"Hot Spots" List of Substances
Health and Safety Code section 44321 requires CARB to "compile and maintain a list of substances" that must be reported under the AB 2588 Air Toxics "Hot Spots" program. CARB must evaluate substances that are listed under:
- Proposition 65 (12/2/05) (section 25249.8), the Governor's List of Chemicals Known to the State of California to Cause Cancer or Reproductive Toxicity;
- National Toxicology Program (NTP) issued by the U.S. Secretary of Health and Human Services (Section 262 of Public Law 95-622 of 1978);
- Hazard Evaluation System and Information Service (HESIS) (Section 147.2 of the Labor Code) California Dept. of Health Services;
- U.S. EPA Office of Air Quality Planning and Standards (OAQPS) (HAP list, TRI List);
- Substances listed under Section 6382 of the Labor Code (IARC, Federal Clean Water Act, Federal Clean Air Act, OSHA, CA Dpt. Food/Ag.);
- CARB's Toxic Air Contaminant (TAC) List;
- In addition to the above lists, CARB may consider "any additional substances including those that present a chronic or acute threat to public health".
The following lists substances currently required to be reported under the "Hot Spots" program. Substances contained in any of the above lists that have not been added to the regulation will be reviewed as necessary and where data is available. Substances may be added to Appendix A if a potential impact on public health exists. A substance is removed from the list if no evidence exists that it has been detected in air, and is not manufactured or used in California, or, if manufactured or used in California, because of the physical or chemical characteristics of the substance or the manner in which it is manufactured or used, there is no possibility that it will become airborne.
At the November 16, 2006, Board Hearing, the California Air Resources Board approved updates to Appendix A (shown below).
