The purpose of this advisory is to inform GDF owners and operators with ASTs which Phase I EVR components must be used as replacement parts for existing, pre-EVR Phase I components that fail and need replacement. Recent regulatory activity and Executive Order G-70-216 have extended the use of pre-EVR Phase I systems on select ASTs until the end of the useful life of the components. New Underwriters Laboratories (UL) specification 2583, Outline of Investigation for Fuel Tank Accessories, necessitated minor changes to the verbiage on the covers of the emergency vents and a height increase. UL allows manufacturers to sell existing equipment that they have in stock, but once that stock has been exhausted, Morrison Bros. is required to produce the 244 series emergency vents to the UL 2583 specification. Morrison Bros. anticipates selling out of their current stock before EO VR-402 can be amended to include the modified component. ARB staff has reviewed the modifications and determined that neither will affect the component’s functionality in relation to vapor recovery. ARB staff intends to include the modified 244 series emergency vent in the next amendment of EO VR-402 and therefore this letter may be utilized until the EO is amended. The purpose of these workshops is to describe the latest studies conducted by ARB and to solicit public input on potential solutions to be presented to the Board in February of 2016 as part of a non-regulatory informational update. Health and Safety Code, Section 41960.2(c) requires the Executive Officer to adopt and periodically update the Vapor Recovery Equipment Defects List, which is incorporated by reference in California Code of Regulations, Title 17, Section 94006(b). Such defects are sufficiently egregious to warrant the removal of the fueling point or the entire station from service until the defect is repaired. Written comments on the proposed regulatory amendments must be received by December 14, 2015, in order to be considered by the Executive Officer. A public hearing is not currently scheduled; however, you may request the Executive Officer to conduct a public hearing. The process for requesting a public hearing is explained in the Written Comment Period and Submittal of Comments section of this notice. If a request for a public hearing is received by November 30, 2015, the public hearing will be conducted by the Executive Officer or his delegate pursuant to the authority set forth in Heath and Saf.
