is to accelerate the movement to zero- and near-zero emission locomotives. Proposed emission standards would cut toxic and smog-causing emissions by 85% for diesel particulate matter (PM) and 66% for oxides of nitrogen (NOx) below current ‘Tier 4’ levels. Newly manufactured locomotives would also have some zero-emission mile capability, reducing harmful diesel emissions in railyards, and benefitting the disadvantaged communities around them. California is requesting that U.S. EPA respond by Summer, 2017. Model year 2010 TRU engines must comply with the TRU ATCM’s in-use performance standards by December 31, 2017. Purchase orders for compliance equipment (e.g. replacement TRUs) or emissions control technology (e.g. diesel particulate filters) must be placed before the TRU ATCM’s purchase order deadlines to qualify for a compliance extension if delivery or installation turns out to be delayed until after December 31, 2017. To qualify for this compliance extension, the TRU must be registered in ARB’s Equipment Registration (ARBER) system, purchase orders must be placed before the purchase order deadlines, and compliance extension applications must be submitted by December 31st. The purchase order deadlines that apply to TRUs are: • For replacement TRUs: August 31st (four months ahead of the compliance deadline); and • For verified diesel particulate filter retrofits: October 31st (two months ahead of the compliance deadline). Replacement trailers should be ordered much sooner due to long lead times and the current manufacturing backlog. Owners must exercise due diligence in attempting to comply by the end of 2017. Due diligence means conducting the compliance process with a measure of prudence, responsibility, and diligence that is expected from, and ordinarily exercised by a reasonable and prudent person under the circumstances. For example, starting the research, budgeting, and financing well in advance of the compliance deadline, and purchasing the compliance technology by the purchase order deadline. The compliance extension application, with attached supporting documentation that demonstrates due diligence was used, must be received at ARB by December 31, 2017. One compliance option to consider is hybrid electric TRUs and TRUs equipped with electric standby, which are often referred to as “eTRUs.” eTRUs are a compliance option, when used in a way that qualifies as Alternative Technology. Fleets with up to three forklifts and/or up to three non-forklifts are exempt from the regulation but can voluntarily report and label their LSI equipment. Once LSI equipment has been reported in DOORS an Equipment Identification Number (EIN) will be issued. Fleets must label their equipment with the EIN. The LSI Regulation reporting user guides, importing equipment guides, the amended regulation language, and other useful LSI regulation information are available at https://www.arb.ca.gov/lsi CARB utilizes an on-line reporting tool (DOORS). DOORS allows fleets to easily complete the initial reporting required by the Board approved July 2016 amendments to the LSI Regulation. These vehicles are found in approximately 2,000 LSI fleets in California in industries as diverse as manufacturing, wholesale, transportation and utilities, retail, services, and construction, as well as public agencies. The 2006 LSI rulemaking and 2010 amendments required operators of in-use fleets to achieve specific oxides of nitrogen + hydrocarbon FAEL standards that became more stringent over time, the lowest FAEL for fleets was to be achieved in 2013. The standards are also more stringent for forklifts than they are for non-forklift LSI equipment. Small fleets and in-field equipment are exempt from the LSI Fleet Regulation. In July 2016, CARB approved amendments to the LSI Fleet Regulation. These amendments require operators to: •Submit an initial report by June 30, 2017, and then annually thereafter; •Label all affected equipment with an ARB issued EIN; and •Continue recordkeeping as they have been required to do pursuant to the existing regulation. The existing performance requirements, including FAEL standards, were not modified by the amendments and continue to remain in effect. Background TRUs are refrigeration systems designed to control the environment of temperature sensitive products transported in trucks, trailers, shipping containers, and railcars. TRU generator sets are internal combustion engine-powered generators designed to provide electric power to electrically driven refrigeration units of any kind. TRUs and TRU generator sets emit diesel particulate matter, oxides of nitrogen, greenhouse gases, and other pollutants while in transit and during stationary operation. This includes use on the road as well as stationary operation at refrigerated distribution centers, grocery stores, warehouses, ports, rail yards, and other locations that are often in close proximity to schools, hospitals, elder care facilities, and residential neighborhoods. The emissions from TRUs and TRU generator sets pose a potential threat to both public health and the environment. CARB adopted the TRU Airborne Toxic Control Measure in 2004 (and amended in 2010 and 2011) to reduce diesel particulate matter emissions from TRU and TRU generator set engines. Despite the progress made, TRU and TRU generator set emissions still contribute to unacceptable health risks and must be further reduced to protect nearby communities. The concepts that will be discussed at this workshop go beyond the current TRU Airborne Toxic Control Measure (title 13, California Code of Regulations, section 2477) to limit the amount of time that internal combustion engine-driven TRUs and TRU generator sets operate while they are stationary, as well as require an overall zero-emission mode operating time. Adoption of the federal Phase 1 rule provided CARB the ability to certify new heavy-duty vehicles and engines and enforce those requirements in the State. In addition, CARB’s adoption of the Phase 1 requirements provided nationwide consistency for vehicle and engine manufacturers. At the same time, CARB amended the TTGHG regulation to align with the Phase 1 rule by sunsetting the 2014 and subsequent model year tractor requirements. Building on the success of the federal Phase 1 rule, in August 2016, U.S. EPA and NHTSA jointly adopted the federal Phase 2 rule, which is more stringent than Phase 1. The federal Phase 2 rule is phased-in over the 2018 through 2027 model years. The structure of the federal Phase 2 rule is generally similar to Phase 1, establishing GHG emission standards for tractors, vocational vehicles, and heavy-duty pickups and vans, and the engines used in tractors and vocational vehicles. However, the federal Phase 2 rule also establishes standards for certain trailers used in combination with tractors. The trailer types included in Phase 2 are box-type trailers (dry van and refrigerated van trailers of all lengths), flat bed trailers, tank trailers, and container chassis. The trailer requirements include aerodynamic improvements and tire requirements for box-type trailers, but only tire requirements for the other trailer types. Although this marks the first time trailers have been regulated at the federal level, trailers have been regulated in California since 2010. On December 22, 2016, the Truck Trailer Manufacturer Association (TTMA) filed a lawsuit that challenges and seeks to vacate the trailer provisions of the federal Phase 2 rule that apply to trailers. The August 31st purchase order deadline approaching! From: rhill@arb.ca.gov Order compliance technology now for your 2010 and 2003 transport refrigeration units (TRU) to beat the purchase order deadlines. August 31st is the purchase order deadline for new replacement TRUs and TRU generator sets. Order now to avoid penalties due to manufacturer or installer delays. It is probably too late to order refrigerated trailers due to long backlogs at refrigerated trailer manufacturers. The California Air Resources Board (CARB) recommends that TRU and TRU generator set owners take action now to order compliance options to ensure TRU model year 2010 engines (or units manufactured in 2010) comply with in-use performance standards by the end of 2017. Model year 2003 TRU engines that met the Low-Emission TRU (LETRU) In-Use Performance Standard in 2010 also need to meet the Ultra-Low-Emission In-Use Standard or be replaced by the end of 2017. Please be aware that replacement engines are no longer a compliance option because replacement engines must be cleaner than the old engine being replaced and there is no replacement engine that fits and functions that is cleaner than a MY 2010 engine (see TRU Advisory 13-18, page 7 for more detailed explanation at: http://www.arb.ca.gov/diesel/tru/advisories.htm). The TRU Regulation allows compliance extensions if delivery or installation is delayed; but, to qualify for these extensions, the unit must be registered in CARB’s Equipment Registration (ARBER) system and purchase orders must be placed early enough to take into account large order backlogs, delivery, installation, holiday, and typical year-end compacted schedules. The TRU Regulation has the following purchase order deadlines: • For unit replacements: By the end of August -- four months ahead of the compliance deadline; and • For verified diesel particulate filter retrofits: By the end of October -- two months ahead of the compliance deadline. Owners must exercise due diligence in attempting to comply by the end of 2017. Due diligence means conducting the compliance process with a measure of prudence, responsibility, and diligence that is expected from, and ordinarily exercised by a reasonable and prudent person under the circumstances. For example, start the research, budgeting, and financing well in advance of the compliance deadline, and purchase the compliance technology before the purchase order deadline. The compliance extension application (with attached supporting documentation that demonstrates due diligence was used) must be received at ARB by December 31, 2017. All model year 2009 and older engines (or units manufactured in 2009 or earlier) should be in compliance now. Please note that trailer manufacture year and in-service dates are not used to determine compliance dates. CARB staff are co-hosting the following meetings to talk with residents living in communities near seaports, railyards, warehouses, and distribution centers about regulatory actions already underway and the development of new concepts to reduce the air pollution and health impacts from freight. Background In March 2017, the Board heard public testimony on the South Coast Air Quality Management District’s (SCAQMD’s) Plan and CARB's Mobile Source Strategy for the State Implementation Plan (SIP). The Board adopted Resolutions 17-7 and 17-8, as well as an addendum that provided additional direction to staff, including: Within 12 months, “…staff shall return to the Board with concepts for an indirect source rule to control pollution from large freight facilities including ports, railyards, warehouses, and distribution centers, as well as any identified alternatives capable of achieving similar levels of emission reductions…” This process will involve stakeholder outreach, including formal workshops and informal meetings, to identify potential options for reducing emissions from freight facilities and to understand the relative pros and cons. CARB staff will present concepts to the Board in March 2018. These CARB freight-related activities will also support the upcoming work to implement Assembly Bill 617 (C. Garcia, Statutes of 2017), which will establish guidance for the development and implementation of community reduction plans focused on reducing exposures in the neighborhoods most impacted by pollution. The August 31st purchase order deadline is next week! From: rhill@arb.ca.gov Order compliance technology now for your 2010 transport refrigeration units (TRU) to meet the purchase order deadlines. August 31st is the purchase order deadline for new replacement TRUs and TRU generator sets. Order now to avoid penalties due to manufacturer or installer delays. Model year 2010 engines/units must meet the TRU Regulation’s in-use performance standards by December 31, 2017. It is probably too late to order refrigerated trailers due to long backlogs at refrigerated trailer manufacturers. The California Air Resources Board (ARB) recommends that TRU and TRU generator set owners take action now to order compliance options to ensure TRU model year 2010 engines (or units manufactured in 2010) comply with in-use performance standards by the end of 2017. Model year 2003 TRU engines that met the Low-Emission TRU (LETRU) In-Use Performance Standard in 2010 also need to meet the Ultra-Low-Emission In-Use Standard or be replaced by the end of 2017. Please be aware that replacement engines are no longer a compliance option because replacement engines must be cleaner than the old engine being replaced and there is no replacement engine that fits and functions that is cleaner than an MY 2010 engine (see TRU Advisory 13-18, page 7 for more detailed explanation at: http://www.arb.ca.gov/diesel/tru/advisories.htm). The TRU Regulation allows compliance extensions if delivery or installation is delayed; but, to qualify for these extensions, the unit must be registered in ARB’s Equipment Registration (ARBER) system and purchase orders must be placed early enough to take into account large order backlogs, delivery, installation, holiday, and typical year-end compacted schedules. The TRU Regulation has the following purchase order deadlines: • For unit replacements: By the end of August -- four months ahead of the compliance deadline; and • For verified diesel particulate filter retrofits: By the end of October -- two months ahead of the compliance deadline. Owners must exercise due diligence in attempting to comply by the end of 2017. Due diligence means conducting the compliance process with a measure of prudence, responsibility, and diligence that is expected from, and ordinarily exercised by a reasonable and prudent person under the circumstances. For example, start the research, budgeting, and financing well in advance of the compliance deadline, and purchase the compliance technology before the purchase order deadline. The compliance extension application (with attached supporting documentation that demonstrates due diligence was used) must be received at ARB by December 31, 2017. All model year 2009 and older engines (or units manufactured in 2009 or earlier) should be in compliance now. Please note that trailer manufacture year and in-service dates are not used to determine compliance dates. Noncompliant model year 2009 and older TRU/TRU genset engines/units must not be operated in California unless they are brought into compliance immediately. Where can you get more information? Background: TRUs are refrigeration systems powered by integral diesel internal combustion engines designed to control the environment of temperature-sensitive products that are transported in trucks, semi-trailers, shipping containers, and railcars. The emissions from these units are a source of unhealthful air pollutants including particulate matter, toxic air contaminants, nitrogen oxides, carbon monoxide, hydrocarbons, and greenhouse gases, that all pose a potential threat to both public health and the environment. These units often congregate in large numbers at California distribution centers, grocery stores, and other facilities where they run for extended periods of time to ensure their perishable contents remain cold or frozen. These distribution and loading facilities are often in close proximity to schools, hospitals, eldercare facilities, childcare facilities, and residential neighborhoods. In 2004, the TRU Airborne Toxic Control Measure (ATCM) was adopted by the Board to reduce diesel particulate matter emissions from TRUs and TRU gen set engines. Background: In December 2013, California harmonized with the federal Phase 1 GHG standards for medium- and heavy-duty engines and vehicles (the Phase 1 rule). Adoption of the federal Phase 1 rule provided CARB the ability to certify new heavy-duty vehicles and engines and enforce those requirements in the State. In addition, CARB’s adoption of the Phase 1 standards provided nationwide consistency for vehicle and engine manufacturers. At the same time, CARB amended the Tractor-Trailer GHG regulation to align with the Phase 1 rule by sunsetting the 2014 and subsequent model year tractor requirements. Building on the success of the federal Phase 1 rule, in October 2016, the United States Environmental Protection Agency (U.S. EPA) and the National Highway Traffic Safety Administration (NHTSA) jointly adopted the federal Phase 2 rule, which is more stringent than Phase 1. The federal Phase 2 rule is phased-in over the 2018 through 2027 model years. The structure of the federal Phase 2 rule is generally similar to Phase 1, establishing GHG emission standards for tractors, vocational vehicles, and heavy-duty pickups and vans, and the engines used in tractors and vocational vehicles. However, the federal Phase 2 rule also establishes standards for certain trailers used in combination with tractors. The trailer types included in Phase 2 are box-type trailers (dry van and refrigerated van trailers of all lengths), flat bed trailers, tank trailers, and container chassis. The trailer requirements include aerodynamic improvements and tire requirements for box-type trailers, but only tire requirements for the other trailer types. Although this marks the first time trailers have been regulated at the federal level, trailers have been regulated in California since 2010. On December 22, 2016, the Truck Trailer Manufacturer Association filed a lawsuit that challenges and seeks to vacate the trailer provisions of the federal Phase 2 rule that apply to trailers. On August 17, 2017, U.S. EPA/NHTSA announced they will reconsider the trailer provisions of the federal Phase 2 rule. The lawsuit and reconsideration of the trailer provisions however, does not affect California’s authority to establish standards for trailers hauled by heavy-duty tractors. The Rypos DPF/ULETRU is a Level 3+ diesel emission control strategy (DECS), capable of reducing emissions of particulate matter (PM) by 85 percent or more without increasing nitrogen dioxide emissions to more than 20 percent of total nitrogen oxides. The RYPOS system consists of a diesel oxidation catalyst (DOC), an active exhaust filter and an automatic filter regeneration system. Specific engine models and families that may qualify are listed in the Engine Family List at CARB's Verification Procedure Website for the Rypos DPF/ULETRU at: http://www.arb.ca.gov/diesel/verdev/companies/rypos/uletru.htm Rypos has completed all of the requirements for this verification update, including extensive field demonstrations, showing reliable backpressure control. To qualify for retrofit with the Rypos DPF/ULETRU, TRU engines must be maintained in accordance with the engine and original equipment manufacturers’ specifications and meet all of the pre-installation compatibility assessment criteria established for the Rypos DPF/ULETRU. All model year (MY) 2009 and older TRUs and TRU gen set engines must meet ULETRU now. MY 2010 TRU engines must meet ULETRU by the end of 2017. Engine repowering is no longer a compliance option for MY 2008 and newer engines because replacement engines that fit and perform are no cleaner than the old in-use engines being replaced. Additional proposed Cap-and-Trade auction proceeds funding for two new CARB incentive programs is also pending before the Legislature: one to reduce agricultural sector emissions and another for air districts to reduce emissions to achieve early actions for the community emission reduction programs developed pursuant to Assembly Bill (AB) 617 (Garcia, Chapter 136, Statutes of 2017). These new programs are outside of the scope of this workshop and the FY 2017 18 Clean Transportation Incentives Funding Plan. CARB will launch separate public processes focused for these new programs shortly. Volkswagen Settlement for ZEV Aspects of Vehicle Replacement Programs: CARB has entered into several partial consent decrees with Volkswagen to resolve claims against the company for equipping its diesel vehicles with illegal defeat devices. One of the partial consent decrees requires Volkswagen to pay CARB $25 million to fund “the ZEV-related aspects of the EFMP Plus Up Program or the ZEV-related aspects of similar vehicle replacement programs.” CARB was appropriated $25 million to implement this part of the settlement in the 2017 State Budget. Zero/Near-Zero Emission Warehouse Program: CARB was appropriated $50 million in one-time funding for a new Zero/Near Zero Emission Warehouse Program. These funds are to be used for a competitive funding program to advance implementation of zero- and near zero emission warehouses and technology with a requirement for a one-to-one match resulting in $100 million for projects. The Legislature directed CARB to develop criteria for implementing this program using the AQIP funding plan process. Low Carbon Transportation: The Low Carbon Transportation Program is part of California Climate Investments, a statewide program that puts billions of Cap-and-Trade dollars to work reducing greenhouse gas emissions, strengthening the economy and improving public health and the environment—particularly in disadvantaged communities. The draft Funding Plan describes CARB’s proposed investments from the following clean transportation incentive funding sources: • $560 million Low Carbon Transportation Program using Cap-and-Trade auction proceeds appropriated to CARB in September 2017. • $28.64 million Air Quality Improvement Program (AQIP). • $25 million Volkswagen settlement funding for the zero emission vehicle aspects of vehicle replacement programs. • $50 million Zero/Near Zero Emission Warehouse Program.
