Staff
initiated a formal scientific evaluation of Environmental Tobacco Smoke (ETS) as a Toxic Air Contaminant (TAC)
in 2001. Based on the results of scientific evaluation, staff promulgated a rulemaking which culminated with a
hearing of the Air Resources Board on January 26, 2006. At the board hearing, the Air Resources Board formally
identified ETS as a TAC with a 6-0 vote.
