TTY/TDD/Speech to Speech users may dial 711 for the California Relay Service. BACKGROUND: Assembly Bill (AB) 32, the California Global Warming Solutions Act of 2006, requires California to reduce statewide GHG emissions to 1990 levels by 2020 and to maintain and continue reductions beyond 2020. As part of this effort, the Air Resources Board (ARB) has developed a Cap-and-Trade program that limits statewide emissions from sources responsible for 85 percent of greenhouse gases and creates a financial incentive for clean and efficient technologies. Under the program, a portion of the allowances required for compliance are auctioned. The State portion of the proceeds from these auctions will be used to fund projects to reduce greenhouse gas emissions, consistent with State law. In September 2012, the Legislature passed and Governor Brown signed into law two bills – AB 1532 (Pérez, Chapter 807) and Senate Bill (SB) 535 (De León, Chapter 830) – that together establish a framework for developing an investment plan for projects and programs to be funded with Cap-and-Trade auction proceeds. SB 535 further requires that 25 percent of the proceeds that will be expended benefit disadvantaged communities and at least 10 percent of the proceeds expended be invested in projects located within those communities. The Department of Finance (Finance), in consultation with the ARB and other state entities, will develop and submit to the Legislature a three-year investment plan for the auction proceeds. The investment plan will identify the State’s greenhouse gas reduction goals and priority programs for investment of proceeds to support achievement of those goals. Funding will be appropriated to State agencies by the Legislature and Governor through the annual Budget Act, consistent with the plan. At this workshop, staff will be soliciting input on the following proposals: •Adopting a new regulation to harmonize with the Greenhouse Gas (GHG) Emissions Standards for Medium- and Heavy-Duty Engines and Vehicles that the United States Environmental Protection Agency (U.S. EPA) adopted in 2011; •Making amendments to ARB’s existing Heavy-Duty Vehicle GHG Emission Reduction Regulation (Tractor-Trailer GHG regulation) to align with the proposed new regulation above; •Adopting a new set of optional oxides of nitrogen (NOx) standards for heavy-duty vehicle engines more stringent than the current 2010 model year standard; and •Making amendments to the Airborne Toxic Control Measure (ATCM) to Limit Diesel-fueled Commercial Motor Vehicle Idling to expand compliance responsibility. The workshop is described further in the workshop notice at http://www.arb.ca.gov/msprog/mailouts/msc1305/msc1305.pdf and will be held at the following time and location: Date: Monday, March 11, 2013 Time: 8:30 a.m. – 4:00 p.m. Location: Air Resources Board Coastal Hearing Room 1001 I Street Sacramento, California 95814 Directions are at http://www.arb.ca.gov/maps/sactomap.htm Background: In September 2011, the U.S. EPA adopted a new regulation for controlling GHG emissions from new medium and heavy-duty engines and vehicles. ARB staff is proposing to align with the federal regulation in order to provide California with the ability to certify engines and vehicles to the new standards as well as enforce them. On December 11, 2008, the Board approved the Tractor-Trailer GHG regulation codified in sections 95300-95312 of title 17, California Code of Regulations, and later amended it on December 17, 2010. This regulation reduces GHG emissions from long-haul tractor-trailer combinations by requiring them to utilize U.S. EPA SmartWay verified or designated technologies that will improve fuel efficiency. To harmonize the tractor requirements of the federal and California regulations, ARB staff is considering modifications to its Tractor-Trailer GHG regulation. ARB staff will be proposing optional NOx emission standards for California certified 2015 and later model year engines. If the optional standards are adopted, ARB’s existing incentive programs such as the Carl Moyer Memorial Air Quality Standards Attainment program could be modified to give preference to engines certified to the optional standards. On July 22, 2004, ARB adopted an ATCM to Limit Diesel-fueled Commercial Motor Vehicle Idling. This regulation is codified in section 2485 of title 13, California Code of Regulations, and was later amended on October 20, 2005 and December 11, 2008. ARB staff is proposing to extend responsibility for complying with the requirements of the idling ATCM to the owner of the vehicle. In addition, staff’s proposal would require California-based shippers and California-based brokers to share responsibility for compliance with the idling restrictions in the event that they utilized the services of motor carriers that violated the regulation and/or they did not settle their outstanding fines. For specific questions regarding the new heavy duty engine and vehicle GHG regulation and the optional engine NOx standard, you may contact Ms. Kim Heroy-Rogalski, Manager of the Off-Road Implementation Section, by email at kheroyro@arb.ca.gov or by phone at (916) 327 2200. For questions regarding the in-use tractor-trailer GHG regulation amendments and the anti-idling ATCM amendments, you may contact Mr. Stephan Lemieux, Manager of the On-Road Heavy Duty Diesel Section, by email at slemieux@arb.ca.gov or by phone at (626) 450-6162. At this workshop, staff will summarize the panels from the first workshop and will summarize the common themes expressed during the individual stakeholder meetings. This workshop will focus on regulatory concepts and options under consideration for ZBus deployment and may include a broader look at the transit fleet rule. An additional workshop may follow this workshop to discuss specific regulatory language and to take comments on draft amendments prior to taking the regulatory package to the Board. From: lquattro@arb.ca.gov The Air Resources Board (ARB or the Board) invites you to participate in the next public workshop on December 3, 2013, in Oakland, California, to discuss concepts that are being considered and take input from stakeholders on what additional amendments should be considered to the Zero Emission Bus (ZBus) regulation and to explore the status of, and future developments to, ZBus technology and related systems. Workshop Location and Time: Metropolitan Transportation Commission 101 Eighth Street, Auditorium Oakland, CA 94607 Tuesday December 3, 2013 10:00 am to 1:00 pm Since the first workshop on September 17, 2013, staff have been conducting individual meeting with bus and technology manufacturers, as well as transit districts. At this workshop, staff will summarize the four panels (fuel cell electric bus, battery electric bus, ZBus infrastructure, and transit fleets operating ZBuses) from the first workshop and the common themes expressed during the individual stakeholder meetings. This workshop will also focus on regulatory concepts and options under consideration for ZBus deployment, and the potential to incorporate potential changes to the ZBus regulation into a broader assessment of the transit fleet rule that will occur next year. Based on feedback from this workshop, additional workshops may be scheduled to discuss specific regulatory language and to take comments on draft amendments prior to taking the regulatory package to the Board. We encourage you to attend the meeting as zero emission buses will be on display for rides and viewing. For those that cannot attend in person, a webinar is available. The webinar information along with the agenda is now posted on our website: ZBus website: http://www.arb.ca.gov/msprog/bus/zbus/zbus.htm BACKGROUND: The ZBus regulation, first adopted in 2000, applies to transit agencies with 200 or more urban buses. The regulation required a demonstration for diesel path transit agencies and 15 percent of new buses purchased to be zero emission beginning in 2008 for diesel path transit agencies, and 2010 for alternative path transit agencies. The ZBus regulation was amended in 2006, to include an advanced demonstration from the diesel path transit agencies. The Board postponed the purchase requirement to 2011 for diesel path transit agencies, and 2012 for alternative path transit agencies. The Board directed the Executive Officer to delay the ZBus purchase requirement through Resolution 09-49 at the July 2009 Board Meeting. In January 2010 “Mail-Out #MSC 10-04” notified all affected transit agencies of the ZBus purchase requirement suspension. The Board will be considering changes or amendments to the ZBus regulation which may affect the purchase requirement in May 2014.
